Kent marijuana business applicants to state up to 18 BY STEVE HUNTER shunter@kentreporter.com

The state Liquor Control Board has received 18 Kent applicants so far for recreational marijuana businesses despite a city ban to

prohibit such businesses. City officials also plan to replace the temporary ban with a permanent ban in 2014 by changing land use codes. Ten more applicants from Kent were on the latest list released

Dec. 17 by the liquor board. The deadline for applications was Dec. 20. A final list of applicants is expected to be released the week of Jan. 6. Kent has four retail applicants, eight producer and six process-

ing applicants for recreational marijuana businesses. Six of the producer and processing applicants are for the same properties. Pat Fitzpatrick, acting city attorney for Kent, said many cities with bans against marijuana

businesses also have numerous applicants. “Receiving an application in a city that has a moratorium on marijuana land uses is not unique [ more APPLICANTS page 7 ]

Hope, inspiration through art Autistic savant artist shares his passion, studio with others BY MARK KLAAS mklaas@kentreporter.com

When Michael Tolleson takes up a brush, his autism paints. In strokes of vivid color

and harmonizing hues, he creates outstanding, and outstandingly beautiful, art. Tolleson in-breathes the emotional tone of a landscape, a person or a situation, and in one hour or less paints an inspiring piece. His medium of choice, acrylic, lets him finish a work even before the paint has dried. The resulting oil-like

painting is revealing, almost impressionistic. It’s a gift he struggles to explain. “I don’t even know what I’m doing,” the autistic savant artist said from his recentlyopened art studio in south Kent. “When I start the canvas, I don’t know what it’s [ more ARTIST page 2 ]

Kent Police are asking for the public's help and more witnesses to come forward to help identify a man who shot and killed a Kent man the night of Sept. 9 in the McDonald's parking lot across from Kent-Meridian High School. Police issued a media release Dec. 18 to ask for help in solving the case. After more than three months, detectives have not yet identified the man who fired the

shot that killed Gregory A. Harris, 22. Police were dispatched at about 9:20 p.m. to the parking lot at 10225 S.E. Kent-Kangley Road for a report of several shots being fired. A 911 caller reported a man had been shot in the face with a single gunshot. Paramedics transported Harris to Harborview Medical Center in Seattle, where he later died about a week later from the gunshot wound.

Numerous witnesses have been interviewed and many pieces of evidence have been processed during the course of the investigation, detective Melanie Frazier said. Several witnesses have indicated that a black male associated to a white sedan, possibly a newer model BMW was observed fleeing the area just after the gunshots were fired. It is unknown if the driver of the BMW is involved, or if he may have witnessed the

going to look like when I finish, but I know it’s always right. “I’m blessed with something,” he said. “It’s a gift housed inside this vessel.” Tolleson’s career has blossomed in such a short time, garnering national and worldwide attention from the autistic art community. Galleries – local and beyond, including Polly’s Place in London – have embraced his emotion-based paintings. The Kent man’s autistic journey through his work is the subject of soon-tobe-published book that will display 100 of his paintings. All this from an unpretentious artist self-diagnosed with Asperger Syndrome, which, he explains, accounts for his ability to paint proficiently and effectively without formal training. Tolleson deflects the praise. “It’s not about me, it’s about what I do through what I have,” he said. His career and company established, Tolleson wants to share his gift with others. Tolleson is continually told that his paintings give hope, inspiration and light to the autistic community, especially to youth. Tolleson has donated his work to numerous charitable organizations throughout the country. Such work, he hopes, opens more gateways and inspires more children with autism to believe that they can express themselves through art. To spread his mission and to become more accessible to families and children in South King County, Tolleson and his partner, Jack Carl Anderson, also an autistic artist, recently moved their Seattle studio and autistic art mentoring center to the Kent Business Center, 25524 74th Ave S. The Michael Tolleson Savant Art Center is roomy, accommodating offices, art

