Kirkland SWAT teams arrest 3, recover narcotics from ‘problem house’ BY CARRIE RODRIGUEZ crodriguez@kirklandreporter.com

SWAT teams arrested three adults and recovered narcotics on April 15 after they raided a Kirkland home that police and neighbors have known as a “problem house.” Kirkland detectives were prompted to search the home after they linked a cell phone dropped in a residential burglary in the area to someone who lived at the house, said Kirkland Lt. Mike Murray. Murray said the house in the 8000 block of N.E. 142nd St. in the Finn Hill neighborhood has been a problem for police over at least the past year. “Our patrol officers were getting complaints from neighbors about a lot of foot and vehicular traffic coming in and out of the house all day and especially at night,” he said, noting neighbors thought there might have been narcotics transactions going on. “So we’ve been watching the house for quite a while and made 10 or 13 arrests of known criminals coming

in and out of the house over the last year or so.” He said officers tried to do what they could to respond to suspicious activity through normal patrol tactics, “but we were limited on what we could do.” The North Sound Metro SWAT Team, which includes the Kirkland SWAT Team, was able to obtain a search warrant after police recovered the phone that was dropped during a burglary. Murray said he didn’t know if the search on April 15 turned up any evidence of that burglary, but police did find evidence to other criminal activity, including some marijuana, heroin, forged documents and stolen mail. During the raid, police also detained seven subjects and arrested three adults living at the house on outstanding warrants, identity theft and forgery charges. Murray said the homeowner doesn’t live at the house, but his son does and wasn’t one of the suspects arrested. Kirkland detectives are handling the follow-up investigation of this case.

Totem Lake Park set for revitalization

Upon arriving in the Totem Lake neighborhood, Kirkland’s urban business district, very few know of the 17 acres of wetland nestled between buildings and the busy Totem Lake Boulevard. The tall grassy marsh is intercepted by a wooden boardwalk that extends on the northwest side of the property. The boardwalk begins at a parking lot and ends at a lake. Even fewer realize Totem Lake’s presence. But the city plans to

change that this year. “This piece of property is a hidden jewel,” said Michael Cogle, deputy director of Kirkland’s Parks and Community Services. “A lot of people don’t even know it exists. When you say ‘Totem Lake,’ people think of the mall.” The city has already begun the master planning process of studying the site, collecting data and learning about its potential so that, come June, the city will begin public outreach to understand what the community wants. However, she intends to run for reelection this November for the Position No. 2 seat and says, “[Voters] are going to want to know that I was doing my homework and fully participating and jumping in with both feet and the record will have to show that.” Kloba will serve until November’s general election results are certified. Whoever wins that election will serve the remainder of the unexpired term, which ends December 31, 2015.

Work to limit parking at South Kirkland Park and Ride lot Parking at the South Kirkland Park and Ride lot will be limited for the next four-to-six weeks as the northwest section of the facility (behind the temporary bus stop) has been closed for resurfacing and restriping. make adjustments to the treatment plan overall so that you can make sure you’re getting the desired results and you’re hitting the goals,” she said, adding, “That is a skill set that applies to a lot of different situations and can very well apply to what I’ll be performing at city council.” Kloba said some of the top issues facing the city include maintaining a responsive and responsible budget, and keeping up the city’s AAA bond rating. She also says the city has a tough job of balancing housing and business growth with transportation. “We have to make sure that we accept the growth that we’re required to by the Growth Management Act, that we absorb that in a way that is smart,” she noted. “When you build housing and when you build jobs, you have to make sure that the transportation in between is not overwhelmed and make sure we’re using the best technology that we have in order to move traffic.” Before she takes the oath of office on May 1, Kloba said she will “do her homework” and learn the top five or so issues facing the city. “I know probably the first night I will probably be

Science in Kinesiology from the University of Illinois at Urbana-Champaign. “People who live in the Midwest have no sense of what mountains look like in the snow and it’s frightening. It was a white-knuckle trip,” she laughed, noting they moved to the Northwest for job opportunities. The couple first moved to the Houghton neighborhood but then bought a home in Everett to be closer to their jobs. They moved back to the North Juanita neighborhood 11 years ago to enroll their daughter into the Lake Washington School District. She first became involved in the community when she served as a legislation chair at Franklin Elementary. “It was through that and advocating on behalf of kids with our state legislators that you start to realize they’re are people just like you and me and to do their jobs effectively, they need to hear from the people that the public policy affects,” she noted. She was also on the Lake Washington Citizens Levy Committee, when she learned a lot about school bonds and how to run a successful levy campaign. “I think my main style of attacking a problem is just jumping in with both feet and learning by doing,” said Kloba, who is currently the legislative director of the Washington Parent Teacher Association. She has also served as a board member on Kirkland’s Park Board since 2009. Some highlights during her service included the city’s purchase and planning of the Cross Kirkland Corridor and the completion of Juanita Beach Park’s phase one in 2011. Kloba first entertained

