T

he City of Kirkland terminated DMSL Construction, Inc. on June 3 after the contractor failed to complete Juanita Beach Park renovations on time. City officials began to see a pattern of project delays and business issues with the company in October of 2010, according to documents obtained by the Kirkland Reporter. But the $1 million insurance bond for the project is complicating efforts to hire a new contractor and may lead the city to rehire DMSL to finish the park. The bond insured the city to receive up to $1 million if the original contractor failed to finish the project. The city is currently negotiating with insurer Pennsylvania-based First Sealord Surety, Inc. to determine whether to hire a new construction company. Kirkland City Manager Kurt Triplett said the city has identified a new contractor for the project, however, if the insurance company doesn’t agree, the city will lose the $1 million. “The insurance company ... has some authority to decide who the contractor is to complete the work. One option they keep bringing out is what if we find a way to ensure DMSL can finish the work,” said Triplett. “We’re

certainly willing to look at any option that can get the park done as soon as possible, but only if we felt confident that DMSL could actually complete the job and we’re very skeptical of that. But the reason we’re discussing that is the insurance company keeps pressing the option. Do we abandon our claim with the insurance bond and go out on our own?” DMSL President Debbie Welch said the company is committed to finishing the Juanita Beach project and is working with the City of Kirkland to resolve any issues that exist. “If they (the insurance company) want us to keep the option of DMSL alive ... We would not agree to that unless we were 110 percent sure that DMSL could complete the project and that would be a pretty high test for them to overcome given their performance to date,” he said. The pattern of business issues that emerged during Juanita Beach Park renovations not only concerned the city, but also state agencies. The Washington State Department of Revenue issued an order to the city on May 9 to immediately withhold all wages and other funds concerning a lien against DMSL Construction for a tax debt of $137,432. Regarding the tax debt, Welch said DMSL is “in the process of getting it removed.” [ more PARK page 2 ]

The letter informed city officials that the department was unable to resolve a dispute between DMSL and 10 employees that it had not paid for work rendered. As a result, the State of Washington filed a lien against DMSL for the wages in the amount of $207,816. However, Welch said the issue was “filed by a dishonest former employee and is a frivolous claim. The former employee is now being investigated by the Kirkland Police Department.� KPD spokesperson Sgt. Rob Saloum said detectives have no active investigations concerning DMSL Construction or any of the company’s workers. He said such specific matters would be investigated

www.kirklandreporter.com by the state. The issues with DMSL during the project also concerned six contract change orders that delayed the completion of portions of the job. Those change orders added up to $146,000, adding $107,000 to the original contract agreement of $1.18 million. According to the documents, DMSL submitted the first contract change order to the city on June 30, 2010, a little over a month after work began. But in October the company submitted three contract change orders totaling nearly $90,000 and delayed various jobs in the project more than a month. On one of the change orders, DMSL absorbed the total cost of $39,000, but the change pushed the job back more than a month. The largest contract change order that the city had to pay for was on Oct. 7 when

DMSL requested a change that cost more than $27,000. The change cost DMSL and the city nearly another month. The final two contract change orders came in December and cost the city more than $39,000 and 84 days of work time for the contractor. “The weather has played a big factor in the delay of this project,� noted Welch. Triplett agreed, to an extent. “It rained for 40 days, so one of the things from the city’s perspective that makes it so frustrating is the rain masked the return of their financial problems.� Michael Cogle, Kirkland Parks interim deputy director, said the amount of change orders the contractor submitted is very common for a project of this magnitude. He added the $2.8 million renovation is the largest project in the city since he has been in his position in 30 years. “We did identify early on that there are going to be things underground that we don’t know about that we’ll uncover as we start digging,� he said, noting an uncovered septic tank workers discovered and had to be removed. However, he said the number of change orders “is less relevant as to what the changes involved and the cost of the change orders.�

In total, the change orders cost 156 days of work for particular jobs within the overall project. Following the change orders last December, Assistant City Attorney William Evans sent a letter to DMSL on Jan. 20 to notify the company it was in breach of contract. The letter also said the city was considering terminating the contract as it was concerned that the project would not be finished by the completion date of June 1. The city attorney was concerned that Cogle was being ignored in attempts to get the company to comply with a final schedule. The letter also stated that the city was concerned that some subcontractors were owed money for work completed and that the delinquent payments would slow the progress on the park further, as some of those contractors were still needed for further work. “The circumstances in January were the contractor was behind schedule and wasn’t showing they were devoting a lot of resources to the project,� said Cogle. “At that point, we had them develop a revised schedule and they assured us that they had the additional financing they needed, that there was a demolition project they were wrapping up in Redmond and they would have additional funds from that project.� Cogle said the pace of the project began to pick up and the city was “under

the full expectation that the contractor had resolved their financial issues fully and were back on track.� But the company’s financial issues soon resurfaced. The city sent a second letter on April 11 reiterating the same concerns it had in January. Triplett said at that point the city was focused on getting the park opened by the June 3 annexation celebration. “So we knew the only way to get that to happen is if DMSL stayed on and even up to last three weeks, they were showing us project-wise that they could achieve that,� he said. “What happened was they weren’t executing that.� The city terminated DMSL on June 1 when it “became clear they hadn’t lived up to their obligations,� said Triplett. “We said third time’s a charm, we have to move on.� Cogle said the city could have terminated DMSL sooner, however “we’re still left with an incomplete park and we’d have to go through a several-month process to bring in a new contractor. We did everything we could to work with DMSL and try to avoid that.� Environmental issues with spawning salmon returning to Juanita Creek in September has also increased the city’s sense of urgency to complete the project. The city is currently in negotiations with the insurance company and Cogle said the city expects to reach a decision this week on how to proceed.

Gov. Chris Gregoire will not seek a third term as governor, she announced Monday morning. After more than 40 years in public service, Gregoire said she was ready for a break. She also wants to make sure she can focus on a crucial Gov. Chris Gregoire 18 months before the 2012 election. “The last thing I need to do is be distracted by a campaign,� she said. “I need to set my sights on the next 18 months to pull this state out of recession.� Before serving two terms as governor, Gregoire was the attorney general for three terms. She has been rumored as a potential candidate for a position with President Barack Obama’s cabinet. Gregoire gave a vote of support to the president, but “that doesn’t mean I’m looking for a job,� she said. Her decision not to run again opens up the field on the Democratic side of the ticket. Gregoire mentioned Rep. Jay Inslee (D-Bainbridge Island) as a candidate she hopes will run. Attorney General Rob McKenna, a Bellevue Republican, last week announced his intention to run. Whoever ends up as the governor after the 2012 election will have a tough job ahead of him, Gregoire said. “I just hope we get the greatest governor that the people of Washington state need and deserve,� she said. “They must continue to lead in health care, and they have to lead in protecting our most vulnerable and qualities of life.�

Recent natural disasters such as the earthquakes in Japan and New Zealand and the volcanic eruption in Chile have raised concerns about how the Puget Sound would cope with such devastation. One group that would be on the frontlines of communication and emergency response is the Lake Washington Ham Club radio operators. “We do focus on emergency preparedness like for earthquakes,” said the Lake Washington Ham Club (LWHC) secretary treasurer Don Sayler. “The internet will fail - ham won’t.” Unlike cell phones that need a signal tower or the internet that needs a connection source, ham radios only need a battery or a generator.

Many cities and some businesses have a ham radio emergency group to help in emergency situations. Kirkland has the Kirkland Emergency Communications Team, of which LWHC members are involved. The club currently owns and operates an analogue repeater system on Rose Hill in Kirkland and a D Star repeater system in Bellevue. Ham radio operators are required to be licensed by the Federal Communications Commission as the radio airwaves are limited and used by many different entities. The reasons for the license is so the FCC can traffic the airwaves and for safety. “RF (radio frequency) energy can be hazardous,” said Sayler. “Getting a license will teach you how to use it in a safe way.”

