A citizens’ group that filed a lawsuit in 2013 has filed an additional action to force the Navy to stop flying the EA-18G Growlers over Coupeville. The Citizen’s of Ebey’s Reserve, or COER, filed a motion Monday in Federal

Court asking a judge to rule that the aircraft be forced to stop using Outlying Field Coupeville until the Navy completes an Environmental Impact Statement. “The EIS isn’t going to be done until 2017,” said COER board member and attorney Ken Pickard Tuesday. “We’re being irreparably injured every time they

fly. We’re not going to wait.” The Navy cannot comment on ongoing litigation, said Mike Welding, the base’s public information officer. The Motion for Preliminary Injunction was filed in the United States District Court, Western District in Seattle. While

Coupeville levy handily passes in Tuesday vote By MEGAN HANSEN Staff reporter

The Coupeville School District’s capital facilities levy was passing with a strong lead Tuesday night, much to the delight of district officials. The first count showed that 55 percent of voters cast ballots in favor of the $5-million levy. The next count will be Wednesday. Some board members and district staff were present at the elections office for the initial count. “We’re so grateful,” said school board member Chic Merwin. “We so love our Coupeville supporters.” The Island County Auditor’s Office sent out more than 7,200 ballots with 3,400 turned in for the initial count Tuesday, landing voter turnout at about 47 percent. The $5-million levy will be collected over three years and will be used to complete capital improvement projects within the school district. Projects are planned in three phases and include replacing the middle school roof, replacing heating and ventilation systems in the elementary and middle school and making needed repairs to the district’s aging athletic infrastructure.

First Miss Oak Harbor to be crowned Saturday By DEBRA VAUGHN Staff reporter

Nine young women are vying for the title of Miss Oak Harbor at a pageant, set for 6:30 p.m. Saturday at the Oak Harbor High School Student Union Building. The inaugural event will include classic pageant activities, including a choreographed dance number and an on-stage interview. But whatever you do, don’t call it a beauty pageant.

This is a scholarship competition that judges local young women on attributes such as community involvement, grades and physical fitness, said organizer Jes Walker-Wyse. “Sometimes pageants are a hard sell because there are so many misconceptions,” she said. “This is something I’m passionate about.” In one portion of the pageant, the girls do move SEE PAGEANT, A5

Fatal fire started with cord The April 13 house fire that claimed the life of Whidbey Island activist Wendy Campbell Strang DeWinter was sparked by an overloaded extension cord plugged into a oil-filled heater, fire investigators concluded. DeWinter perished and a man was injured in the earlymorning fire at her home in the Dugualla Bay Heights neighborhood of North Whidbey. Overloaded extension cords are a common cause of fires in all kinds of homes, said Mike Brown, deputy chief of North Whidbey Fire and Rescue.

PR firm owner arrested for child rape

In DeWinter’s home, items including newspapers and cardboard were stacked over the extension cord. Brown said that while the proliferation of such combustible items on DeWinter’s property didn’t necessarily cause the fire, it probably contributed to the speed and heat. The U.S. Consumer Product Safety Commission reports that overheating of extension cords is usually caused by overloading or connecting appliances that consume more wattage than the cord can handle. “Extension cords should only be used temporarily,” the commissioner reports. “Protect young children by keeping them away from extension cords and unplugging the cords when not in use.” DeWinter was remembered as an intrepid activist, a pet rescue advocate and a gifted photographer.

Jonathan Sage turned himself in Monday By JESSIE STENSLAND Staff reporter

A Langley man who ran a public relations firm on South Whidbey turned himself in Monday after being charged with several sex crimes. Prosecutors charged Jonathan S. Sage, 32, in Island County Superior Court April 13 with four counts of rape of a child in the second degree. Sage is accused of raping two boys numerous times in 2010 and 2013, when the victims were 12 to 13 years old, according to Island County court documents. In March 2014, Detective Ricky Felici, with the Island County

Sheriff’s Office, met with the two boys after they had disclosed to their father what had allegedly occurred, according to Felici’s report. The boys Jonathan Sage now live in another county The boys reported that abuse started after they drank alcohol with Sage and that the assaults occurred regularly for years, Felici said in his report. The boys’ father confronted Sage, who allegedly asked him not to report the matter to police and “promised that the family would not hear from him anymore.” After the alleged victims came forward, Felici and patrol deputies

attempted to contact Sage several times, but his residence looked vacant and his business appeared to be shut down, the report said. A judge set bail for Sage at $125,000 on April 13. The sheriff’s office posted his photo and information about him on Facebook Monday. Sage turned himself in at the south precinct a little over an hour after the information was posted. Sage owned a company called Northwest Public Relations, which created promotional videos for businesses and nonprofit organizations, among them Whidbey Animals’ Improvement Foundation and Whidbey and Camano Islands Tourism. If convicted on the charges filed against him, Sage face up to 23 years in prison under the standard sentencing range.

