the order. The ruling means Tsang can re-open his Herbal Choice Caregivers business along West Valley Highway in North Kent.

The day after Ella’s family came home from the hospital following her younger brother, Brogan’s, brain surgery, is the day she saw the hurricane coverage. She told her mother, Nicole, she wanted to help, and her mother told her to pray. “And she looked at us and said, ‘I will, but that’s not enough. What else can we do?’ � Nicole said. A bit overwhelmed after her son’s surgery, Nicole didn’t know what to do. She enlisted the help of a friend at church who helped Ella organize a bake sale. Soon, nearly $900 was raised. While sorting out the details of the disturbance, officers were made aware of prostitution activity, as well as drug and firearm trafficking originating from a specific location. Detectives from the Kent Police Special Investigations Unit and Innocence Lost Task Force stepped in to assist and were able to quickly identify the couple.

After developing probable cause for the arrests, a SWAT team took the pair into custody the following day. A search of their apartment yielded additional evidence of the crimes. The couple pimped the girls last summer through advertisements posted on www.backpage.com, a website known to be used by pimps and prostitutes to find customers through ads posted for escorts, according to charging papers.

Keiser rips Republicans’ Senate proposal BY STEVE HUNTER

State Sen. Karen Keiser, D-Kent, says the Senate Republicans’ proposal to take control of the Senate and divide control of committee chairmanships “will mean the upcoming (legislative) session will be devoid of real progress on critical issues.” Sens. Rodney Tom, D-Bellevue and Tim Sheldon, D-Potlach,

announced Monday that they are joining the Republicans to give them a 25-24 control of the Senate rather than the Democrats having the majority. The 23 Republicans and two Democrats are calling the group the Majority Coalition Caucus. “My constituents do not want their legislators playing political games,” Keiser said in a statement released Tuesday. “Sadly, the recent power plays by Senate

Republicans with the connivance of two conservative Democrats will mean the upcoming session will be devoid of real progress on critical issues. Stalemate and impasse may be goals of this ‘new majority’ but it certainly isn’t what our citizens want us to achieve.” The Majority Coalition Caucus proposes to have six Democrat-led committees, six committees led by Republicans and three panels that are evenly split between the two parties.

Woman finds hope with Goodwill job

UPTHEGROVE REAPPOINTED TO CHAIR STATE HOUSE ENVIRONMENT COMMITTEE State Rep. Dave Upthegrove, D-Des Moines, will continue to serve as chairman of the House Environment Committee for the 2013 legislative session. Upthegrove represents District 33, which includes part of Kent. Every two years, committee structure and chairmanships in the state House undergo a reorganization process. As in years past, the House Environment Committee will continue to consider issues relating to air quality, aquatic lands, oil spill prevention, recycling and solid waste, hazardous waste, toxics, and climate change, as well as overseeing the Puget Sound Partnership’s activities. Additionally – and new for the coming year – the committee will also be responsible for all energy-related issues, including renewable energy standards and energy availability, production and conservation. “Energy and environmental issues have a lot of overlap, so this shift makes sense,” Upthegrove said. “Washington state is already a national leader in promoting energy technologies that both spur economic growth and help protect the quality of life we all cherish.”

Those committees will have no more than a one-vote majority. The 2013 legislative session begins Jan. 14. Tom, who will serve as the coalition’s majority leader, said during a news conference in Olympia that “the public is hungry for us to come together, to work together in a collaborative manner and that’s exactly what this coalition is trying to accomplish. We want a cooperative relationship and making sure that we work across party lines.”

A grant application written jointly by seven King County school districts has won $40 million in federal Race to the Top funds, the U.S. Department of Education announced Tuesday. The Auburn, Kent, Federal Way, Highline, Renton, Seattle and Tukwila school districts competed together this fall as “The Road Map District Consortium,” a reference to their participation in the Road Map Project. The project is a collaborative effort to dramatically improve education in South Seattle and South King County. The King County districts’ application was among 16 winners selected out of 372 applications. Awards ranged from $5 million to $40 million, depending on the number of students served by the plan. The Road Map District Consortium was one of only two applicants to win the maximum award of $40 million. “This is a major victory for students and families in South King County,” said Sen. Patty Murray, DWash. “When we level the playing field by providing increased access and op-