One of the LWHC’s main focuses is to help local residents, especially kids, earn their license. “Without them the hobby dies,” said Conrad Thompson, LWHC vice president. But the club has done a lot for building interest in Kirkland among all ages. “We have licensed over 100 people during the past 12 months,” said LWHC member Dave Condon, who teaches some of the organization’s classes. “Kirkland has the highest concentration of ham radio operators in the United States thanks to this program.” The organization’s biggest day of the year is a national event called Field Day. The local event, which is free to the general public, will be held on June 25-26 at Juanita Beach Park. Registrants pay

an entry fee of $10-25 for the two-day event. The event is designed to show the public how amateur radio can support the community in the case of a major disaster and give interested people a chance to find out more about ham radio. The LWHC currently has about 70 active members and meets once a month at local fire stations. The meetings focus on getting the word out about events and classes. “We do focus on getting the idea over to children,” said LWHC member Bob Morrisson. During a meeting on Saturday morning at the Houghton Fire Station 22, some young kids worked on building a circuit with an electronic kit. “After they assemble the kit it will make some sort

I am really disappointed in the Kirkland Reporter editorial last week. You completely missed the point in why people are not happy about annexation. Smiling city council members sipping sparkling cider alongside the road or handing out strawberry shortcake, historical articles and editorials saying get over it does nothing to help the feelings of distrust engendered against the political body in Kirkland. Telling us that the council repeated history when they rammed through the annexation merely over the issue of tax assumption and a simple majority does little for establishing credibility. It was wrong in 1968 and it was met with the same outrage as now in 2011 as it was then. We were told that it would take a 60 percent vote to achieve annexation, not the city council overruling it or using a simple majority. It doesn’t mater that it failed by seven votes. It either passes by 60 percent or it doesn’t. The Kirkland City Council and the mayor have not engendered trust or respect when they also after annexation tried to change the boundaries on the newly annexed areas so as to mitigate or dilute the demographic impacts of Finn Hill and Kingsgate. People also resent the City of Kirkland getting hundreds of thousands of dollars in their treasury as a result of people getting new agreements for utilities, which resulted in a rate increase for getting the same service. Yes, we are now annexed and we have to move on, but the mayor and the city council need to do some serious work in mending some fences with all of their constituents and gaining the public trust. Smiles and PR opportunities are not going to do it.

Has there been a recent crime wave that I don’t know about that is sweeping through our newly annexed Juanita area and Finn Hill?! I’ve seen more cops in the past two weeks than all the previous 19 years! And the number of traffic stops ... On Juanita drive, along 100th Avenue, on 132nd – everywhere, it seems, Kirkland Police has motorists pulled over in traffic stops. I can’t wait to see when the KPD meter-maids discover our area too. We’ll have your debt paid down in no time folks. So officers, we get it: we’re annexed and you’re our policing agency. But we don’t live in a police state where cops outnumber the residents. This used to be a pretty nice neighborhood. Really, trust me on this.

Why it’s important to be come involved early on Thank you for shedding more light on the behemoth condo building on Juanita Drive. I think it is important to use this as a reminder why residents should be involved in their neighborhood associations and with what is happening in their extended neighborhoods. I am a resident of Goat Hill and, while the building does not directly block my view, I anticipated how it would block the open views to Lake Washington similar to the condos behind Michaels (built before Juanita was annexed to Kirkland). When we were first notified several years ago of the project, I couldn’t find support to fight it in my neighborhood. I talked with city planner, Angela Ruggeri, to see if anyone in the city was contesting it, but even the condos immediately next door were not object-