COER members said they are concerned about homes, businesses and organizations that lie in the flight path of OLF Coupeville. “While the Navy will assert that FCLP training at the OLF is in the public interest, invoking national security, the use of Ault Field serves the public interest far better than use of OLF Coupeville,” according to the motion. “Use of OLF Coupeville compromises the visual and auditory integrity of a national historic reserve and the tranquility and safety of an entire community with homes, schools, parks, and important public and private facilities, including a hospital, local government, law enforcement and commercial development.” While the Navy is always looking to balance real-life training with simulation

RESIDENTS CAN log a complaint with the Navy via phone or email. From there, Gaber says, each communication is entered into a database so the Navy can track trends and follow up on anything that appears unusual. In most cases, complaints can be correlated with known operations, Gaber said. A common complaint is that aircraft are flying too low in areas they shouldn’t. Gaber said pilots who fly at unauthorized altitudes or in locations would be reprimanded. “There’s very little for making it up as you go,” Gaber said. “It doesn’t happen here. If we had a pilot that was breaking the rules, that would be very bad for him.” Air traffic control monitors all operations as well, Gaber said. If the Navy receives complaints that an aircraft is flying too low or in an unusual location, they go back and review recorded radar readings. GABER SAID the Navy received 825 complaints in 2013 made by 289 individual callers and 797 calls made by 283 individuals during 2014. “What you will see is that a lot of callers are calling more than once,” Gaber said. Approximately 145 of those calls came from one person in 2014. “There’s a handful of frequent callers,” Gaber said.

and other locations, ceasing use of OLF is “unrealistic,” said Butch Bailey, former Wing 10 commander and president of the local Navy League. “From a national security standpoint, right now that has to be done,” Bailey said. “OLF is uniquely set up in order to provide that kind of training.” Bailey said that, during his command during Desert Storm, the Navy exceeded 30,000 operations annually at OLF but has since brought that number down to 6,120 annually in 2005. The Navy exceeded this operational cap in 2011-13, however. “The Navy has been a good partner and a good citizen over the years, and the idea that the Navy would go away and not use Coupeville, it’s unrealistic,” Bailey said. In a press release Monday, COER responded to Navy “personnel and retirees who have frequently called those affected citizens unpatriotic.” “It’s quite the opposite,” Pickard said. “We all care deeply.” In recent years, COER has expanded its original mission to close OLF and has stated its larger goal is to get the Growler removed from the Pacific Northwest. Pickard said Monday’s motion was simply one of many fronts on which the group

In those cases, they still log the call but are less likely to follow up unless specifically asked. “In all cases, the highest leadership has got eyeballs on the process and who’s calling about the noise,” Gaber said. In some cases, there are instances where the aircraft has to make an emergency maneuver or needs to change its route according to weather. “There’s always a reason people hear noise,” Gaber said. “We don’t call everyone back, but we try to find the ones that seem to be something different.” IN SOME instances, the noise doesn’t come from the Navy at all, Gaber said. There have been times when a noise complaint has come in and the runway was closed. In those cases, Gaber said it could be a private airplane, a commercial aircraft or a Canadian military operation. Both the Navy and

is fighting. “We think the Growler is a very poor fit for Northwest Washington,” Pickard said. “It’s one of the many things we’re doing. And it’s a major one. It’s what got our group started.” In its motion, COER claims the jet noise is damaging the physical and mental health of those working and living under the flight path. The anti-noise group has also collected a number of first-person “declarations” on its website from people who describe the jets’ effects. “We are extremely disappointed with our elected officials who won’t speak out on behalf of those they purport to represent,” said COER board member Maryon Attwood. “Congressman Rick Larsen, who takes credit for bringing the Growlers to Whidbey Island, supports the Navy’s use of the OLF even though he admits to never having heard the Growler noise experienced by the community.” Navy Admiral Bill Gortney, in his official capacity as the commander, Fleet Forces Command, and Commander Mike Nortier, in his official capacity as commander of Whidbey Island Naval Air Station, are identified as defendants in the lawsuit.

