Bikini baristas at about a half dozen Kent coffee stands will need to wear a bit more clothing or face arrest for lewd conduct. The Kent City Council last month approved a new lewd con-
duct ordinance that becomes effective Feb. 21 to give police a new tool to handle complaints from residents about the lack of clothing worn by the women who serve coffee at the drive-thru stands. “We do not anticipate this will put anybody out of business
who is in business but it might slightly alter the way they conduct themselves,” said Pat Fitzpatrick, acting city attorney, last month at a council Public Safety Committee meeting. “For example, some of these businesses female baristas wear tape or pasties over their
breasts and that will no longer be permitted under our ordinance.” Lewd conduct is a misdemeanor, which carries a maximum penalty of 90 days in jail and a $1,000 fine. Police have received complaints about seven bikini barista stands

W
hen Mill Creek science teacher Connie Franks was asked to come up with an elective class, she wasn’t expecting her rigorous forensic science class to get approved, much less become one of the most popular classes at the downtown middle school. The class teaches eighth-graders about biology and biochemistry in
a way they can practically apply to each lesson during the day. “It really puts your brain to work,” said Grant Staton, one of Franks’ students. “It’s very challenging but very rewarding.” The class has received such a good reception that parents will fight to keep their students in the classroom, sometimes making significant sacrifices to stay in the Mill Creek area. “One mom said she didn’t move from her apartment,” Franks said, “so that was really a lot of pressure on me!” Franks, who has been teaching science in the Kent School District
for 15 years, got the idea after studying at the Fred Hutchinson Science Education Partnership, a professional development class at the Fred Hutchinson Cancer Research Center in Seattle. Through her studies, she gained access to the center’s technology, which she can rent out and use in her own classes, so she took advantage of the opportunity to use the technology in her classroom. Her forensics class provides a number of advanced lab classes, ranging from handwriting analysis to even low level genetic engineering. [ more FORENSICS page 2 ]
The Kent City Council cut a list of 38 applicants on Tuesday night to seven finalists to replace Ken Sharp on the council. The finalists are Jed Aldridge, Christine Budell, Brenda Fincher, Barbara Phillips, Debbie Raplee, Wade Schwartz and Sarah Veele. “It was a challenge,” Council President Dana Ralph said during a phone interview. “We had some really good applicants.” Council members met in executive session to discuss the applicants. The council returned to an open public meeting and each of the six members voted for their top seven choices. Any applicant with three or more

After the first batch of ballots were counted Tuesday, both levies were leading with more than 56 percent approval. The M & O levy was leading 10,278 to 7,857 votes,
votes became a finalist. The council will pick a replacement for Sharp at a public meeting at 6 p.m. Tuesday, Feb. 25 when each finalist will be interviewed. Sharp resigned in January after only two weeks into his four-year term because of pending first-degree theft charges for allegedly stealing nearly $300,000 from his 93-year-old mother’s bank account. Former council members as well as several people who have run for the council were among the applicants. and the technology levy was winning, 10,511 to 7,629 votes. A simply majority is needed to pass levies. The M & O levy will go toward re-implementing school programs that were cut. [2] February 14, 2014 [ FORENSICS from page 1 ] To guide her students through the work, Franks has her class focus on three specific areas: deductive reasoning and logical thinking, understanding biochemistry, and applying the two for practical forensic labs. “They kind of do a combination of just using the biotechnology to do forensics and then also to do scientific research and genetic
www.kentreporter.com engineering and things like that,” Franks said. For the deductive portion of her class, she creates assignments such as mystery handouts that require deductive reasoning. After getting their heads around the thought process, students move on to study the mechanics behind a lab, such as how antibodies bind to a virus and can be used as indicators, and finally use the knowledge practically. They recently used what they learned to test whether
a cat, and the bird it had eaten, carried the H5N1 avian flu virus. Other labs the students will take part in include blood spatter analysis, a murder mystery, DNA fingerprinting (breaking down a DNA strand to get a unique personal identifier), and even low level genetic manipulation of “plasmids” to make them bioluminescent. The applied exercises are also helpful for many of her students who would otherwise struggle in a traditional environment. When

she hands out a brain teaser exercise, every student in the class gets to work. “We do a lot of brain challenges, and boy the minute I hand them one, you can hear a pin drop in here,” she says, “they’re so into it.” Franks has found several unexpected benefits from the class’s nonstandard format. The more open atmosphere has encouraged her gifted students to engage more with each other and discuss their knowledge, and students that would typically struggle in school do well by working with high achieving students. are AP or honors achievers. Some struggle in other classes but she says that she hasn’t had any issues. One of the biggest lessons Franks has learned from the class is how useful it is to combine high performing and struggling students to help each other learn. While not all of the students are high performing or honors level students, she sees the advanced students act as leaders that help bring other students up to their level. In the next year, Franks hopes to expand the class if she can get time for it. She’d also like to get more professionals helping out in the course to give a living example of what students can do with the skills they learn. But tackling those challenges will have to wait until she finishes her murder mystery lab.
Retired district superintendent passes away Former Kent School District Superintendent George T. Daniel passed away Jan. 30 of lung cancer. He was 83. “His foresight was instrumental to our success at serving students today, and his impact on our organization is lasting,” said Kent Superintendent Edward Lee Vargas. Under Daniel’s leadership, the district added 20 schools to accommodate an increasing student body. Man gets 38 years in prison for murder of Devin Topps

