Kirkland is in another fiscal fight about Juanita Beach Park, this time over the possible need for as much as $850,000 more in funding. The park along Lake Washington has been the subject of a lot of dispute since the city acquired it from King County in 2002. The city began an upgrading project there in 2010, awarding the work to DMSL Construction, Inc., then firing DMSL from the work in June and hiring Marshbank Construction 10 days later to complete the work. The park was partly reopened on Aug. 5. But more work remains to be done, and in a presentation to the Kirkland City Council on Sept. 6 from parks managers, a new money problem was laid out. The difficulty, explained Michael Cogle, interim deputy director, is that the project is short about $750,000 or more. A project-completion budget shows the city has about $2.5 million available to do the work, but the total cost is expected to be about $3.2 million. The original DMSL contract was for $1,180,390, with change orders bringing the figure to $1,346,059, parks figures indicate. Of that, some $897,315 was paid to DMSL, leaving $448,744 still available from the original funding. But in later work, done under a contract awarded to Marshbank without competitive bidding and executed partly because of “strong community interest” in reopening the beachfront, more costs [ more PARK page 5 ]

The operator of a former Kirkland securities-brokerage firm was charged in both civil and criminal lawsuits Sept. 8 with swindling clients out of millions of dollars and trying to hide the losses from the victims, who often were friends or
relatives. The federal charges were brought against Richard A. Finger, Jr., who operated a business called Black Diamond Securities LLC in Kirkland, according to the filings. Finger operated Black Diamond from offices at 516 Sixth St. S., which now are deserted, with undelivered financial

A woman accused of trespassing at a home in Kirkland’s West-of-Market neighborhood last summer entered a plea of not guilty Tuesday at Kirkland Municipal Court. But her attorney added that there’s a lot more to the matter than that, and made a voluminous filing of paperwork to emphasize his point. The plea was entered by Jill Elaine Lane, 31, who was accused of trespassing at a house at 435 Eighth Ave. W. on June 15, 2010. A Kirkland Municipal Court commissioner set a pretrial hearing date of Oct. 12 to consider further proceedings. However, Lane’s attorney, Andrew Magee, filed several motions contesting the case, asking that it be dismissed, and that the city explain why the gross misdemeanor charge was ever brought at all. Among other arguments, Magee quoted from a Kirkland Police Department report describing how Lane wasn’t at the house when police moved to arrest her, and officers instead had to call her on a cellphone so she could be arrested. “The Kirkland Police Department, using contact information provided via Ms. Lane’s prior cooperation with the police, lied to Ms. Lane and lured her to the property to wrongfully entrap her,” Magee wrote. A police affidavit of probable cause prepared on June 17, 2010, contains this description of the arrest, according to public records: “On June 15, 2010...Jill or anyone else was not at the home at this time, however, her belongings were still in the interior of the home to include the bedrooms and garages. I contacted Jill via phone and asked her to respond to the residence. Upon arriving, she was arrested and taken into custody for tres-

Magee also made several arguments asking that the charge be dismissed, including that nearly 1-1/2 years had passed between the reported trespassing and the filing of charges, hindering Lane’s ability to prepare a defense, and that the trespass charge was prejudiced by still another charge, brought in King County Superior Court. That case was filed in January 2011 and dismissed Aug. 3, 2011, according to court records. Shortly afterward, on Aug. 23, the city brought the trespass charge, Magee noted, compromising Lane’s right to defend herself. “There is no explanation, nor, therefore, justification for this delay and Ms. Lane has been actually prejudiced accordingly,” Magee argued. Court Commissioner John Olson denied Magee’s arguments for dismissal and set the October pretrial hearing date, when the city would be expected to respond. The home overlooking Lake Washington was valued at about $3 million, but construction had stopped before it was completed and the building had been abandoned.

Sunday morning on 9/11, I was driving up Market Street and then on to Central Way. I was so surprised and touched by the poignant display of scores of American flags placed all over Kirkland. I want to thank the entity or entities who took time out to remember the tragedy of 9/11 and all the lives lost to terrorism. As a recent, retired flight attendant, this was especially important for me to see my beautiful city honor the fallen. The year after the 9/11 attacks, I was chosen to read a poem I wrote for a memorial held in Washington D.C. It was the defining point of my long airline career and very sad. As we all know, the airlines were forever changed with more security and headaches. However, I felt honored to be a part of the memorial in Washington D.C. And when I saw all the flags displayed in Kirkland, I again felt proud and honored to live in such a civicminded and patriotic city. Although the events of 9/11 were personally devastating for me, those displayed
flags gave me a sense of gratitude that I live in this city. Please thank and give big kudos to those who placed the flags on 9/11 in Kirkland. It was much appreciated.