mentoring classrooms, a parent lounge area, a large art studio and a warehouse to store finished artwork. The center allows the artists to continue their meaningful work even as they inspire others to grow through the language of art. At the center, children on the autistic spectrum can express themselves through art and various mediums. “We’re making a difference,” Anderson said. “We believe in giving them the opportunity and tools they need to express their creativity and judgment.” The center provides oneon-one attention, a flexible hands-on approach to artists age 6 and older who are able to take instruction, nonverbal or otherwise. Each month, the MTS Art Center hosts a group art project as part of an open house and community outreach. “What we do for the kids who come in is needed,” Tolleson said. “They look forward to being here, and they look forward to what we do with them.” The idea, Tolleson says, is to welcome and challenge students, not judge them. “We give them a safe place and a place where they are recognized,” he said. “We listen. We’re not art therapy, we’re not babysitting. … We’re here because we have something to give. “We push limits, what their abilities are. By doing that, we’re making them go beyond.” And become something more, just like the instructors themselves. “For whoever we are,” Tolleson said, “we recognize that (if) you have a gift, you give a gift.” To learn more about the center and its programs, call 253-850-5995, visit www. Court hearing continued for boy accused of raping girl BY STEVE HUNTER

shunter@kentreporter.com

A court hearing has been continued to Jan. 15 for a 14-year-old Kent boy charged with first-degree rape and first-degree rape of a child for his alleged attack Nov. 7 on an 8-year-old girl near a Kent hotel. The teen had been scheduled for a status conference Dec. 13 in King County Juvenile Court in Seattle but that has been continued to Jan. 15, according to the King County Prosecuting Attorney’s Office. Prosecutors want to charge the boy as an adult because of the seriousness of the alleged offense committed in an aggressive, violent, premeditated and willful manner,

according to charging papers. Because the boy is 14, the Juvenile Court will first handle the charges. A Juvenile Court judge must order adult prosecution for the boy and decline the case, which would send it to King County Superior Court. A decline hearing isn’t expected to be held for a few months. The teen won’t be arraigned until after court jurisdiction is decided, according to the Prosecuting Attorney’s Office. The boy remains in custody at the King County Juvenile Detention Center in Seattle.. If convicted in Juvenile Court, the boy could face incarceration up to his 21st birthday. If convicted

in adult court, the sentence range could be 20 or more years in prison with a potential maximum sentence of up to life in prison. Under Washington state law, an offender who commits a serious violent offense is automatically charged in adult court if they are 16 or 17 years old when the alleged crime occurred. The boy attended Kent-Meridian High School before dropping out. Kent Police arrested the teen Nov. 7 for investigation of first-degree rape after an 8-year-old girl on Nov. 7 entered the Red Lion Hotel, 25100 74th Ave. S., wearing only a shirt and socks and told hotel employees she had been raped. The girl had a

The Kent-Meridian Veterans of Foreign Wars Post No. 6785 honored Kent Police Officer Jeff Kluzak as its Law Enforcement Officer of the Year during its monthly meeting Dec. 18. “It’s nice to get the recognition,” a humble Kluzak said after receiving the award. “We’re not always looked upon favorably, so this is good recognition for the work that we do.

“I just want to thank (the VFW) for recognizing me and the Kent Police Department.” In addition, the VFW Post 6785 has nominated Kluzak for the State Officer of the Year Award, which is expected to be announced in June. Kluzak, 29, has been with the KPD since 2008 after previously working in public safety in Michigan, first as a firefighter and then as a police officer.

At Kent, he has been assigned to the patrol division and lately, the Neighborhood Response Team. He has earned three lifesaving medals, two of which occurred while on duty in Kent. Kluzak is married and has two children. He enjoys family and the outdoors.

Virginia to attend each day of the trial. “After this long between the date of Seth’s murder and the trial and the length of the trial, they were looking forward to having some closure one way or another,” said Hinds, who gave the trial’s opening statement. “It puts it off for longer either way. They were disappointed with that but they understand this is one of the things that happens when you have a jury system. It needs to be unanimous to convict, unanimous to acquit and anything in between you keep going. I think they understand that.” Closing arguments were given Dec. 17 by Senior Deputy Prosecutor Wyman Yip and defense attorney Anuradha Luthra. Yip portrayed Phillip, 33, of Portland, Ore., as a man who wanted to return to a romantic relationship with Johnson and went so far as to kill Frankel in an effort to get back together with her. Yip said the evidence of a towel found near the murder scene with the DNA of Phillips, cellphone records and text messages prove Phillip drove up from Oregon and committed the crime.

