Pierce County prosecutor charges man with first-degree rape of 9-year-old girl By Kevin Hanson Senior Writer

For nearly 17 years, police could not pinpoint a suspect who brutalized a young Buckley girl. Now, Pierce County authorities believe they have their man. County Prosecutor Mark Lindquist last week charged Donald Victor Schneider, 53, with first-degree rape and first-degree rape of a child. Both charges stem from the 1995 kidnapping and sexual assault of a 9-year-old. He entered a not guilty plea Thursday in Pierce County Superior Court and a trial date has

John Leggett has been appointed to the vacant seat on the Buckley City Council, voted in by a quorum of the councillors during a July 18 special meeting. Leggett was selected after a 90-minute question-andanswer session side-by-side with Marvin Sundstrom, his rival. Third candidate Brian Gilooly dropped out of the running due to increasing work demands. John Leggett Leggett is a former sports writer and Buckley city reporter for the Courier-Herald newspapers, and a 20-year resident of Buckley.

According to police and news reports at the time, a man stopped his car and asked the girl what time it was. After she replied “8:17,” the man dragged her by her hair and forced her into his car. According to the prosecu-

tor’s news release last week, the suspect told the youngster, “Get down and stay down or else I’ll cut your head open.” He then put a blanket over the victim and drove her to a wooded spot in the Alder Lake area, not far from the small town of Eatonville in south Pierce County. The victim was forced to undress, was bound with duct tape and then sexually assaulted. Before letting her go, the suspect reported warned, “Don’t tell or I’ll come back cuz I know where you live and I’ll kill your family and

Years passed until May when a cold case detective sent the victim’s underpants to the Washington State Patrol crime lab. There, WSP experts matched genetic material left on the garment to the defendant’s DNA. The probability that the DNA does not match the defendant is estimated at one in 160 quadrillion, according to the prosecutor’s office. Schneider is a registered sex offender and was originally convicted of second-degree rape in 1982. In 2007, he was sentenced to life in prison

after a jury convicted him of kidnapping and raping a woman in Tacoma. He has been incarcerated at Walla Walla State Penitentiary – where he has no chance of being paroled – but was moved to the Pierce County jail to face the most recent charges. He was arraigned Thursday. “While the defendant is currently serving a life sentence for a different crime, we are prosecuting him for two reasons,” Lindquist said. “One, to obtain justice for this victim on this case, and two, so we have an insurance policy to keep a dangerous offender in prison where he belongs.”

have visited the White River School District to witness the process in action. “As a parent I have a lot of confidence in this district,” said Hugh Flint, the district’s Director of Student Support Services. “One of the reasons we picked the house in the neighborhood we did was I wanted my kids in her school. When I see the growth over the past 10 years and her work with the principals; I would be fine with our kids in any one of these buildings. White River High’s 2012 graduating class earned more than $1 million in scholarships, has the highest percentage of students moving on to post-secondary education in the district’s history and has one of the highest on-time graduation rates in the state at 92 percent. The home of the Hornets boasts nine Advance Placement classes, which involve nearly 400 students. Advanced Placement classes are college-level course and exams offered at the high school level. These courses give students a jump on college. WRHS offers AP classes in biology, chemistry, U.S. History, environmental science, government, statistics, calculus, psychology and English. Last year, 177 White River students took 235 AP exams with a number of those earn-

ing high honors. “The kids, their job is to get a strong education and develop as people,” Fugate said. “The academic focus has really changed. It’s not just a handful of kids taking it serious; they all do.” Fugate said she believes the change in attitude is directly tied to Keating and Principal Mike Hagadone’s leadership. “She’s very supportive. She’s very accessible. She’s very hands on,” Fugate added. “She becomes part of the training. She’s not a distant observer. She sits down with us. She helps teachers become more educated so they, in turn, can educate the children.” Keating said plans to remain directly involved in her new role. “My work with the principals and staff, that’s just going to continue,” Keating said. Hagadone will assist Keating as director of secondary education and principal on special assignment. The appointment is in lieu of the school board filling the deputy superintendent vacancy. Lainey Matthews, who worked with Hagadone as assistant principal at WRHS, will take over primary leadership of the high school.

