Pope Francis donates P5-M to ‘Odette’ victims VATICAN/MANILA – Pope Francis has donated around 100,000 euros (around P5 million) as initial financial assistance for the victims of Typhoon Odette. Church-run Radio Veritas reported on Wednesday that the Holy Father, through the Dicastery for Promoting Integral Human Development and in collaboration with the Apostolic Nunciature in the Philippines, allocated the financial aid for the rehabilitation of damaged homes and churches in provinces severely damaged by the disaster. The gesture is an expression of the Pope’s solidarity with typhoon victims.

“It is intended to be an immediate expression of the Holy Father’s sentiment of spiritual closeness and paternal encouragement towards the people and territories affected,” the Vatican said in a statement. During his Angelus last December 19, the Pope immediately extended prayers for the victims of the disaster caused by the typhoon. At present, the social arms of the church, including Caritas Philippines and Caritas Manila, are conducting relief, rehabilitation, and reconstruction in the ten dioceses that were severely damaged. Caritas Manila has distributed up to

P20 million in cash assistance to the affected areas. These are the Dioceses of Surigao, Tagbilaran, and Talibon in Bohol, Maasin, Cebu, Kabankalan and Dumaguete in Negros provinces, Taytay and Puerto Princesa in Palawan and the Archdiocese of Cagayan De Oro. On the other hand, Caritas Philippines, headed by national director Kidapawan Bishop Jose Colin Bagaforo, continues to visit affected areas to personally extend financial assistance and determine the extent of the damage from the recent calamity.

4 governors, 21 mayors tested positive for COVID-19 MANILA – Four governors and 21 mayors have been positive for COVID-19, Interior and Local Government Secretary Eduardo Ano, who himself had been infected with the virus. Construction of 380-km Laguna-Albay PNR route to start soon MANDALUYONG CITY – Good news to Bicolanos. The Department of Transportation (DOTr) awarded the single largest rail contract worth P142 billion, or about US$2.8 billion, to a Chinese joint venture to build a 380-kilometer Philippine National Railways (PNR) route. The construction will run from Barangay Banlic in Calamba, Laguna to Daraga, Albay. The contract was signed on Monday by DOTr Secretary Arthur Tugade and representatives of the Chi-

na Railway Group Ltd., China Railway No. 3 Engineering Group Co. Ltd., and China Railway Engineering Consulting Group Co. Ltd. (CREC JV). The contract includes the design, construction, and electromechanical works for the project. “Listed in both the Hong Kong and Shanghai stock exchange, CREC JV ranked 35th on the Fortune Global 500 list and 5th among China’s top 500 enterprises in 2021,” the DOTr said in an announcement on Tuesday. The project will span

across 39 cities and municipalities in four provinces and two regions. Aside from the construction of 380 kilometers of railway, the project will include 23 stations, 230 bridges, 10 passenger tunnels, and a 70-hectare depot in San Pablo, Laguna. Chinese Ambassador to the Philippines, Huang Xilian, said the project will be the “fastest and longest railway segment so far in the Philippines” and “another milestone” for the relationship between the Philippines and China. Huang said the project is so far the “highest-funded G-to-G (governmentto-government) project” between the two countries. Once operational, travel time between Calamba, Laguna and Legazpi, Albay will be shortened to four hours from the usual 12 hours and will serve 14.6 million passengers yearly. The project is also expected to create “more than 10,000 direct construction jobs each year” aside from “hundreds of thousands” of jobs in related areas, according to Huang. “I wish the scenario come true the soonest and the project a smooth progress!” Huang posted. The PNR Bicol project is a 565-kilometer railway that will connect Metro Manila to the southern Luzon provinces of Sorsogon and Batangas. Its passenger trains will run at a speed of 160 kilometers per hour while freight trains will run at 100 kilometers per hour.

Senate OKs bill creating Metro Davao authority DAVAO CITY/PASAY CITY - The Senate, voting unanimously, approved on third and final reading on January 17 a bill seeking to create a special body that will coordinate and promote socio-economic growth and sustainable development of Metropolitan Davao- the Metropolitan Davao Development Authority (MDDA). Under House Bill No. (HBN) 8930, the MDDA will have jurisdiction over Davao City, cities of Panabo, Tagum, the Island Garden City of Samal (IGACoS) in Davao del Norte; the City of Digos in Davao del Sur; the City of Mati in Davao Oriental; and the municipalities of Sta. Cruz, Hagonoy, Padada, Malalag and Sulop in Davao del Sur, Carmen in Davao del Norte, Maco in Davao de Oro, and Malita and Sta. Maria in Davao Occidental. It will be the second metropolitan government in the country after Metro Manila which is composed of 16 cities and one town and created in 1975. Sen. Francis “Tol” Tolentino, chairman of the Committee on Local Government and sponsor of the measure, thanked his colleagues for accepting the concept of metropolitanization, especially in Southern Philippines. “The establishment of MDDA will institutionalize the

rapid urbanization of Davao region through strategic and viable reforms primarily towards regional cooperation and economic growth. By agglomerating major cities and municipalities of the region, MDDA will further liberalize LGUs (local government units) within its jurisdiction from their dependence upon the national government and promote a sustained and all-inclusive decentralization in the region,” Tolentino said. The bill mandates that MDDA services shall include development planning, transport management, solid waste disposal and management, flood control and sewerage management, urban renewal, zoning, land use planning and shelter services; health and sanitation, urban protection, and pollution control; and public safety. Comelec junks 2nd petition vs Marcos

MANILA – Another case seeking to revoke the candidacy of presidential aspirant Ferdinand “Bongbong” Marcos Jr. has been junked by the Commission on Elections (Comelec). This, as the poll body’s Second Division has unanimously denied the petition filed by Fr. Christian Buenafe, among others, to cancel the certificate of candidacy (COC) of Marcos for lack of merit. “Wherefore, premises considered, the instant Petition is hereby denied for lack of merit,” said a part of the 32-page ruling penned by Presiding Commissioner Socorro Inting promulgated on Monday. The decision said Marcos did not mislead and deceive the public when he claimed in his COC that he is eligible to run for public office and that he has not been found liable for an offense that merits perpetual disqualification. “It is clear therefore that when the Respondent replied ‘No’ to the question in Item No. 22 of his COC, he did so without any intention to mislead, misinform, or hide a fact, which would otherwise render him ineligible. When Respondent

answered ‘No’ to the question in Item No. 22, it was precisely because he had no basis at all to answer in the affirmative. To the best of Respondent’s knowledge, what with decades of public service tucked under his belt, be honestly thought or believed that he has never been disqualified from holding public office,” the poll body said. “Similarly, when the Respondent signed and subscribed to his COC, which contains the declaration in Item No. 11 that he is eligible for President, he again did so without any intention to mislead, misinform, or hide a fact, which would otherwise render him ineligible. As previously discussed, there is nothing in the CA Decision dated 31 October 1997 that would have categorically apprised herein Respondent that he is suffering from any ineligibility,” it added. The petitioners asked to cancel the COC of Marcos in November last year, claiming that he committed false material representation when he stated in his COC that he is eligible to run for President despite his earlier conviction for not filing

income tax returns from 1982 to 1985. As for petitioners’ argument on the tax evasion cases of Marcos as being a crime involving moral turpitude, the poll body cited an earlier decision of the Supreme Court categorically stating that failure to file an income tax return is not a crime involving moral turpitude. “Hence, Petitioners contention that Respondent has been convicted of a crime involving moral turpitude is completely false. Therefore, when Respondent declared under oath that he is eligible for the position of President, he was telling the truth,” it added. On the other hand, lawyer Theodore Te, legal counsel of the petitioners said they will appeal the decision before the Comelec en banc. “Petitioners disagree with the Comelec in its ruling, among others, that the material representations made were not false and will seek reconsideration of the Resolution with the Commission en banc within the five-day period provided under the Comelec Rules,” he said in a statement. Lawyer Vic Rodriguez, Marcos’ chief of staff, said they welcome the poll body’s decision. “We thank the Commission on Elections for upholding the law and the right of every bona fide candidate like Bongbong Marcos to run for public office free from any form of harassment and discrimination. After granting the petitioners’ right to have their day in court where their case was fully heard and ventilated, the Comelec has unanimously spoken -- the petition to cancel the certificate of candidacy of Bongbong Marcos was denied,” he said in a statement. Rodriguez also said they are extending their “hand of unity even to the fiercest of the adversary” and urged them to help ensure a clean, fair and credible elections.

