Archdiocese to potentially add names to list of sexual abusers following Reporter story REPORTER STAFF
A week after the Reporter and community members revealed that a list of Seattle-area priests who had sexually abused children failed to include employees of the Archdiocese of Seattle who had been accused of the same
crime and the organization had paid out settlements on, the organization said they will review the list and determine if more names need to be added. “We will continue to review the list to determine if additional information or names should be
included,” the archdiocese said in a statement. They also encouraged anyone with information about sexual abuse by a member of the clergy, employee or a volunteer to come forward. The archdiocese had released the list with the aim of transparency, with
spokesperson Greg Magnoni telling the Reporter that it is an ongoing effort. The initial list released by the archdiocese included 77 priests from the Seattle and other archdioceses. Three of the people on the list worked in Kirkland. However, both
community members and the Reporter identified alleged abusers who were not named on the list. Also absent from the list was a former youth minister named Jim Funnell who allegedly molested a child in the mid-1980s for more than a year while serving at St.
John Vianney Church in Kirkland. A lawsuit filed by the victim was settled out of court by the parish district in 2012. For the last 13 years, the archdiocese has run background checks and conducts training programs for their 5,000 [ more ABUSE page 3 ]

has amassed more than 1,000 signatures on its petition and garnered hundreds of comments from supporters, believe that any rapid transit on the CKC, along with the Eastside Rail Corridor, is the wrong approach to solving traffic congestion. “We understand Sound Transit has an easement on the Trail for transit purposes,” the letter reads, “but we want you to know of our opposition to any plan which puts mass transit on the Trail because of concerns with high cost and inefficiency, lack of demand, construction challenges and safety issues revealed by the city’s plan, and environmental issues.” The letter states that the operating costs per rider for the rapid transit projects on the CKC are twice as much as all the other candidate projects and lacks specificity as to how they would work and operate, as the CKC cuts through several intersections, as well as concerns over the sound and safety of such a system. In its letter, the city stipulated that “only vehicles that are quiet and have zero or ultra-low emissions, such as electric vehicles, can operate on the CKC.” Environmental concerns were also brought up in the letter, warning that construction “would invite costly legal challenges based on SEPA and other violations, and require a complex, costly and lengthy Environmental Impact Statement.” “It is our duty as stewards of the environment to preserve green open spaces where possible and to avoid costly, unwanted,
Lake Washington School District is seeking potential authors for the Voter’s Pamphlet statements opposing the Lake Washington School District bond measure that will appear on the April 26, 2016, ballot. Election regulations require Lake Washington School District to solicit members to “pro” and “con” committees who want to write statements for the local voters’ pamphlet. Since there is an organized promotional campaign committee, the Lake Washington Citizens Levy Committee, the district has asked that organization to name the three individuals
who will serve on the “pro” committee. The district is soliciting members for the “con” committee for the voter’s pamphlet. If you would like the district to consider you for appointment to the committee that will be asked to write a statement in opposition, please email your name, mailing address, phone number, and email address to Diane Jenkins, djenkins@ lwsd.org, by Feb. 15. The district expects the School Board will take final action to name the committees officially, assuming volunteers step forward, on Feb. 22. Complete information on the bond measure, including all projects, is available on the district website at www. lwsd.org.
projects whose hallmark is miles of one hundred feet wide paving,” the letter reads further. Another aspect of ST3 that has raised eyebrows is the total bill - roughly between $747 million and $3 billion. “We are concerned with the prospect of already high property taxes going higher, making it less affordable to live in Kirkland or the Eastside,” the letter reads. “It will be much more difficult for families to make ends meet. For a city our size, we do not see how Sound Transit can justify asking voters to fund a project that costs $74.7 million per mile to build.” Placing BRT on I-405 instead, the letter states, would be a “win-win” if it had a station on Northeast 85th Street at the center of I-405 and added bus lines
were included. “Working with Metro to increase transit service on existing routes would alleviate surface street congestion. We do not feel the City Council gave these options due consideration, so we are asking your members to do so going forward,” the letter reads. “What we envision for the Trail is to be a part of a world class green mode of transportation to connect to the current system of non-motorized trails. The cost would be minimal and the benefits to the communities and the Evergreen state would be priceless.” The Cross Kirkland Corridor Masterplan envisions rapid transit alongside the trail, though it does not specify what kind of mode or call for any specific action on the part of the city. Citing examples in Europe, the consultants also told the council at the meeting that it would be feasible to have buses pass through intersections every five minutes or so without disrupting traffic. The lone vote against the council’s decision on the Sound Transit was Councilmember Toby Nixon, who has referred to light rail as “19th Century technology.” He has advocated the idea of personal rapid transit (PRT), which uses smaller, driverless vehicles operating on guideways.