Congressman Rick Larsen expressed their desire to somehow decrease the impacts of jet noise on the area’s residents. Installation of a “hush house” was kicked around, but it would only partially mitigate the on-ground engine “run-ups” and wouldn’t impact the in-air noise, Navy officials said. The majority of complaints are in reference to in-air operations, Gaber said. DURING A recent town hall meeting, Larsen mentioned the possibility of installing chevrons on the engines to decrease the noise. But testing conducted by the Navy found that chevrons are costly and wear out, according “Currents Magazine,” published by the Navy’s department of Energy, Environment and Climate Change. The most recent change requires that pilots keep landing gear retracted during touch-and-go operations at Ault Field until they are away from the San Juans and

over water. “If there are potential mitigations, we’ll look at that,” said Mike Welding, public affairs officer for the base. “It takes time, but we don’t ignore it.” CITING A lack of trust for the Navy’s public input hotline, the anti-noise group Citizens of Ebey’s Reserve created its own complaint hotline in January 2014. COER representatives said they would track complaints and forward them to the Navy. “We have had approximately 460 calls since we set it up a little over a year ago,” said COER spokesperson Cate Andrews. “I have personally called back each person who asked, and I have heard a tremendous amount of anger, sadness and shock at the fact that this is allowed to happen.” According to COER’s count, Andrews said, 70 percent of the complaints come from Coupeville residents, with the rest peppered through the San Juans

Customers get acquainted with new shop Whidbey Coffee’s remodeled store gets warm welcome downtown By RON NEWBERRY Staff reporter

Even on her day off, Hilary Gardner-Carpenter couldn’t stay away. Gardner-Carpenter, manager of Whidbey Coffee’s newly remodeled Pioneer Way store in Oak Harbor, kept texting her assistant manager about how the second day of business was going Sunday then couldn’t resist the temptation to stop by and see for herself. “I definitely have an emotional attachment to the store,” she said. “This is my baby.” Few can appreciate the store’s transformation better than Gardner-Carpenter, who’s managed the store on Pioneer Way for nearly eight years. What was once a drive-thru and place for company storage is now a contemporary coffee shop with indoor and outdoor seating and lots of windows allowing unobstructed views of the water and marina. The remodel was a long time coming, owner Dan Ollis conceded, getting the store on

After beginning construction in December, the historic downtown store opened Saturday just in time for the city’s Holland Happening festival. It wasn’t until about late Friday afternoon that the digging finally stopped and the City of Oak Harbor issued Whidbey Coffee a temporary occupancy permit. The store opened the next morning, and it wasn’t long until a line of customers

and seemed in no rush to leave as they sat underneath an umbrella. The store features 16 outdoor seats and 65 in all, many with views of the water, Cascades and Oak Harbor Marina. “I enjoy the sunshine,”

Whitehead said. “I’m very happy to be in a place like this. You can see the view.” The drive-thru will continue to be a part of the remodeled store. Store hours are 6 a.m. to 8 p.m. every day except Sunday, which is open 6:30 a.m. to 6 p.m. “It is a culmination of my 26 years in the business,” Ollis said. “I’m so excited and so proud of this. It’s the last one in our entire system that needed to be updated. Of course, every one of our buildings needed a little bit here and there, but this one needed the most. “If you look at the transformation, what a difference. It’s just so exciting to be down there on the waterfront and hopefully setting a new tone for Pioneer Way. It’s really cool.”

www.pageantwyse.org Walker-Wyse said she wanted to organize a pageant in Oak Harbor because pageants were an important of what shaped her into a successful adult. She didn’t have many opportunities in the town where she was raised, she said. She never held a major title, but the experience boosted her self-esteem and confidence. “I had to get a business to sponsor me,” she said. “The moment I got my sponsor to say, ‘yes’ I thought, ‘Here is someone who believes in me.’ ” Today, Walker-Wyse is a branch manager at Peoples Bank and serves as a City of Oak Harbor planning commissioner. The pageant is a nonprofit. Among the judges is Kenzi Novell, Miss Washington 2015. Tickets are available at the door for $10.