She helped organize the first kindergarten at Meridian Elementary in 1949 and was the first president of the Kent area PTA council. She is survived by daughter Cheryl Barrett; son and daughter in law Russ and Paulette Hulk, grandsons Jeremy Barrett and Paul Michael Hulk, brother Darrell Markham, and two great grandchildren. Denise was born in Hermiston, OR to parents Dennis Grigsby and Sandra (Jones). Beloved mother, daughter, sister, granddaughter, auntie, niece, cousin and friend to all who knew her. Denise was a 1990 graduate of Kentwood High School. Denise had a kind, generous heart and loved her children, Jessica Anne and Joshua Lee, unconditionally. She was especially proud to become “auntie� to her sister, Anne’s son, Colby James. Denise’s ready smile and laugh are deeply missed. Denise loved her family, the ocean, camping trips, rides in the country, and animals. She passed on her love of dogs to her children along with her fun sense of humor and sunny smile. State law allows medical marijuana use but council members decided the state law remains unclear about distribution of the drug and doesn’t want any medical marijuana businesses operating in the city. Deputy City Attorney Pat Fitzpatrick said the Supreme Court ruling wasn’t unexpected. “The city is not surprised by the order,� Fitzpatrick said in an email. “The threshold for obtaining a stay of an injunction in a case such as this is low. The party requesting the stay need only establish the existence of a debatable legal issue. In no way does this order imply that the Superior Court committed an error when it ruled in the city’s favor.� The state allows medical marijuana use by patients who may participate in

In his commissioner role, Goff serves as gatekeeper for the Supreme Court, helping to review and analyze the hundreds of petitions and motions that come to the court each year. His office has a primary role in determining which cases will be heard by the full court. In Goff ’s ruling, he wrote, “Mr. Tsang has presented a debatable issue under this standard regarding whether the power to regulate community gardens through zoning includes the power to zone them out of existence. new (2011) legislation, the medical use of cannabis in accordance with the terms and conditions of the act ‘does not constitute a crime,’ and qualifying patients and others who act in compliance with the act are not subject to ‘civil consequences.’� Goff continued that nothing in the state law (RCW 69.51.040) “precludes a qualifying patient or designated provider from engaging in the private, unlicensed, noncommercial production, possession, transportation, delivery or administration of cannabis for medical use.� Goff said the city has made contrary arguments and that “these arguments may ultimately prevail in this appeal. But Mr. Tsang has at least a plausible argument for his position on the subject.� The commissioner also looked at the relative harm to Tsang if a stay were not issued to temporarily lift the ban. “It seems likely to me that Mr. Tsang will suffer greater injury if a stay is not imposed than the city would suffer if a stay is imposed,�

Goff wrote. Tsang told the court that he personally leased a building for the collective garden that remains binding until 2015. Goff said the building is safe and secure with 24-hour video surveillance, alarm monitors and an electric strike door and it is next door to a Washington State Patrol unit office. “He (Tsang) says that one of his co-patients is a woman with late stage 3-C cancer and she is unable to drive to Seattle to obtain medical marijuana,â€? Goff wrote. The city argued that Tsang is actually running a marijuana dispensary willing to provide marijuana to anyone with a valid state ID and medical marijuana recommendation in exchange for a contribution. “But if the city has cause to believe Mr. Tsang is engaged in illegal activities rather than a collective garden, it can control those activities by means other than a zoning ban on collective gardens,â€? the commissioner wrote. more story online‌ kentreporter.com

Apartment dwellers need to carry the load So, voters (property owners) rejected another hike in property taxes. Duh. And why shouldn’t they? Why should property owners have to pay for everything in the city of Kent? The election results probably reflect property owners versus apartment dwellers. When will apartment dwellers start paying their “fair share?” Apartment dwellers tend to have more kids than property owners and thus, without a yard of their own, tend to use parks and ball fields more than property owners who have their own yards for their kids to play in. They use schools and streets and bridges at least as much as property owners and yet they pay next to nothing for these facilities. OK, a few bucks of