PHL to allow entry of fully vaxxed foreigners starting Feb. 16

MANILA – The Philippines will allow the entry of fully vaccinated foreigners starting February 16, Malacañang announced. In a Palace briefing, acting presidential spokesperson and Cabinet Secretary Karlo Nograles said the new guidelines, which were approved by the InterAgency Task Force for the Management of Emerging Infectious Diseases (IATFEID), would require foreigners to present proof of full vaccination against the

coronavirus disease (Covid-19) and to undergo additional protocols. “Beginning Feb. 16, 2022, proof of full vaccination shall be made a requirement for entry of all foreign nationals allowed to enter the Philippines,” he said. Nograles, however, noted that the following groups are exempted from the requirement: -children below 18 years old -people medically unable to receive

the vaccine, as certified by a competent public health authority in the country or port of origin -foreign diplomats and their qualified dependents or 9(e) visa holders He said the Department of Transportation (DOTr), through the Civil Aeronautics Board, has been directed to mandate the airlines to require foreigners traveling to the Philippines to present proof of full vaccination prior to boarding flights to any points in the Philippines. Meanwhile, Nograles said the national Covid-19 vaccination certificates of Colombia, Iraq Monaco, Italy, Tunisia, and Vietnam shall be accepted for purposes of arrival quarantine protocols, as well as for interzonal or intrazonal movement, in addition to other countries or territories whose proofs of vaccination the IATF has approved for recognition in the Philippines. The Bureau of Quarantine, the DOTr-One-Stop-Shop, and the Bureau of Immigration are directed to recognize only the proofs of vaccination approved by the IATF.

Senate, House suspend sessions over COVID-19

PASAY CITY/QUEZON CITY – The Senate and the House of Representatives have suspended their plenary sessions until January 24 because of the uptick in coronavirus disease (Covid-19) cases in the country, Senate President Vicente Sotto III and Speaker Lord Allan Velasco said. The Senate suspended onsite work for the rest of the week after recording 88 active COVID-19 cases among its employees - with nearly 200 others in quarantine. “We have decided to suspend the plenary sessions for the rest of the week because of the continuing surge in Covid-19 cases in almost every corner of the metropolis, and the House of Representatives is no exception. We arrived at such decision to control the spread of the fast-moving coronavirus that has also affected our members and staff,” Velasco said in a statement. Velasco said since the start of the year, over 70 House members and employees have contracted the disease, and many others are undergoing quarantine or self-isolation after exhibiting symptoms or having close contact with people who tested positive for Covid-19. He, however, assured that the House continues to fulfill its “constitutional duty of enacting laws that promote the interests and welfare of our people” while taking necessary measures to create a safe environment for House members and employees.

Vaccinated vs unvaccinated

ave we come down to this? Is the world so polarized into two camps now, the vaccinated and the unvaccinated, that never the twain shall meet? When the world’s Number 1 tennis pro heads to a Grand Slam event in Australia knowing full well he is unvaccinated and potentially carrying and spreading the deadly virus, he sees nothing wrong with his actions. His cavalier attitude was not acceptable to the Aussies, who must be congratulated for putting such a big star in his place by first placing him under hotel arrest, then cancelling his visa and then deporting him. Despite this, Novak Djokovic still has his followers and true believers who insist that he did no wrong. Such selfishness is mind-boggling. This is what scares us. The anti-vaxxers ignore the undeniable fact that they can be carriers of the virus that has spurred the deadliest pandemic in more than a century while ignoring the science that says vaccines work. Back in our beloved motherland, the Republic of the Philippines, the government placed extreme pressure on the unvaccinated this week, preventing them from using any form of public transport, airlines included, if they cannot show proof that they have been fully vaxxed. The outgoing lameduck president even threatened to have any unvaxxed person who leaves his or her place of residence arrested without the benefit of a warrant. Then there are the anti-vax protests that have taken place in parts of Europe, notably in Austria, Belgium, France, Germany, and Italy. Some have even deteriorated to violence. The anti-vaxxers say that their personal freedom is being infringed upon by their governments. There is no denying that here in the US, there remains a large segment of the population that is fiercely anti-vax. They aren’t that easy to identify either as former president Donald Trump has been finding out every time he speaks out in favor of getting vaccinated. He has been booed by crowds normally considered as his fanatical followers. What is it about COVID-19 that it suddenly became a political issue, instead of the health issue it truly is? To be honest, we do not have the answer. We can only acknowledge its existence, and wish there were some way to resolve the differences between the two warring sides. For now, we can only recognize that there have been countless cases of anti-vaxxers being infected by COVID-19, and in the worst cases have resulted in the passing of the men and women who could have been saved had they allowed themselves to receive the preventive vaccines freely available practically anywhere. We, therefore, see the need to take sides on this debate. There should be no contest. As a general rule, the unvaxxed spread coronavirus, the vaccinated do not. Allowing the unvaccinated to mingle with the vaccinated is wrong. To paraphrase an old saying, your freedom to throw a punch ends where my face begins. Or, as Star Trek’s Mr. Spock would say, the rights of the many outweigh the rights of the few, or the one. Do yourselves a favor, friends. If you haven’t done it yet, get vaccinated ASAP.

Freedom comes with responsibility Upside

O DRIVE, we are required to own a license. To earn that license, we need to pass a test. As licensed drivers, we are required to comply with traffic rules: Full stop at a red light, Go on green, yield at yellow. We brake for pedestrians. We abide by speed limits. We wear seatbelts. We were corrective lenses as needed. Why? For our safety, for sure, and also for everyone else who has the right to be on the road, on foot or any kind of wheels. As in all of us. Civilization demands rules to ensure public safety. CHERIE M. QUEROL MORENO Public safety means the protection and welfare of the general public, which is generally the responsibility of the government accomplished through transparent deliberations with the participation of the general public. Public safety is not an individual choice but rather an individual duty. If everyone on the road went however way they wished, human lifespan would definitely be shorter. If laws did not exist, funerals would outnumber birthdays. At some point a driver’s license may be revoked because of reduced capacity – physical or mental - again in the name of public safety. We all live together, sharing space, the ground we tread, the air we breathe. So how is it that we who are willing to comply with the rules for the privilege of driving now refuse to take precautions to ensure the safety of others? Those unvaccinated against the coronavirus confidently enumerate a litany of reasons: They are against government “overreach.” They practice holistic medicine. They are highly allergic or highly immune. And then there are the ones who’ve heard from a cousin of a friend who knows someone who told him that her neighbor’s co-worker learned from a social media post that a celebrity became impotent after getting vaccinated. Or somesuch. Some believe the virus is a hoax, despite over 800,000 deaths it has caused in this country alone, or that the government is conspiring with big pharma to enrich the 1% further, and that Dr. Anthony Fauci, who has steered our nation to safety through HIV, SARS, MERS before this virus has a personal agenda, when even he has conceded that the coronavirus is an unknown that is constantly evolving and so would responses to it would be. It’s hard to believe the well-educated fall prey to political rhetoric, but that indeed is their right - to read what they want from the source they prefer. Where individualism and self-sufficiency are the heart of ideology, though, the welfare of others is the least priority. Freedom is defined as power, the ability to think and act without restraint. In a civilized society, however, freedom comes with the responsibility to uphold the rights of others who share this life. If we insist on being unvaccinated, we ought to know how our choice affects others. We need to be open and listen to other points of view, especially those from the pertinent field of science, in this health crisis. Cherie M. South China Sea: US should do more

