FIELD ARTS & EVENTS HALL

WAYS TO GIVE

• Cash, Credit Card, Check: Outright gift

• Multi-Year Pledge: Leverage your giving over time • Highly Appreciated Stock: Added advantage of avoiding capital gains

Field Arts & Events Hall at the Port Angeles Waterfront Center was first envisioned by the late Donna Morris. Ms. Morris left in her estate plans $9 million directed specifically for the design, construction, and ongoing operation of a performing arts center. Field Hall is a 501(c)3 tax exempt nonprofit corporation established to accept her gift and fulfill her wish. Young and old, many people find great comfort in knowing that their legacy will live on for generations to come through the impact of a gift through estate planning. Field Hall is a unique opportunity to support your community by honoring our mission for many years to come. Our mission is simply to be “A home for arts and events that brings people together and strengthens our community.”

• IRA: If you are 701⁄2 years old or older, you can make a gift directly from your IRA

The process of estate planning should be tailored to the circumstances in each individual’s situation. Usually, estate planning includes the creation of a will, setting up powers of attorney, limiting estate taxes by setting up trust accounts in the name of beneficiaries, appointing a guardian for living dependents and pets, appointing an executor of the estate to oversee the terms of the will, making funeral arrangements and establishing annual gifts to reduce the taxable estate. While all these things are important aspects of planning for the end of one’s life, it also is important to not overlook the sentimental things, such as writing letters to people you care about — ultimately, possessions and all the worldly items people value are insignificant compared to cherished memories and loving thoughts. Boost your ability to give back By Jamie Maciejewski, Habitat for Humanity You can continue to make an impact on what matters most to you, even after you’re gone. What is your passion? What brings you joy? Where do you spend your time? If asked, most people would probably love to continue to support the things they care deeply about far into the future. Yet many feel their capacity to contribute is too insignificant to bother — they don’t realize what a difference their gift could make. However, a bequest or other legacy gift can be the single largest gift most people ever make. That’s because assets build up over the course of a life, such as property, life insurance and retirement accounts.

Peg gy Whyte Ryan & Joe Ryan Peggy Whyte Ryan spent most of her adult life moving from one rental home to another all across the country. She was keenly aware of her own vulnerability when landlords raised the rent or sold her home right out from under her. Because of her experience, Peggy became a strong supporter of Habitat for Humanity and its mission to provide people with access to safe, stable, affordable housing.

Peggy finally became a first-time homeowner when she moved to Port Townsend in the early 2000s and met her future husband, Joe Ryan, while volunteering at the Port Townsend Marine Science Center. When Peggy passed away in 2018, less than a year after Joe’s death, she left a legacy for the two organizations that meant the most to her. Peggy and Joe’s generous bequests are serving as cornerstone gifts for the Marine Science Center and Habitat for Humanity of East Jefferson County, as both organizations work to expand their programs to serve future generations. With Peggy’s final and most significant gifts, she supported the causes that brought her joy during her life and addressed her deepest concerns.

State University Extension before she died. But that wasn’t all. For many years, Lisa had quietly loaned money to nearly a dozen low-income people so they could purchase their own homes. Although her decision to act grew from Lisa’s strong commitment to affordable housing and were an expression of her remarkable kindness, most of her friends were unaware of her gifts. In her will, Lisa left the proceeds of the remaining loans to benefit two organizations that carry out work she cared deeply about during her lifetime: the Marrowstone Island Foundation endowment, which provides emergency medical and fire services to island residents, and Habitat for Humanity.

End-of-life planning guide By D. Michael Hatch, attorney-at-law Despite the somewhat macabre nature of end-of-life planning, it is important to be well-informed and prepared long before you expect to need such plans. What is an end-of-life plan and why should you bother? Simply stated, it is a plan you put in place for finalizing your affairs in the case of your death. A thorough plan enables your loved ones to grieve during your last illness and after your ultimate death. By completing the appropriate arrangements beforehand, you may spare your family and friends from dealing with lawyers and courtrooms during your final days. Although there is not a standard end-of-life plan that everyone uses, there are a couple details you should include in whatever preparations you make. Here are some documents to start with, along with explanations of why they’re useful.

It is merely a document that grants to another authority to represent you in dealing with banks, creditors, landlords and the legion of others you regularly interact with. The power of attorney can be as limited or as broad as you wish — limited to permitting another to buy a single loaf of bread for you or so broad that the authorized person is empowered to perform any act you could perform. Its breadth, term of effectivity and the trigger that makes it active is strictly up to you.