thoughts about running for city council when Mayor Joan McBride announced in February she would not seek reelection. “So I thought there’s an open seat, is this the right time? Am I the right person? I waited it out, talked to some folks and said this isn’t quite right.” But when Sternoff announced his resignation, Kloba said she had a second chance to think about it. “So I had to take a deep breath. It’s like having children. There’s never the absolute perfect time,” she said. “But I’m very happy to have the opportunity and I’m very excited about the challenge.” And while Kloba’s background in kinesiology – the study of human movement – is somewhat unconventional for a council member, she sees it as helpful, she said. As the owner of Shelley Kloba Massage and Personal Training in Kirkland and a massage therapist at The Donaldson Clinic, Kloba said there are several steps she has to take to treat a patient in less than five minutes. She said she must establish a rapport, evaluate the problem, create a treatment plan and earn the patient’s trust. “And as you go along you

Aligning spending priorities with the people’s priorities

s the weeks became months for those of us crafting the Senate operating budget, and the plan itself crept closer to the 400-page mark, it helped to pause and remember that our task was about more than making policies and allocating dollars. We were making choices that would affect people’s lives, be it the student who is counting on government to provide the tools he or she needs to succeed, the small-business owner who is trying to keep the doors open, or the person with mentalhealth challenges who will struggle even more without state support. I relied on a clear set of priorities to guide my decision-making and serve as a reminder of what we were hoping to achieve. First, we must avoid hindering the slow but gradual recovery of our state’s fragile economy, which meant the Senate budget couldn’t increase tax burdens on families and small businesses. Second, we must start down a path that improves Washington’s education system – not only through funding but from the policies that connect additional dollars to improved student learning. Finally, we must preserve the infrastructure and network to support our most vulnerable friends and neighbors who need care. I believe most Washingtonians would agree with these priorities – and I know for certain that Republicans and Democrats in the Senate share them. That is why, since day one, the Senate budget-building process has been collaborative and bipartisan. The Senate’s new leaders chose to leave the partisan bickering to the “other Washington” and work across the aisle to address our many challenges. Many wondered aloud how the Senate could successfully address these issues without general tax increases. Here’s how: During the next budget cycle the state anticipates collecting almost $2 billion more in revenue under our existing tax structure. Because our plan prioritizes spending on education, we allocate almost 90 percent of that revenue towards early learning, K-12 and higher education. Public school and

higher education spending would both increase from the previous budget by more than 10 percent, and early learning by 20 percent. However, it’s inefficient to simply pour more money into a system that fails one out of every four students. That’s why this dramatically larger investment in education is being connected to outcomedriven education policies. Doesn’t it make sense that as funding for education increases, students should emerge from our schools and higher-ed institutions better prepared to advance in life? At the same time, government is the means through which we provide essential services and the Senate plan provides targeted funding and refined programs for low-income children who need health care and food, people who are developmentally disabled, senior citizens who need help, and mental-health coverage. Still, to provide these services and ensure that school superintendents, hospital administrators, non-profit directors and others can develop longterm plans to meet demand, we need a budget that’s sustainable. At a time when there are as many positive as negative economic indicators, increasing taxes would slow down our recovery, taking money families have earned and need out of their pockets. It would also hamper growth as businesses both small and large continue to grow, and bring on employees to meet rising demand. The Senate plan meets the new requirement that budgets balance for the next four years. Many of the gimmicks used in past budgets that created future deficits aren’t responsible options and are not used in the Senate budget. By setting priorities and making difficult decisions – something all Washington residents must do and should expect from their elected representatives – we’ve developed a plan that won’t endanger the state’s financial well-being, enhances our commitment to public education and continues providing the government services Washington residents expect.