Teachers’ rally scheduled at Windjammer Park By DEBRA VAUGHN Staff reporter

The public is invited to attend a rally organized by the Oak Harbor Public School teachers’ union 10 a.m. Friday at the Windjammer Park gazebo. Teachers plan to picket throughout the day and write and call state legislators. At the rally, speakers will talk about highstakes testing, class size and cost-of-living increases for teachers and educational support staff. Organizers also plan a food drive for North Whidbey Help House and ask those attending to bring a nonperishable food item to donate. Teachers voted to walk out of class for one day, part of a statewide movement organized by teacher unions meant to send a message

to lawmakers. Members of the local teachers’ union, the Oak Harbor Education Association, have lobbied lawmakers through meetings, phone calls and letters to no avail, said association president Kathy Ridle. “Those methods have not made a difference, so it is time to try something more drastic,” Ridle said. Classes are cancelled Friday for all schools in the district. After-school athletic practices for middle and high school students are cancelled. High school sports events and evening extracurricular activities will be held as usual. The missed school day will be made up May 26.

Fund is critical to preserving ‘treasures,’ including the Reserve For nearly 50 years, the federal Land and Water Conservation Fund has invested nearly $17 billion nationwide and $500 million in Washington in state and federal land conservation projects and matching grants for state and local parks, trails, recreational facilities, and to support working forests and family farms. Among the projects that the fund could aid in Washington state next year would be preservation of 165 acres of historic farmland at Ebey’s Landing on Whidbey Island through the use of conservation easements. Ebey’s Landing National Historical Reserve has protected both public land with stunning vistas and private farmland that has been in working production since the 1850s. No taxpayer ever paid a dime into this fund. Each year the conservation fund receives about $900 million from a portion of the fees collected from offshore oil-drilling operations, but, over the years, some of that funding was diverted by Congress for uses other than the act’s language intended. Loss of this funding should be corrected, but the fund itself faces a questionable future, judging by recent symbolic votes in Congress. In late March, the U.S. Senate voted 51-49 on an amendment to a nonbinding budget resolution that would allow for the transfer to the states of federal public lands, with the exception of national parks and monuments. Those public lands, including national forests, wildlife refuges, historical areas and wilderness areas, could then be auctioned off by each state as its current legislature and governor saw fit. It’s not hard to imagine a situation in which a state, strapped for cash, would seek to sell off lands once owned by all Americans. The budget amendment isn’t likely to become law anytime soon, but it followed a similar vote, again nonbinding, in the House, 228-119, to turn over public lands to state and local governments to allow “increased resource production.” In both votes, Republicans heavily carried the majorities. In seeking to turn over public lands to private companies, the votes in the House and Senate ignore the economic benefit, not to mention the lands’ intrinsic value, that national forests and public lands already provide to the nation through timber and other resource production and recreation. Legislation was proposed in the House to reauthorize the Land and Water Conservation Fund, which would otherwise expire at the end of September. The House bill incorporates language in legislation sponsored by Washington state Sen. Maria Cantwell that was approved by a Senate majority in January. What’s significant is that among the House bill’s original cosponsors is 8th District Republican Rep. Dave Reichert, who, in signing onto the legislation, said the conservation fund has “played a pivotal role in preserving America’s national treasures for future generations. “In Washington alone, it has helped to conserve the natural beauty of the Pacific Crest Trail, Mount Rainier National Park, SEE FUND, A7

Teachers will never be satisfied with pay Editor, The Oak Harbor School District teachers’ walkout on May 1 coincides with International Workers’ Day, a holiday to celebrate workers by the Socialists and Communists. A few years ago, OHSD teachers adorned red T-shirts and publicly embraced on their Facebook page the clenched raised fist symbol for autonomism, a set of left-wing political and social movements and theories close to the Socialist movement. Class size reduction is a well-used disingenuous meme the educationists push every decade or so, but no serious long-term permanent action is ever taken to reduce class sizes. Teachers’ unions have been fighting any and all standardized testing since 1983 when the “A Nation at Risk” report came out, starting the current era of so-called K-12 educational “reform.” While teachers protest the states’ alleged lack of increasing support to K-12 for their benefits, they also collectively bargain behind closed doors

for increasingly expensive local supplementary salary contracts, drawing dollars away from local discretionary revenue derived from excess local property tax levies and Federal Impact Aid. However, no amount of money will ever satisfy the teachers’ union militancy. We currently spend, in the OHSD, almost $65 million (all funds), just shy of $12K per FTE student. Local supplementary union contracts perennially place about $2 million (about 12 percent of teachers’ total compensation) directly into teachers’ pockets, taking that local discretionary money away from classrooms. The OHSD teachers union’s own website delineates that, “In 2015/2016, the District will increase its contribution to the health care retirement carve-out to cover 100 percent of the amount.” William Burnett Oak Harbor

Response was hostile and unnecessary Editor, I believe that every American has the right to his or her own opinion.

