When it comes to funding the Southeast 256th Street project, the Kent City Council might just take the approach if at first you don’t succeed, try, try again.

Property owners along the street last month turned in enough signatures to overturn the city’s plan to charge them extra property tax fees to help pay for improvements. The property owners dissolved a Lo-

cal Improvement District (LID) approved by the council to pay for about $2 million of an estimated $7 million project to upgrade and widen 256th Street on the East Hill from the “Y” intersection at Kent-Kangley Road to 116th

Avenue Southeast. But the three council members of the city’s Public Works Committee on Monday at City Hall voiced how upset they were that a few property owners had the power to stop the fees that

A Canadian truck driver who used a Kent warehouse as a hub for marijuana distribution, received a 12-year prison sentence Tuesday in U.S. District Court in Seattle for conspiracy to distribute marijuana. James Postlethwaite, 60, of North Vancouver, British Columbia, drove cocaine and thousands of pounds of marijuana known as BC Bud across the U.S./Canadian border, according to a U.S. Attorney’s Office media release.

Investigators identified Postlethwaite as a drug smuggler for a criminal group related to the Hells Angels. He was convicted in November following a three-day trial. He was a transporter in a criminal organization that was smuggling marijuana south into the U.S. and cocaine north into Canada. U.S. District Judge John C. Coughenour said at the sentencing that Postlethwaite, “understood the size and scope of the conspiracy,” and was responsible for smuggling vast [ more TRUCKER page 2 ]

It’s going to get a little greener around Kent Elementary School in the next few years. Brighten A Life, a nonprofit organization committed to education and the environment, chose the school last fall to be the new site of a Green Schoolhouse, one of four in the country.

“This is a really cutting edge, 21st century concept,” said Page Meyer, principal of Kent Elementary School. “It’s pretty darn cool.” Brighten A Life “focuses on positively impacting the learning environments, living conditions and communities of disadvantaged children and families,” according to its website. The Green Schoolhouse series is the organization’s signature cause, focusing on “meeting the critical needs of chil-

dren, education and the environment,” according to Kent School District documents. This means the curriculum used in the new building will emphasize science, technology, engineering and math (STEM) lessons and environmental awareness. The Green Schoolhouse, intended [ more GREEN page 4 ]

tration (DEA) and Homeland Security Investigations (HSI) determined the drug ring was transporting and distributing 1,000 to 2,000 pounds of marijuana and 100 to 200 kilos of cocaine every month, according to the media release. The marijuana was smuggled into the U.S. from Canada and distributed across the country to California, Illinois, Missouri, Georgia and New Jersey, among other locations. Proceeds from the marijuana distribution were used to purchase cocaine in Southern California. The cocaine was transported to British Columbia for distribution. After identifying the Kent warehouse that served as the hub for the marijuana distribution, investigators were able to identify Postlethwaite’s semi-truck that delivered to the warehouse. After search warrants were served on the warehouse in April 2011, agents learned more about a hidden compartment in Postlethwaite’s semi that allowed him to transport as many as 95 loads of drugs across the border. Each load was hundreds of pounds of BC Bud – the hidden compartment could hold more than 600 pounds. Postlethwaite was indicted for his role in the conspiracy

and was arrested March 9, 2012 as he tried to drive a different truck into the U.S. from Canada at the Eastport, Idaho, Port of Entry. The truck with the hidden compartment was later located trying to enter the U.S. with a different driver. The hidden compartment had a very elaborate access system using a separate battery to access a void in the floor of the trailer. Testimony in the trial revealed that the marijuana belonged to the Hells Angels organization in British Columbia. Postlethwaite has been in custody in the U.S. since March 2012. Two dozen people in the U.S. and Canada have been charged in the case. Seven have already been sentenced to lengthy prison terms. Other defendants already sentenced in the case include: Jacob Saul Stuart, the U.S. based leader of the ring, was sentenced last year to 15 years in prison; Michael Murphy, a pilot who transported drugs, 12 years in prison; Jacob Burdick, who stored and organized transportation of the drugs, 12 years in prison; John Washington, a drug distributor for the group, 11 years in prison; Glen Stewart, 52, a

