More than 20 Kirkland locations may sell hard liquor Three state-run liquor stores on auction block in Kirkland BY MATT PHELPS mphelps@kirklandreporter.com

T

he list of stores selling spirits, or hard liquor, after June 1 is growing in Kirkland. Prior to the passage of Initiative 1183 last November, which privatized the sale of spirits in Washington State, the City of Kirkland had just three state-run liquor stores.

According to the State Liquor Control Board, more than 20 locations in Kirkland could be selling spirits after June 1 if the State Supreme Court rejects an appeal by opponents of the initiative. “We are at 1,220 (new spirit licenses),” said Washington State Liquor Control Board spokesman Brian Smith on March 22. “We are working a lot of

overtime and weekends. It begins as a master business license and is basically a brand new license.” The new spirit license fee is $166 annually. The new law allows businesses with at least 10,000 square feet of enclosed space to sell spirits. If the business is smaller than 10,000 square feet and is located in a trade area with no other possible outlets, the state can make

exceptions. Some of the large retailers in Kirkland that have applied for a spirits liquor license during the past month are the Metropolitan Market, Bartell Drugs, Walgreens and Red Apple Market. Albertsons, Costco, Fred Meyer, QFC, Rite Aid and Safeway previously submitted applications for spirit licenses. The state also launched its online auction of 167 [ more LIQUOR page 3 ]

Kirkland resident Carol Miller and her three dogs retired to her bedroom the night of March 21 to watch American Idol and fell asleep. When she awoke around 10 p.m. her dogs were gone and she was in the crawl space of her house. “I heard a big boom and all of a sudden I saw sky,” said Miller on March 22 at her Kirkland home in the 12300 block of 105th Place N.E. “I thought lightning had hit my house. It was such a loud noise you would not believe it.” Miller saw a fire and thought the lightning caught a tree in her backyard on fire. But she soon discovered that a yellow Hummer H2 had crashed into the corner of her Kirkland home where her bedroom was and it had caught on fire. As a result of the crash, part of the floor under her bed collapsed, sending her and her mattress into the crawl space of her house, essentially protecting

A Lynnwood man was arrested outside of his workplace at the Chase Bank branch in Kirkland on March 21 and was charged in connection with his wife’s slaying in 2006. Detectives with the King County Sheriff ’s Office Major Crimes Unit arrested Martin David Pietz, 34, for the murder of his wife, Nicole Theresa Pietz, of Lynnwood. He was arrested outside of his work place in the 200 block of Kirkland Ave. Nicole was reported missing to the Snohomish County Sheriff ’s Office on Jan. 29, 2006. Her body was recovered in a wooded area near 1010 South 144th St. in the City of Burien in February 2006. The victim’s car that had been missing was recovered in a parking lot in the area of 936 NE 42nd St. in Seattle on Feb. 22, 2006. Auction For more information or to bid on the Washington State Liquor Control Board auction of state-run liquor stores, go to: http://liq.wa.gov/ retail/auctions “What most people do not understand is that half of (the liquor stores in Washington State) are privately owned,” said Smith. The private businesses are paid a commission to sell spirits. Those stores, many of which are in rural locations and are under the 10,000-squarefoot threshold demanded by the initiative, will be

grandfathered in after the initiative takes effect. “That store was probably in the process for some time,” said Smith of the Rose Hill store. “Right now, that is our liquor he is selling and we are paying him a commission. Come June 1 he will be independent.” While the business community is preparing for the shift, opponents of the initiative still have hopes of stopping the law. A Cowlitz County judge reversed his previous decision that the initiative covered two issues. Initiatives in Washington State have to pertain to a “single subject.” That ruling put the passage of the initiative in

Today’s court ruling allows the state to continue to work to implement their directive,” said McKenna in a press release. In Warning’s earlier ruling, he found the initiative violated a state rule prohibiting initiatives from addressing more than one subject — also known as the “single-subject” rule — because it included the section directing $10 million of the liquor revolving fund proceeds to public safety. Opponents argued that the two issues are separate and will bring that argument to the State Supreme Court in a final appeal.

