irthdays and Christmas are meant to be celebrated with family and friends. Thanks to a King County Court commissioner, Maile Metalwala will spend both with her father and his family. Maile will be reunited

with her father Solomon Metalwala on or before Dec. 17, one day before the child’s fifth birthday. The commissioner gave full custody to Metalwala during a hearing Monday morning in King County Superior Court in Kent. The girl’s mother, Julia Biryukova, was also granted limited visitation rights with her daughter.

“I feel very good. I am excited to have Maile back in my life 100 percent,” Metalwala told the Reporter following the hearing. “I can’t wait to just talk to her.” The Kirkland father also has many plans for the holidays. “We have never really celebrated Christmas, so I’m going to start some new traditions because Christmas is a beautiful time of the year

Family and friends of 19-year-old Scarlett Paxton gathered on Thursday night outside the Juanita Starbucks to remember the Kirkland woman, who was found dead by her boyfriend early on Nov. 30. Mourners packed around

a table covered with candles, flowers, and photos of Paxton. Many in attendance held candles, and tearfully shared memories of Paxton, who was a graduate of BEST High School in Kirkland. “She was an awesome, wonderful girl,” said Jonathan, a friend of the woman. “She was always there for you, and would listen to you.

A Redmond man who threatened the Mayor of Kirkland and other government officials has been sentenced to 40 months in prison. David R. Myrland, 53, will be on federal supervised release for three years following his prison term and is required to repay the City of Kirkland $1,961 for police overtime costs. Myrland faced U.S. District Judge Ricardo S. Martinez Friday who told him, “The law applies to everyone … And the consequences of breaking the law apply to everyone as well.” Myrland claimed to be part of the “Sovereign Citizens” movement, based in Mount Vernon, Wash., which claims the laws of the United States do not apply to them. threats over the years to ‘arrest’ government officials using ‘deadly force.’ He continues to this day to apparently believe that he was in the right, and everyone else is in the wrong. Despite his guilty plea, he continues to argue that he had a legal right to make the threats he made; that they were not legally threats; and that he was in the right in virtually every respect,� prosecutors wrote in sentencing documents. Rey, who lives in Seattle, received a voicemail message from Myrland on his home phone on Sept. 20, 2010, found by his wife. The caller ID had Myrland’s name and phone number listed and the message stated: “Keep your doors unlocked. Don’t resist. You’re going to be meeting people.� Fearful for his family’s safety, Rey contacted Seattle Police. Myrland, a self-described legal advocate and consultant, has a long history with the City of Kirkland and contends that the city has performed unlawful actions against him since 2002. He sent a letter to Gov. Chris Gregoire, among others, on Sept. 20, 2010 seeking an investigation into a “half dozen� Kirkland city employees. Rey and McBride could not be reached for comment.

Durkan. Myrland threatened to arrest Mayor Joan McBride and Kirkland’s Assistant City Attorney Oskar Rey in 2010. The Redmond man was arrested in January for making those threats. “Today the court held Mr. Myrland accountable for his crimes,� said Durkan. “His crimes had real victims. For too long Kirkland Mayor Joan McBride and other city officials have had to live with the specter of Mr. Myrland’s armed associates invading their homes. I applaud the courage of the mayor and her officers who appeared at the sentencing hearing today and described how this defendant’s selfish campaign of threats and quasi-legal filings has altered their lives.� Myrland’s threats to the mayor came via email and were in response to his arrest by a Kirkland Police officer in April of 2010. That arrest resulted in the impounding of his vehicle for driving

with a suspended license and expired vehicle-license tabs. At the time of Myrland’s arrest, he was found to have an unloaded handgun on the front passenger seat with a loaded magazine lying next to the firearm, according to court documents. The gun was initially taken for safe keeping but later returned to Myrland. Myrland said police wrongfully took his handgun, which compromised his safety when he encountered a threatening stray dog soon after. He stated that Mayor McBride is an offender of Washington State felony statutes and is a threat to the safety of all state residents, according to court documents. He went on to say that he was going to arrest the mayor and warned McBride to leave her doors unlocked and to not resist arrest. McBride told Kirkland Police that upon receipt of the email she became fearful for her safety, as well as the safety of her family. She was unaware of Myrland’s arrest. She was so fearful that she obtained a temporary antiharassment order against Myrland, according to court documents. In asking for a four- year prison term, prosecutors wrote to the court that Myrland “has made repeated