Artesano Coffee helps fund woman’s trip I lived in Kirkland for

20 years until I moved to Snohomish last October. I commute to Bellevue each day and rather than stay on Interstate 405, I continue to go out of my way to visit Artesano Coffee Company at 1431 Market Street (outside Dooley’s Dog House) because not only do they have good coffee but, more importantly, I had built a morning ritual type friendship with Sarah, their incredibly sweet barista. Recently, I mentioned to Sarah that I am going to Uganda for three weeks in July on a humanitarian trip with a nonprofit dental organization called For World Wide Smiles. She was excited for me and took it upon herself to collect and donate all of her tips for one day to support my trip to

Africa. She advertised to her customers via her tip jar and set a goal of $180 dollars on April 16. Due to the generosity of her customers, she collected (in one day) $274.30 for my trip. When Phil and Rosanna of Artesano Coffee Company heard what Sarah was doing to support my trip, they matched the customer tips for a total donation of $548.60. We don’t get to hear all of the good news very often, but the generosity they have shown is truly amazing.

Goodman’s alleged marijuana use is relevant During a recent Kirkland

town hall meeting of 45th District legislators, citizen participants returned to their cars to find a flyer on their windshields. The flyer was about Rep. Goodman’s alleged illegal marijuana use and was funded by The Reagan Fund, a Republican political action committee. The flyer stated that “Driving high is a violation of state law and endangers everyone.” It came on the heels of controversial articles in local newspapers reporting Goodman’s alleged drug abuse and impaired judgment. What did not receive the legislators’ consideration was a question submitted by a local resident about [ more LETTERS page 5 ]

www.kirklandreporter.com what state legislators were prepared to do proactively to limit taxpayer exposure to lawsuits when the federal government determines to prosecute state-licensed growers, processors and distributors for violating federal laws. The question was not read aloud by facilitator Rep. Larry Springer, D-Kirkland, and neither Sen. Andy Hill, R-Redmond, nor Rep. Goodman had an opportunity to answer it that day. Despite partisan criticism leveled against local editors for publishing Rep. Goodman’s alleged personal lapses, the issue is relevant for many reasons. At a Washington State Liquor Control Board public hearing in Bremerton on March 7, one speaker provided testimony that if growers disagreed with the rules being developed by the Liquor Control Board, many would not follow them. Is it naïve to think that people who have been doing their own thing in supplying an illegal market will now become law-abiding citizens, and voluntarily subject themselves to laws that, up to this point, they did not regard as worthy to follow? Although the Republican hit piece on Rep. Goodman was regarded by many citizens to be tasteless, it was an attempt to surface an important issue directly related to Rep. Goodman’s oath of office and conduct. Once elected, he swore to uphold the laws of the Constitution of the United States and the Constitution and laws of Washington state. In 2010, when Rep. Goodman wanted to legalize marijuana, he knew it was illegal although he was allegedly secretly using it, thus calling into question his ability to be impartial on the issue of marijuana

regulation. Although Gov. Inslee’s approach to keep the U.S. Attorney General Eric Holder informed of Washington state’s efforts to create a legal market for marijuana is open and forthright, marijuana is still a Schedule I controlled substance under the federal Controlled Substances Act, and Washington and Colorado state laws are in violation of it. What is going to happen when marijuana grown by a state-licensed grower seeps into the black market, and the federal government prosecutes the grower and the grower, then, turns to the state for his defense? The question is whether Washington taxpayers want their tax dollars – federal and state – going to prosecute and defend growers who knowingly violate federal laws. If not, now is the time to let legislators know well in advance of the first lawsuit.

Redirect Planned Parenthood funds to other needed services The state of Washington is facing a $1.2 billion shortfall for the 2013-2015 biennium. We are running out of money! All of us

have been tightening our financial belts, removing the non-essentials from our spending. Should the state not do the same, especially with our tax dollars? We have heard that we are down to the “bare bones.” Yet $25 million remains in the upcoming budget for Planned Parenthood affiliates. Personal politics aside, we need to question why, when safety net and other important services are being cut, we are funding an entity listing over $38 million in net assets, six-figure executive salaries, millions of dollars for “government relations and advocacy,” and other questionable business practices (which have led to criminal and civil lawsuits nationwide). With so many other urgent needs facing our state, I urge our legislators to consider redirecting these funds to other needed services that are more in line with their (the legislators’) own stated primary goals for this biennium of “jobs, education and a sustainable budget.” We need to challenge our legislators’ decision to continue to use taxpayer funds to support Planned Parenthood!