What’s coming up in Olympia A preview of coming attractions and distractions for lawmakers next year can be found in the pile of legislation awaiting them when they return to Olympia in January. There have been 59 bills filed early – 38 in the House and 21 in the Senate – dealing with specialty license plates and protecting hospital employees from violent criminals as well as naming a state waterfall and ensuring natural disasters don’t shut down government. Here’s a sample of new laws House and Senate members are already pushing: One overpass, hold the art: There’s a move afoot to end the prettification of bridges, overpasses, sound walls and off-ramps. House Bill 2092 would bar state transportation agencies from spending public funds to “acquire works of art” or make “decorative finishes or designs that are not integral to the function of a transportation structure.” Washington Pot & Trust: Who better to handle the cash for the pot industry than the state, right? Senate Bill 5955 creates a publicly owned trust to “act as the sole depository for in-state marijuana producers, processers, and retailers and to use taxable earnings from

those deposits for the benefit of the people and economy of the state.” All in the cannabis family: You won’t get high off hemp but you might make money selling oils, clothes and other products made from this variety of cannabis sativa. Senate Bill 5954 sets the rules for a new industrial hemp industry. Growers will need licenses and pay fees and those dollars would be deposited in the proposed publicly-owned trust. RDHWKFN: The University of Washington has a specialty license plate. So too do Washington State University and Gonzaga. Seattle University may be next. That’s the idea behind House Bill 2100 which would direct proceeds from any sales into a student scholarship fund. A layer of protection: When a person suspected or convicted of a violent crime is brought to a hospital for care, sometimes they attack nurses or other employees. Under Senate Bill 5968, these potentially violent individuals must be accompanied by a law enforcement officer or guard at all times during the visit. Scenic standout: Washington’s got its share of official symJerry Cornfield

Question of the week:

Christmas is such a special time of year that I always try to mentor the young married couples and those preparing for the big fall to understand just how hopeless and happy it all really is. At a certain crossroads in my life I learned an essential lesson when buying presents at Christmas or Valentine’s Day, or any other present-giving trap day. I am sure you have heard the axiom, “it’s the thought that counts.” If you believe that one you had better be adding lots of 151 rum to the eggnog. You are going to need it. It may be your only friend for a while. Here is the secret, and this part of the column is for men only. Women should stop reading until the last line, please. You are supposed to fail at buying a gift for your wife. Only in the beginning of a marriage does the “oh, that is so nice” line get activated. After that you get the “look.” We all know what the “look” is … it is frightening and prompts 151 eggnog in Mason jars. Here is the revelation of the secret code. You are predestined to fail. No matter how hard you try, you will eventually be a present-buying failure. I did a very scientific poll of the women in office and a few others to get the inside scoop. More than one gave me the line, “Well he is not too bad at Christmas (translation: he’s an idiot, but Christmas is close and he may read this column so we will see how he fares) but at Valentine’s Day he sucks.” Another said her husband bought his mother and grandmother a gift for Mother’s Day, but not her. They have a 3 year old. Here is a very hot tip. On Mother’s Day when you do not buy a gift for your wife, but you do buy a gift for your mother and grandmother, do not respond to your wife by saying, “Well, honey bunny, you are not my mother.” During the Mother’s Day season there is a severe shortage of eggnog, which means the 151 rum will need to be consumed straight. You may suddenly find yourself converting into a flambé rubber chicken. Here is another very good wife quote, “Years ago he bought me a shirt for Christmas, not something I asked for, he guessed that I might like it. I hated it. I instructed him to not buy me clothes ever again. My husband tries but without specific directions about what I want, he fails.” My favorite is one of my longtime contributor to failed Christmas presents from her husband. Ron Olness has a long history of buying just the wrong Christmas present for Becky. She hates electronic presents, which he always buys her. He consistently buys her something I would absolutely love, and she hates.

bols. There’s a state bird, fruit, insect, folk song and even a ship. House Bill 2119 would name Palouse Falls in southeast Washington as the official state waterfall. The sales pitch: The falls drop 198-feet and are considered one of the most amazing waterfalls in the U.S. and the world. Disclosure duties: A little training might help elected leaders of cities, counties and special districts avoid violations of the public records act that can result in big payouts to seekers of records. House Bill 2121 would require every elected official to complete a training course within 90 days of taking office. Primary avoidance: When voters fill the unexpired term of a partisan county office, as they will for Snohomish County executive next year, a primary is held even if only one candidate files. Under House Bill 2106, no primary would be held in such instances. The candidate must still go before voters in November in case a write-in candidate surfaces. In the event of an emergency: Washington’s constitution lays out how government will operate in an “emergency resulting from enemy attack.” It doesn’t mention other emergencies like a natural disaster. Valmonte keeps gymnastics connection BY ROSS COYLE

rcoyle@kentreporter.com

KENTWOOD GRABS WIN AT SHOWARE SHOOTOUT The Kentwood High School boys basketball team beat Auburn Mountainview 53-36 in the ShoWare Shootout, a high school basketball showcase, at the ShoWare Center Saturday night in Kent. Kentwood improved its overall record to 4-3 with the nonleague victory. Kentwood (2-2) is in fourth place in the SPSL North. Kentridge leads the league with a 6-0 record followed by Tahoma at 4-1 and Auburn Riverside at 3-2.