However, their opinions are not facts. I’ve been doing research, looking for facts about jet noise. COER posted a public meeting advertising this: “The medical and scientific evidence is clear and undisputed: Noise damages health and well-being. Military jet noise is particularly harmful. A lot of misinformation is floating around on this issue. Attend this meeting and get the facts for yourself. COER is sponsoring this informational meeting. A presentation with visuals and information derived from health and noise experts will be followed by a questionand-answer period.” COER always gives its opinion but offers no facts. I wanted to attend their pubic meeting to find out the facts behind their anger. I was recently at Congressman Rick Larsen’s hometown meeting in Coupeville, and I was appalled at COER’s disruptive behavior as you can hear on the COER video. The COER temper tantrums are worse than a 3-year-old’s. I was shocked to see adults act like this in public. I asked for more information about the meeting. Also, I’ve researched COER members’ property values as well above $350,000. However, your newspaper wrote on April 22, “This seller’s market is particularly evident in the $200,000 and less homes coveted by first-time homebuyers and military personnel.” This affirms my belief COER has anti-Navy greed. Dike

Dismayed by the state of Dugualla flats Editor, First, I want to say I dislike writing letters, but I can no longer remain silent. I am dismayed by what is happening to the dike and meadow north of Oak Harbor. To those of you who are unaware of the dike, when you drive north on State Highway 20, you see the fruit stand at Dugualla Flats. If you look to the east, you see a beautiful meadow used for grazing cattle and growing blueberries and other crops. It includes a lovely fresh-water pond where ducks and swans spend their lives. Years ago, some very enterprising people built the dike to reclaim the land from the ocean. It was to be used for farming. Now, some people want to tear down the

Here’s what was happening in the news this week:

100 years ago

n M. Fakkema, one of the best known and most respected citizens, passed away at his country home Friday, April 23, after a short illness, the primary cause of which was paralysis. Deceased was aged 59 years. He was born in the Netherlands and came to this country when quite a young man. He came to Oak Harbor 19 years ago. The remains were laid to rest in Maple Leaf Cemetery. n In the estimation of the News, tomorrow (May 1, 1915) would be the most eventful day in the history of Oak Harbor. It would decide the question of incorporation — whether our people were progressive as a majority or whether they desired to remain a nonentity among the enterprising towns and cities of Northwest Washington.

75 years ago

n Fire from an overheated stove did serious damage to the kitchen in the home of Mr. and Mrs. Bert Roodzant. n Six persons were fined $10 and costs of $2 and 50 cents in Justice Gilbert S. Olsen’s court. The men were caught by the game protector digging clams just east of Coupeville. When apprehended, the culprits had six sacks of clams, considerably more than the legal limit.

50 years ago

n It was announced that Oak Harbor’s John Vanderzicht would be the national director and Washington state president of the Navy League. He and three other Oak Harbor men attended a national Navy League Convention in Washington, D.C. n According to Hospital Commissioner Ted Christenson, there was complete ambulance service available, but Police Chief Fred Murcray reported that the ambulance was available for emergency use only. A new ambulance was purchased, but there was no driver available because Homer Bakker, the driver for seven months, left for an ambulance job on South Whidbey.

n An internal Pentagon memorandum signed by a high-ranking Navy official recommended Lemoore Naval Air Station (California) as the future site for the Navy’s top secret A-12 bomber over the Whidbey Island Naval Air Station. NAS Whidbey had been the unofficial choice by the Navy for the A-12 since 1987. The A-12 was scheduled to replace the aging Vietnam-era A-6E attack bomber then currently stationed at NAS Whidbey starting in the mid-1990s. n Strapped with financial woes and binding investigations, Tennex Industries faced permanent closure, but Tennex advocates were pleading for more time to resolve problems. Lack of funds forced Tennex to close its doors and lay off its staff of five in December 1989, prompting a financial audit into the problems that led to the organization’s demise. Tennex was also the subject of a criminal investigation by the Island County Sheriff’s Department for alleged misappropriation of public funds. Tennex industries was a private, nonprofit organization that had contracted with the county for years as a sheltered workshop for developmentally disabled adults.