Daniels proposal for seminary is last, best hope We wholeheartedly agree with Seattle Times reporter Lynn Thompson who, in her Aug. 23 article, stated, “The proposal from Kevin Daniels… may be the last, best hope to preserve the [Saint Edward Seminary].” Mike Siegel’s photos on the Times website show much of what any party is up against with this particular restoration project. A brief history of how we got to this point can be found on the Daniels Development Company website: “Completed in 1931, the Saint Edward Seminary building is a significant historic and iconic structure that was listed on the National Register of Historic Places in 2007. Dedicated to Saint Edward the Confessor and located in the city of Kenmore, Saint Edward Seminary operated for 46-years before closing in 1976. Closed for 39-years (almost as long as open) the aging Seminary building has been in a state of disrepair with repairs estimated in the tens of millions. With an experienced team in historic restoration, Daniels Real Estate has proposed a plan to reuse the building as a ‘great lodge,’ allowing more public access than ever before while preserving the solitude of the 316 acre state park that surrounds it.” In her article, Lynn Thompson continues, “Under the proposal by Daniels Real Estate, all but about eight acres of the grounds immediately surrounding the seminary building would remain a state park. In exchange for the building, Daniels would buy almost 10 acres of adjacent, undeveloped Lake Washington waterfront and deed it to the park.” The Daniels firm is the one that beautifully restored Seattle’s King Street Station. As citizens of Kenmore and people who deeply care about Saint
Edward Park, we have come to the same conclusion as the Seattle Times Editorial Board, “The seminary must not be allowed to end up like countless other historic treasures regrettably shuttered or torn down. Instead, it should be renovated into the vibrant, majestic structure it deserves to be.” We would be foolish to let this opportunity pass us by. There will be no other.

Stop running PSE advertisements Stop being a traitor to the community by running advertisements for PSE. Energize Eastside Project is primarily a money making scheme. Way don’t you publish that? It’s a regressive engineering concept and a foreign owned project forcing ‘growth projections’ already negated by traffic woes. But it’s strange how PSE does not care to construct a transparent rational argument to justify its method as opposed to alternative methods. The argument flows between profit for investors in Australia, power for Canada and demand for energy in a future time that transportation woes will not support. But once one tower is put up people will be shocked at the monstrosity. Like in northern California, one tower goes up people will rise up and stop it. Moreover, the project will fell 8,000 trees we need for the heavy traffic we have now. Many of these trees are hundreds of years old, massive filters vital to clean air. And we need these trees to protect us from the new onslaught of pollution from China coming over in the jet stream. Trees are going too fast. Over 300,000 acres of trees burnt last summer in Washington State. I flew to Hong Kong one week ago and traveled over land up through BC, Alaska
and down through Siberia and China. It was daylight the whole time and I had a window seat. It was shocking to see the logging and absence of trees. Energize Eastside Project is extortion and will stain the company and all associated with it for an indefinite period of time. PSE does not entertain sophisticated technological solutions, they think like Bolsheviks when it comes to alternatives. This power line will look hideous and make the skyline of Bellevue look industrial, total dystopia. Bellevue was named the number two city to live in America by the Wall Street Journal. It truly is the city in a park. One must really understand how special this area is by going to other areas in the world and then one is shocked by our oasis. Anyone associated with this project will be ugly for life. Energize Eastside is a traitor to our community. It’s surprising that a multinational can push such bad engineering and technology forward in a sophisticated technological hub. This must be stopped. Thank you for your kind attention.