I’ve been reading “1948,” an interesting book by David Pietrusza. Pietrusza’s book is a well-documented account of the race for the White House in 1948 when Democrat Harry Truman pulled out a shocker over Republican Tom Dewey. Dewey has been characterized as something of an intellectual stuffed shirt through the years, which may have been true. I came across an interesting scene in the book where Dewey and Harold Stassen were debating in Portland on May Dennis Box 17, 1948 prior to Editor the state’s primary election. The two were locked in a pretty good battle for the Republican nomination. The serious effort to hunt down communists was just beginning to gather steam and would boil over when the Alger Hiss case hit in August 1948 and Sen. Joe McCarthy took center stage in the troubling period of tyranny for our country. Stassen was riding a populist movement based on a bill proposed by Republicans Richard Nixon, then a representative from California, and Rep. Karl Mundt of South Dakota. The bill established the Subversive Activities Control Board and outlawed the CPUSA, Communist Party USA. The easy thing was to jump on the “let’s hate the commies” bandwagon. It made for easy talking points and easy votes. Stassen’s point was the communist organization should be outlawed because “patriotic young Americans” were being drafted to fight the menace.

I am not sure I understand the recent letter Mr. Ted DeVol sent to The Courier-Herald. Mr. DeVol does not like the new healthcare act and goes on to complain about every type of socialism. So I take it Mr. DeVol hates the countries in this Group A: the USA, Canada, United Kingdom, France, Germany, Holland, Denmark, Switzerland, Sweden, Norway and Finland. These countries have big governments and socialism. Now, group B: Guatemala, El Salvador Nicaragua, Costa Rica, Venezuela, Colombia, Ecuador, Guyana and many,m any more. Lois McGreen Enumclaw The Fourth of July is always an enjoyable time of the year here in Enumclaw. Not only does it kick off the summer, but it is also the start of many fun outdoor activities in the area. A day before this great holiday I prepared for work and looked out the window of my home on Porter Street. What I saw was a fantastic site. The street had been lined with small American flags. These flags were about 15 feet apart and lined both sides of the street. I figured the city had decided to spruce up the town for

the holiday. It was not until I walked out of my home that I noticed that the flags were placed here by two local business women, Lori Whittum (Keller Williams Realty) and Georgette Goudy (Mortgage Lending Experts). Now, I am all about marketing a local business, but the way these two business women went about doing it was not thought out extremely well. These flags were pulled out of the ground by people walking down the street on the Fourth of July. They then discarded the business cards that were attached to the flag sticks on the street and sidewalk. This left litter everywhere these flags were placed. They spent all that time placing these flags all over town. Did they spend anytime cleaning up the mess they caused? I appreciate the flags, but next time use some common sense. Todd Smith Enumclaw

Black Diamond decisions must involve the public There is a movement afoot to change Black Diamond’s form of city government from a strong-mayor to a council-manager. The Black Diamond City Council is attempting to change over 50 years of rich history without citizen involvement. At (a July 9) special meeting, Council member Carol Benson initiated and attempted to pass a poorly written resolution to change the form of government in Black Diamond. Her resolution was not on the meeting agenda or in the council packet; it was not vetted through the city attorney or any city committees, and it did not include any plan for a public hearing. The democratic way to take action of this magnitude is to get citizen input. Where is the transparency the council says is so important to them? Thankfully, the resolution was temporarily withdrawn but it (was to be) discussed again at the July 19 council

The city attorney and new interim city administrator swayed the council to consider the total impact to the city, pointing out that the process should go through a committee and legal review. Examination of the financial impact to the city should also be considered, as well as the addition of the opportunity for public input. Why the attempt to hurriedly change our city government? Why was this done in a special, lightlyattended council meeting on Monday, July 9 (council meetings are normally held on Thursday)? Was the purpose to undermine civic involvement? The rush seems to be to place the matter on the November 2012 ballot. This type of rogue behavior seems to be indicative of Councilmember Benson who was appointed to Position No. 4 in March 2012, not elected. And what is the financial implication of this action to the city? There will be costs to our citizens to place this one item on the fall ballot. Are the majority of citizens willing to pay this extra expense when it would be less expensive to combine with multiple city races in 2013? Where will the City Council find funds to pay for the city manager that a council-manager form a government requires? Are the citizens of Black Diamond willing to be taxed equally to pay for this position? Who is looking into these financial issues? Is the City Council considering these concerns? Perhaps the issue of unequal taxation for Black Diamond residents is where the council should be devoting their time. The 801 households of “old town” Black Diamond, who pay utility taxes on city water and sewer and stormwater, pay for city services. However, the residents of the Lake Sawyer annexation area, who use

