After multiple continuations, the case against Vineet Kumar Srivastava, a former Microsoft Corp. employee who was charged with second-degree rape of a Microsoft janitor a year ago, has been dismissed. The order of dismissal was filed by King County prosecuting attorney Daniel Satterberg’s office on July 3. The court documents had cited “evidentiary considerations not known at the time of filing and in the interests of justice” as the reason why the case dismissed. “You cannot imagine the ordeal that Mr. Srivastava has been through during the last 11 months — having been falsely accused of this offense,” said Todd Maybrown, Srivastava’s attorney. “It is shocking that any person would fabricate such a claim. However, our investigation has revealed that this is not the first time that this person has made a false accusation of rape against another person.” [ more RAPE page 5 ]

Shortly after 2 p.m. on Tuesday, crews from Redmond, Bellevue, Kirkland and Mercer Island fire departments responded to a call regarding a construction worker who was buried in a trench in the Rose Hill neighborhood of Kirkland. Once they arrived on the scene, the first responders found a car teetering in the corner of an L-shaped trench and an individual trapped

under a pipe beneath the car. The crews from the different cities worked together to get the person out without having the trench collapsing on them or the car falling further into the trench.

A JOINT EFFORT While this could have happened in real life, Tuesday’s incident was just a drill for the fire departments. The “trapped” individual was just a dummy. This was all part of a specialized,

joint training exercise through the East Metro Training Group (EMTG). EMTG was formed in 2012 to facilitate training programs for the fire departments of Redmond, Bellevue, Kirkland, Mercer Island and Northshore. The consortium was also designed to increase interoperability and reduce costs for citizens. The current EMTG training, which takes place on publicly owned property at the southeast corner of 132nd Avenue Northeast and Old [ more EMTG page 6 ]

Derby Days, Redmond’s annual summer festival, begins at 5 p.m. tonight with music, a beer and wine garden, carnival games and rides. The evening ends with the showing of “Iron Man 3.” The Redmond Fire Department will begin tomorrow’s activities with a pancake breakfast from 8 a.m. to noon at Fire Station 11, 8450 161st Ave. N.E. Donations will be accepted and all proceeds will go to the RFD Benevolent Fund, which supports local residents when they are facing personal tragedy. There will also be a Derby Dash 5K, kids’ parade, grand parade, kids’ activities, carnival, more live music, criterium bike races, food, fun and more. In the race for the 45th District Senate seat, both the challenger, Matt Isenhower (D-Redmond), and the incumbent, Andy Hill (RRedmond) earned a rating of “Very Good.” Hill, who did not return a request for comment, increased his rating from “Good” in 2010. “As a first-time candidate, it’s an honor to be judged as someone who is a skilled builder of consensus, understands the issues facing our state and inspires confidence,” Isenhower said. “The community leaders who volunteer with the Municipal League of King County go to great lengths to evaluate candidates’ effectiveness, character and knowledge. It’s not a resume measuring contest or a partisan judgment. Because they really seek to understand whether a candidate is prepared to make an impact, I think their ratings are particularly helpful to voters.” The non-partisan process used 50 volunteers, who devoted more than 1,000 hours to collect the information. To determine candidate ratings, the volunteers reviewed candidate questionnaires, studied the public record, spoke with references and conducted interviews with candidates, according to the Municipal League’s website. The questionnaire the candidates fill out include information on the candidate’s background like other elected offices held, volun-

teerism, community work and employment. The ratings are not meant as an endorsement by the league but rather it assess each candidate’s potential to be effective in office and ability to serve the community. Committee members then rated each candidate on four criteria: involvement, character, effectiveness and knowledge. Former Kirkland mayor Joan McBride, in her first legislative race, earned a rating of “Very Good” in her bid for representative position No. 2 in the 48th District. She is running against Libertarian Tim Turner, who earned a rating of “Adequate.” The seat is currently held by Rep. Cyrus Habib, who is running for State Senate in the 48th District, currently held by Rodney Tom (D-Bellevue), who is not running for re-election. Habib was one of just two candidates in the two districts to earn a rating of “Outstanding.” Habib’s opponent, Republican Michelle Darnell, earned a rating of “Adequate.” The other candidate to earn a rating of “Outtanding” is longtime State Rep. Ross Hunter (D-Medina). Hunter increased his rating from “Very Good” in 2012. Hunter is being challenged by Bill Hirt (R-Bellevue), who did not participate in the process and was the only candidate in the two districts to earn a rating of “Not Qualified.” Hirt did participate in the process in 2012 when he challenged Hunter and also earned the same rating. State Rep. Larry Springer