Imagine picking up your local newspaper to find this story: “Today lawmakers from both political parties agreed to cooperate in support of a shared set of principles that include helping middle-class families and promoting a world-class public education system.” As of this week that headline could be a reality, not in Washington, D.C., but right here in the Washington State Senate. Earlier this week I helped lead a bipartisan majority of my colleagues to change the way the Senate operates. Members of this coalition of Democrats and Republicans agree on a set of ideals that reflect the things I believe our community expects us to work towards in the Legislature – growing jobs, helping middle-class families, making government accountable and supporting public schools. In order to realize these goals, we must first change the way the Senate operates. To appreciate these changes, let’s look at how the Senate handles its workflow through its current committee structure. Committee chairs are powerful people in the Legislature and decide the fate of proposals brought before them. Currently, the partisan majority in both the House of Representatives and the Senate controls every chairmanship in the Legislature. Unlike the current arrangement, we believe the organizational framework our bipartisan coalition has created will provide more balance, greater accountability, and allow – even promote – compromise. When the 2013 legislative session begins in January, we will do so with a balanced committee structure. Of the Senate’s 15 policy committees, six will be chaired by Democratic senators, six by Republicans and three chaired jointly by a senator from each party.

Maybe then we will get away from apartment dwellers voting for every property tax hike that comes along, on the basis that it will not cost them a dime but they will benefit from it. Instead, let’s get everyone to think whether the tax hike will benefit them enough to vote a tax increase on themselves, instead of sticking it to someone else every time. Hah. Good luck. Why and when you may need an elder law attorney Elder law attorneys have been specially trained to set up effective plans to deal with disability before it strikes and to help soften the blow when it comes. Elder law attorneys are able to offer insight and services not found in traditional law firms. Estate lawyers typically focus on death-time planning, such as distributing assets to heirs through a will or living trust and taxes. Elder law attorneys, on the other hand, address not only these needs but also needs before death, preparing for periods of serious illness or incapacity. While a portion of my practice is traditional estate planning, a growing percentage of the clients I see each week come to me with elder law issues. Elder law recognizes that people are living longer with chronic illnesses and will face periods of either short-term or long-term incapacity. These chronic illnesses cause impairments that result in long-term care expenses and loss of

time in our schools and listening to parents and teachers. It’s about studying stacks of budget documents on any given program one day, and visiting the homes of the people that program affects the next. It’s about brushing aside predetermined talking points and briefing memos and instead seeing and hearing things for myself. It’s about making difficult decisions with the greater good of our community in mind. What I have heard consistently, from the time

Because falls are the leading cause of injury among those aged 65 years and older, there is a broad effort afoot to prevent them. With this in mind, the American Geriatric Society recommends that older adults be asked about falling on a yearly basis. Those reporting falls should have their gait and balance assessed by a standardized test, and if their performance is poor, they should receive further assessment. Among the treatments that have proven effective in reducing the risk of falls are physical therapy and exercise. Curiously enough, recent research has shown that vitamin D supplementation among those with vitamin-D deficiencies can also reduce the risk of falls by approximately 17 percent, perhaps by staving off age-related bone loss. He focused on the council’s plan to increase the internal utility tax (when the city taxes revenue from its water, sewer and storm drainage funds) to 13 percent from 10 percent to help pay off about $10 million in debt over the next 10 years. The increase also raises $500,000 per year to bring up reserves in the general fund to 10 percent of the previous year’s budget rather than the 4 percent mark now.

“You want to grow your reserves by 10 percent, how about we just cut everything by 10 percent,� Massagli said. “If some of you gasp at the thought of that, then what makes you think I can add that to my bills? Because you just added 6 percent to my cable bill.� Council President Dennis Higgins, Deborah Ranniger, Jamie Perry and Bill Boyce voted to adopt the budget of $72 million a year in general operating costs. Kent man reportedly bites girlfriend during dispute BY STEVE HUNTER shunter@kentreporter.com

A Kent man reportedly caused a bruise and left teeth marks in the shoulder of his girlfriend during a dispute at about 10:28 a.m. Dec. 1 at a house in the 25700 block of 143rd Avenue Southeast. Officers responded to a call from a woman that her boyfriend had bit her and left their home in a car, according to the police report. The woman told officers that she and her boyfriend had been having problems for some time. They were arguing and when she tried to get away from him, he allegedly bit her shoulder. Officers looked at the woman’s shoulder and observed a bruise and teeth marks. She said a few days earlier her boyfriend had bit her lip, “like he was going to try to rip it off.�

The two have dated since 2011 and lived together for about six months. Officers found the boyfriend at the home the day after the dispute. He told police he was sleeping when his girlfriend tried to wake him POLICE up and yelled at him for drinking all of the juice. He said they had a lot of verbal disputes. The boyfriend denied hitting or biting his girlfriend and claimed she hit him in the head with her fist and he couldn’t remember anything after that. Officers arrested the boyfriend for investigation of fourth-degree assault and took him to the city jail. The girlfriend told police her boyfriend normally was nice but he had used methamphetamine in the past and she thinks that makes him have violent outbursts.

The man had walked up to his van when he saw a woman he didn’t know inside of it and a man standing outside the vehicle, according to the police report. When the van owner started to talk to the man, the man became orally aggressive and claimed the van belonged to a friend. The van’s owner didn’t have his phone so he asked a passerby to call police. The woman said her friend owned the van and she climbed through a broken window to try to find

The woman called 911 to report trouble with the father of her baby, according to the police report. She was driving along Pacific Highway when she saw the man on foot. He reportedly climbed on to the running board and started to hit the vehicle’s windows which caused a side mirror to crack and come loose. She said he also threw rocks at the vehicle. The man told officers he grabbed the vehicle’s door handle just to talk to the woman.

Swimmer Erik Fulmer is never satisfied – even when he comes in first. The 17-year-old Kentlake senior hopes to take first in his mid-distance races this year. But whether he actually achieves those goals or not, it’s still not going to be good enough to merely be “good.� “You can always do better,� he said. “You should never settle for good.� This personal motto is reflected in his advancement year-by-year. He has qualified for state since he was a freshman. He finished last year with a sixth place at the state meet in the 200-yard freestyle with a time of 1 minute, 46.47 seconds. He also took seventh in the 500 free with a time of 4:52.05. Ironically, Fulmer didn’t

On the swim team for the Kent Swim and Tennis Club, Fulmer said he initially did not care for the water at all. While his mother did not force it on him, he said, she felt he should keep his options open.

“I really, really didn’t want to,� he said. “At first, I hated it.� Whatever was in the water, it started to grow on Fulmer until by the age of 12 he acquired a taste for competing. It’s like a job. It’s still very competitive.� He started off his high school career with a state-

He also found a way to control the natural nervousness he experienced right before a race by listening to music by Mozart, which he said calms him down. As far as setbacks go, Fulmer said he has avoided season-crippling injuries or health problems. While

he did well his junior year, he said, it concluded on an extremely heart-breaking note when his coach, Seth Dawson, was killed in a plane crash the day before the state meet. Going into his races, Fulmer said the tragedy affected the entire team as a whole as well as him individually. “It was the hardest meet of my life,� he said. “It was on my mind the whole time.� With new coach Matt Zietzke at the helm, Ful-

mer has high expectations not only for himself, but for the team. “To win state‌I think that is a very realistic goal.â€? he said. “The group of guys are getting along, and we’re training well together. I think that’s a big plus. I think the future is looking bright.â€? Regardless of how this season ends for Fulmer, his future in the pool is already determined. He signed on to swim at University of the Pacific in California.

The second week of December is a dormant season in the garden. Container gardens that once bloomed with colorful annuals will look drab and lifeless unless you get snippy now and celebrate the season with evergreen clippings. Simply prune off sections of sturdy evergreen shrubs such as boxwood, pieris, pine, cedar, fir and even big leaf rhododendrons and use these pruning snippets to poke into the soft soil of your winter-weary pots and window boxes. Add a few pine cones or weather-resistant ornaments, and you’ll have a festive display of outdoor evergreens to enjoy for months. Look for blooming, potted hellebores this week at area nurseries and garden centers. Hellebores are perennials with evergreen foliage that flower as early as December and continue to bloom into the spring. These tough slug, deer and drought-resistant plants have been improved from resent breeding experiments and many now boast blooms that are larger, more upright and adaptable to indoor use. This means you’ll find potted hellebores, wrapped in foil and ready to give as indoor gift plants – enjoy hellebores indoors for a few weeks and then remove the plant from the foil wrapping and plastic pot and replant in a shaded spot in the garden.