A

fter a few months of silence and inactivity in the South China Sea, the US State Department released last week a study conducted by its Bureau of Oceans and International Environmental and Scientific Affairs that debunked China’s sweeping claims in the disputed waters. Describing China’s sweeping claims as “unlawful,” the State Department panel said VAL ABELGAS such claims “gravely undermine the rule of law in the oceans and numerous universally recognized provisions of international law reflected in the Convention,” referring to a 1982 United Nations treaty on the law of the sea ratified by China, but not the United States. China claims sovereignty over “virtually all South China Sea islands and their adjacent waters,” but has not made specific claims in the area. Instead it uses a “nine-dash line” that goes past Vietnam and the Philippines and towards Indonesia, an area that encompasses virtually all of the South China Sea” to describe its claims. The State Department paper rejected four major bases for China’s sweeping claims: • China’s sovereignty claim over un-claimable features The US study questioned China’s claim to “more than one hundred features in the South China Sea that are submerged below the sea surface at high tide,” stressing that UNCLOS is “crystal clear” that submerged maritime features and lowtide elevations – rocks or shoals “above water at low tide but submerged at high tide” – do not fit the definition of an island and do not generate their own territorial sea. • China’s use of straight baselines to claim waters around and between island groups - China is claiming the right to draw a circle of sovereignty around self-defined island groups, but UNCLOS is clear that China’s self-defined island groups do not qualify as islands nor as island groups since they are “geographically isolated” from each other. • China’s claim of maritime zones (and associated rights and entitlements, like internal waters, territorial seas, contiguous zones, and EEZs) – The study said maritime law accord these rights only to archipelagic states and not island groups governed by continental states, like China. Also, just as UNCLOS does not allow “straight baseline” claim, it also does not allow China’s claim of “internal waters.” In addition, China says that based on its “maritime zone” claim, it can regulate military activity within its EEZ to justify its warning foreign planes and ships for alleged incursions. International law, however, allows only regulation of economic activity within a nation’s EEZ. • China’s claims to “historic rights” –Chinese officials insist that the areas included in the “nine-dash line” historically belong to China. Tracing back its historical ties to the South China Sea during the Han Dynasty, they said the Chinese people have been sailing that part of the sea and discovered some of the land features in the region. The study, however, debunks these claims as having no “legal basis” in international law since China has not offered any specifics. Scholars have said the International Convention on the Law of the Sea (UNCLOS) does not grant claimants the right to use historical rights to back their claims. The study is a blatant rejection of China’s sweeping claims in the South China Sea by the United States and a reiteration of an earlier statement made in July 2020 by then Secretary of State Mike Pompeo, who said that the US aligns with the tribunal’s 2016 ruling and that China’s expansive claims in the South China Sea are “completely unlawful.” A few days later, then Assistant Secretary of State for East Asian and Pacific Affairs David Stilwell said that China seeks to “replace international law with rule by threats and coercion” as he slammed China’s misdeeds in the disputed waters. In July 2016, the State Department acknowledged the legitimacy of the UNCLOS tribunal’s decision, and said it recognized the decision as “final and legally binding on both China and the Philippines.” It also published a white paper in 2014, which made a detailed analysis of China’s nine-dash line claim and the limited conditions under which it could possibly adhere with the international law of the sea as codified in UNCLOS. Because Mike doesn’t want the hassle and inconvenience of driving to the Secretary of State, Notary Public Section in Sacramento, California, he availed himself with the complete, efficient and unique services of MSS. With the creative idea and suggestion of Mike, I received the notarized documents he needed and required by the Supreme Court of the Philippines, Office of the Court Administrator last Saturday, January 15, 2022, the fastest turn-around I’ve experienced since the COVID-19 pandemic lockdown. I sent the apostilled documents to Mike by Priority Mail the following Monday. N AN ATTEMPT to institute sweeping changes to rules regarding voting and campaign finance, the Democrats passed the House version 220-210 with no Republican support. But when it went to the Senate, it stalled –- like a car about to run out of gas – with two votes short of the minimum number of senators to pass the voting rights bill. PERRY DIAZ If the 50 Democratic senators would vote for it, then a 50-50 split would result. But Vice President Kamala Harris who presided over the Senate would break the tie; thus, delivering a win for the Democrats. But two maverick Democrats – Senators Joe Manchin and Kyrsten Sinema -- have indicated that they are not going to support it, therefore killing what a majority of Americans was hoping would equitably level the playing field in the forthcoming elections. Proponents of the bill say it is necessary to protect access to the polls, especially for minority voters. They also said that it is crucial now because many Republican-controlled state legislatures are considering passing their own laws to tighten voting rules, claiming they would “improve election security.” But the Republicans argued that the bill would amount to a partisan, federal takeover of elections that would make voting “less secure.” Also, Republicans argued that states should “retain flexibility” on how they run elections, claiming that the proposal would be tantamount to a federal takeover of voting rules. This was precisely what “states rights” was all about: to diminish the role of the federal government and give more latitude to the states to exercise their freedom from federal control. Voting rights legislation Every state would be required to provide at least 15 days of early voting. The bill would also require every state to allow voting by mail and mandates online and same-day voter registration. The bill would restore voting rights to felons who have already served their sentences. The bill would also loosen state voter-identification requirements by providing a workaround. If a state requires ID, a voter who lacks the proper ID could instead sign a statement that attests to his or her identity. The bill would mandate drop-off boxes for mail ballots, and would allow voters to designate another person to drop off their mail ballots on their behalf. Democrats say that allowing third parties to transport ballots can help vulnerable voters. But Republicans call the practice “ballot harvesting,” saying it invites fraud. The bill would also create independent panels to draw voting districts in each state to end partisan gerrymandering. Nuclear option But what would ensure the death of the bill is the Senate’s antiquated filibuster rule that requires at 60 votes to muster passage. With the Senate split 50-50 between Democrats and Republicans, the bill would fail to pass unless ten Republicans cast their votes with the Democrats. The only way to pass the Voting Rights bill is to eliminate the filibuster or create a carve-out for civil rights or voting rights legislation, a procedure known as the “nuclear option.” Nuclear option is a parliamentary procedure, which allows the Senate to override a standing rule by a simple majority, rather than the two-thirds supermajority normally required to amend Senate rules. The way it works, the Senate Majority Leader – in this case, Sen. Chuck Schumer -- would raise a point of order that contravenes a standing rule, meaning the 60-vote filibuster threshold. The presiding officer – Vice President Kamala Harris – would then deny the point of order based on Senate rules and precedents; which would then be appealed and overturned by a simple majority vote, thus establishing a new precedent. The problem is that Senators Sinema and Manchin would vote against it; thus failing to get a majority vote. In other words, any way you look at it, there is no way out of this dilemma unless the Democrats are united. In 2017, it was invoked by a Senate Republican majority led by Mitch McConnell, which eliminated the 60-vote rule for Supreme Court nominations; thus, confirming then-President Donald Trump’s three Supreme Court nominees. or almost two years now, we as a nation have been battling the scourge of CoVid 19 that has caused so much suffering among Filipinos and affected the country’s economy. We have kept faith and we persevered. Slowly, the economy was starting its recovery. But before it could fully recover, typhoon Odette devastated MELANDREW T. VELASCO parts of the country and a surge in CoVid cases dealt another blow to our country. We are grateful that we have in our midst kind-hearted individuals who endlessly share their resources to uplift the lives of the needy. One of them is San Miguel Corporation’s president and chief executive officer Ramon S. Ang (RSA). RSA, who celebrated his birthday recently, has been actively involved in efforts to boost the economy through the varied businesses of SMC. He has also involved his businesses in programs and projects for the social good. His compassion for his kababayans is evident as the country continues its fight against CoVid 19. SMC has extended assistance to those immensely affected by the varying quarantine classifications and alert levels. It has donated food and medical supplies and assisted in vaccinating Filipinos against the virus. It ensured a steady supply of SMC products for the consumers even during the strictest lockdown imposed by government. It has its Ligtas Lahat employee vaccination program to ensure the safety of employees. With NCR now on alert level 3, SMC limited its work force prioritizing essential workers involved in critical business activities. RSA said that with the increase in CoVid cases, the most important thing as a company is to help prevent its further spread and avoid burdening the hospitals and health care system. As Typhoon Odette battered parts of the country, SMC led by RSA once more has shown what malasakit is all about. It immediately conducted relief operations—sending food donations estimated at Php30 million to affected areas. An additional Php5 million worth of food donations was given out through partner organizations and its own businesses. It has donated water from its Bulacan Bulk Water Project. Beneficiaries of SMC donations included Antique, Agusan del Norte and Agusan del Sur, Bacolod, Bohol, Biliran, Bukidnon, Cagayan de Oro, Camiguin, Cebu, Dinagat island, Davao del Sur, Eastern Samar, Guimaras, Iloilo, Leyte, Marinduque, Misamis Oriental, Negros Occidental, Negros Oriental, Occidental Mindoro, Oriental Mindoro, Palawan, Siquijor, Surigao del Norte, Surigao del Sur, and Tagoloan, among others. SMC also immediately repaired and reopened its damaged fuel service stations since these are necessary in restoring business operations, transportation, and relief operations in the affected places. According to RSA, even as we continue to deal with the surge in COVID-19 cases in Metro Manila, let’s not forget that many of our countrymen in the Visayas and Mindanao are still struggling to recover from the devastation of typhoon Odette. “Many are still left with almost nothing. Together with partners from LGUs, the Armed Forces and non-profit groups, we in San Miguel continue to leverage our resources to help affected families gain immediate access to basic needs such as food and water. There is nothing we can’t do when we come together and look out for each other. We are in this together and we’ll be here to help you recover and rebuild. Sama-sama. Walang iwanan,” he added. RSA is also an environmentalist. Under his leadership, SMC undertakes several environment protection projects. One of its environment protection initiatives is coastal clean-up. Recently, its coastal clean-up drive benefitted the towns of Calatagan and Balayan in Batangas where a total of 1,340 bags of garbage were collected. The activity was done in collaboration with the Department of Labor and Employment through its TUPAD program. Weekly clean-up activities are also being done by SMC together with DENR and the LGU of Navotas in Isla Pulo, site of the Tanza Marine Tree Park in Navotas. The tree park is a 26-hectare mangrove strip with a 3.5 km shoreline and serves as nearby cities from storm surges and coastline erosion. The coastal clean-up drives complement SMC’s ongoing river rehabilitation programs (Continue on page 27)