Custer-based drug courier, 12 years in prison; Mario Joseph Fenianos, a Canadian who obtained and smuggled cocaine for the ring, 13 years in prison, and Michael William Dubois, another Canadian working on the cocaine side of the smuggling was sentenced to 10 years in prison. Over the course of the investigation, law enforcement seized more than $2 million and 136 kilograms of cocaine. On April 28, 2011, the day search warrants were executed, law enforcement seized more than 1,000 kilograms of marijuana from locations across the country. This was an Organized Crime and Drug Enforcement Task Force (OCDETF) investigation, providing supplemental federal funding to the federal and state agencies involved. The case was investigated by the DEA; ICE’s Homeland Security Investigations - Seattle and Sacramento; Customs and Border Protection – Office of Air & Marine; King County Sheriff’s Department; Seattle Police Department; Washington State Patrol; Snohomish Regional Drug Task Force; and the Bureau of Narcotics Enforcement (California).

A Kent man and his stepson were arrested May 3 following their indictment on seven criminal counts related to gun sales and controlled substance distribution, according to a U.S. Attorney’s Office media release. The indictment alleges that Mark E. Bryant, 49, and his stepson Andrew Gagley, 30, illegally distributed Demerol. Bryant is also charged in four different counts with distributing Oxycontin, hydrocodone, and morphine on three days last September and October. Bryant is

also charged with selling a firearm to a drug user. Gagley is separately charged with selling a firearm to a felon and illegal alien. Both men appeared May 3 in U.S. District Court in Seattle. Bryant owns Westside Guns and East Valley Auto Rebuild in the 8000 block of South 222nd Street in Kent. On multiple occasions Bryant allegedly sold guns or drugs to people working with law enforcement on the property of his Kent gun shop. Gagley also is accused of gun and drug sales in and near the business.

to house preschool and kindergarten students, will be built on a 15,000-squarefoot grassy lot currently used as a baseball field. Adjacent to that area, a new synthetic grass turf will be installed to replace the dirt soccer field. All materials used in constructing the schoolhouse will be certified environmentally friendly and up to LEED (Leadership in Energy and Environmental Design) Platinum Standard, the highest designation awarded by the U.S. Green Building Council. Everything used in building the schoolhouse and for curriculum purposes will be donated either financially or in kind by various companies except the foundation of the building, costing about $3 million, which will by paid

for by the school district. The new building will include eight classrooms, a computer lab, an outdoor fitness area, multi-purpose room, a green garden and other educational spaces while also serving as a community center after school and on weekends. As part of the series, each of the Green Schoolhouses is built according to a unique theme. Kent Elementary has not chosen a theme yet. During a special school board meeting April 17, architects, administrators and community members were invited to “put (their) dreams on paper,� according to Meyer, to draft a creative vision for the new space. Smart walls and tables, rooftop gardens, water retention systems and solar panels – all were proposed in an effort to

incorporate the latest technology to teach students the importance and relevance of science and sustainability. “When you’re in the initial planning stages, anything is possible,� Meyer said. “It’s the most creative process I’ve been a part of.� Meyer says students will be able to grasp concepts like solar energy and green construction. “It’s going to give them an opportunity to be exposed to this cutting edge way of living,� she said. “I don’t think it’s over their heads. This building dovetails into those next generation science standards.� Kent Elementary was an ideal location for Brighten A Life’s next project due to its urban location and proximity to an industrial area, diversity of student body and socioeconomic standard of living in the surrounding community.

The school has 27 spoken languages, 23 countries represented, and 85 percent of its student body qualifies for free or reduced lunch. The other Green Schoolhouses, two in Phoenix and one in San Diego, are in the process of being designed and built. Construction of the new building will begin next school year and is projected to be finished in 2015. Meyer is excited for the project and future of Kent Elementary, seeing the benefits of incorporating more technology and green awareness into the classroom. “We are going to be a showcase for the technology coming out,� Meyer said. “This is going to set these kids up in life.�

www.kentreporter.com [ PROJECT from page 1 ] “LIDs have been used over 100 years in this community,� said Councilwoman Dana Ralph. “What I feel happened here is a very vocal minority has said we’re an exception to this rule. I struggle with that. This vocal minority also will gain the most benefit if this project goes through because of the increased value of their property.� Property owners dissolved the LID because they gathered signatures from those who own at least 60 percent of the assessed land value within the LID boundaries. The committee on Monday told the Public Works Department to seek bids for the project in an effort to find out exactly how much money is needed turn a two-lane road without sidewalks and lights into a three-lane road with a center turn lane, sidewalks and lights.