(D-Kirkland), who holds position No. 2 in the 45th District, earned a rating of “Very Good,” while his opponent, Republican Brendan Woodward, earned a rating of “Adequate.” The best rating a candidate can receive is “Outstanding.” The Municipal League’s website defines “Outstanding” as that the candidate “Has made numerous outstanding contributions requiring skills related to the office, is a path-finding and respected leader, brings knowledge and creativity to issues facing the office.” “Very Good” is defined as “Makes significant contributions, is a skilled builder of consensus, inspires confidence in the way he/she would serve, is thorough and

attentive to issues.” “Good” is defined as “Has been active and effective in many roles, is capable of moving people to productive action, has strong record of participation in problem solving, shows satisfactory commitment to tackling issues.” “Adequate” is defined as “Has a record of participation and interest, is effective on specific issues, has provoked questions about suitability as an office holder, will need significant time/energy to fill gaps in knowledge.” The worst rating a candidate can receive is “Not Qualified,” meaning that the candidate “Doesn’t appear engaged, has a record that casts doubt on ability to

be productive, hasn’t demonstrated ability to deal with responsibilities of office, has narrow focus, inflexible attitude or is otherwise troubling.” An example of questions that are asked of the candidate include is “Describe your most important personal characteristics or traits as they relate to the office you seek;” “Please describe, in sufficient detail, one to three accomplishments or contributions of which you are most proud;” and “Please list or describe current and past activities in the community in which you have acquired skills that relate to the office you seek.”

From impromptu negotiations down the hall to discussions on the subway to the Capitol, sometimes, something as simple as having offices next door to one another can make all the difference in Congress these days. As colleagues on the Senate Health, Education, Labor, and Pensions (HELP) Committee, we’ve had our share of disagreements on policy, but as next door neighbors on the first floor of the Russell Senate Office Building, we’ve taken advantage of our proximity and our unique ability to work together and reach a bipartisan, bicameral deal to reauthorize and improve our federal workforce development systems for the first time in almost two decades. The Workforce Innovation and Opportunity Act (WIOA), which recently passed the Senate, is the product of years of work and months of bicameral discussions with six of our colleagues, Republicans and Democrats from both the House and Senate. The bill, which now heads to the House, and hopefully soon after, to the president’s desk, will bring our federal workforce development and job training systems into the 21st century at a time when our economy needs it most. Each year, federal workforce development programs serve roughly 20 million Americans, one in eight men and women of working age, but in 2014, we’re still training those workers with programs written in the 1990s. That’s no way to prepare someone for a job with Boeing in Washington state or Siemens in Georgia. So our legislation doubles down on the federal workforce development programs that work and improves or eliminates programs that have become outdated. It creates a federal workforce development system

that’s more nimble, better aligned with the modern needs of new businesses, and more accountable, so we can continue to make it better in the future. Neither of us got everything we wanted in this bill — nobody did — but we all knew that our workforce programs, which have been due for reauthorization for more than a decade, simply needed to be improved. So, we rolled up our sleeves and got to work. Here in the Senate, we worked across the aisle to pass a reauthorization bill through the HELP Committee, and in the House, our colleagues crafted a version of their own. Then, we honored an old Congressional tradition that is too rarely used these days, and we met in the middle. Since then, a long and diverse list of businesses, labor, and workforce development leaders, as well as governors and mayors, community colleges and economic developers from around the country have voiced their strong support for the bill. And that wide-ranging support further solidifies what the two of us have known all along: that federal workforce development programs are critical for workers, for businesses, and the economy. Each of us has heard from hundreds of businesses in our home states, from video game design firms in Washington state to shipping and maritime companies in Georgia, who desperately want to hire workers with high-tech skills and expertise for 21st

century jobs. And each of us has met with workers from places like Tacoma and Savannah, Ga., who have been laid off and need new training, new skills, and new jobs to support their families. So as it heads to the House, we will be urging our colleagues across the Capitol to support this bill and continue making critical investments in American workers. We were proud to work together, break through the gridlock and push this bipartisan, bicameral bill through Congress. But our work together won’t end when this bill is signed into law. We still plan to walk over to each other’s offices, talk about where can find common ground, and work together to build on this bipartisan deal and continue helping workers, businesses, and the economy.

Wanton disregard for piece and quiet The Fourth of July, a time to celebrate the foundation of our nation, family and summer. I love the Fourth, it’s one of my grandsons’ birthdays. I live on Education Hill. What I don’t like about the Fourth is the wanton disregard for peace and quiet in what would normally be a nice quiet neighborhood. What possesses people to set off loud fireworks when they know full well and good that it is illegal to do so, that it disturbs the peace, that it drives many pets into an anxious frenzy, thus

stressing out not just the pets but their owners as well? The police department does its best, but the odds are overwhelming against them in patrolling our streets to keep them peaceful on the evening of the Fourth. As pet owners, we know it’s coming but we are at a loss to figure out a way to handle the stress of our pets under the constant barrage of explosions in and around our neighborhood, it sounds like a war zone. We sedate them, we close the windows, we turn up the music and try to comfort them as best we can. I know it’s traditional to set off firecrackers and other noise

makers on the Fourth, but seriously, do we still need to keep up this tradition? There are many community fireworks displays around our area. Go enjoy those displays instead of trying to create your own in your backyard or the front of your house. As I’ve gotten older I now see the less-than-innocent harm this craziness causes our pets. My wife and I even put our dogs in our car and drove around looking for a location where we could let them out where they would not be bombarded with the noise of explosions. We drove down to Redmond Town Center, could still hear explosions, drove to