Pierce said the formal interview process began at the end of October and beginning of November — about a month and a half after Kimball announced he would be leaving — but she didn’t learn about the board’s decision until Monday’s meeting. “I’m thrilled. I’m very excited,” she said. “I have a love for this district.” Pierce said the process included submitting a resume, making a presentation to the board and interviewing with trustees individually. She was also interviewed by the board of directors as a whole a couple of times — each time for several hours. At Monday’s meeting, board member Ravi Shahani said the extensiveness and thoroughness of Pierce’s interview process would not have been possible with a candidate from outside LWSD. District trustees decided to initially to look for an internal candidate because continuity and a smooth transition will be important to have when Kimball leaves as LWSD has a number of initiatives in place that will come to fruition next year. These initiatives include a grade reconfiguration and the opening of a new

When the plane failed to reach its destination, a search involving federal, state and local officials was started on Lake Huron. Searchers found the plane on Sunday, 110 yards off shore

and about three miles north of St. Ignace. Both men were found dead, according to the U.S. Coast Guard. Phillips was manager of Amazon Web Services and also a former Microsoft, Corp. employee. He joined Amazon earlier this year after nearly two decades at Microsoft. Federal investigators arrived Monday to investigate the cause of the crash.

A Kirkland woman was arrested Monday night just outside of Salem, Ore. after Oregon State Police (OSP) pulled her car over and found approximately five pounds of marijuana in her trunk. The 37-year-old woman was also found to have a small amount of cocaine in a backpack. The OSP Drug Enforcement Section is continuing the investigation into the case. “We’ve been pretty successful in the last few years (with finding illegal drugs),” said OSP spokesperson Lieutenant Gregg Hastings. “This is actually a relatively small amount for us.” The stop occurred around 11 p.m. as the woman drove northbound on Interstate 5. An OSP trooper stopped the 2002 Mercury Sable displaying Washington license plates near milepost 253 for a traffic violation. “She was stopped for following too close,” said Hastings. So why not have the best of both worlds this holiday season? Assistance League of the Eastside’s signature fund raiser, Celebrations Holiday Home Tour, is scheduled from 10 a.m. to 7 p.m. Friday, Dec. 9 in Kirkland. Celebrations is a self-guided tour of six Kirkland homes – one in Houghton and five located West of Market – beautifully decorated for the holidays. Event co-chair Kay Zatine, who is also a member of the Assistance League of the Eastside, says everyone wins with this event: “the merchants, Kirkland and the people who will be served by the money raised on this one fabulous day.� All proceeds from the tour help to fund the philanthropic programs of the organization that include Operation School Bell, Assault Survivor Kits, Starting Over Support and Assistance League Outreach. These programs annually provide new clothing to more than 2,600 students selected by school personnel in the Lake Washington, Bellevue and Northshore school districts; help to restore dignity to survivors of sexual assault with clothing to replace items retained as evidence by the police; and bring comfort to families seeking shelter from domestic violence.

Four tickets will pay for new school clothing for one junior high school child; three tickets will pay for a basket of essential items for families fleeing domestic abuse; and one ticket will pay for a full Assault Survivor Kit and one mini kit in hospitals statewide. It is a constitutionally mandated service – which can be run efficiently under a service model but not a for profit business model ‌ and why should it run under a business model? A business model can pick and choose its products/delivery routes and set its own rates. Unlike UPS or Fed Ex, the USPS cannot pick and choose where it will deliver services. This does not mean that the USPS cannot reinvent itself to provide additional services in different ways. One barrier is of course the number of Congressional regulations and mandates that constrain change in the USPS. Comparing the breakup of the USPS to AT&T divesting itself of the “Baby Bellsâ€? and assuming that would bring more choice, better rates and better service is very misleading. AT&T did break up into many “Baby Bells.â€? But with acquisitions, mergers and name changes these companies are now consolidated into three major regional companies (very difficult to

figure this out). However, my land line service will still be provided by the regional company that has the monopoly in my area. Interestingly, since the divestiture AT&T has actually bought back one of the Baby Bells – Bell South. Comparisons between the USPS, UPS and Fed Ex are difficult to make because each operates so differently. UPS is a for-profit company whose employees are unionized. It sets its own rates and routes. My understanding is that most UPS employees work their way up through the company (like the post office). Fed Ex is actually a for-profit airline! And so it falls under different federal rules and regulations. The pilots are Fed Ex employees and are unionized. Fed Ex deliveries to your home and business are made by selfemployed contractors. These delivery contractors do not work for Fed Ex. They do buy their routes, trucks, and paint to paint the trucks etc. If a route is not profitable Fed Ex does not deliver there. In areas where Fed Ex chooses not to go it contracts with the USPS to deliver its mail.