I noticed the other day as I drove over the dike that the pond is getting larger and larger. Flooding already started? Come on, Oak Harbor and Island County, can’t we stop this? I faintly heard years ago that someone was thinking of this but heard nothing more until two months ago. What about the people who farm there? What about the delicious blueberries we’ve been eating all these years? What about the house built on the same level? What about the cattle grazing and raising their young? Remember a few years back Ala Spit? Again, some enterprising people with foresight placed large rocks on the east side. They held back the ocean, just a little, but made a lovely place to walk, go clamming, walk the dog, build beach forts or just enjoy a time with nature. I’m not certain, but I think it’s these same people who wanted to make Ala Spit back to the way it was and help the salmon. Well, they destroyed it. Its just a pile of dirt, and it’s unsafe. Are we going to let them do the same on Dugualla Flats?

Daisy Louise Ness

Daisy Louise Ness, age 88, of Oak Harbor, passed away at Harbor Tower Village Tuesday, April 21, 2015. Mrs. Ness was born in Bremerton Nov. 5, 1926, to Adolphus and Florence (Moore) Nelson. She was raised in the nearby community of Crosby and attended Silverdale schools. In 1944, Daisy married Gerald Grothaus, and the couple resided in Federal Way, where they raised their family. Daisy was a home care nurse for many years and also worked at her husband’s pharmacy,

Jerry’s Drug, in Federal Way. Gerald Grothaus died July 3, 1971. Daisy later married Irvin Ness, and the couple lived in Auburn. He preceded her in death in 1989. Daisy moved to Oak Harbor in 2013 and became a resident of Harbor Tower Village, where she immersed herself in the many social activities offered to residents. Daisy was a volunteer at Sea-Tac Airport Traveler’s Aid. While in Auburn, she was active in Respite Care at the Auburn Senior Activity Center. She had been a member of White River Presbyterian Church in Auburn, Steel Lake Presbyterian Church in Federal Way and Grace Community Church in Auburn. Daisy is survived by her six children, Jackie Ralph of Sandy, Utah, Patricia Mack and husband Tim of Freeland, Dennis Grothaus of Spokane, Phillip Grothaus and wife Kathy of Taylorsville, Utah, Debbie Armstrong and husband Darrell of Oak Harbor, and Terri Roedell and husband Randy of Bellingham; near-

Hazel Earnest Hazel I. Earnest, 91, of Kansas City, Mo., formerly of Oak Harbor, Wash., passed away April 23, 2015. She was

born July 11, 1923, in Sapulpa, Okla., to George B. and Esta M. (Crossman) Doty. She graduated from Sapulpa High School and received her degree as a registered nurse from the Queen of Angels School of Nursing in Los Angeles. Following nursing school, she met her future husband, Burt Earnest. They were married in 1948 and later divorced in 1970. Hazel spent the majority of her working years at Whidbey General Hospital in Coupeville, Wash. She was preceded in death by her parents and nine siblings. Survivors include her two sons, Steven Earnest of Kansas City, Mo., and Ronald Earnest (Jeanne) of SedroWoolley, Wash.; four grandchildren, Joshua, Daniel, John and Anna; and three great-grandchildren. Per Hazel’s request, cremation will take place and her ashes will be returned to Oak Harbor. Memorial contributions are suggested to the favorite charity of the donor’s choice. The future bride graduated from Central Regional High School, Bayville, in the spring of 2011. In June 2013, the couple relocated to the Seattle area, where he is enrolled in the Everett Community College Fire Science program with a view toward a career as a fire fighter/paramedicemergency medical technician, and she is employed at Evergreen Veterinary Hospital as a receptionist/ veterinary assistant. An intimate wedding with immediate family is planned for late summer 2015, in Freeland, Wash., with informal receptions being planned for later in the year for West and East coast extended family and friends.

He would have placed higher up the record chart but missed one game as a junior because of an injury, and Oak Harbor played two fewer games this past fall than most seasons when a Canadian team backed out of a game and Oak Harbor did not play the day of the Marysville-Pilchuck shootings.

At the moment, Oak Harbor High School senior Dejon Devroe is focused on running 400 meters. In the future, his goal, he hopes, will change to rushing for 100 yards per game. Devroe currently owns the fastest 3A 400-meter time in the state this season, 49.46 seconds. His goal is to stay on top, all the way through the state finals. In the process, he would like to break the long-standing Oak Harbor High School record in the event, 48.7 seconds, set in 1971 by David Garrison. He is obviously an elite Washington high school track athlete, but his passion is football, and it is on that field that he would like to compete collegiately. There is one problem, though. Schools have shown little interest in recruiting him. The knock against Devroe is his size – 5-feet, 10 inches, 155 pounds. Several small colleges have inquired about Devroe competing for their track teams, and more are likely to come calling as the league, district and state awards pile up. If track is a means to help him earn a college degree, he is willing to go that route. First, however, he would like to give football a try.