Disappointed to see crosswalk lights replaced with flags A couple of years ago, at 124th Ave. N.E. and N.E. 140th St. of the then-unincorporated Kingsgate area, the county put in a new pedestrian crossing. When I first saw it in action I was impressed how effective the system was in drawing my attention to the entire crosswalk. The systemâ&#x20AC;&#x2122;s effectiveness derived from a series of flashing yellow lights embedded in the street along the crosswalk. The lights were activated by crossing push buttons on either side of the street. They were highly visible a distance away, even in bright daylight, and supplemented by overhead caution lights. I was disappointed to see workers pulling up the embedded lights the other day. The city has replaced this sleek, modern and effective safety system with orange flags that the pedestrians are supposed to carry
across the street. The lights notified the drivers of a pedestrian before they stepped from the curb, now a walker is hardly observed until in the street. Sometimes I have noted all of the flags on one side of the street; the pedestrians from the other side left to dodge traffic and pray. This is big-city progress?! Besides the safety and aesthetic superiority of the light system over the flags, it is a heartbreaker that they trashed a several-thousand dollar system for the sake of conformity to Kirklandâ&#x20AC;&#x2122;s inferior standard. Perhaps the flag system is effective in two-lane downtown Kirkland. It is not as effective on a five-lane thoroughfare.

Metro system doesnâ&#x20AC;&#x2122;t work if buses are mandated to be full Iâ&#x20AC;&#x2122;d like to respond to Jeff Jaredâ&#x20AC;&#x2122;s recent column against the $20 car tabs to support public transit. Name one city where public transit is fully funded by collected fares. Name one city where road costs are fully paid by the people who use them? If this were the case, the 105,000 people who use the Alaska Way Viaduct should pay $40,000 each for the tunnel replace-
ment. Letâ&#x20AC;&#x2122;s put that to referendum and see if it passes. The Kirkland to Seattle bus I take each day leaves every 10-15 minutes with 40-60 people on board, depending on the bus size. This route was to be cut without the extra funding. Imagine 40-60 extra cars in front of you for every bus taken off the road. And what would the affect be on parking with an additional 1,000 cars vying for parking spots? Sure, sometimes when I come home late, the bus is only half full. But there is a minimum service Metro needs to provide to make transit viable. The system doesnâ&#x20AC;&#x2122;t work if buses are mandated to only leave the stop when they are full. As for gypsy cabs, I can only imagine 40-60 people at a park and ride waiting (hoping?) for a stranger needing $20 to offer them a ride to Seattle. I have read many negative responses to the $20 car tabs in newspapers and online, and am shocked and saddened by how rude and selfcentered people can be over $20. It is a small price to pay to have a livable community. We have all drunk from a well we did not dig. Our family will be donating our $48 in free bus tickets to families with disabilities.

As an interim measure, the Parks Department on Sept. 6 sought $750,000 from the cityâ&#x20AC;&#x2122;s General Capital Contingency Fund to complete the Juanita work, and the council approved the allocation. Meanwhile, First Sealord continues to send representatives to the park, Cogle added, and has requested documents from the city.

woman for making a false statement, that she pleaded guilty to avoid a trial and paid a fine. When Colorado police found the attack really did take place, the Lynnwood charges were dismissed, the fine repaid, and the case removed from records, according to news reports.
Aside from those steps, however, investigators found the name of the Kirkland victim in Oâ&#x20AC;&#x2122;Learyâ&#x20AC;&#x2122;s computer, and were able to use the DNA tests from the shoelaces to match them to Oâ&#x20AC;&#x2122;Learyâ&#x20AC;&#x2122;s Colorado DNA profile, leading to the charges in the Kirkland assault. Kirkland police also
determined that Oâ&#x20AC;&#x2122;Leary was stationed at Joint Base LewisMcChord in the Army from November 2006 to September 2009. Oâ&#x20AC;&#x2122;Leary is being held in Colorado and would be returned to Washington to face the charges here after the Colorado cases are resolved. King County prosecutors
asked that bail not be allowed if Oâ&#x20AC;&#x2122;Leary is returned here, calling him â&#x20AC;&#x153;an extreme danger to the communityâ&#x20AC;? who uses â&#x20AC;&#x153;surprise and fear as his weapons of choice.â&#x20AC;? Oâ&#x20AC;&#x2122;Leary faces lifetime sentences for the crimes in both Colorado and Washington, prosecutors added.