Or in Salatin’s case, “carbonacious diaper�: a combination of dead leaves, wood chips, and any other carbonbased material normally tossed aside by conventional farmers that he uses to catch and hold the winter waste of his cattle (at a time when the soil and grass are dormant, to be used come spring), preventing it from seeping into the ground or vaporizing away. Yes, everything has a purpose on Salatin’s farm. And it all works in harmony to produce not only the highest quality food, but also the happiest and healthiest microbes, soil-based organisms, nemotodes, chickens, cows, pigs, rabbits, turkeys and people as possible, a phenomenon Salatin refers to in the title of his latest book, “The Sheer Ecstasy Of Being a Lunatic Farmer.� His series of how-to books

have helped hundreds of families and small farmers quickly develop profitable pasture based animal raising operations. Along with his grandfather and father, he has used these methods to produce dramatically more per acre than his neighbors while simultaneously healing a landscape left barren by years of annual mono-crop farming. But his message is compelling for more than just DIYers, and has much broader implications: one does not need to sacrifice the health of the environment for the health of the economy, or sacrifice either for improved human health. In fact, they all depend on each other, similar to the elements of Salatin’s farm. It is a message that lead him to be extensively profiled

by food writer Micahel Pollan in “The Omnivore’s Dilemma,� as well as become an inspiration for and large part of several documentaries, including the Oscar nominated “Food, Inc.�, and Washingtonbased filmmaker Ana Joanes’ “Fresh�. A frequent speaker on Capitol Hill in Washington, D.C. advocating for the local food movement and small farmer’s rights, Salatin spends 100 days a year travelling and giving lectures around the world. Police Blotter The blotter feature is both a description of a small selection of police incidents and a statistical round-up of all calls to the Kirkland Police Department that are dispatched to on-duty police officers. The Kirkland Reporter Police Blotter is not intended to be representative of all police calls originating in Kirkland, which average about 1,000 per week. Between June 3-9, the Kirkland Police Department reported 688 traffic violations (seven DUIs), 28 alarm calls, 35 car accidents, 32 noise complaints, 17 thefts, nine car prowls, 11 domestic violence calls, 12 calls for harassment, five acts of fraud, 13 calls of a disturbance, six calls for illegal substances and 23 calls of civil disturbance. At least 42 people were arrested.

June 9 Disorderly conduct: 12:22 a.m., 8500 block of N.E. 135th St. A 21-year-old Kirkland man was arrested for disorderly conduct and obstruction after being kicked out of a party and punching a car. The man’s brother was also arrested for failure to obey police after he fled from the scene in a car.

June 8 Domestic: 9 p.m., 11600 block of N.E. 95th St. A 16-year-old Kirkland girl called police

to report that her parents were constantly yelling at her for doing things wrong. The parents were contacted and they explained that the girl does not follow the rules of the house, has a GED and won’t get a job. All agreed to separate for the evening. Theft: 1:04 p.m., 8629 120th Ave. N.E. Two teenagers were arrested after attempting to steal T-shirts and two pairs of jeans from Costco.

June 5 Assault: 12:12 a.m., 8500 122nd Ave. N.E. An Everett woman reported that her husband assaulted her in the parking lot of Valhalla. The man was contacted by police via phone and dispatchers triangulated his location as he had fled the scene. A K-9 unit tracked the man down near an I-405 on ramp and arrested him. Warrant arrest: 11:52 a.m., 10400 block of N.E. 116th St. Two men got into an argument and were yelling loudly. A neighbor called police and both men were found to have warrants out for their arrest.

June 7 Domestic: 6:50 p.m., 12000 block of 96th Ave. N.E. A 32-year-old Kirkland man called police to report that his live-in girlfriend was intoxicated and throwing household items at him. The woman also allegedly pushed and slapped the man. The woman was arrested. Warrant arrest: 3:42 p.m., 11900 block of N.E. 81st Cir. A 31-year-old Kirkland man was contacted at a family member’s house as an unwanted suspect and found to have a warrant for theft out of Seattle. Theft: 7 p.m., 10020 N.E. 137th St. A 52-year-old man took a 12 pack of beer from Safeway without paying for it. The man was also served a no trespass order for a prior theft and was arrested.

June 6 Minor, liquor violation: 12:02 a.m., 11000 98th Ave. N.E. A 19-year-old Lake Forest Park man was arrested for possessing alcohol.

Assault: 12: p.m., 11900 block of 93rd Ave. N.E. A 37-year-old Kirkland man grabbed, pushed and slapped his wife during an altercation. The man was arrested for domestic violence assault.