Marymoor Park, could still hear boom, boom, boom. No escape. No, it’s not the end of the world. Yes, it only lasts a few hours, but it is harmful to our pets and the peace and sanctity of our neighborhoods. Oh, and did I mention....illegal?

Srivastava, a former Microsoft senior program manager who was 36 at the time, was charged with second-degree rape on July 31, 2013 in King County Superior Court. The alleged crime took place at about 11 p.m. on July 22, 2013 in Srivastava’s office in Building 27. According to charging documents, he invited a janitor into his office, fondled her breasts and buttocks, prevented her from escaping and raped her. He placed his condom in the trash and took the bin with him as he left his office. The then 33-year-old janitor informed her onsite supervisor of the incident, but he didn’t believe her and didn’t alert police, documents state. Another supervisor eventually contacted the Redmond Police Department (RPD) about the rape on July 24, 2013. An RPD detective met with the janitor on July 25 and showed her six photos, one of which was of Srivastava, according to documents. When she saw his photo, the janitor said, “That’s him, that’s the man

that raped me.” The detective added that the woman had visible bruises on both shoulders that appeared consistent with finger pressure. The woman said that she received the injuries during her struggle with Srivastava. When the detective met with Srivastava on July 26,

he said the janitor forced him to have sex, according to documents. “We are glad that justice has prevailed in the end, yet nothing can reverse the harm that Mr. Srivastava suffered,” Maybrown said. “We only hope that this will never happen to any other person in the future.”

Redmond Road, will focus on trench rescue. In addition to the five cities in EMTG, fire departments from Bothell, Shoreline and Woodinville will also be participating in the training exercise. Redmond Fire Department (RFD) Battalion Chief Ralph Ashmore said the training is part of annual refreshers they do to maintain the skills required for various types of calls. He added that when a call comes in, the units closest to the emergency respond — regardless of jurisdiction. Because of this, Ashmore said having everyone train together is important so they are familiar with each other’s equipment and techniques. “It just makes the calls so much better,” he said. Ashmore added that no single department is big enough to tackle such a call on its own without compromising service in other areas of its jurisdiction.

REAL-LIFE SITUATIONS The drills the fire departments have been running have been about an hour and a half long, but Mercer Island Fire Department Battalion Chief Les Kenworthy said a real-life situation can take up to three or four hours. This is because in a real trench rescue, there may be other

factors that may lead first responders to choose to wait before extracting a trapped individual. In addition, the drills have had between 20-25 first responders working the rescue. In an actual rescue, the initial response team would consist of about 20 first responders. The fire crews with their apparatuses will be conducting training exercises at the site from 9 a.m. to 4 p.m. several days per week, through July 24. Apparatuses include ladder trucks, rescue trucks, fire engines, aid cars and medic units. For safety reasons, the site is closed to non-fire department personnel without a prearranged escort.

This month’s training exercise specifically prepares firefighters for incidents involving trenches created in regional roadways and on construction sites to install underground utilities such as water and sewer piping, natural gas pipelines or electrical wiring. RFD Capt. Don Sanderson said technical rescues such as these are about critical and creative thinking and require the battalion chief in charge, as well as the rest of the first responders, to think about the big picture. The region’s fire departments have been holding these exercises for several years — long before EMTG was formed — but Sanderson remembers responding to a call in the mid to late 1990s in which part of a dirt wall caved in, trapping a construction worker, before he received any specialized training. The 2013 Redmond Transportation Master Plan (TMP) was recognized by Gov. Jay Inslee with a Smart Vision Award, as an example of how a community’s vision can be translated into action. The TMP is the document that guides Redmond’s transportation investments and activities over the next 18 years and builds on years of public outreach and planning development. Central to Redmond’s vision is the development of two regional growth centers, downtown and Overlake, into thriving, mixed-use, pedestrianfriendly places that will absorb most of the additional 23,000 residents and 40,000 jobs expected to arrive by 2030. The TMP identifies transportation investments to provide strong support for both urban centers while creating connections in neighborhoods. As a key planning tool, the TMP identifies the resources and strategies needed to accommodate that growth. “The city’s transportation plan ensures that all growth-related transportation investments contribute to bicycle, pedestrian, light rail infrastructure and transit service. These efforts involve staff from multiple city departments and I’m pleased their hard work has been recognized,” said City of Redmond Mayor John Marchione.