W

hile conventional wisdom says that the presidential race this year is only between Leni Robredo and Ferdinand Marcos Jr., this is not necessarily so. (As of this writing, one of the disqualification cases against Marcos Jr has been settled in his favor, while another one will be decided at a BETING DOLOR later date owing to the Commission on Election being partially crippled by the Omicron variant of COVID-19.) There are three other major presidential candidates, each of whom has something to offer the electorate. Or so they say. There are Manila Mayor Isko Moreno, and senators Ping Lacson and Manny Pacquiao who all believe they can win, even if all surveys show them only being favored by a small fraction of the country’s voters. Of the three, it is Moreno (real family name Domagoso) who has shown a higher favorability rating with some surveys showing the former actor being favored by up to five percent of the electorate. Indeed, Moreno has shown that he is more than a former actor wanting to seek the highest elective post possible, not unlike Erap Estrada. He has taken his work seriously and has a number of accomplishments in his first term as chief executive of the country’s capital. He has also taken some courses to help him better understand the art of governance. A respected figure in the academe told some of his friends, myself included, that he was approached by Moreno prior to his announcing his presidential run. The academician advised him to go for the vice presidency instead, as his youth was on his side, and he would have had an easier time winning the vice presidency instead of the presidency. Alas, Moreno’s ambition got the better of him. In running for president, he is abandoning his post as Manila mayor. If and when he loses, there is nowhere for him to go. He will have to relaunch his political career in 2024, possibly by running for a seat in the House of Representatives, or even the Senate. He may even try to regain the mayorship of Manila in 2026, but all will depend on how his successor performs. Then there is Senator Manny Pacquiao, the official bet of the PDP-Laban, which should be the administration party had it not split into two factions due to the machinations of Energy Secretary Al Cusi. Having a record as one of the greatest prizefighters of all time, Pacman as he is known worldwide is considered a national hero at home. But it’s one thing to be a sports superstar and another to be a political titan. Pacman’s record in politics has been less than exemplary so while he is still a beloved figure to most Filipinos, he will not necessarily win their votes. A member of his camp told me that Pacman has been drawing huge, adoring crowds, and his doling out cash to anyone who asks – this just about means everyone who attends his rallies – gets a crisp P1,000 bill, or about $20. As a billionaire, he can afford to share his wealth with those who have less in life. Even before his presidential run, he had given away thousands of small houses to the very poor. Well-meaning friends and advisors have said Pacman can better serve the people by doing other things. He could join the Phil. Sports Commission or he can train the next generation of fighters in the hopes that he can develop the next great Pinoy pugilist. Being a basketball lover, he can even turn his Maharlika Pilipinas Basketball League into a true alternative to the Philippine Basketball Association, which has seen better days. His ardent followers believe he can still make it to the presidential palace somehow simply because his heart is in the right place. A long shot? Perhaps. But for the Pambansang Kamao, it is a shot worth taking. Finally, there is Senator Ping Lacson, now in his third and last try at the presidency. In my book, the senior senator could have made a good president despite his numerous (Continue on page 27)