June 4 Assault: 2:13 a.m., 200 Central Way. A 22-year-old man was arrested after he hit another man in the head and knocked him unconscious.

Students wow judges in poster contest When the Kirkland Summer Concert Series committee needed a great poster, they turned to the Digital Design class at Lake Washington High School. This year’s students designed a poster, flier, and banner. A panel of six judges chose the winners in May. Junior Juan Gonzalez created the winning design. Kirkland Crossfit wins NW regionals The Kirkland Crossfit team recently won the 2011 Northwest Crossfit Regionals competition. aspects of rhythmic gymnastics and spending time with friends and for others it becomes more competitive over time. Karaali said many times in the beginning, a student tries it just to see what it’s all about, falls in love and the passion grows from there. Because of her philosophy, Karaali not only has one of the biggest gyms in the region, but also has been one of the most successful. Students who take part in the competitive side of the sport at La Luna have been to the Junior Olympics National meet. In the last five years, La Luna has had a student qualify for the meet each year, after placing in the top 10 at the regional competition. The gym uses the USA Gymnastics training system, which starts students off with learning the basics, including how to work with the hoop, ball and rope before moving on to clubs and ribbons. Karaali said the first three are easier for new students to master and typically they advance to the last two after a couple years of training. This summer the gym is offering summer camp, which run for a week at a time, and are open to all age levels and beginners. Karaali said she keeps the groups small, usually no more than 12 so that each can get individual attention. This summer, he competed internationally, rowing in a quad at the U-23 championships for the U.S. in Brest, Belarus. He will return to the U.S. Rowing camp this summer looking for another opportunity to race in the U-23 championships.

The girls are eight and nine years old and have been working at the gym for the last two years. The annual Kangs Klassic basketball tournament will be held this weekend. The tournament, featuring local varsity and junior varsity squads, will begin on Friday, June 17 and runs through June 19 with the championship games. All varsity games will be

held at Lake Washington High School, while the JV tournament will be played at Kirkland Junior High. Admission is $5 for adult, $3 for seniors and anyone 11 and under is free. The tournament will feature local teams such as Lake Washington, Bothell, Juanita, Woodinville as well as Kentwood, Roosevelt, Stadium and Burlington Edison. Games on Friday begin at 4:30 p.m. and run until 9:10 p.m. and pick back up on Saturday starting at 9 a.m. The varsity championship game will be held at 4 p.m. on Sunday.

The filing period for the 2011 elections season came to close Friday with King County Councilwoman Jane Hague to face two separate opponents in a run-off in August for her seat in District No. 6. Kirkland resident and former Seattle Port Commissioner John Creighton, 45, is one of Hague’s opponents. One of Creighton’s biggest issues is slimming down the council from nine seats to seven and cutting their pay. Hague’s second challenger is Richard E. Mitchell, 46. The former counsel to Gov. Chris Gregoire is a Mercer Island resident and is an attorney in the Summit Law Group. His primary campaign pledge is to make sure that tax dollars go toward basic services, public safety, transit and infrastructure. District No. 6 includes Kirkland. Hague was first elected to the King County Council in 1993 after serving on the Bellevue City Council.

Mud clings to the hem of his green pants, but nothing quite sticks like the memory of his first summer at Lake Sammamish State Park. “It was nuts,� said Ranger Rich Benson, as thoughts of the Fourth of July in 1979 trapped a smile. So many families brought fireworks, the rangers gave up on enforcing the ban and focused instead on making sure people were being safe. The place was packed with people. It was among the glory years for both the ranger and the park. With declining facilities and a beach filled with weeds, the Eastside’s aging gem is now struggling to attract the picnickers and swimmers it once did. Few know Lake Sammamish more intimately than Benson, and, like most park

rangers, few have worked harder to find money to keep the park going. However, the solution isn’t just more money, he said. It’s in finding people willing to champion Lake Sammamish over the long haul. While Benson has not been alone in his work, it takes a community to save a park.