Purchase wisely this holiday season “Their selection of wrapping was precarious,� I thought to myself, and timidly I reached my hand into the plastic bag. Feeling around for the contents within, my hand locked onto the items and pulled them out one by one. First, a tape dispenser; not the orthodox choice for a gift, but it must be a prelude for something else. Second, a desk calculator; I already have a Ti-84. As my hand grasped the last object, the cushioned and flimsy texture of it perplexed me, and I eagerly yanked out what could be my second

night of Chanukah’s salvation. Orange, black stripes and yellow eyes looking up at me, the tiger mouse-pad remained clenched in my hands as I shot my mother an inquisitive look of “why?� “Zach, isn’t it great? I know you’ve always loved big cats,� she said. Grimacing, I looked up and forced a smile of confirmation, set the mouse pad back in the bag, and then retreated to my room, reflecting on the fact that never had I ever made any statement about an existing adoration of big cats. To help prevent a situation like mine, I conversed with countless kids in order to get a general consensus of good gift ideas. According

The emphasis of this holiday season, like every year, is joyous celebration of religious holidays and goodwill towards all people. It is a time for reflection and being thankful for the people around you as well as the materials things you have. With the holidays comes the tradition of giving and receiving gifts, and nothing is as gratifying as giving someone a gift you know they will appreciate. Still, it is the thought that counts – with a few exceptions. Parents, let the following anecdote serve as a reminder of the importance of giving your children gifts that will be appreciated. If you are going to spend the money, you might as well get them something they want. It was the second night of Chanukah, 2010, and after the first night’s present slump I was thinking to myself “how could tonight be any worse?� My parents opened the kitchen drawer containing our candles and lighter and placed the two candles representing the second night in the holders on the menorah. After reciting the prayer and sealing it with an Amen I now prepared myself for the important part of Chanukah: the presents. Usually in Chanukahs past, I have been accustomed to selecting one of the excellently wrapped presents underneath our piano. This was not the case. Instead, my mom handed me a plastic OfficeMax bag complete with what seemed to be a fresh receipt crawling out the opening.

KIRKLAND IMPACT BOYS WIN DISTRICT TITLE The Kirkland Impact boys 16U soccer team recently won their district competition. The team won the Washington State Youth Soccer Association’s Recreation Cup for District 2. It’s the second straight year the team has won the title. Impact advanced to the state semi-finals after beating the District 4 champions from Bainbridge in a 5-1 game on Dec. 3. The state finals will take place this weekend on Sunday, Dec. 11 at the Starfire Complex in Tukwila. Last year the team finished as a runner up. The team is based at Juanita High School and includes: Ryan Bartleson, Stephen Fleming, Conor Goodwin, Kellen Harlington, Sean Joergensen, Austin Knerr, Pao Lor, Christoph Mayr, Jonah Maki, Jason McLean, Sam Merritt, Sean Nelson, Justin O’Farrell, Jacob Reyes, Robert Snyder, Keegan Taggart and Nahom Zaid. The Lake Washington girls basketball team is returning to the court this winter with a new style. After losing a top player to an ACL tear over the summer, the Kangs rethought their game plan and are moving forward. “Last year we had a girl named Kat Whitfield, who was arguably our best inside player. She tore her ACL in July so she’s missing her senior year. So we kind of have to change the way we play. Instead of marching up the floor and giving it to Kat we’re working on pushing the ball and getting turnovers. Adding speed to our game, rather than relying on our size. It’s a different style,� said returning head coach Cory

She can cause some mismatch problems for people,� said Shepard. “I think we’re flexible. I think we can be kind of like a chameleon and do different things.�

Juanita Flyers win year-end tournament The Juanita Flyers soccer team won their division end of the year tournament in November. The Flyers took the top spot in the Lake Washington Youth Soccer Association’s year-end tournament for the boys U12 division. The team includes players from Frost, Keller and Muir elementary schools in Kirkland. They finished the regular season undefeated and won the semi-final game with a 1-0 final score.

Beginning their second season competing in the 3A KingCo conference, the Lake Washington boys basketball is ready. Ready to begin a season they hope will take them back to the state tournament. “We’re excited to get going,� said senior captain Matt Staudacher. “We’ve all been friends for a long time.� The team has a talented senior group returning to the court, but also features more than just them. “We have more depth,� said returning head coach Barry Johnson. “(We have) a couple of sophomores on the team this year who are going to see a significant amount of playing time.� Early in the season, Johnson said the Kangs have been working on defense, which is also a strength for the team. “Our defensive pressure. I think we’re all starting to buy into the team concept of defense and pressuring our opponents a little more,� said the coach. The captains see it too, knowing it will only help them in games. “We’ve been working on defense,� said captain Darien Nelson-Henry. “We have a lot of guys who can score, but getting stops are just as important so we can turn around and let them score.� Now that Lake Washington has had a good look at the teams in the league, they know what it takes to succeed. “We know what to expect as far as the league goes,� said