ill disqualification cases against Marcos fly?” That was the title of our previous article. On January 17, 2022, COMELEC shot down one of the disqualification cases, denying it “for lack of merit”. Ferdinand R. “Bongbong” Marcos, Jr. thus won a major decision seeking EMMANUEL SAMONTE TIPON to deny due course or cancel his certificate of candidacy (COC) for President in connection with the 2022 National Elections in the Philippines which he filed on October 6, 2021 with the Commission on Elections (COMELEC). The Second Division composed of Commissioners Socorro B. Inting, Presiding, and Antonio T. Kho, Jr. and Rey E. Bulay, issued the Resolution. Case No. SPA No. 21-156 (DC). The petition was filed by Fr. Christian B. Buenafe et al. against Marcos, Jr. on November 2, 2021 under Section 78 of the Omnibus Election Code (OEC) which provides that a COC may be denied due course or cancelled on the ground that any material representation contained therein as required under OEC Section 74 is false. The petitioners alleged that Marcos, Jr. committed false material representation under Section 74 when he stated in his COC that he is eligible to run for President notwithstanding his prior conviction in a Philippine Court of Appeals (CA) decision on October 31, 1997 in CA-G.R. CR No. 18569 for violation of Presidential Decree No. 1158 dated June 3, 1977, aka National Internal Revenue Code (NIRC), which allegedly carries with it the accessory penalty of perpetual disqualification from holding any public office, to vote and to participate in any election. The CA modified a Decision of the Quezon City Regional Trial Court and found Marcos guilty of violation of the NIRC for failure to file income tax returns for 1982 to 1985 but acquitted him of the charge of nonpayment of deficiency taxes for 1982 to 1985. The CA ordered Marcos to pay to the BIR the deficiency income taxes due with interest and to pay a fine of P2,000 for each charge of failing to file income tax returns for 1982, 1983, and 1984 and a fine of P30,000 for failure to file income tax return for 1985. Marcos denied the allegation, saying that he has all the qualifications of a President under Section 2, Article VII of the Constitution, thus, there can be no material misrepresentation under OEC Section 78. Petitioners also claimed that Marcos, Jr. was convicted of a crime involving moral turpitude thereby disqualifying him under OEC Section 12 to be a candidate and to hold any public office. But the COMELEC ruled that under its rules a petition to deny due course or to cancel a certificate of candidacy that invokes grounds for disqualification shall be summarily dismissed. Nevertheless, the COMELEC said that despite summary dismissal being warranted, it would relax compliance with the technical rules of procedure and discuss the merits in order to fully and finally settle the matter because of its paramount importance. MARCOS’S MISREPRESENTATIONS ARE MATERIAL The COMELEC held that two misrepresentations by Marcos in his COC pertained to a material matter because they refer to respondent’s qualifications for public office, citing the Supreme Court decision in Villafuerte v. COMELEC that “material misrepresentation contemplated by Section 78 of the Code refer to qualifications for elective office.” The first material misrepresentation refers to Item 11 of his COC which states: “11. I am eligible for the office I seek to be elected to.” The COMELEC cited the Supreme Court decision in Aratea v COMELEC holding that the word “eligible” means having the right to run for elective office, that is, having all the qualifications and none of the ineligibilities to run for public office. n August 9, 2021, the USCIS announced that applicants filing for lawful permanent resident status are now able to apply for a Social Security number (SSN) or replacement card as part of the adjustment of status application process. A person who qualifies to be a permanent resident may be able to apply to obtain a green card without leaving the U.S. This procedure is called adjustment of status (AOS). When a person applies for adjustment of status, he also applies for a work permit (EAD) and, if he is eligible, for a travel permit (“advance parole”). Generally, an applicant for adjustment of status must have entered the U.S. legally and have never violated his immigration status. To apply for adjustment of status, you must submit a form I-485 Application to Register Permanent Residence or Adjust Status plus supporting evidence and the proper filing fee. Use form I-765 to apply for an EAD work permit and form I-131 to apply for an Advance Parole travel permit. There are some exceptions to the general rule to qualify for Adjustment of Status. Section 245(i) of the law provides that certain persons with old priority dates may pay a penalty fee and adjust their status despite entering the U.S. illegally or violating or overstaying their nonimmigrant status. Section 245(k) provides that if a person is applying for AOS pursuant to an employment-based immigrant visa petition, he is eligible to do so as long as he entered the U.S. lawfully and has not been out of status for over 180 days since his most recent admission. Also, persons who are immediate relatives (parents, spouses and children of U.S. citizens) may adjust their status if they entered the U.S. lawfully even if they overstayed or worked without authorization without having to pay a penalty fee. Asia-focused RCEP free trade deal takes effect; PHL Senate delays action over groups’ protests BANGKOK – The world’s largest free trade pact forged by 15 Asia-Pacific countries entered into force over the weekend to provide a tailwind for the region’s post-pandemic recovery and a catalyst for global economic progress, bringing a ray of hope. The Regional Comprehensive Economic Partnership (RCEP) agreement groups 10 Association of Southeast Asian Nations (ASEAN) countries like the Philippines, as well as China, Japan, South Korea, Australia, and New Zealand, covering nearly a third of the world’s population and gross domestic product. So far, only ASEAN member countries Brunei, Cambodia, Singapore, Lao PDR, Thailand, and Vietnam, however, have ratified the free trade deal. The Philippines, Indonesia, Malaysia and Myanmar have yet to submit their instruments of ratification of the agreement. Given its size and terms, the RCEP is widely expected to bolster regional trade and investment flows and boost economic integration and prosperity in the region and beyond. The free trade bloc is expected to eventually eliminate tariffs on more than 90 percent of goods, expand market access for investment, harmonize rules and regulations, streamline customs procedures, and set common rules concerning the development of e-commerce as well as small and medium-sized enterprises, according to business insiders. In Manila last month, 48 local agriculture groups urged the Senate to reject the RCEP trade agreement which they said was finalized without consulting stakeholders in the farm sector. The groups — composed of farmers, fishers, workers, and businesses — called

on the Senate to “withhold” their concurrence to RCEP, arguing that the lack of consultation among stakeholders deprived them of the opportunity to shape the agreement into something that won’t hurt their livelihood. As of this week, the Senate has not ratified the trade deal, said Sen. Aquilino L. Pimentel III, chairman of the Senate Committee on Foreign Relations, adding that many senators are requesting interpellations. “We have to give them the chance to ask questions when session resumes this Jan. 17,” Pimentel said. In calling for Senate rejection of the RCEP, the Samahang Industriya ng Agrikultura (SINAG) (SINAG) said in a position paper submitted to the Senate that the “promised” benefits of the country’s accession to the World Trade Organization (WTO) 27 years ago did not materialize and instead produced dismal results. It said the Philippines’ agricultural balance of trade has consistently produced deficits since 1995. Likewise, the share of agriculture in the country’s gross domestic product also declined from 20.89% in 1997 to 10.18% in 2020, the group said SINAG noted that the proportion of employed persons in agriculture declined from 43.3% in 1996 to 24% in 2020, The group said the proponents of the country’s accession to the WTO had projected an increase in annual agricultural export earnings by at least P3.4 billion, an increase in the annual gross value added of agriculture by P60 billion, the creation of an additional 500,000 jobs annually, and an improvement in the balance of trade in agricultural products.

BOI sets P1-T investment approval target for 2022 MAKATI CITY – The Board of Investments (BOI) is confident of hitting the PHP1-trillion mark investment approvals this year after the setbacks that happened in 2021 due to the pandemic. Trade Secretary and BOI chairman Ramon Lopez is optimistic about the outlook following the improvements in foreign investments in the country. “Buoyed by 2021 FDI (foreign direct investments) results as well as the healthy pipeline of strong investment leads —both foreign and domestic, and with the reforms that we are anticipating to still be passed in the next months, we are confident of hitting PHP1 trillion in BOI approved investments this year,” Lopez said in a statement Tuesday. In BOI alone, foreign investments increased to PHP151.8 billion in 2021, higher by 218 percent than the 2020 fig-

ure. The Bangko Sentral ng Pilipinas (BSP) also reported that FDI in the country for January to October 2021 period rose 48 percent to USD8.1 billion from the same period in 2020. Trade Undersecretary and BOI managing head Ceferino Rodolfo said the BOI missed its 2021 investment approval target due to stricter travel protocols globally amid the surge brought by Delta variant. “Because of the global surge in the Delta variant and now with the emergence of the Omicron variant, these resulted in global setbacks in economic recovery, which then translated to the implementation of stricter protocols in the country. We were hit hard during the second quarter and the early part of the third quarter last year,” Rodolfo said.