Covington Water and Soos Creek sewer, only pay the stormwater tax, a small contribution to the enterprise funds compared to old Black Diamond. Why is the council not addressing this inequity rather than attempting to change our government? In response to the council’s request for a city administrator, Mayor Rebecca Olness recently hired an interim city administrator. Again, part of the funding for this position is from enterprise funds which Lake Sawyer residents only pay stormwater fee. Per the Municipal Research and Services Center (MRSC), this strong mayor with a city administrator form of government “is really a hybrid of the council-manager and strong-mayor forms, since it borrows some of the characteristics of each. There is a single elected executive to represent the community and provide political leadership – assisted by a professional manager” and it is growing in popularity, particularly among cities with a population of less than 10,000 (Black Diamond has a population of 4,160). Ninety percent of Washington cities with a population of less than 5,000 have a mayor-council form of government. According to the MRSC, the trend today is for cities to be formed and/or changed to the mayor-council government with a professional city administrator – which is exactly where Black Diamond is today. Why would some members of this council attempt to change a system that is working for Black Diamond? In Black Diamond, we want to vote for our mayor. We want the mayor to be directly responsible to the voters. We don’t want the council members to decide amongst themselves who will be mayor, as in the council-strong form of gov-

Let the council know that an issue as big as changing the form of government in Black Diamond is not indicative and at the very least it needs to be looked into further and there needs to be a public hearing. We must speak up and let this council know that a special election is an expense we don’t want to bear. The pros and cons can be evaluated over the next year and after all implications are known we can proceed, knowing we are knowledgeable of what the change means to the city. Please, get involved, email the council members. Attend the meetings on the first and third Thursday of the month at 7 p.m. Watch for special meetings of the council as listed on the city’s website. Your voice matters. Even if you are not a resident of Black Diamond, but you are directly connected to what happens here – Black Diamond needs your voice. I always get a bad feeling when a candidate uses “patriotic,” “young” and “hero” in a sentence. Dewey’s response was simple and based on the Constitution, which he clearly understood. “I am unalterably, wholeheartedly, and unswervingly against any scheme to write laws outlawing people because of their religious, political, social or economic ideas,” he replied. I have too often seen candidates and sitting political officials at the federal, state and city level fall to pandering for an easy slap on the back, because your friends like you better, or some other reason excluding a reasoned and thoughtful position. The clarity of Dewey’s statement has something for everyone. Council members, representatives and community members are faced with difficult choices that often put them at odds with friends and neighbors. It may be most troubling for council members who will be seeing their neighbors in the grocery store, probably walking past without speaking. (It happens to me all the time after I write a column someone doesn’t like, but it cheers me up because… well, let’s not get into that.) National issues like hunting commies may seem remote from our little towns, but they are not. Why do cats think outside the box?

www.courierherald.com If your cat is neutered or spayed and marking anyway, look around and see if there might be something causing your cat to feel stressed or uncomfortable. This could be: new furniture or other large objects introduced into their environment; other cats coming into your yard or “visiting” your cat at windows in your house; or frequent or long-term guests or visitors in your house (human or otherwise) You can use nontoxic sprays to discourage marking or even use essential oils like peppermint, citrus and eucalyptus to repel your cat and discourage marking in a particular area. There are also some man-made and synthetic sprays and pheromones you can spray in areas your cat is eliminating that will help reduce stress. Your veterinarian can recommend products of this nature.

Random Inappropriate Urination and Defecation

Hidden problems may cause a cat to quit using its litter box. The trouble could be medical or it could be environmental. Either way, the behavior needs to be corrected.

