The process of estate planning should be tailored to the circumstances in each individual’s situation. Usually, estate planning includes the creation of a will, setting up powers of attorney, limiting estate taxes by setting up trust accounts in the name of beneficiaries, appointing a guardian for living dependents and pets, appointing an executor of the estate to oversee the terms of the will, making funeral arrangements and establishing annual gifts to reduce the taxable estate. What brings you joy? Where do you spend your time? If asked, most people would probably love to continue to support the things they care deeply about far into the future. Yet many feel their capacity to contribute is too insignificant to bother — they don’t realize what a difference their gift could make. However, a bequest or other legacy gift can be the single largest gift most people ever make. Peggy finally became a first-time homeowner when she moved to Port Townsend in the early 2000s and met her future husband, Joe Ryan, while volunteering at the Port Townsend Marine Science Center. When Peggy passed away in 2018, less than a year after Joe’s death, she left a legacy for the two organizations that meant the most to her. Peggy and Joe’s generous bequests are serving as cornerstone gifts for the Marine Science Center and Habitat for Humanity of East Jefferson County, as both organizations work to expand their programs to serve future generations. With Peggy’s final and most significant gifts, she supported the causes that brought her joy during her life and addressed her deepest concerns.
State University Extension before she died. But that wasn’t all. For many years, Lisa had quietly loaned money to nearly a dozen low-income people so they could purchase their own homes. Although her decision to act grew from Lisa’s strong commitment to affordable housing and were an expression of her remarkable kindness, most of her friends were unaware of her gifts. In her will, Lisa left the proceeds of the remaining loans to benefit two organizations that carry out work she cared deeply about during her lifetime: the Marrowstone Island Foundation endowment, which provides emergency medical and fire services to island residents, and Habitat for Humanity.

Michael Hatch, attorney-at-law Despite the somewhat macabre nature of end-of-life planning, it is important to be well-informed and prepared long before you expect to need such plans. What is an end-of-life plan and why should you bother? Simply stated, it is a plan you put in place for finalizing your affairs in the case of your death. A thorough plan enables your loved ones to grieve during your last illness and after your ultimate death. By completing the appropriate arrangements beforehand, you may spare your family and friends from dealing with lawyers and courtrooms during your final days. Although there is not a standard end-of-life plan that everyone uses, there are a couple details you should include in whatever preparations you make. Here are some documents to start with, along with explanations of why they’re useful.
It is merely a document that grants to another authority to represent you in dealing with banks, creditors, landlords and the legion of others you regularly interact with. The power of attorney can be as limited or as broad as you wish — limited to permitting another to buy a single loaf of bread for you or so broad that the authorized person is empowered to perform any act you could perform. Its breadth, term of effectivity and the trigger that makes it active is strictly up to you.

Property ownership To implement the “perfect” end-oflife plan mentioned above (avoiding lawyers and courtrooms), several other documents can be used to simplify matters for your loved ones after your death. A community property agreement enables a surviving spouse or domestic partner to avoid probate and simply re-title or re-register property in their name. Similarly, real estate owned by a married couple or a domestic partnership as “joint tenants with a right of survivorship,” automatically transfers ownership to the survivor following the spouse or partner’s death. Also, Washington permits the filing of a transfer-on-death deed with the county where the land is situated. As its name implies, title to the land is automatically transferred upon the death to the person designated on the deed.

The Veteran’s Administration operates national cemeteries throughout the country (with the exception of Arlington National Cemetery in Virginia, which is operated by the U.S. Army). There are zero fees for a veteran to use a national cemetery, but it is not “free.” National cemeteries are considered monuments, and veterans earn the right to become part of them. In doing so, they also secure that same right to their spouse, minor children and adult dependent children, even if they pass on before the Veteran. Washington Veterans are served by Tahoma National Cemetery in Kent. “Tahoma” is a Native American word for Mount Rainier, which is visible from the cemetery. While other types of cemeteries may have sections dedicated to Veterans, only National Cemeteries are at no cost to the family. The number of certified death certificates a person needs varies. Think of it as your final business document. It allows your next of kin to cash out insurance policies, close accounts and transfer property. Always ask what discounts a funeral home offers. Our funeral home extends the discounted cremation price (even if no prepayment is made) to all of our patients of Volunteer Hospice of
Clallam County and Assured Hospice of Clallam and Jefferson counties. The reason for this discount is simple: the nurses at both hospices take care of duties that reduce our work load. They gather the necessary information to complete the death certificate and prepare the family by explaining what to expect in the immediate aftermath of a home death.
Evaluating funeral options All these options can be very confusing, especially since the average person makes funeral or cremation arrangements only a couple times in his or her life. Historically, funeral homes have taken advantage of this. In 1984, the Federal Trade Commission (FTC) enacted what it called its Funeral Rule. While any government regulation brings on costs that are passed along to the consumer, it did have important benefits for consumers who are looking at the costs associated with burial and cremation. The language used on those price lists is standardized. Having uniform disclosures that inform the consumer, such as letting people know that embalming is not required by law except in special circumstances, is one example. Standardized terminology also was established so the consumer could directly compare prices for services, such as “direct cremation,” between funeral homes. The best advice I can give you is this: Be wary of multi-page price lists with “package deals” that include multiple services and offer a slight discount. Although these can simplify your selection process, you usually end up paying for things you don’t need or want. A funeral home should be able to fit their prices onto a single sheet of paper that includes all of the required FTC language that makes the selection process easier, allowing the consumer to select only the services they want. Be wary of funeral establishments that advertise their low cost of cremation and put the dollar amount on the ad. To assess the accuracy of the ad, write down the amount quoted in the ad and call the funeral home. If the business won’t stand behind its advertised number as the amount you can write on the check before coming to see them, don’t bother. The business will most likely try to convince you to “upgrade” or otherwise spend more money than you want. A sales pitch at this moment is not what you need. Clallam County has one of the highest cremation rates in the country. Over 80 percent of the families I serve want to know how much cremation will cost and have the check made out even before they meet with me. My clients let me know if they want something more than the minimum. Even after the transaction has been completed, your funeral director should take time to answer your questions and let you know what else he or she can help them with that will not affect the contracted price. A large percentage of our clients do not attend a church regularly and need assistance in planning a celebration of life or memorial service, but they don’t always want to use our chapel.