Law renaming Roosevelt Ave. in QC to Fernando Poe Jr. Ave. signed

QUEZON CITY – President Rodrigo Duterte has signed a law renaming Roosevelt Avenue located in Legislative District 1 of Quezon City as Fernando Poe Jr. (FPJ) Avenue. Under Republic Act No. 11608 signed by Duterte on Dec. 10, 2021 and released last week, the Department of Public Works and Highways (DPWH) will issue the necessary rules, orders, and circulars to implement the provisions of this Act within 60 days from its effectivity. Actor and Sen. Ramon “Bong” Revilla Jr. and Sen. Mary Grace Poe, lauded the signing of the law saying it is a chance

Alternative loan programs are back in to the mix of mortgage loans Lenders have been finding ways to make it easy for homebuyers with challenging credit scores, recent bankruptcies, foreclosures, mortgage late etc . to borrow again. And they have been successful in coming out with new innovative programs to fit their needs. Will the consumers pay higher rates and fees for their unfortunate financial credit issues, of course! A lot of professional home flippers made a ton of money using these so called “Hard Money Lenders” these past few years flipping homes paying rates as high as 8-9% short term and making 30-45% profit on their investments. The key is to be able to know that these high rate loans will have to be short term. Don’t use them if you don’t have an exit strategy within a year or less. The interest alone will eat up your equity in a few years and you will drown and throw away good money. These loans have to be labelled “Non Qualified Mortgage” by these lenders due to the lending guideline set by Fannie Mae and Freddie Mac as far as making loans for home buyers occupying the property and getting a home owner occupied loans. These Non-QM loans will mainly favor investment properties and foreign home buyers. Here are some of the very flexible guidelines that you could say mirrored the so called “No Ration Program” loan that was once the only type of loan that was being offered: • Loan to value to 90% with credit scores as low as 620. • Bank statement program with no tax returns or W2 required. • Qualifying based on the rental income alone to qualify. • No seasoning on bankruptcy, foreclosure, short sale & deed in lieu ( compared to 4-7 on conventional and government financing) • Non warrantable condos up to 80% loan to value. ( meaning condos with litigation or high ratio of rental occupancy ) • Mixed used property, commercial property, properties with poor conditions. • No seasoning requirement when borrower returns back to work after an extended period of time. • 30% equity is not required on departure properties to show as rental income. • Reserves requirement between 3-6 months could be waived depending on the loan to value. Home borrowers are not all flocking to get these types of loans, but now with the housing market sort of taking a short breather, sellers are more willing to review offers that are not all cash or with huge down payments. These types of program will mainly benefit self all borrowers with a down payment to start to consider short term loan options to buy a house. These aren’t the same products as the so-called “liar loans” that were pervasive before the housing bust. Instead, the loans are going to borrowers such as small business owners or investors buying properties they intend to rent who can demonstrate an ability to repay, verifiable through bank or brokerage statements. Lenders said they look for enough assets to pay six to 12 months of payments, while also demanding high down payments to reduce the chance of default. The Dodd-Frank law said that, for all owner-occupied mortgages made in the United States, lenders must make sure the borrower has the capacity to repay, or face enforcement from the Consumer Financial Protection Bureau as well as consumer claims in court, where lenders could be liable for up to three years of finance charges and fees. Ability-to-repay rules apply only to mortgages for people who will live in the house. That means there is potential for abuse if borrowers apply for the mortgages saying they’ll rent out the property when in fact they intend to live there. Because these kinds of loans are not subject to ability-to-repay rules and require less documentation, borrowers could be talked into taking on mortgages they cannot afford, a lender at a large bank said. The law, and the CFPB’S rules on the matter, will likely prevent lenders from re-embracing the worst varieties of stated income loans during the bubble years, such as so-called “ninja” loans, a near-acronym for “no income, no job or assets.” Therefore, there is still a thick wall to avoid a repeat of the recent mortgage fall out we all experienced. Mortgage rates are really low and homeowners with rates over 3.125% should consider a lower rate now before the Feds decide to raise rates higher. Golf ace Yuka Saso dons Japanese flag as LPGA campaign starts in Florida MANILA – After winning for the Philippines top honors in amateur and professional golf tournaments, Bulacanborn and raised Yuka Saso now dons the Japanese flag as she followed the citizenship of her father. Saso made the decision days before the reigning US Women’s Open champion launches her 2022 campaign on the LPGA Tour in the United States. Some Philippine officials were reportedly surprised with Saso’s decision as it came two years ahead of her scheduled renouncement of the Filipino citizenship in favor Japanese citizenship. Under the Japanese law, Saso has until age 22 to make a choice of the citizenship of her father or mother. On the LPGA website, Saso’s official profile now features the Japanese flag instead of the Philippines’ flag which she has carried since she started competing oveseas as member of the Philippine national team. Saso, ranked eighth in the world, will open her 2022 season in the Hilton Grand Vacations Tournament of Champions in Orlando, Florida, which starts on January 20. During her amateur run, she racked up honors for the Philippines, including winning the 2014 Sabah International Junior Masters, the 2015 Kartini Cup and the 2018 Victorian Junior Masters. She claimed the individual gold and led the Philippine team (with Harmie Constantino and Sofia Legaspi) to the

championship in the 2016 World Junior Girls Championship in Canada then pocketed the individual gold in the 2018 Asian Games in Jakarta while powering the squad of Bianca Pagdanganan and LK Go to the team championship in the quadrennial regional sporting conclave. The ICTSI-backed shotmaker fell short of winning a medal in the 2019 Youth Olympics and represented the Philippines last in the Tokyo Olympics, where she wound up ninth. The Governor in October issued an executive order directing state agencies to help identify additional ways to alleviate congestion at California ports and announced a state-federal partnership to help kick-start infrastructure projects designed to improve goods movement. In addition, the Governor has launched a multi-agency Supply Chain Task Force working to find opportunities to lease state and privately-owned land for container storage space, Caltrans has issued temporary truck weight exemptions on State Highways to keep goods moving efficiently and the Department of Motor Vehicles has worked to nearly double its capacity to conduct commercial driving tests. Governor Newsom signs EO to prevent price gouging on At-Home COVID tests SACRAMENTO – As part of the state’s ongoing efforts to protect Californians amid the national surge in COVID-19 cases driven by the Omicron variant, Governor Gavin Newsom signed an executive order establishing consumer protections against price gouging on at-home test kits.

Helping to improve access to these tests at a fair price, the order generally prohibits sellers from increasing prices on COVID-19 At-Home Test Kits by more than 10 percent. The order also gives additional tools to the California Department of Justice and Attorney General’s Office, District Attorneys

and other local law enforcement to take action against price gougers. Moving to bolster California’s robust testing program, Governor Newsom announced the deployment of more than 200 Cal Guard members to expand capacity at 50 testing sites around the state. This effort is in addition to the existing 6,000 testing sites that have been set up across California, the recent demand-based expansion of hours at stateoperated sites and the 9.6 million tests that the state has distributed to schools since early December. The Administration earlier unveiled Governor Newsom’s proposed $2.7 billion COVID-19 Emergency Response Package, including $1.2 billion to bolster testing efforts through expanded hours and capacity at testing sites, distributing millions of COVID antigen

tests to local health departments, clinics, county offices of education and schools, and more. He seems to be the only lawmaker who believes there is something wrong about the pork barrel system that has been around for decades, and which is the primary source of corruption among the men and women of the House and the Senate. She almost made it the first time, losing in a tight race to eventual winner Fidel Ramos. But in her second and especially her third try, she placed last among the serious presidential bets in 2016. Lacson says that if he loses, he will simply retire, which isn’t necessarily a bad thing. If by some longshot, any of the trio rises in the surveys and finds a way to make it to Malacanang, it will not be as tragic as a Marcos Jr. becoming president. At least with Messrs. Moreno, Pacquiao, and Lacson, the Philippines will not be a global laughing stock. Still and all, Leni Robredo remains the best choice. She has the competence, clean record, and most importantly the heart to become not just a good president, but a great one.