Talent is there

Prep school next He will attend the Atlanta Sports Academy, a prep school, next year to enhance his college football opportunities. Devroe went to middle school in Georgia, and one of his former coaches helped him secure a spot in the Academy. While colleges have been slow to acknowledge Devroe’s football talents, it didn’t take long for the Oak Harbor coaches to see his abilities. Devroe was a four-year starter on the football team, a rare occurrence at a school the size of OHHS. He also lettered in track his freshman year, placing in four events in the league championship meet. Devroe moved to Florida the second semester of his sophomore year and didn’t compete in track for Oak Harbor that spring.

Football, however, is his first love, and he would like to play the sport in college, but schools are showing minimal interest. Although he isn’t from a military family, he has moved seven times while growing up. The final move was when his mother, Lynette, brought the family back to Oak Harbor, her hometown,

Oak Harbor High School football coach Jay Turner said Devroe is a true football player, not just a sprinter wearing a helmet. “He always did a great job of waiting for his blocks to develop, and then when he needed to turn on the jets he could to burst through the hole,” Turner said. “He also possesses a lot of balance, which makes it tough to bring him down with one tackler.” Turner said that the colleges “are missing something” by not recruiting Devroe. “Dejon is a special athlete with some amazing natural abilities,” Turner said. “But what makes me most impressed with him is his relentless desire to get better. He is one of the hardest workers that I have coached. The guy is never satisfied and is always trying to improve and make himself better. Without a doubt, Dejon can play college football.” Devroe said his current goals, the 400-meter school record and state title, are achievable because of the help of his teammates. “We compete and we push each other to get better and better and better,” he said. “I learned a lesson from my brother (Devante), to be one of the best, you have to work against the best.” He is also getting help improving his football stock from Oak Harbor High School graduate Rodrick Rumble, who went on to be a record-setting receiver at Idaho State University, and Terrance Booker, a member of his church. “Rodrick told me you have to keep pushing and pushing

because there will not always be someone there to push you.” Rumble is helping Devroe improve his football and track skills through weight training and agility drills.

Leans on faith Devroe, whose grandparents David and Linda Jenkins, are pastors of the Living Faith Christian Center, looks to his faith to help him through the frustrating recruiting process. “I put my faith in God that it will all work out in the end,” he said. “You may not get looks, so you have to look beyond that. As long as you put in the hard work -– if you do your best –- God will reveal your path to you.”

46th Holland Happening draws good weather, crowds

Festivals in April are always a gamble when it comes to Whidbey Island weather. So when the clouds opened and raindrops came down on Oak Harbor Saturday morning, it appeared that it might rain all over Holland Happening’s parade. But about 10 minutes before the parade started, the rain stopped, temperatures started to rise and it turned out to be a rather glorious, sun-filled weekend for Oak Harbor’s celebration of its Dutch heritage. Christine Cribb, executive director of the Oak Harbor Chamber of Commerce, which organizes the event, said she never doubted it would turn out to be anything different. “We all knew the weather forecast,” Cribb said. “We knew it was going to pass over.” The 46th running of Holland Happening drew about 8,000 people, according to counts taken at the street fair by organizers. Cribb said the estimate didn’t include carnival attendance, and some people told her that number seemed conservative. After Saturday’s parade, the street fair along Pioneer Way was jam-packed with people who perused the booths that lined the street and got a taste of freshdipped corn dogs, Dutch des-

serts and a wide assortment of ethnic dishes. Some local businesses also benefitted. Kay Coolidge, owner of Popsies, said she couldn’t remember a better day of business than Saturday in her 10 years of running the store during Holland Happening. “This was our biggest year,” she said. “We lucked out with the weather, didn’t we? We’ve seen it not so good.” The event commenced with Friday night’s carnival and the Dutch Dinner, provided by Oak Harbor High School’s advanced culinary arts students who cooked up authentic Dutch dishes. “The Dutch Dinner went just beautifully,” said Jan Ellis, a former longtime Holland Happening entertainment chairperson whose ancestry is Dutch. “The food was excellent. They got it all right.” Ellis, Safeway, Thrive Fitness and Ronnie Wright of Pacific Grace Tax and Accounting were the biggest of a large field of generous event sponsors from the community, Cribb said. She also pointed to the efforts of 60 volunteers and City of Oak Harbor staff. “Equally important as the chamber is in planning and promoting this event, the city employees jump through hoops to make this happen,” Cribb said. “I’m sincerely pleased but am looking forward to the Fourth of July.”