Jorge Lizarraga received a 38year prison sentence for the 2010 murder in Kent of Devin Topps, 18, a popular student athlete at Kentridge High School. King County Superior Court Judge Patrick Oishi sentenced Lizarraga, 23, last Friday at the King County Courthouse in Seattle. Lizarraga has a significant criminal history and based upon those prior convictions and the seconddegree murder conviction, Senior Deputy Prosecuting Attorney Jessica Berliner asked the judge to impose a 40-year sentence, according to the King County Prosecuting Attorney’s Office. A jury convicted Lizarraga in De-
cember of shooting Topps after a Halloween party in 2010 outside of a Kent home. They also convicted him of two counts of violation of the Lizarraga uniform firearms act (for being a convicted felon in possession of firearms), residential burglary, theft of a firearm and possession of a stolen firearm. Topps, a popular Kentridge student and football player, became involved in a fist fight with another man outside a house party when Lizarraga pulled out a gun and fired multiple shots into the air, causing people at the party to scatter, before he walked up to Topps and shot him once in the
messages that showed Lizarraga attended the party. Prior to the shooting, Topps had left the party to walk a friend to her car. Someone in a group outside the house made a comment to Topps that the Kentridge star didn’t like. A second comment led to a fight between Topps and two other men before Lizarraga reportedly entered the fight and shot Topps once in the back. Topps had signed in 2010 to play football at Eastern Washington University but didn’t enroll in the school because of low grades. He had hoped to enroll at Eastern in winter 2011. Nearly 1,000 people attended the memorial service for Topps in 2010.
Gunman seriously injures Kent woman A gunman shot and seriously injured a 31-year-old Kent woman in her home at about 9:04 p.m. Sunday in the 24500 block of 104th Avenue Southeast. Officers arrived at the house and found a woman with a gunshot wound to the head, according to a Kent Police media release. She was responsive and breathing. Paramedics stabilized the woman and transported her to a nearby hospital for treatment. No one else was injured. Gunshots were fired into the residence that housed multiple people, including children. There is no
known motive for the shooting and the gunman fled the scene. “This incident could have easily been far more devastating,” detective Melanie Frazier said. Frazier said in an email on Tuesday that “multiple shots” were fired but added she did not yet have an accurate count to release. “It is unknown who the target actually was; however indication of the multiple shots fired would lead us to assume that someone living in that residence was targeted for some reason or another,” Frazier said. Anyone with information about the shooting is asked to call 911 or Kent Police at 253-856-5808.

FIRE DAMAGES WEST HILL HOME IN KENT Firefighters responded at about 12:30 p.m. Feb. 5 to a fire in the 3700 block of South 270th Street, according to a Kent Fire Department media release. Fire units could see a column of smoke as they approached the residence. The residents were already safe and outside of the house when crews arrived. Nobody was injured. The cause of the fire remains under investigation.

He then used that gun to shoot Topps. Detectives later recovered that gun in a Des Moines motel room where Lizarraga stayed after the shooting. The city receives complaints every month about bikini baristas showing too much skin. “They ebb and flow but we receive a lot of complaints,” Fitzpatrick said. “We hear complaints from people who are not patronizing the business might be able to see some of the activity going on in the business. Another complaint is often people who work in the coffee stands exit their business scantily or barely clothed to take out the garbage. “Sometimes we even receive complaints from an unsuspecting customer who just drove up and wanted to get a cup of coffee and was shocked by the lack of clothing worn by those selling the product.” A barista who talked to a reporter says that none of her customers fit the perverted mold that some people associate with the bikini stands. “People have this stereotype of our customers,” she said. “Everyone here is super sweet. They’re just here to get their coffee.” The woman acknowl-
edges that other shops have provided lewd services, but says that the one she works at doesn’t resort to those practices. “Some shops give extras, and that’s really gross,” she said. Police have stopped at the stands to ask the bikini baristas to wear more clothing, Hemmen said. He added the women comply for a while and then go back to wearing less clothing. “They are wearing pasties or tape over their breasts but there’s no ordinance we can use against them,” Hemmen said prior to the council’s approval of the new ordinance. “We ask them to put more clothes on or block windows from the public when they drive by. We’re asking for this ordinance because it gives us something where we can take complaints and enforce them. And the kid riding his bike down the street can’t see what’s happening in these stands.” Other cities have adopted similar ordinances. “This is a little bit of a touchy situation when you are dealing with First Amendment rights for expression,” Councilman Les