City approves eminent domain for potential Fire Station development BY TJ MARTINELL tmartinell@kirklandreporter.com
T
he Kirkland City Council approved a resolution authorizing the use of eminent domain to acquire four properties adjacent to the proposed site for the new Fire Station 24, though the city may not have to actually use it. At the council’s Jan. 19 meeting, the council approved the measure as part of their ongoing efforts to obtain land next to the site where they hope to build the new Station 24. The city is looking to
improve fire services in the Finn Hill neighborhood, where the 2012 Fire Strategic Plan found a gap in response times. They concluded that the consolidation of Stations 24 and 25 as originally conceived was no longer feasible and that a dual-station model is “the most reasonable and cost-effective way to accomplish the goals of the Interlocal Agreement.” The new duel-station model, based on recommendations from a 2013 standard of cov-
erage study, would renovate Station 25 while building a new fire station somewhere in the general vicinity of Northeast 132nd Street and 100th Avenue Northeast to replace Station 24. At the moment, Station 24 no longer has any fire staff and has ceased operations. Despite the approval of eminent domain, city officials told the council that negotiations with the property owners has been mostly amenable. However, some of the own-
ers are hoping to use the property sale as part of a tax deferred exchanged in the Internal Revenue Code, which it would be eligible for if it were sold under the threat of eminent domain. “It appears that none of the property owners are philosophically opposed to the City’s acquisition of their property through eminent domain,” a city memo states. City officials stated that if they initiated eminent domain proceedings it would up to the courts to decide if it fell under a legitimate public use, they believe it meets those requirements.
“It’s in our view clearly a public purpose and hopefully that we won’t need to exercise it,” City Attorney Robin Jenkinson said. Deputy City Manager Marilynne Beard told the council that she and Fire Chief Joe Sanford have met with residents living around the proposed site to discuss the ramifications of the fire station. In October, the council approved two resolutions concerning its interlocal agreement with the now-defunct Fire District 41 which covered unincorporated neighborhoods such as Finn
Hill. The resolutions clarified the intent of the interlocal agreement and called for $3.8 million of the fire district funds to go toward Station 25’s renovation, which would include repairs, fire alarm and fire sprinkler installations, fire separation walls and accessibility improvements, among other things. The remaining $1.4 million would be used to purchase property for the new Station 24 site. The city is authorized under RCW 8.12 to condemn land and property or its acquisition for projects deemed to be in the public’s interest.

Receiver calls for Potala Village site to be sold; project moves forward Although the receiver handling Potala Village has called for selling the Kirkland-based project, along with others owned by an Everett-based developer accused by fraud, it continues to move forward with the city’s design review board process. Lobsang Dargey, Potala’s owner, is being sued in federal court by the SEC for allegedly raising more than $125 million through sales of securities to at least 250

Between Jan. 22-28, there were 166 traffic incidents, 22 traffic accidents, four DUIs, 29 general traffic incidents, 33 alarm calls, eight abandoned vehicles, four burglaries, eight incidents of fraud, eight civil incidents, six cases of harassment, 10 thefts, vehicle prowls, seven vehicle thefts, five warrants served, six noise complaints, one animal call, eight incidents of domestic violence, six incidents of malicious mischief, nine disturbances, three assaults, three

After filing the lawsuit in August, SEC filed a motion to appoint a receiver over Potala Village Kirkland and other LLCs owned by Dargey, to “ensure that their remaining assets are not dissipated or unnecessarily subject to loss in value during the pendency of this litigation.” The SEC complaint alleges that Dargey and Path America used the EB-5 system, which allows foreign nationals who invest at least
$500,000 in a project that generates or preserves at least 10 jobs for U.S. workers to qualify for residency in the United States, to raise money from Chinese investors by encouraging them to invest in Potala Place and Potala Tower. However, instead he allegedly misappropriated $17.6 million, $14.7 million involving Potala Shoreline LLC and Potala Village Kirkland LLC, which are not eligible for the EB-5 visa program. Jan. 26 Warrant: 1:16 a.m., 12600 block of 120th Ave NE. A 26-year-old man was contacted loitering around a closed business. A check on him returned with an outstanding felony warrant for drug offenses and making false statements, with bail amount at $6,500. He also had another warrant with bail at $7,500. He was arrested and transported to the King County Jail without incident. Warrant: 12 a.m., 10000 block of NE 137th A 33-year-old man was contacted at the Juanita Safeway and found to have multiple warrants out of Kirkland, Redmond and Bellevue. He was arrested and booked on

changing the design of the driveway to make it closer to Lake Street. “That requires considerable design change and it’s just a lot of work on their part,” she said. “They’re trying to figure it if they’ll have everything done by that meeting.”
Jan. 23 Disorderly conduct: 11:52 a.m., 300 block of Kirkland Ave. A 30-year-old man was arrested for disorderly conduct after he was reported by numerous people, the Heathman hotel staff and library staff that he was acting aggressive toward people and chasing them with broken bottles. When police contacted him, he was extremely confrontational. Upon being placed in the patrol vehicle he began spitting and thrashing about violently. He ended up cutting his forehead open and bleeding throughout the back of the patrol vehicle. Med-Tech responded and cleaned out the vehicle. He was transported to SCORE Jail by corrections.