the coach. “We’ve seen everyone a couple of times and I think the biggest difference is going to be – the league we know, but going into districts when we have the Metro teams. Our district has the toughest teams. When you go into districts those are state championships right there for whoever gets out. We get five teams who go to state out of our district, but there are like nine teams right there that could go.� To get there, the team knows it takes hard work. “Honestly we want to win state,� said Nelson-Henry. “We have the tools to win, we just have to do it. This is our year. It’s going to take a lot of dedication and we can’t get discouraged if we get down in a game. We have to stay positive because we can do it.� For Johnson, the immediate goal this season is winning league. Making it happen however, is easier said than done in KingCo. “Everybody being healthy. Keeping our composure going through adversity,� said Johnson of what it will take to be the top team in the league. “There are a lot of good teams in our league and our cross team – what I consider to be our rivals now – Juanita is playing really well. A lot of teams are ready to knock off a big guy. Last year we were supposed to be up there, we were ranked up there, but we weren’t mature enough yet. Now I think we’re ready for that challenge. We’re welcoming the challenge now.�

Disorderly conduct: 1:32 a.m., 300 block of Central Way. A 31-year-old Seattle man was arrested for jumping out in front of cars and knocking over a city planting pot.

Dec. 2 DUI: 12:16 a.m., 12400 block of 100th Ave. N.E. A 32-year-old man was stopped by police after running a red light. The man performed poorly on a field-sobriety test. The man was arrested and transported to the Kirkland police station.

DUI: 8:45 a.m., 12400 block of 116th Ave. N.E. McDonalds’ employees called police to report an intoxicated man in the drivethru. The man was contacted in the McDonalds’parking lot and he failed a field -sobriety test and was arrested.

Assault: 10:03 p.m., 14300 block of 104th Ave. N.E. A 33-year-old Kirkland man was arrested after he assaulted the mother of his 2-year-old daughter. The woman alleged that the man dragged her, threw her down to the ground and then choked her.

Nov. 28

Trespass: 8:40 a.m., 12000 block of Slater Ave. N.E. A Kirkland man reported an unwanted man sleeping in the gym area of a leasing office. The man was contacted and issued a no- trespass order.

Burglary: 8:15 a.m., 12800 block of N.E. 107th Place. A residential burglary occurred with no

Some unknown suspects spray-painted several walls and windows around the building. A district employee was called out over the weekend to remove the obscene pictures and clean up the paint before students returned.

Nov. 25 Theft: 5:30 p.m., 11700 block of N.E. 112th Street. An Auburn man reported to police that someone cut a lock that was securing four scaffolding planks and eight ladders. The unknown individual took the planks and the ladders and left the lock behind. No evidence was found and no suspect information exists at this time. Total value of the items stolen is $3,060.

St. John’s Episcopal Christmas Pageant St. John’s Episcopal Church presents its annual Christmas Pageant, Away in a Manger, at 4 p.m. Sunday, Dec. 18 at the church, located at 105 State St., Kirkland. The pageant, presented by the Sunday school youth and children, has become a beloved tradition and is a wonderful way to celebrate the season. The birth of our loving Savior, Jesus, is brought to life through shepherds guarding their sheep, the heavenly host celebrating a special gift, animals gathering in a stable and a young couple trying to find a place to stay in Bethlehem. Waste Management Driver of the Year Waste Management driver Steve Wegener was a finalist for Driver of the Year out of 26,000 drivers company-wide. His coworkers and managers nominated Wegener for the program for the third year in a row.

A driver in the Kirkland area, Wegener recently traveled to Houston for a celebration, along with four other finalists. Wegener has been with Waste Management for 23 years and co-workers and even customers know him as an inspiration. “Steve does his work with precision, professionalism and a smile,” one Kirkland customer

said when nominating Wegener for the program. “He is the guy who would give you the shirt off his back; he comes to work every day with a smile even when it is stressful,” said a co-worker. Others say Wegener is dedicated to his customers, always fixing their problems. Co-workers and managers

submit nominations for the program, and then a selection committee in each category selects finalists, without identifying the nominees’ names or locations. There are strict criteria and scoring requirements, with co-worker and customer statements weighed in the final scoring.

Biryukova, who had full custody of both children at the time, took Maile with her to get help but claims that she left the boy in the car because he was sick. A judge on Tuesday removed a restraining order filed by Biryukova on behalf of her daughter against Metalwala. The woman’s lawyer said during the hearing that Biryukova would not remove the restraining order but she would also not contest it being removed by the judge. Biryukova will also have limited visitation rights with the girl. Maile has been in foster care since the night of her brother’s disappearance and has told investigators that Sky was in the car, wrapped in a blanket, on the morning of Nov. 6. Solomon was able to visit with Maile four

times in the last month while she was in foster care. But he had not seen either of his children since December of 2010 prior to those visits.