the contract indemnifies Drummond against any lawsuit that the county prosecutor may file against her. Vickie Churchill and Alan Hancock, the county’s Superior Court judges, approved the contract for special attorney services in a letter that addressed and brushed aside concerns raised by Prosecutor Greg Banks. They wrote that his objection — and threat of a lawsuit — are puzzling. “Such special counsel will actually aid his own office in carrying out its duties,”

the letter said, “and is being appointed because, among other things, the prosecutor is apparently unwilling or unable to provide some of the legal advice and services that the board is requesting, and has every right to request.” Banks asked the commissioners not to hire the outside attorney, laying out two general concerns about the contract. He argued that hiring outside counsel over the objection of the prosecutor is unconstitutional. He contends that the action

amounts to hiring someone else to do the job of an elected official, which is contrary to the state constitution. The commissioners, he said, are relying an a statute — RCW 36.32.200 — which he believes is unconstitutional, but untested in court. “Prosecutors around the state are really interested in the issue,” he said. Also, Banks said his office is capable of and has been preparing to work on the comprehensive plan update. He said he has two

talented land-use attorneys on staff and that the outside expenditure is a waste of taxpayer money. He criticized the commissioners for quietly squirreling away hundreds of thousands for the comprehensive plan update while denying his office a “modest increase” in moving a half-time paralegal to full time. Then the commissioners asserted that his office was under-resourced as a justification for not hiring outside counsel, he said. Deputy Prosecutor Chris Anderson, head of the deputy prosecutor’s union, said that the members also aren’t happy with the hiring of outside counsel. He said the action basically amounts to hiring someone to do their job. Anderson said the union is exploring its options, which may include filing a grievance. “Ideally, it would result in the work coming back to the office,” he said. Price Johnson said one of the reasons she sought outside legal help is that Banks told the board that he can’t give them “strategic legal advice.” The judges also criticized Banks for refusing to provide strategic advise to the board. “This is troubling,” the judges wrote, “because at their best, legal services represent, figuratively speaking, not only the ambulance providing services to someone who has fallen off a cliff, but also the guardrail preventing someone from falling off the cliff in the first place.”

Banks said its simply not the case that he’s not willing to provide strategic advice. In a meeting with the commissioners, he questioned what “strategic advice” means and asked what the commissioners want from his office that they are not getting; the issue was not resolved. He also said it was puzzling to him that the judges were relying on “the commissioners’ false claims” about his office. Price Johnson said this week that the hiring of Drummond should be seen as an opportunity. “I will continue to reach out to Greg Banks,” she said, “and hope he will work collaboratively with the commissioners to achieve the best possible outcome for the community.” Banks previously said he may file a lawsuit against Drummond if the contract is approved. Banks said more recently he hasn’t decided what he’ll do, but he hasn’t ruled that out. If he does sue, the county will pay Drummond’s legal fees because the commissioners indemnified her in the contract. There is a chance, he said, that the case could end up in the Supreme Court in order to settle the constitutionality of RCW 36.32.200. In their letter, the judges opined that they believe a court of competent jurisdiction would find the statute constitutional, but Banks is not so sure. “At least we would get a final answer,” he said, “one way or the other.”

The Washington State Auditor’s Office dinged the Oak Harbor School District for not having adequate “internal controls” for tracking its employees in Special Education and Title I programs. The school district receives federal grant money for these programs, and most of that money goes toward paying employee salary and benefits. The school district is supposed to keep track of the “time and effort” of these employees. A routine audit found that the district didn’t ensure all personnel changes were communicated to the employee responsible for collecting “time and effort” documentation. The finding amounts to a paperwork error, and the auditor did not find money was mishandled, said Kelly

Collins, who oversees the teams that perform audits. The finding is a “significant deficiency” because if the problem isn’t corrected, the district risks losing funding in the future. “This could jeopardize teacher funding if they don’t get a handle on it now,” Collins said. The state auditors use two terms to describe findings — significant or material. “Significant” is the less serious of the two. In the 2014 fiscal year, the district spent $1,191,870 in federal money on its Special Education program and $872,093 for Title I. In a statement to the auditor, the district writes that it recognizes “certain paperwork was not filed.” In response, the district has implemented changes to better obtain and track documentation for these employees.