Become the greenest town in the Puget Sound Puget Sound Energy and the city of Kirkland are teaming up to challenge local residents and businesses to become the greenest town in the Puget Sound through the “Take Charge Green Power Challenge.” If 400 PSE electric customers in Kirkland enroll in PSE’s Green Power

Program in 2013, the energy company will provide the city with a $20,000 grant to fund a community solar photovoltaic project. Instead, electronic sensors detect a windshield-mounted transponder that a driver has acquired in advance and linked to a prepaid or online account – or, if the driver has not installed a transponder, the license plate of the vehicle is photographed and the owner is billed by mail for the toll. But as described in news articles, in some cases the bill never arrived in the mail or was not forwarded to the vehicle owner’s new address, triggering penalties for delays in making payment: $5 after a 15-day lapse, and another $40 after an 80-day lapse, for each crossing of the bridge. Habib’s bill does not excuse unfairly penalized drivers from paying the actual toll.

Cogle said the park levy funding will be used for other park projects for the next six to seven years, but “over a period of time, we’ll be able to have the levy as an opportunity for this site.” But for now, Cogle anticipates the master planning process. “I’m very interested to see what the community thinks, particularly what the potential is to make the lake an asset for the Totem Lake business community,” he said. “It’s a nice respite from this very busy commercial area.”

Evergreen Hill Neighborhood Association chair Johanna Palmer and cochair Lynda Haneman say they will be involved in the planning process. “I hope the lake gets some attention,” Palmer said. “There are invasive plants that need to be removed and trash picked up. The paths need to be repaired and extended. With some work, it could be a wonderful urban park that could be shared by humans and wildlife.” Haneman, who used to be the Totem Lake Neighborhood Association’s chair, said there is a great deal of interest in the lake, not only citywide, but by the Evergreen Hill community, which is where much of the residential area is in relation to Totem Lake. “When people think of Totem Lake, they think of traffic,” Haneman said. “I’m really excited about the next five to 10 years because [the area] will become the core of the city.” Palmer said once the master plan is implemented, this would be the first general-use park in the Totem Lake neighborhood.

Totem Lake has been in Kirkland throughout the generations, but was called various names such as Lake Wittenmeyer, Lake Watstine and even Mudd Lake. “Back in those days, we basically called it a swamp,” Cogle said. After a failed attempt to sell the lake property to the city of Kirkland, the original owner of the Totem Lake Malls sold it to the King Conservation District, a state agency, about 50 years ago. However in the late 1980s, Cogle said the city approached the Conservation District with the idea of creating more access through a public boardwalk or trail. With a little grant and city funding, the boardwalk - which can sometimes be found hovering just under the surface of a winter flood - was built. Since then, the city and the Conservation District have co-managed the area and worked toward restoration activities. While ideas for the site are preliminary, Cogle acknowledges the park could be a hub or “trail head” for the planned Cross Kirkland Corridor trail by creating amenities, such as parking and restrooms. “We know that the King Conservation District is very interested in maintaining and improving the ecological integrity of the site and really focusing in on ways we can deal with flood control, remove invasive plants, and make this system really function as well as it can,” Cogle said. “That’s always going to be a prime focus for us.” But Cogle and others, such as Kirkland resident Lincoln Brigham, think having a trail loop around the entire lake is a good start. “A loop would be really nice because there’s some interesting wetlands back there and [the trail] just kind of peters out,” Brigham said, pointing to the northeast portion of the property. “The loop would make it a lot bigger an area for a trail system to just come down and hang out.” Cogle’s other ideas include picnic tables, places to kayak or canoe, and an entrance for the park so that a “sense of place” can be created for the Totem Lake community. And through the trafficked roads and industrial plants nearby, Cogle emphasizes this area will not be subject to water ski boats, lifeguard stands and invasive actions to the habitat.

To further connect people to the park, there is the potential to create off road pedestrian connector trails through the “green fingers” that surround the site, Cogle said. North of the site, a grassy hill extends upward toward the EvergreenHealth Medical Center. “That would be a great overlook for the employees at the hospital and there’s the Madison House Retirement up there,” Cogle said. “Wouldn’t it be cool to have a table and a bench, and maybe a telescope up there? Maybe down the road, there would be a stairway or a trail system so they could easily access the property.” With the endless number of possibilities for Totem Lake Park, the city is hopeful one benefit will be a revitalized Totem Lake business district through this civic investment. “This gives us the opportunity, really for the first time, to work with the entire community on what the vision is for this site, and how it can not only serve the park and open space needs of the community in better ways, but how it can be somewhat of a catalyst for the local business community,” Cogle said. “The Totem Lake neighborhood as a whole is a very important part of the Kirkland community.” Cogle said he’d like to understand how the lake’s surrounding businesses could benefit from a better park, and if they value the lake as an asset to business. Cogle noted many of the surrounding businesses face the street instead of the lake, such as Cafe Veloce.