He said Kent does allow adult entertainment in certain zones so the coffee stand could move to do business under that code. Kent Police investigated lewd conduct complaints in 2012 at Twin Peaks Espresso on the East Hill that later led to an Everett Police prostitution sting at several coffee stands in Snohomish County and the Kent business. Police also made two arrests of baristas who reportedly exposed themselves to customers in February 2013 at the Twin Peaks stand. A barista who works at another location says that ultimately the issue is who makes the best coffee, and the bikini setups are simply a side benefit for the customers. If bikinis help attract customers, she doesn’t see a problem with it as long as it’s not lewd. “People just work to make money, you know,” she said. “Sometimes you gotta do what you gotta do.” Reporter Ross Coyle contributed to this story.

A few of the drive-thru stands promote through Facebook pages or business signs that baristas will wear pasties on certain days. A bikini barista who works at Hottie Shots Espresso declined to comment about the change in city law. She said she would give a reporter’s number to the coffee stand’s owner. The owner did not call. Hottie Shots Espresso features hot girls and delicious drinks, according to its Facebook page. The employees often wear pasties based on its Facebook photos and comments. “The main matter in this ordinance is a new tool for the police department to deal with a problem that has plagued this city and probably almost every agency in the state,” said Fitzpatrick, who added the lewd conduct ordinance explains what is permitted

The second week of February is the time to finish up any winter pruning of fruit trees and grape vines and use a dormant oil spray on roses or other leafless plants. You can find safe and organic dormant sprays at garden centers now and they work by coating a dormant or leaf less plant with a thin layer oil that will suffocate overwintering disease and insects. Let’s preserve a treasure, the par 3 When I moved to Kent in 1998, this city had nothing but the two golf courses. No Kent Station. No ShoWare Center. Now they are talking about maybe selling the par 3 golf course. Are you kidding me? To pay down debt? Let’s just forget about all the kids and beginners learning the game. Let’s just forget about all the senior men and women who play all the time. This course is a Kent treasure. The only par 3 course south of Seattle in King County. Let’s save municipal golf in Kent Recent letters to the editor and columns in the Kent Reporter have suggested that saving the par 3 course at Riverbend is the primary issue. Saving municipal golf in Kent is the real challenge at hand. Riverbend Golf Complex is a
wonderful asset that Kent has enjoyed for over 20 years. Consisting of an 18hole course, a 9-hole par 3 course and a driving range, the complex is operated as an enterprise fund, meaning it is a self-supporting facility not subsidized by the city’s general fund.