The ad for bids will be posted later this month and city staff expects to have the bids by construction companies ready for the June 3 committee meeting. City staff cost estimates show the project has a $2 million grant awarded six years ago to the city from the state Transportation Improvement Board (funded by the gas tax); $1 million from the city Transportation Impact Fee (charged to new developments and pre-existing structures with a major change in use); $1.6 million from the city storm drainage utility fund; and $360,000 from LID covenants that were pre-approved when developers built projects. The state grant, however, could be taken back and given to another jurisdiction if the city isn’t ready to start construction by July 1. The board wants evidence that the city has a funding package to pay for the project.

Councilwoman Elizabeth Albertson brought up the idea to try for another LID. “Is there anything in the law that prevents us from educating those on the LIDs exactly what happened and who signed and go out and try to form it again with new information?� Albertson said. “Because I hear people want this.� Public Works Director Tim LaPorte said the council could take that step. He said a LID could even be formed after street construction starts. “Sometimes it takes several tries,� LaPorte said. City Attorney Tom Brubaker said if the council forms another LID the same procedure would happen with property owners again having the chance to protest and overturn a LID. He also pointed out that if a LID is formed after road construction

May 10, 2013 [5] starts, the banked-on money might need to be found somewhere else if property owners again dissolve the property fee. “If we do that we’re still bumping against the large property owners and I’m not sure we can change their minds,� Councilman Dennis Higgins said about going for a new LID. “I only have to change one,� Albertson responded. “I only have to take pictures of kids and show these people that live in Vancouver (B.C.), Gig Harbor or Kirkland or wherever they happen to be what we are really talking about and that being a good steward in the community means you participate in the community. I’m very frustrated but I can’t in good conscience not do anything.� City officials want to improve the street not only for vehicles but to provide sidewalks and lighting for children who walk to school as

well as those who walk to nearby businesses. Higgins researched the property owners who opposed the fees and found out that 124 people signed petitions, with a few of them owning more than one piece of property. The signatures were from people who own $1.251 million worth of property or 62.35 percent (just more than the 60 percent threshold of $1.2038 million needed) of the total LID amount of $2.006 million. “Four protest signers, comprising six of the properties, had the capacity to make or break the entire protest with their one signature,� Higgins said. “Without their signature the protest would have failed.�

Three hospital commissioners are not serving us I’m not surprised at Anthony Hemstad’s resignation from the UW Board of Trustees. He and two fellow Valley Medical commissioners Paul Joos and Aaron Heide have been trying to sabotage the alliance with UW Medicine from day one – an outcome that would be very detrimental to us local residents. Given the state of our health care industry today, this alliance was an excellent move by the past Valley Medical Center Board for several reasons. It’s very unfortunate that these commissioners are behaving as they are. It’s clearly not in our best interest. – Jim Sullivan

Like many other people throughout the region, I caught the evening local news covering the May Day demonstrations. Peering up at a television inside a cafe, I watched with mounting anger as for yet one more year, people, their faces swathed in bandanas or concealed under gas masks, hurled rocks and obscenities at police who had asked them to clear the streets. Bad enough. But hearing local media describe the provocateurs as “demonstrators” and “protestors” or even “anarchists” really fried my wig. I don’t buy any of that, no way, no how. And people who make their living with words should know better. I have always considered it one’s patriotic duty to raise a fuss from time to time in the face of wrong and injustice, to sound, in Whitman’s words, one’s “barbaric yawp” over the rooftops of the world. Like those civil rights protestors of the 1960s did, demonstrating for the simple right to sit at a lunch counter in Birmingham, Ala., and eat lunch. Or before them the women’s suffragettes, agitating for the right to vote. Or the abolitionists before that, demanding an end to human chattel slavery. But extending these terms to people involved in the May Day mayhem in Seattle grants them a status and a dignity to which they are not entitled. For one thing, it makes no distinction between the earlier, peaceful May Day demonstrations and the primitive stuff that developed as darkness came on. In a wider sense, it lumps them in with the women suffragettes and other brave souls who suffered cracked bones and worse, fighting for a better deal. It’s not acceptable. I think the more egregious error, however, in calling those guys “protestors,” was the total absence of anything on the ground remotely resembling a cause as evening came on.