The restoration project is still in the planning phase and the City of Redmond is still seeking resident input to see which areas in the basin have drainage or other issues that would benefit most from the improvements. The planning process for the project is funded by a state grant and it will still be about a year before any construction will be done. Hitch said the city will be looking into additional grants to help fund the project in addition to dollars from the city’s capital improvements budget. The City of Redmond is in the very early stages of restoring the Tosh Creek Basin to improve the area’s water quality and ability to support wildlife. In addition, the project’s goal is to improve stormwater infrastructure. Covering about 200 acres just southwest of Marymoor Park, the basin is a combination of residential and commercial development. Steve Hitch, the City of Redmond project manager for the restoration, said it is all of this development that has led them to making plans for improvements. He said before development, when the land was still forested 100 years ago, the natural environment would do its job in filtering and controlling the flow of the water. But with development, stormwater runoff just sits on the pavement,

collecting whatever oils and pollutants are on the surface before returning to streams and other waterways. Hitch said the goal of the restoration project is to make Tosh Creek, an urban stream, think there is a forest surrounding it by building projects that will help with flow control, stormwater treatment and infiltration. With flow control, he said the city could possibly build a storage pond or vault to capture and store water and release it slowly back into the stream, which cuts down on erosion that would be caused if the water was released all at once. Hitch likened it to using a fire hose for your yard. He said treatment facilities would capture any pollutants in the water before it is released and infiltration projects, such as rain gardens, would capture and remove water so the area is

Courtesy Photo It all started one quiet Saturday morning in January, when Tobin Sudo, 9, and his sister Mie started folding paper boats for fun. When their father saw that they had folded an impressive pile of 400-plus boats, he looked up the Guinness World Record for origami boats and found that, at the time, it was a little over 4,000 boats. He said under his breath, “Oh, that looks doable.” Tobin overheard this and that’s how it all started. The world-record attempt recently took place at Horace Mann Elementary school as part of the annual Art Night Festival, coordinated by chair Annie Savage. Tobin and his

family only had about three hours to set up 20,000-plus origami boats in the school library before the Guinnessapproved counters, Jane Wither (Redmond Arts and Culture Commission) and Jordan Swain (Redmond High School art teacher) showed up. The task seemed impossible, but the school community pitched in to help. In fact, with the teachers’ and students’ help, setup completed early so some of them even started to fold additional origami boats to add to the count. Prior to the attempt, the world record for “Largest Display of Origami Boats” was 16,343. The confirmed origami boat count on May 30 was 23,689.

With the excellent weather we have been receiving, Marymoor Park was cooled down with the breezy sounds of Steely Dan this past weekend. Originating members Donald Fagen and Walter Becker, along with their 11-piece band, played both Saturday and Sunday nights as part of their Jamalot Ever After Tour. Sunday night’s attendance was filled with a more varying age than one might expect. There were plenty of concert goers who have perhaps been fans of Steely Dan since the release of their first album back in 1972. But there was also a handful of fans from the younger generation who appreciated the jazz stylings that are

unique to Steely Dan. The night kicked off with opener Bobby Broom, a jazz guitarist from Harlem. The first two songs of the four-song opener were inspired renditions of “Superstition” and “Layla,” better known by Stevie Wonder and Eric Clapton, respectively. Broom’s unique take on these classics paved the way for the anticipated night to come. The crowd was met with the 11-piece band, which included a four-piece horn section and three backup singers called the Danettes, starting the headlining set with a jazzy instrumental intro. Fagen and Becker then made their entrance onto the stage to meet the enthusiastic crowd. They begin with classics “Bodhisattva,”

“Aja,” and “Hey Nineteen.” They followed up with songs such as “Rikki Don’t Lose That Number,” “Dirtywork,” “Babylon Sisters” and “Josie,” familiar tunes that even the casual fan could sing along to. By the end of the night, concert goers were on their feet, arms in the air, dancing along. The night came to a close with “Kid Charlemagne” and a jazzy instrumental outro that would bring the show around full circle from the beginning. The seasoned veterans brought us a great show that left us looking forward to the next time we might see Steely Dan again. Mary Lou Larsen was raised in Redmond on Avondale Road. Her entire school career was spent at Redmond’s red brick school house.There she made many lifetime friends. She graduated as a proud member of the class of 1943. Throughout her lifetime she remained a proud supporter of her school and attended many of the alumni events. In 1946 she married William Mack. They had four children. She also helped to raise numerous foster children. With time she became a very proud grandmother and great grandmother. She and Bill retired to Whidby Island. They remained married 63 years till Bill’s death. Shortly after his death she moved to Seattle. She died peacefully on June 20, 2014. A memorial bench is being installed in her name.