But on March 19, Superior Court Judge Stephen Warning ruled that the privatization of the sales of spirits and the initiative’s provision to set aside $10 million for public safety, does not constitute two separate subjects. “There is a well-established, albeit negative, relationship between public safety and liquor,” Warning said. The rare reversal of his own decision stunned the opposition. State Attorney General Rob McKenna’s office argued in favor of the initiative. “Washington voters said they supported privatizing liquor sales in our state

ccording to Google Maps, I live exactly 12 miles, or 19 minutes, from the office. Let’s get something straight — I’ve never made it to or from work anywhere close to Google’s estimation. It’s often double, or triple that time. I know, it’s the greater Seattle area, traffic congestion is inevitable. There’s no way around it, right? Wrong. I think there’s an answer to this, and it’s simple — LEARN HOW TO MERGE. Day after day during my commute on I-405 between north Kirkland and Bellevue I see it. Traffic comes to a halt as cars hesitate to enter or exit the roadway. The scene is akin to the Pemco Insurance commercial featuring, the “You Go. No You Go. No You Go. Guy.” Are you one of the merging-challenged struggling to understand the concept of entering/exiting the roadway? A quick internet search will return four simple rules: use your turn signal, enter the freeway at an appropriate speed, oncoming traffic has the right of way and most importantly, don’t stop. I know this philosophy works. I’m a Washington native, but spent a year in the central California City of Fresno — an area that registered 510,000 people in the last census. That dwarfs the combined 170,000 people in Bellevue and Kirkland. Somehow, when drivers hop on Fresno’s highways during rush hour they manage to maintain a

healthy speed — quite often the posted 60 mph speed limit. The main difference? You guessed it, they weave in and out, merging with precision. It’s a true thing of beauty. I don’t know the reason for the difference. Maybe Washington drivers are less aggressive than California drivers? Maybe Washingtonians are nicer? And that’s an argument I might buy, if I didn’t consistently witness another major merging problem — the rule breaker. You know who I’m talking about. The person who knows full well they need to exit, but drives all the way to the end of the line and forces their way in. Not only are you cutting, but you’re blocking the lane that I’m in. This happened a couple of weeks ago when the Sounders were playing their first game and everyone decided

to avoid I-90 west and take 520. It took me 25 minutes to cover a 2-mile stretch between downtown Bellevue and the 520 exit all because some people thought their time was more valuable than the hundreds of cars stacked behind them. There’s probably no answer to the problem, short of a forced re-education of Washington drivers. Maybe more lanes and improved exits will help? But for now, I just have one simple request. Please use common sense … oh, and that little black pedal on the right side of your floor panel.

City mistake deprives citizens of property rights Developers are property rights advocates. But what if their “rights” infringe on the rights of neighbors? Whose rights come first? If you live next to commercial zones in the City of Kirkland, your rights no longer count. A one-word oversight in Kirkland’s zoning code is systematically denying property rights to Kirkland citizens. That word is “none” in a box specifying minimum lot size for residential development in areas designated for Neighborhood Business. By failing to correct this one simple word in the zoning table – as twice instructed by the Kirkland Council – the city has opened the door for developers to build as many apartments as they can cram onto any commercial-zoned property, no matter how small that property may be, and right next door to single-family homes. This is completely contrary to both the clear language (and city leaders’ admitted intent) of Kirkland’s

Comprehensive Plan. This oversight has systematically denied neighbors’ protection from over development of adjacent property. Commercial zones are meant for commerce. Residential zones are meant for residences. Does it strike anyone but me as odd that a small scale, low impact “neighborhood business” zone should be allowed unlimited residential density – despite protections against that in the Comprehensive Plan? The city must uphold its end of the bargain and correct this error in the zoning table. Neighbors have property rights too. When a city mistake gives a developer a loophole big enough to drive 100-200 apartments through, it’s easy for that developer to say “Variance? I don’t need no stinkin’ variance.”