The mayors of several East King County cities, including Kirkland, will soon proclaim Sept. 24 through Oct. 22 as “Eastside Month of Concern for the Hungry” as part of the annual “Day of Concern for the Hungry” campaign sponsored by the Emergency Feeding Program of Seattle & King County. The proclamation officially launch the annual “Share What You Can” campaign to benefit those served by local food banks and feeding programs. The emphasis is to fill food bank shelves with non-perishable food items as the school season begins. Donation centers include various community centers, city halls, and fire stations. September is National Preparedness Month. So you have your emergency plan, and your emergency kit with food, water and extra clothing, but what about your skincare needs? Granted, in case of a real emergency, beauty products are probably the last thing anyone’s going to worry about. But still, if you are in an emergency situation, wouldn’t it be nice to have some skin basics? Here are five non-food items you can add to your emergency kit, that are not only generally useful, but are specifically useful for skincare: 1. Jojoba Oil 2. Petroleum Jelly 3. Baking Soda 4. Lavender Essential Oil 5. Witch Hazel Here’s how they are useful: Jojoba Oil is a botanical extract of the seed of the jojoba plant. Of all the compounds in nature, it is most similar to human skin oil. Jojoba oil is non-comedogenic, meaning it won’t clog pores. It can balance oil production, be used as an eye and makeup remover, eye and face moisturizer, massage oil, cuticle oil, lip balm, hair conditioner and shave prep, and is fungicidal, keratolytic (exfoliates), and has an SPF of 2-4. Petroleum Jelly is also non-comedogenic. It is excellent as an occlusive dressing, which keeps germs out and moisture in. It can be used as a lip balm, cuticle softener, personal lubricant and mustache wax. Baking Soda regulates pH. It is an excellent tooth polish if you have no toothpaste. It can be used as a personal deodorant, antacid, and shoe deodorizer, as well as a facial exfoliant and a dry shampoo for hair (though baby powder is the best for this). Lavender Essential Oil is one of the most useful essential oils nature provides. It is the one oil that you can put directly onto your skin without the need for a carrier oil. Put a few drops directly on a burn and it will take away the pain, and keep it from blistering and it will heal with no scar. It is also calming, so is beneficial to smell in times of emergency. It will soothe nerves and help promote restful sleep if placed on a

Lawsuit adds another hurdle to 520 bridge construction BY PEYTON WHITELY pwhitely@kirklandreporter.com
Thousands of drivers from Kirkland and other Eastside locations could be affected by a lawsuit filed in federal court in Seattle. But the filing also could become just one more level of dispute in questions about the Evergreen Point Floating Bridge that date back more than 40 years. The new filing is a complaint brought by the Coalition for a Sustainable 520, a Seattle-based community organization that’s questioning the building of a new Highway 520 route, which includes the floating bridge. The filing was made Sept. 2, the last possible day to bring
such an action, said David Bricklin, attorney for the coalition. “They kind of forced our hand,” said Bricklin. “The deadline was the day we filed it.” The lawsuit argues that an environmental-impact statement prepared for the 520 project was inadequate and had several failures, including not considering alternatives and not properly considering adverse environmental impacts. Defendants include the United States Department of Transportation through the Federal Highway Administration and the state Department of Transportation. The defendants have 60 days to respond to the filing and no replies have been made to the arguments. No trial date has been set, and Bricklin estimates it could be six to nine months before the matter comes before a judge. At the same time, Bricklin also acknowledged the entire matter may be moot. “They don’t have enough money to build it anyway,” he said. Bricklin pointed out that a number of factors could affect bridge construction long before the lawsuit reaches a trial

stage, including the successful implemention of tolls, now expected to begin in December, and the outcome of a November ballot measure, Initiative 1125, which could curtail tolls. Bricklin said one possible outcome for the lawsuit is that it could “be put on hold” until funding questions are resolved. The 520 bridge opened in 1963 and as early as 1970 the state was considering options to increase its capacity. A Translake Study Committee met during the 1990s and considered dozens of options, including a tunnel under, or a suspension bridge over, Lake Washington. The final decision, which is now proceeding forward, was to replace the present bridge with a six-lane tolled configuration. The state estimates the project cost at $4.65 billion, with some $2.62 billion in funding received so far, and with a planned opening in 2014. More than 100,000 vehicles use the route between Seattle and the Eastside daily.

The 31-year-old Redmond man appeared to be intoxicated and refused all field sobriety tests. He was booked into Kirkland Jail on DUI. Earning their second win of the season, Lake Washington put up solid numbers during the 39-17 win over Redmond on Sept. 9. The Kangs, which won their first game after Garfield forfeited, has a 2-0 start to the season. Against Redmond, the Kangs struck first with a kickoff return by quarterback Shawn Gray for an 85-yard touchdown, followed by a failed kick by Hugh McGlynn. The Kangs led 6-0 at the end of the first quarter. Redmond followed their scoreless first quarter with 17 unanswered points, giving the Mustangs a 17-6 lead going into the half time. Growing up in Kirkland inspired author of ‘The New Kid’ series While a student at the UW, Mathews became interested in filmmaking. He said he made some films and won awards at the Bellevue Film Festival years ago. He eventually became a cameraman at KIRO-TV, then moved to Los Angeles to write screenplays. During the writers’ strike of 2007, Mathews’ manager asked if he had any good ideas for writing a novel. The idea of “The New Kid” came to him. Patrick Hughes, founder of Hughes Capital Entertainment and Mathews’ manager, went into the film business when he was 16 years old. He went on to San Diego State University and then the American Film Institute. Mathews has been one of his clients for the past 10 years. “Mathews is one of the most creative guys I’ve
had the pleasure of working with,” said Hughes. The good thing about screenplays is that it is fun to go out and make a movie, Mathews said. But, he added, everyone comments on a script to tell you how it could be improved. With a book, however, there is a sense of completion and great satisfaction when receiving emails from fans.