Despite standing a little over 4 feet tall, 16-year-old Crystal Valmonte has a strong spirit and dedication to her sport as a gymnast. At 12 years old she placed in the top 10 gymnasts in her division at the USA Gymnastics Western National Championships. She got an early start to the sport; her parents enrolled her in classes when she was two years old. “They pushed me when I was little,” the Kentridge High gymnast says, “but that was because they knew I would be good, but I didn’t.” Even after a severe knee injury and surgery, she returned to gymnastics to compete on a less stressful level. But there were moments when she wanted to give up, specifically she says during sixth grade. She started to doubt her skills, and whether she had the will to continue with the rigorous training, but her parents insisted that she continue. “I wanted one of those teenage lives; like hanging out with friends and just doing whatever, not going to practice every day till eight and then home. The same routine every day,”

Crystal Valmonte, center, with her Kentridge teammates Ivey Lam, Justine Huliganga, Eva Dahlia and Aiko Luckinsadge. ROSS COYLE, Kent Reporter Valmonte said. Valmonte found the resolve to continue with her training, and succeeded in making top 10 rankings in the Western Nationals competition for her sixthgrade division. Two years later, her body told her it couldn’t take anymore, and she tore her knee’s anterior cruciate ligament (ACL) and meniscus tissue, which connect the upper and lower leg bones. She didn’t realize quite

what it meant for her career until she got home, and then broke down. “I cried, it sucked,” she said. It wouldn’t be the first injury she suffered over her career as a gymnast. She says that besides the tears, she’s also endured one broken arm and no less than six twisted ankles. Valmonte still isn’t certain about just when she tore the ACL, but she first noticed it after landing

from a balance beam event. She was initially optimistic that she would be able to walk the tear off, but surgery killed that option just as well as it repaired her knee. She tried to continue with gymnastics, but found it difficult to practice consistently without the intermittent pain from the surgeries. “There’s no warning to it,” she says, “sometimes I’ll do something hard and it’ll

tweak. Sometimes it’s just standing or walking.” While Valmonte feels that her best days are behind her, she also wants to stay involved with gymnastics. She tried taking a year off, finally getting the reprieve that she had desired for so many years. Instead of relaxing, she found that she missed the sport, and her mother encouraged her to join the high school team. While less competitive, it would keep her around gymnasts. “It’s a different environment,” she says. “In club you’re doing harder tricks, and like, putting more pressure on your muscles and stuff. And more endurance and cardio involved.” Since Valmonte already had a good handle on most of the stunts that beginners learn in the first few weeks, she took to offering her expertise to her peers. It’s been a learning experience for her as she learns to take charge and teach her teammates successful techniques. “At my gym I was always the baby, always the youngest,” Valmonte says. “But here I’m one of the oldest, so I have to like, take control and make sure everyone’s on task.”

The liquor board has received 2,444 applicants statewide, including 512 retail store applicants. The state will limit the number of stores to 334 and has limits in each city, including three in Kent. Fitzpatrick said city officials didn’t know how many applicants to expect. “Washington is only the second state (Colorado is the other) to allow for the production, processing and sale of marijuana,” Fitzpatrick said. “The city is not surprised, because it had no historical information to form an expectation. Federal Way, Renton and Auburn have moratoriums and all have received applications. Applications have also been received in cities like SeaTac, where permanent code language prohibits marijuana land uses.” Kent’s six-month moratorium against recreational marijuana businesses expires May 27. But Fitzpatrick said plans are underway in the city for a permanent ban. “Before the expiration of the moratorium, the Land Use and Planning Board will make recommendations to the City Council re-

garding a permanent policy relating to marijuana land uses,” he said. If Kent applicants receive a recreational marijuana license from the liquor board, Fitzpatrick said the city won’t issue them any permits. If the business opens anyway, he said the city will take action. The liquor board will issue licenses to applicants even if a city bans recreational marijuana businesses. “Kent’s City Council set a policy that marijuana land uses are not permitted in Kent,” Fitzpatrick said. “This office is prepared to defend and enforce that policy. If the Liquor Control Board issues a license, we expect the applicant will comply with Kent’s laws, and if the applicant chooses not to, we will determine whether to seek relief in