The 1977 NIRC was amended by Presidential Decree No. 1994 dated November 5, 1985, Section 286 of which added the penalty of perpetual disqualification to hold public office, to vote, and to participate in any election for an offender who is a public officer or employee. It only became effective on January 1, 1986. The COMELEC said that the accessory penalty of perpetual disqualification cannot be made to apply to the taxable years of 1982-1984, because crimes are punishable only by the penalty provided by law at the time of its commission. The COMELEC pointed out that as to the 1985 taxable year, P.D. 1994 was already in effect as of January 1, 1986, and the mandatory filing of income tax return for that year was March 18, 1986, but it cannot be made to apply to Marcos because he was no longer a public officer when he failed to file his 1985 income tax return on March 18, 1986, because he and his family were forced to leave the country on February 25, 1986, thus effectively removing

him from the purview of Section 286 of P.D. No. 1994, which cannot be made to apply to a private individual. Hence the CA Decision is correct for not imposing on Marcos the penalty of perpetual disqualification from holding any public office, voting, and participating in any election. The COMELEC noted that since Marcos was not meted such penalty, it cannot be rightfully said that he committed a false material misrepresentation when he answered “NO” to the question in Item 22 of his COC. When Marcos declared in Item No. 11 of his COC that he is eligible for the office for which he seeks to be elected to, he was essentially speaking the truth. Marcos material representations are actually not false. MARCOS DID NOT DELIBERATELY ATTEMPT TO MISLEAD, MISINFORM, OR DECEIVE THE ELECTORATE The COMELEC said that in addition to materiality and falsity of the representation, the Supreme Court has decreed a third element to warrant cancellation of COC – that there must also be a “deliberate attempt to mislead, misinform, or hide a fact which would otherwise render a candidate ineligible.” “In other words, it must be made with an intention to deceive the electorate as to one’s qualifications for public office.” Salcedo v. COMELEC. The COMELEC indicated that Marcos “cannot be said to have deliberately attempted to mislead, misinform, or hide a fact which would otherwise render him ineligible.” The CA Decision did not categorically hold that Marcos is convicted of a crime involving moral turpitude nor did it mete the penalty of imprisonment of more than 18 months or declare him perpetually disqualified from holding public office. When he answered “NO” to Item 22, he had no basis to answer in the affirmative. When Marcos declared in Item 11 that he was eligible for President, he did so because there was nothing in the CA decision that categorically apprised him that he was suffering from any ineligibility for the position of President. He sincerely believed that he is eligible for said office and he had no reason at all to think otherwise. The COMELEC noted that the Supreme Court already ruled in 2009 in Republic v. Marcos that Marcos’s conviction for “failure to file an income tax return is not a crime involving moral turpitude”. Therefore when he declared that he is eligible for the position of President, he was telling the truth. CONCURRING OPINION In a separate concurring opinion, Commissioner Kho said that the penalty of “perpetual disqualification from holding any public office” is a principal penalty and there is need for the court to “impose” it. But the CA did not impose it on Marcos. Consequently, the representation of Marcos in his COC that he is eligible to be elected to the office of president and that he has not been found liable for an offense which carries with it the accessory penalty of perpetual disqualification from holding public office are not false. OBSERVATION: This is not the end of the disqualification story for Marcos. The petitioners are expected to appeal all the way to the Supreme Court. There are other cases seeking to disqualify him which are still pending in the COMELEC. Will the Supreme Court and the COMELEC resolve all the cases in his favor? Abangan. ATTY. It’s interesting to note that two Democrats – Manchin and Sinema -- wouldn’t support eliminating the filibuster “under any circumstances,” which begs the question: Why is it that they were hell-bent in opposing their fellow Democrats’ attempt to pass the voting rights bill? In order to maintain a fair and equitable democratic institution, Americans need to fully – and without exception -- exercise their right to vote. Sinema dooms Biden agenda Last January 13, Democratic Sen. Kyrsten Sinema stoically stood before the Senate floor – as President was on his way to the Capitol to meet with Democrats to push for the Voting Rights bill – and to everybody’s surprise reiterated that she is not backing off her position to uphold the filibuster. Biden lost her vote before Biden could pitch to Democrats on eradicating it. She said removing the filibuster would not guarantee “that we prevent demagogues from being elected” and that getting rid of it would merely be treating the “symptom” of partisanship and not the underlying problem. But she is the “symptom” of an incurable disease called “egotistical attitude.” She said that while she continues to “strongly back Democrats’ elections legislation” she would not support “separate actions that worsen the underlying disease of division infecting our country. There’s no need for me to restate my long-standing support for the 60-vote threshold to pass legislation.” Doesn’t she realize that her opposition would further propagate the “disease of division” that she herself abhors? “When one party needs only to negotiate with itself, policy will inextricably be pushed from the middle towards the extremes,” she added, noting that she does not support that outcome, and she knows “Arizonans do not either.” Is supporting voting rights legislation for the benefit of all Americans an extremist viewpoint? Arizona Democratic Party chair Raquel Terán criticized Sinema, saying the party was “disappointed to say the least that she has chosen to protect an antiquated rule over her constituents.” Arizona Rep. Ruben Gallego said that he has not ruled out running against Sinema in the 2024 Senate primary. “We won’t shrink from protecting our democracy and the voting rights of all Americans,” he said. “It’s past time for the US Senate and Senator Sinema to do the same.” Sinema’s wish list Sinema acknowledged that she would support voting rights bills coming from the House. However, she is not going to support a change to the filibuster rule. She argued the country needs a “sustained robust effort to defend American Democracy.” Isn’t it that voting rights is the foundation of American Democracy? Didn’t the landmark Voting Rights Act of 1965 open the way for all Americans – regardless of race, religion, political belief, and sexual orientation -- to avail of their 14th Amendment and 15th Amendment rights guaranteed by the U.S. Constitution? Does Sinema have a problem with that? She then recited a litany of issues such as “supporting state and local candidates who represent the values enshrined in our Constitution,” ensuring that “we have a judiciary that is less lopsided in its political leanings,” and “confront and combat the rise of rampant disinformation.” It’s amazing how Sinema could come up with a lot of “wishful thinking ideas” to put on the front burner but at the same time put voting rights and civil rights legislation on the back burner. Simply put, it’s not going to work because if Congress needs to address Sinema’s “wishful thinking list,” she should – nay, must -- cast her vote to eliminate filibuster or carve-out it out and then cast her vote to pass the voting rights legislation. She needs to put just these two items on her “to do list.” It’s as simple as that. She doesn’t have to go through the rigmarole of chasing unrealistic goals on her long “wish list.”

COVAX delivers its 1 billionth COVID-19 vaccine dose; cases hit 323 M, deaths at 5.5 M GENEVA - On 15 January 2022, a shipment of 1.1 million COVID-19 vaccines to Rwanda included the billionth dose supplied via COVAX. This as globally, the number of new COVID-19 cases increased in the past week (10-16 January 2022), while the number of new deaths remained similar to that of the previous week. Across the six WHO regions, over 18 million new cases were reported this week, a 20% increase, as compared to the previous week. Over 45 000 new deaths were also reported. As of 16 January, over 323 million confirmed cases and over 5.5 million deaths have been reported worldwide Despite a slowdown of the increase in case incidence at the global level, all regions reported an increase in the incidence of weekly cases with the exception of the

African Region, which reported a 27% decrease. The South-East Asia region reported the largest increase in new cases last week (145%), followed by the Eastern Mediterranean Region (68%). New weekly deaths increased in the South-East Asia Region (12%) and Region of the Americas (7%) while remaining approximately the same as the previous week in the other regions. Together with partners, COVAX is leading the largest vaccine procurement and supply operation in history, with deliveries to 144 countries to date. But the work that has gone into this milestone is only a reminder of the work that remains. As of 13 January 2022, out of 194 Member States, 36 WHO Member States have vaccinated less than 10% of their population, and 88 less than 40%. COVAX’s ambition was compromised by hoarding/

stockpiling in rich countries, catastrophic outbreaks leading to borders and supply being locked. And a lack of sharing of licenses, technology and know how by pharmaceutical companies meant manufacturing capacity went unused. COVAX is working with governments, manufacturers and partners to ensure that when countries receive vaccines they can get them to people quickly. MAKING SANDCASTLES By TIM PEDROSA