Welcome to Buckley Veterinary Hospital’s monthly pet care column. This month we are touching on litter box issues. Have you noticed your cat is no longer using the litter box? Are you frustrated?! There is likely a logical reason behind your pet’s inappropriate urinations and defecations and hopefully this article will shed some light on alleviating the situation. This piece is pulled from our network of information from IDEXX-Cornerstone Laboratories. Through our collaborative efforts, we strive to ensure your furry family members enjoy the longest, healthiest, and happiest lives possible. Eventually, every cat owner will have a feline family member decide the litter box is not the best place to do its business. All too often, a cat will decide it’s far better to use a discreet corner in your house, a favorite shoe or even the bathroom sink. It might seem like this is a random and meaningless change in behavior but, generally, you’ll probably be able to figure out the cause and get your cat back on track. Here’s the big question: why do cats, who usually like to

be neat and clean about their elimination habits, decide to change? Firstly, make sure it’s not medical. The first thing you should do, particularly if this bad behavior is unusual for your cat, is see your veterinarian. The veterinarian will likely want to run some simple tests (urine, blood) to ensure there is nothing wrong with your cat’s kidneys, bladder or digestive system.

Marking and Spraying

A common cause is the instinct to spray or mark, and this is most common among unneutered males, though also can happen in females and neutered males. Cats usually mark to lay claim to their territory, especially if there is a female in heat in the area. It also can be a reaction to stress. In the case of marking, if your cat isn’t neutered, get him neutered. It will often quickly stop inappropriate urination, but also it leads to better health and a longer life. Neutered males can’t develop certain kinds of cancer, are less likely to stray and are often calmer and easier to live with.

Cats will choose to stop using a litter box for a variety of other reasons, some obvious and some not. Some of the most common causes include: • dirty litter boxes. Cats hate a dirty bathroom as much as we do. You should scoop the box every day, at least once a day, removing any solid waste. If you use clumping litter, remove those clumps of urine every day, as well. Change the box as often as required to keep it clean and ensure that cat litter can do its job of absorbing moisture and bad odors. • litter box over-crowding. Cats don’t like to share their boxes with too many other cats. Ideally, each cat in your house should have his own litter box. While they may not exclusively use their personal litter box, it’s a good rule to follow to ensure that every cat feels like he has ample space to do its business. • bad litter box feng shui. Believe it or not, cats do care about where their litter boxes are located. Because the act of using the litter box leaves a cat temporarily vulnerable, they don’t like to feel as though they can be cornered or snuck up on while relieving themselves. Also, cats like a little privacy, so having their box in the middle of a busy place in your house isn’t a good idea.

Cleaning Up Messes

Cats have strong powers of smell (not as strong as a dog, but more powerful than humans). Normal household cleaners will not remove the smell or urine or feces. You will need to use special enzymatic cleaners to get the (awful) odor out of carpet, upholstery, wood floors and anything else that your cat’s waste might touch. The odor from the urine of an unneutered male is particularly difficult to get out of many materials (another reason to get your kitty neutered). Your veterinarian can recommend the best product for you.

Then the amber faded into a pleasant steel-blue sky and mist settled over the distant foothills. As the last bale was thrown on the trailer, night softly, as poet Carl Sandburg once said, came “on little cat feet” – or something like that. ELFERS FROM 6 tion and then comment on a lesson from this experience: “U.S and South Korean policy makers have shied away from such risks (of a nuclear war), demonstrating that they are deterred by North Korea’s threat to destroy Seoul in a second Korean war. North Korean leaders have taken advantage of this fear to develop an effective strategy for blackmail. It begins with an extreme provocation blatantly crossing a red line that the United States has set out, along with a threat that any response will lead to a ‘sea of fire.’ After tensions have risen, a third

party, usually China, steps in to propose that ‘all sides’ step back and cool down. Soon thereafter, side payments to North Korea are made by South Korea or Japan or the United States, leading to a resumption of talks. After months of negotiations, Pyongyang agrees to accept still more payments in return for promises to abandon its nuclear program. Some months after that, North Korea violates the agreement, Washington and Seoul express shock, and they vow never to be duped again. And then, after a decent interval the cycle starts once more.” There seems to be a major lesson from this story: The lesson forces us to look at the limits of

power in high stakes situations like this one. For any president, Republican or Democrat, the choice is difficult. Does the U.S. force North Korea to be accountable for its irresponsible and provocative actions and risk a second bloody war on the Korean Peninsula, or does a president appease North Korea and encourage a nonending repetition of North Korea’s bullying and manipulative behavior? Appeasement will only encourage other dysfunctional nations like Iran to adopt the same behavior. The answer seems to lie in the middle ground between nuclear war and giving in to bullies. This was the same problem President Kennedy faced

during the Cuban Missile Crisis. Kennedy, because he had time to examine his options, chose a naval blockade around Cuba to force the Soviets to back down and remove its missiles, rather than risk an invasion of Cuba that might have provoked a nuclear war. That crisis over Cuba has never repeated itself. A red line has to be drawn that countries like North Korea and Iran know must not be crossed. The only way for any president to do that is to not make threats, unless they are carried through. It’s easy to say but very difficult to do. That requires integrity and strength on the part of any president and any person in authority.