Navigation 101 is an education program for students, scientifically proven to reduce dropout rates. Fifty-two percent of all middle and high schools here in Washington use Navigation 101 to help kids prepare for their future and graduate. Eliminating it now will make our state’s dropout problem worse. We use Navigation 101’s curriculum and tools to help our students develop their core competencies

Indeed, I’m convinced after years of watching this play out that the rock throwers really don’t have a cause, unless one wants to call a cause showing up in Seattle every year on May 1 to vent one’s personal anger and disappointment with life by smashing things. You don’t bring gas masks unless you intend to pick a fight. You don’t bring weapons unless you expect to wreak havoc on people and or property.

These guys call themselves anarchists. But I wonder if they have ever considered what real anarchy would mean. Something the writer G.K. Chesterton once wrote made an impression on me. Without rules, Chesterton argued, “life wouldn’t be any fun.� Without rules and standards, that is, everything that enables human beings to live together in relative harmony, everything we hold dear would be impossible. In the absence of rules, for example, there would be no sports, which certainly rely on them. Without agreed-upon standards of behavior, no one would be safe at night anywhere. No, anarchy

wouldn’t be any fun. And I suspect that had the Seattle police simply waded into the crowd and started clubbing and punching, the “anarchists� would have been the first to bitch about “police misbehavior.� Which, of course, would imply some sort of standard officers had failed to live up to. So please, let’s have no more nonsense about “demonstrators� or “protestors� or even “anarchists�. If we must call them something, I prefer the short, yet apt words of Mr. Tom Petty: “Rebels without a clue.�

The public came out to show support in honor of the Sikh holy day, wearing orange and navy, the true colors of the Khalsa (The Order of the Pure Ones). Downtown Kent was a sight to see last Saturday as the Sikh community came together at the ShoWare Center for Vaisakhi, a holy day celebration. The sun-graced Vaisakhi 2013 Day of Empowerment presented a festival filled with music, programs, exhibits and a parade. The annual Nagar Kirtan, a Sikh processional custom, is held on behalf of the Gurdwara (place of worship) Singh Sabha of Renton. The Nagar Kirtan parade went off without a hitch with thousands of spectators in attendance. Inside the ShoWare Center, the Darbar Sahib (main prayer hall) was set up with elegance and detail. Warmer weather means more outdoor time with Fido. Whether you’re walking through the neighborhood, attending a community festival or visiting your local dog park, here are some tips to make your canine-accompanied outings more enjoyable. Teach your dog to walk beside (not in front) of you in crowded areas. When greeting people (with or without dogs) always have your dog sit beside you. Ask permission to pet someone else’s dog and request that others do the same before approaching your dog. This will make your dog feel more secure and show others that your

dog is under control. If you visit the dog park, practice basic obedience (controlled walking, sit stay and come) on leash, before (and after) you let your dog play. This will help your dog be more

responsive to you when it’s time to go home, or if you need to intervene when a play session gets a bit too frisky. Remember, dog parks are not appropriate for all canines. Be fair to your dog, and with others, if his personality is not appropriate for these types of play sessions. Some dogs may become fearful, while others may become overly assertive, making the dog park visit stressful for all concerned. A good dog park experience is one where all the canines, and owners, have a good time. If your dog needs help with manners and/or appropriate body language around other dogs, enroll him in a basic dog obedience class where he will learn these skills in a controlled environment.