Let us greet each new day with no rules; with unconditional opportunity. Do not dilute the power of this new day with the hardship of yesterday but greet this day the way it has greeted us; with open arms and endless possibility. The irony of life is that, by the time we decide to enjoy life, we are too old to do it. Most of us after having spent many years working to live, spend many more years living to work; and when finally there is no more work we don’t know how to live. Let us learn from the following inspiring narrative. As the story goes, in a hot sun, salty air, rhythmic waves, a little boy is on his knees scooping and packing the sand with plastic shovels into a bright blue bucket. Then he upends the bucket on the surface and lifts it. And, to the delight of the little architect, a castle tower is created. All afternoon he will work. Spooning out the moat (water surrounding the castle). Packing the walls. Bottle tops will be sentries. Popsicle sticks will be bridges. A sandcastle will be built. In a big city, busy streets, rumbling traffic, a man is in his office. At his desk he shuffles papers into stacks and delegates assignments. He cradles the phone on his shoulder and punches the keyboard with his fingers. Numbers are juggled and contracts are signed and much to the delight of the man, a profit is made. All his life he will work. Formulating the plans. Forecasting the future. Annuities will be sentries. Capital gains will be bridges. An empire will be built. Two builders of two castles. They have much in common. They shape ordinary into extraordinary. They see nothing and make something. They are diligent and determined. And for both the tide will rise and the end will come. Yet that is where the similarities cease. For the boy sees the end while the man ignores it. Watch the boy as the dusk approaches. As the waves near, the wise child jumps to his feet and begins to clap. There is no sorrow, no fear, no regret. He knew this would happen. He is not surprised. And when the great breaker crashes into his castle and his masterpiece is sucked into the sea, he smiles. He smiles, picks up his tools, takes his father’s hand, and goes home. The grownup, however, is not so wise. As the wave of years collapse on his castle he is terrified. He hovers over the sandy monument to protect it. He blocks the waves from the walls he has made. Salt-water soaked and shivering he snarls at the incoming tide. “It’s my castle,” he defies. The ocean need not respond. Both know to whom the sand belongs. I don’t know much about sandcastles. But children do. Watch them and learn. Go ahead and build, but build with a child’s heart. When the sunsets and the tides take - applaud. Salute the process of life and go home. Finish each day and be done with it. You have done what you could. Some blunders and absurdities no doubt crept in; forget them as soon as you can. Tomorrow is a new day. You shall begin it serenely and with too high a spirit to be encumbered with your old nonsense. The secret to living the life of your dreams is to start living the life of your dreams. Don’t be afraid that your life will end, be afraid that it will never begin.

Walk With Faith There is always some sense of hesitation and fear in every start of an endeavor. It is natural to have fear of failures or be concerned with the unknown future. Every time we begin on something, there is some sense of a leap of faith and trust in God and in oneself. We must consider God’s involvement in our journeys and endeavors in as much as we consider also our own skill set, talents, and potentials. We must let God be involved in our endeavors and plans. We have to regain our confidence in living our daily lives and living our faith to the fullest. St. Paul teaches us: “None of us lives for oneself, and no one dies for oneself. For if we live, we live for the Lord, and if we die, we die for the Lord; so then, whether we live or die, we are the Lord’s (Rom. 14: 7-8.).” Moreover, our faith teaches us that we are people of communion; so, let us not hesitate to reach out and associate with people outside of our family circles as we used to do before. Let us walk with Christ Jesus, let our faith in Him be our light and strength as we do our activities and go through our day, week, and month. If we believe in God; then, let it be seen through our confidence and cheerfulness in our daily existence. In the world around, there may be the lingering fear of the covid, but let your faith in God be stronger. We may have many problems coming this year; but with faith in God, things will still be fine and we will emerge a better person, better people of God, in the end. With our faith in God and in our Lord Jesus who walks with us, we are to remember these three basic things: first, God is our Protector and Provider; hence, believing in Him means believing He will provide and protect us all the time. There is no need to be afraid, but continue to walk in faith. Second, God’s Holy Spirit dwells in us; hence, we have to renew our act of faith and docility to His actions and inspirations in our life. Most often, we take for granted this truth of God’s divine presence through the Holy Spirit in us; this year let our faith and awareness of His presence be stronger than last year. Third, God continues to speak to us in Christ; then, we must listen attentively. God continues to command us through the Ten Commandments and other commandments as in the life the Church; so, we must obey. Faith demands relationship with God. Faith demands we be obedient and trustful. Faith empowers us to follow Christ Jesus in good times and in bad; if we have faith all things and events in our life, we look at them with different perspective, for we view them according to faith, according to God’s view. Let God’s words: “Do not be afraid” resound in our heart. Let our Lord Jesus’ assurance: “I am with you always,” accompany our daily existence. Let us respond eagerly to His call: “Come follow me.” He tells us too in the Eucharist, “take this and eat…” take this and drink…” we do and follow His voice. Living our daily life must not be separated from our faith and love of God. Like the Saints, their faith in God modified everything in their existence; may we do the same. Let us walk indeed not with our sight alone but especially also with faith in order to live meaningfully this year 2022. Amen.

Recipe of the Week Papaitan Baka / Pinapaitan Baka Ingredients: 1 k. ox tripe/innards 1/2 c. diluted ox bile 1 head whole garlic 1 thumb size ginger, crushed 2 thumb size ginger, cut into strips 1 head garlic, chopped 2 medium size onion, chopped 1 bundle spring onion, chopped 1 small packet, sampalok sinigang mix 2-3 siling labuyo, chopped 1/2 c. patis salt and pepper

Cooking procedure: Wash thoroughly ox innards, drain and cut into small slices, set aside liver. In a sauce pan put all innards, whole garlic and crushed ginger cover with water and boil for 15 minutes, drain and discard liquid. Rinse and add fresh water and boil for 1-2 hours or until innards are tender. Remove from pan separate broth and keep aside. In same sauce pan sauté onion, garlic and ginger. Add innards including liver stir for 3-5 minutes, add patis and cook for another 3-5 minutes. Pour in broth and simmer for 10-15 minutes, add siling labuyo, sinigang mix and goat bile (half quantity at time and taste sourness and bitterness add more if required). Simmer for another 3-5 minutes. Season with salt and pepper, garnish with spring onion. Serve hot.

Quezon Memorial Shrine declared National Cultural Treasure QUEZON CITY – The Quezon Memorial Shrine is now a National Cultural Treasure (NCT) as declared by the National Museum through Declaration No. 29-2020. The National Museum, through its website, stated that to be declared as NCT, there must be “a unique object found locally, possessing outstanding historical, cultural, artistic and/ or scientific value which is significant to this country and nation”. The highly valued cultural properties are indispensable in the understanding of the country’s history and culture, thus, they are to be preserved and protected by the state through the National Museum of the Philippines. “Maraming salamat sa National Museum of the Philippines sa pangunguna ni Director General Jeremy Barns. Malaking karangalan ang natatanging pagkilala na ito na sumasalamin din sa makulay na kasaysayan at kultura ng Lungsod Quezon (We thank the National Museum of the Philippines headed by Director General Jeremy Barns. This is a big honor for us that reflects the colorful history and culture of Quezon City),” Mayor Joy Belmonte said, confirming the NCT declaration. Museo ni (Museum of) Manuel Quezon is housed in the shrine, which was designed by architect Federico Ilustre, according to the National Historical Commission of the Philippines (NHCP). The shrine has an equilateral triangular base that serves as the mausoleum of President Quezon and his wife, Aurora Aragon. “Surmounting the base are three pylons measuring 66 meters in height, representing Quezon’s age upon his death, and the three major islands of the Philippines. Above the pylons are Art Deco statues of three angels holding Sampaguita funerary wreaths sculpted by Italian artist Francesco Riccardo Monti,” the NHCP

stated. The museum also features the former president’s personal and political belongings, books, articles and documents, and photos from his youth until his death in 1944, with

interactive booths about him and his family. The Quezon Memorial Shrine is the second NCT in the city after the National Shrine of Our Lady of the Holy Rosary of La Naval de Manila at the Santo Domingo Church in Sta. Mesa Heights.

Located inside the 27-hectare Quezon Memorial Circle national park, the shrine is open Tuesdays to Saturdays from 8 a.m. to 4 p.m. Visitors are required to present vaccination cards.