Washington has a part-time, citizen Legislature. This means lawmakers gather in Olympia anywhere from two to four months per year to debate policy and vote on changes to state law. However, the job is anything but part-time; lawmakers spend the full year working with constituents, researching potential legislation and, for many, also working their day jobs. There is a benefit to having a part-time Legislature that invites people from a variety of backgrounds, with different skills and experiences, to work together toward a common goal. Last year the Legislature succeeded in strengthening drivingunder-the-influence laws, and as a lawyer I became interested in getting an inside look at how those laws were working and what additional tools prosecutors needed. After the 2013 session, I began work as a prosecutor for King County. It was a great privilege to work alongside our public-safety professionals. I was impressed by the level of professionalism and abilities demonstrated by our public servants serving as state troopers, local officers, and public defenders. Washingtonians are fortunate to have them working as a team to dispatch justice and keep our communities safe. After prosecuting five jury trials and handling hundreds of cases in court, I learned what works and what doesn’t for our talented team of prosecutors in King County. The result was an opportunity to bring forward legislation that addressed problems from this newfound perspective. One DUI-related proposal would help prosecutors seek more-appropriate sentences for repeat offenders who violate the conditions of their sentences, namely the requirement that they only drive automobiles equipped with an alcohol-detection device. Through the decades, Riverbend has not generated enough revenue to support its operating costs and capital reinvestment needs. This is a structural budget problem. My plan would enable a prosecutor to seek increased sentences for these offenses. A second measure would add to the types of offenses that are considered when sentencing repeat offenders. These include operating commercial vehicles, boats, and aircraft while legally impaired. By adding these offenses, prosecutors and judges would gain a more
comprehensive picture of offendersâ&#x20AC;&#x2122; past behavior when holding them accountable. In addition to keeping dangerous drivers off the roads, I proposed a measure that would help food assistance reach families needing it most. Too often prison inmates continued receiving state food benefits while incarcerated. Aside from violating the law, this systemic flaw took resources away from people in need. While people in jail are prohibited from receiving benefits from the stateâ&#x20AC;&#x2122;s Basic Food program, there is no process for communicating
between correctional agencies and the Department of Social and Health Services, which issues these payments. To correct the problem, I proposed legislation that would require information sharing to ensure tax dollars didnâ&#x20AC;&#x2122;t continue going to someoneâ&#x20AC;&#x2122;s public-assistance account while they are in jail. The legislation will not affect the families of inmates, who would continue to be served, but will close this costly loophole. The proposal has received support from individuals within our stateâ&#x20AC;&#x2122;s
social-service agency who want to see this problem corrected. The outside experience of all part-time legislators informs how we approach policymaking in Olympia. In simple terms, the primary issue is this - How do we save municipal golf in Kent? This is the core question. We all would like to solve the question of how to save the par 3, but I encourage us to remember this primary issue. Also, in a post-recession economic climate, the golf market has changed, making for a much more competitive marketplace. This structural budget problem is difficult and will require difficult decisions. We held public workshops, citizens offered many ideas, and the City Council has discussed all of this in open public meetings. We shared the feedback gathered at
last summer’s open houses with the Parks and Human Service Committee. Additionally, Riverbend’s general manager, Pete Petersen, and I had numerous meetings and discussions with members of the Save the Par 3 group, the Ladies and Men’s Clubs at Riverbend, our golf customers and our junior golf partners. Their feedback and ideas helped inform the discussions with the City Council, always keeping in mind the core goal of achieving a fiscally sustainable Riverbend. Many suggested revenue enhancements and increased marketing, all the while emphasizing the need to remain a facility that serves all ages and all abilities. These strategies must and will be part of any eventual solution. Others suggested selling other city property to address these budget chal-
lenges. But those other city properties are controlled by other city funds and if sold, proceeds from those sales would be restricted to those other funds. This is the case with the recent example shared by Mr. Gravender, who suggests selling a parcel across the river from the par 3. The City Public Works Utility owns that property for future flood storage, and any proceeds from that sale would not help Riverbend. I have expressed my willingness to continue to meet and answer any question posed by the Save the Par 3 members. I restated my commitment recently to Mr. Sample. Any insinuation that I am not willing to answer their questions is false. The City Council directed staff to explore the following: • Consider Riverbend

KENTLAKE GYMNAST TAKES FIRST PLACE Kentlake High gymnast Ashley Pernell earned first place honors at the South Puget Sound League 4A subdistrict meet on Feb. 8. Pernell earned a total score of 37.025 in her four events, Kentwood senior Zoe Krembule earned fifth place with a 35.15 total. As a team, Kentlake finished third with a score of 166.200, three points out of second.

An 11th-hour push from Todd Beamer High School wasn’t enough to stop Kentridge from sealing the South Puget Sound League boys basketball title Tuesday night at the ShoWare Center. Jawan Stepney scored 13 points and Keasean Kelly and Joe Wainhouse each had 12 points to lead the Chargers past the Titans 69-58. With the victory — and the league title in hand — the Chargers (21-0) advanced to play Evergreen, the No. 3 seed from the Greater St. Helens League, Thursday in the first round of the West Central/ Southwest District 4A tournament. Results were
unavailable at the Kent Reporter’s press deadline. The top-seven placers at the 16-team tournament will advance to regionals. The Titans dropped to 16-4. Kentridge coach Dave Jamison says that the game was one of the hardest match-ups for his team. Jamison also said that he was pleased with the results, saying that he felt the whole team played together. Kentridge held a 51-50 lead after three quarters. In the fourth quarter, the Chargers’ defense, composed of Wainhouse, Danny Torlai and Cristoph Adams, stepped up to block a number of potential shots and prevent the Titans from picking up easy points. CIRULATION MANAGER - KIRKLAND Sound Publishing, Inc. is currently accepting applications for a Circulation Manager at the Kirkland and Bothell/Kenmore Reporters. The primary duty of a Circulation Manager (CM) is to manage a geographic district. The CM will be accountable for the assigned newspaper as follows: Recruiting, contracting and training independent contractors to meet delivery deadlines, insuring delivery standards are being met and quality customer service. Position requires the ability to operate a motor vehicle in a safe manner; to occasionally lift and/or transport bundles weighing up to 25 pounds from ground level to a height of 3 feet; to deliver newspaper routes, including ability to negotiate stairs and to deliver an average of 75 newspapers per hour for up to 8 consecutive hours; to communicate with carriers and the public by telephone and in person; to operate a personal computer. Must possess reliable, insured, motor vehicle and a valid Washington State driverâ&#x20AC;&#x2122;s license.