KICKOFF PARTY SATURDAY FOR HYDROPLANES AT KENT MUSEUM Big boat teams and drivers will appear for the inaugural H-1 Season Kickoff Party from 4 to 7 p.m. Saturday at the Hydroplane and Raceboat Museum, 5917 S. 196th St., Kent. Fans are invited to meet drivers and hydroplane teams as they prepare for the May 31-June 2 unlimited H-1 season-opening race at Folsom Lake in Granite Bay, Calif., east of Sacramento. Embrace Mother Nature: design more wildlife-friendly landscapes

Provide some food – berries, insects and seeds. Plants with berries such as Oregon grape or mahonia, seeds from coneflower, sunflowers and ornamental grasses and blooming plants that attract insects such as euphorbia, lavender and roses are all examples of how to set out a “come and get it” buffet and welcome the wild life to your landscape.

water will draw raccoons, frogs, salamanders and flocks of colorful birds to the garden. If you’re concerned about the safety or maintenance of a traditional pond and waterfall consider a “pondless waterfall” that recirculates water that is trapped beneath a covering of loose stone. There is no standing water so no buildup of algae or mosquitoes and very little maintenance. A pondless waterfall provides moving water that also provides a continuous drinking source for pets. The second week of May is a celebration of mothers and all things maternal. Mother Nature gets to join in the holiday spirit with new life sprouting up all over. Life began in a garden, and so in honor of the birds and wildlife that also enjoy the gardens we humans create, here are four tips for designing a more wildlife-friendly landscape:

Create shelter and protection from predators with layers of plants. Formal landscape designs are neat and tidy but they often lack the layers of plant material that provide protection for small birds and forest creatures. By allowing at least one section of the landscape to grow in

a more casual style with low growing sword ferns, medium sized shrubs such as azaleas and rhododendrons and taller understory trees like Japanese maples you can provide birds with nesting material and protection as they build homes and teach their young to fly.

Go Wild – at least a little bit in every garden. Our native plants are not only the perfect source of food and protection for our native wild life but they also thrive in our soil and climate. It makes sense for every gardener to include at least a few native plants no matter what your garden style. You can now find native plants at many local nurseries and in our state there are also native plant salvage parties that allow citizens to dig and take home plant material from property that will be cleared for construction. Look for native sword ferns that provide evergreen cover for tree frogs and use these drought-resistant ferns beneath tall fir and cedar trees or in any area

Tom passed away at the age of 71 on Saturday, May 4, 2013. He was born in Paddock, MN on February 24, 1942. He grew up on a farm in Sebeka, MN and moved to Rosholt, SD in his junior year. After graduation he enlisted in the Army and was stationed at Ft. Lewis. In 1965 he married Patricia A McCauley and they had two children, Cindey and Doug. His life’s goals were spoiling his grandkids and family, helping others, and golfing. He retired from Boeing in 2003 as a manufacturing engineer. Tom was President of Kent Valley Artists for 13 years.This year he gave it up and then got nominated to be secretary. He painted several years ago, but had too many projects to pursue it, but was getting ready to start again. He is survived by his wife, Pat, of 47 years, daughter, Cindey (Steven Lewis), grandkids Nicole (deceased) Kryshna, (Jake Beattiger and baby Ava due May 12), Bryanna, and Zach. His son Doug (April) grandkids Kyle and Ethan. Tom is survived by his siblings: Eunice Bankord-DeSiato (Neil), Helene Jacobson (Dave), Paul Bankord (Zoe) and John Bankord. Tom’s service was held on May 8th. 787371

Kent School District selected for Green Ribbon Award Kent School District recently was recognized as a 2013 U.S. Department of Education Green Ribbon School District Sustainability Award recipient by U.S. Secretary of Education Arne Duncan and Chair of the White House Council on Environmental Quality Nancy Sutley in Washington, D.C. KSD was recognized on April 22, Earth Day. A second recognition will take

place at 4 p.m. June 27 at the McKinstry Innovation Center in Seattle. The award acknowledges the district’s achievements in taking a comprehensive approach to sustainability. The areas encompassed by the award include reduced environmental impact and costs, improved health and wellness, and effective environmental and sustainability education. The district has several programs at schools and districtwide to reduce the environmental footprint of the

district and educate students about the importance of environmental awareness. Among the programs implemented by district is an energy conservation program that has allowed the district to reduce its utility costs by approximately $1.1 million. Some of that savings is going towards funding staff support jobs in schools. Many schools are recognized as Green Schools by King County for efforts by students and staff to reduce waste, recycle food, and conserve energy.