When in love, mistakes bring a soft landing I have four sons and we have just had a milestone in our lives, as our third son was the first to get married. These are the comments I shared with those at the wedding; thought you might enjoy them… It is an honor to be part of this day, I think. When I was making sure they knew that they did not have to use Dad to do the service,

OBITUARIES LAWRENCE NELSON Lawrence Olaf “Butch” Nelson died July 13, 2012, from injuries sustained in an auto accident. He was born Jan. 15, 1921, in Enumclaw to Olaf and Byrdis (Sandnes) Nelson. He attended high school in Enumclaw where he played varsity football. After high school,

he moved to southern California and found work with Douglas Aircraft. He worked for the company until 1981,when he retired and returned to Enumclaw with his wife of 50 years, Opal. He served in the Navy during World War II and spent time in the South Pacific as a gunner on a troop carrier. He was a talented craftsman and enjoyed building dollhouses and miniature

furniture for nieces, nephews, grandchildren, great grandchildren and others. He is survived by son Dr. Michael K. Nelson and wife Sarah of San Clemente, Calif. He was preceded in death by sister Georgine Randall, brothers Charles Nelson and Robert Nelson and his wife Opal Mae Nelson.

Bonney Lake; and sister Nicole Brurs and husband Jason of Temecula, Calif. He loved camping, fishing, going swimming with his dog Sarah and playing pool with friends. He was artistic and liked to landscape his yard before his health declined. He was lovingly called “Uncle Buck” by his family.

EVELYN TAYLOR Evelyn F. Taylor died July 17, 2012. She is survived by her son Bill; daughters Sally and Mary; three grandchildren and three greatgrandchildren. She spent many of her retirement years at the Buckley Senior Center and loved playing bridge.

ELFERS FROM 6 tion and then comment on a lesson from this experience: “U.S and South Korean policy makers have shied away from such risks (of a nuclear war), demonstrating that they are deterred by North Korea’s threat to destroy Seoul in a second Korean war. North Korean leaders have taken advantage of this fear to develop an effective strategy for blackmail. It begins with an extreme provocation blatantly crossing a red line that the United States has set out, along with a threat that any response will lead to a ‘sea of fire.’ After tensions have risen, a third

party, usually China, steps in to propose that ‘all sides’ step back and cool down. Soon thereafter, side payments to North Korea are made by South Korea or Japan or the United States, leading to a resumption of talks. After months of negotiations, Pyongyang agrees to accept still more payments in return for promises to abandon its nuclear program. Some months after that, North Korea violates the agreement, Washington and Seoul express shock, and they vow never to be duped again. And then, after a decent interval the cycle starts once more.” There seems to be a major lesson from this story: The lesson forces us to look at the limits of

power in high stakes situations like this one. For any president, Republican or Democrat, the choice is difficult. Does the U.S. force North Korea to be accountable for its irresponsible and provocative actions and risk a second bloody war on the Korean Peninsula, or does a president appease North Korea and encourage a nonending repetition of North Korea’s bullying and manipulative behavior? Appeasement will only encourage other dysfunctional nations like Iran to adopt the same behavior. The answer seems to lie in the middle ground between nuclear war and giving in to bullies. This was the same problem President Kennedy faced

during the Cuban Missile Crisis. Kennedy, because he had time to examine his options, chose a naval blockade around Cuba to force the Soviets to back down and remove its missiles, rather than risk an invasion of Cuba that might have provoked a nuclear war. That crisis over Cuba has never repeated itself. A red line has to be drawn that countries like North Korea and Iran know must not be crossed. The only way for any president to do that is to not make threats, unless they are carried through. It’s easy to say but very difficult to do. That requires integrity and strength on the part of any president and any person in authority.