Thank you, Totem Lake QFC and food drive participants We would like to take this op-

portunity to thank Totem Lake QFC for supporting us in a food drive on Saturday for Pantry Packs. QFC and its staff were gracious, helpful and accommodating. Pantry Packs is an organization that provides a rolling backpack for kids who otherwise would not have food over the weekends. It serves more than 250 kids in the Lake Washington School District. We met great people and heard many stories from employees and customers about their experiences of having no or little food in their house when they were children, yet there were few organizations to step in and help. We know it might be difficult to understand that in such a prosperous area as the Eastside we have children who go without a good meal or that their shelves are literally bare. However, these are the stories we hear from kids, families and teachers. Pantry Packs helps fill a little bit of this void. At our food drive, some customers came out with more bags for us than they had for themselves, others gave us a can of food, and others gave us cash. Whatever it was, it was nice to

be a part of! It was nice to hear the stories; it was nice to see people slow down for our kids to share what we were doing. We were all thrilled to see what we had accomplished and a good way for us to be a part of a larger humanitarian effort! Thank you to everyone who helped make this food drive a success.

Stu Clarke was an inspiration Your story about Stu Clarke in the Kirkland Reporter dated Aug. 8, 2011 by Rachel Harris caught my eye when I was searching the internet for Stu Clarke. Stu was my former scout master while I was attending junior high school in Hong Kong. I was one of his scouts in Troop 1, Hong Kong 1977-1978. He took us on 50 mile backpacking trips to Taiwan and Korea. He was the inspiration for my love of the outdoors and finally achieving the rank of Eagle Scout.

Some of the root of Finkbeiner’s agenda begins with his personal life and growing up in Kirkland. Finkbeiner’s wife, Kristin Rowe-Finkbeiner, is a

About 15,000 students nationally have been named finalists in this competition.

The candidate has lived in Kirkland since he was 6. He says that being around independent people in Kirkland who vote based on the person and not the party has helped to shape his political views. Finkbeiner began his political career when most people are still figuring out what to do with their life. He was elected to the state legislature from the 45th District as a Democrat in 1992 at the age of 23. Two years later he won the Senatorial seat from the 45th District as a Republican. He eventually became the youngest Senate majority leader in Washington State history. But Finkbeiner’s public service came to an end following a very controversial vote.

The following students have advanced to finalist status in the National Merit Scholarship Program: International Community School: Pauline Chane, Edward Cordell and Jack Speelman. Juanita High School: Audrey Hsu, Sam Schwabacher and Luke Sironski-White. Lake Washington High School: Jake Nash, Suejean Hwangpo and Peter Dolan.

The state Department of Transportation is giving the green light to the new 520 bridge – literally. Four “sentinels,” large pillars on each side of the bridge at the east and west ends, will be aglow at night with a green light topped by an amber beacon. The column-line sentinels will mark where the bridge transitions from land to water. It’s just one of several new features planned for the bridge. In addition to six lanes for vehicles, the bridge also will include a 14-footwide path for walkers and cyclists. Because the bridge is so long, five viewing points will be built along the length and include benches where people can take a break. Also planned are noise barriers that will extend out from the land portion of the bridge to the water portion. One new aspect of the bridge will be noticed by both drivers and workers who maintain the bridge – the roadway will be elevated on the pontoons. That not only will mean drivers no longer will be hit by spray during high windstorms, but also that maintenance crews will have access to the pontoons without having to shut the bridge. The bridge also won’t have a draw span. Instead, ships will have clearance at

the west end of the bridge. Large marine equipment began arriving at the bridge March 22, including a large crane on a barge. Later this summer, the first batch of 77 huge floating pontoons will be towed into Lake Washington and assembled north of the existing 1963 bridge. It will take contractors four days to tow the pontoons from Aberdeen to the lake. The target date for completing the bridge in the end of 2014. Including highway construction on the Eastside, an estimated 900 people have worked on the SR 520 corridor to date. More are expected as floating bridge construction ramps up on Lake Washington. The new bridge has a lifespan of 75 years, but should, in fact, last twice as long and be able to withstand “significant wind events,” according to John White, WSDOT SR 520 Floating Bridge Design official. The bridge also will have crack-free pontoons, said Mike Cotten, WSDOT SR 520 Floating Bridge director. “We’re learning a lot in 50 years (of building bridges),” White said. WSDOT has $2.43 billion of $4.65 billion budgeted to build improvements in the 12.8-mile SR 520 corridor between Seattle and Redmond.