Battle over seminary building heating up, meeting in Kenmore planned Tensions ran high at a Parks and Recreation Commission meeting at Edmonds Community College Jan. 28, where dozens of people came to voice their opinions on the seminary rehabilitation. “Change. interest last year in restoring the building and turning it into a publicly accessible lodge, similar to those found at Yellowstone or Rainier National Parks. A deadline for submissions was extended to September of this year, to allow Daniels to submit a fleshed-out proposal on what he would do with the building. In doing so, a land swap was proposed, whereby the state would trade around five acres, which the seminary sits on, for nearly 10 acres of undeveloped land along the park’s northern boundary. But this proposal has rubbed many people the wrong way, especially many neighbors of the park and
environmental activists. David Stokes, an ecologist at the University of Washington Bothell, said the park’s most valuable resource is the natural environment. The high attendance rates, he said, showed people care not for the seminary, but for the well-preserved forestland and grounds. In separate phone interviews, concerned citizens also voiced their concerns. “We want to protect that legacy for our kids, we don’t want to give away our public park and turn it into a private hotel just to enrich the privileged,” said Kenmore resident Joe Marshall. “The land’s got to remain public, the buildings must remain dedicated

It also provides for the regulation and disclosure of political contributions and spending. Washington State’s Public Disclosure Commission regulates campaign-financing limits, including contributions, for state and local candidates and initiatives. The state Elections Division completed a random sample of the 333,040 signatures submitted by sponsors, confirming that there were sufficient signatures. Secretary of State Kim Wyman certified Initiative to the Legislature 735 yesterday. The measure seeks to put Washington on record as favoring an amendment to the U.S. Constitution overturning the Supreme Court’s Citizens United ruling. The initiative’s preamble states: “This act declares that the people of Washington State support amending The Constitution of the United States to eliminate the undue influence of concentrated money and political power on elections and governmental policy.” The amendment would overturn decisions by the Supreme Court of the 288410_5_x_6.1.indd 1

to park use or nonprofit use.” Either partially restoring the building for public use, he said, or letting the building continue to deteriorate and stand as an open air monument would be ideal. This idea doesn’t sit well with Kenmore Mayor David Baker. “I would hate to see that building fall down,” he said. “I think it’s an historic building, it is a national landmark, and I’d like to see it preserved.” Though he said he would need to see the Daniels’ proposal before coming to a decision, a feeling Kenmore resident Anita Merrill shared at the meeting. “I am concerned that we are talking about the property exchange issues like putting the cart before the horse,” she said. Bastyr University, which is also located in Saint Edward State Park, supports the Daniels bid. “We’ll all be better off to preserve this historic landmark than to demolish it, or wall it up behind a fence,” university Chief of Staff Coquina Deger said at the Jan. 28 meeting. “Every interaction we had with (Daniels) and his staff was of the utmost quality.” A State Parks meeting will be held on Feb. 9 at Kenmore City Hall, where Daniels Real Estate will discuss the land exchange and design proposal, as well as provide an opportunity for a public hearing.
rejection rate for Washington ballot measures in recent decades, Wyman’s office reported. I-735 now goes to the House and Senate, where lawmakers may approve it, ignore or reject it and let it go to the fall ballot, or place it and a legislative alternative side-byside on the ballot. The attorney general’s formal title states the measure would urge the Washington state congressional delegation to propose a federal constitutional amendment that constitutional rights belong only to individuals, not corporations, and constitutionallyprotected free speech excludes the spending of money.

And the stated purpose of increasing density - all this “in filling was to slow development in surrounding areas. And it failed. Total fail. It hasn’t slowed sprawl one little bit. What it has done is severed the connection we had with nature in our special location at the top of the lake. Kenmore has a lakefront and the slough. And it has a very special park, a unique park, Saint Edward. A small oasis away from houses and traffic and stores. And you want to plunk a hotel into its center. Stop guys, you are stabbing its heart.

this park, this unique park, for a bit of fresh air, to see the kingfishers, to hear the thrush calls, to walk among the trees, to walk down to the lake and hear the water lapping against the shore and watch the ducks and the clouds. One would think people who work for parks would understand this better than most. I’m so sick at heart to see so many large single family lots here in Kenmore that held deer, Douglas squirrels and little Mountain Beavers razed flat, then several large houses built on them. Those backyards have been habitat for decades. Full of little critters left homeless, who get attacked by cats and dogs then squashed flat by cars. The tall trees are felled, and there are less birds, less squirrels. They really miss the mulberry, cherry and walnut trees that were next door until last summer. No more little flocks of quail running by, no more band tail pigeons flopping about in the tall trees, far fewer woodpeckers and ducks. There was even an osprey nest one street over. Coy-
When all the backyards are filled in with houses, the park will be our backyard. We will need the park more than ever. We will need it without a hotel, and without parking spaces for more cars and preferably without lights on at night. Some people like to gaze at the stars now and then. I like the seminary building. And I like it silent and dark at night. The McDonald 10 acres are already a habitat. We will trade the center of our park for that ten acres then probably develop it in some way. That will be a loss of two more areas for animals. No net gain for nature there! People and nature don’t mix well. I vote for nature.