Durable power of attorney for health care Another uncomfortable reality is that during that final illness there frequently is a period of lost consciousness during which you can no longer give instructions to the medical professionals treating you. That is when a durable power of attorney for health care becomes important. It is a straightforward Durable power of attorney power of attorney that authorizes Most of us will not instantly another to make medical transition from an active life to our decisions for you. death. In most cases, there is a period A durable power of attorney of illness during which someone else for health care is often confused is needed to handle our affairs — with a Physician Orders for Lifebanking, bill paying, arranging for Sustaining Treatment (POLST) specialized medical equipment for document, which is a directive to the home and a hundred other tasks physicians, also called a living will. you will be unable to take care of in Unlike a POLST or a directive to your final illness. physicians, which merely outline The “durable power of attorney” what procedures you do or do accounts for just such a situation. not want performed, the durable

power of attorney for health care grants another authority to give instructions to medical professionals on your behalf. The durable power of attorney for health care also must identify the same person as your medical representative under the Health Insurance and Accountability Act (HIPAA) to enable treating medical professionals to share medical information that would otherwise be confidential.

Property ownership To implement the “perfect” end-oflife plan mentioned above (avoiding lawyers and courtrooms), several other documents can be used to simplify matters for your loved ones after your death. A community property agreement enables a surviving spouse or domestic partner to avoid probate and simply re-title or re-register property in their name. Similarly, real estate owned by a married couple or a domestic partnership as “joint tenants with a right of survivorship,” automatically transfers ownership to the survivor following the spouse or partner’s death. Also, Washington permits the filing of a transfer-on-death deed with the county where the land is situated. As its name implies, title to the land is automatically transferred upon the death to the person designated on the deed.

Resources Now, a warning — there are hundreds of websites offering free or low cost legal documents. Knowing which are reliable and which are not can be a daunting task. The best resources are two nonprofit groups of lawyers dedicated to providing accessible legal services for Washington residents: Columbia Legal Services (columbialegal.org) DOCUMENT

and Washington Law Help (washingtonlawhelp.org). Columbia Legal Services provides a broad range of very informative, easy-to-read brochures on topics ranging from the documents mentioned in this article to a broad range of other subjects, such as Medicaid. Washington Law Help is a wealth of legal information providing not only Elder Law information, but also

guidance on wide-ranging issues from family law, to landlord-andtenant, to debt relief. They provide the forms you will need, as well as offer checklists to help you ensure you’re using the right form and not going astray. Last, but most assuredly not least, Volunteer Hospice of Clallam County is a rich source for temporary access to medical equipment — the organization has

equipment that can be borrowed for free. The staff and volunteers at VHOCC are true angels on this planet. If they can help, they will, without asking for a single penny. D. Michael Hatch is a Washington lawyer practicing Elder Law in Port Angeles. He offers periodic workshops on end-of-life planning designed to enable the attendees to prepare their own legal documents.

Death care should not break the bank

By Douglas R. Ticknor, Drennan & Ford Funeral Home and Crematory You can arrange a basic burial for $1,740. (This does not include a casket or cemetery fees, which I will explain shortly.) My friend is a woodworker and could conceivably build his own casket — yes, you can do that. However, if he didn’t want to build his own casket, he could add our minimum casket for another $795. Even with tax, the burial cost would still be around $2,600, which includes the fees to pick up your loved Burial costs one from the place of death and bring them to the funeral home, refrigerate I answered my friends’ query by (as opposed to embalm) the body, file stating that I could perform their the death certificate, obtain a burial cremation for $1,990 (or $1,790 if permit, then transport the body in prepaid). Funeral homes often offer our minimum-cost casket (a clotha small discount like this if you are planning ahead and pre-pay for your covered plywood) to a local cemetery. cremation. Aside from the discount, it also locks in the price. FUNERAL continues on page 17 >> I recently asked a group of close friends if there was some aspect of my being a funeral director that they wanted to know more about. I was shocked when they asked, “What is available if we don’t want to spend $10,000?” If my close friends thought $10,000 was the norm, there must be others thinking the same thing. So I decided to provide an explanation of death care costs on the Olympic Peninsula.

The Veteran’s Administration operates national cemeteries throughout the country (with the exception of Arlington National Cemetery in Virginia, which is operated by the U.S. Army). There are zero fees for a veteran to use a national cemetery, but it is not “free.” National cemeteries are considered monuments, and veterans earn the right to become part of them. In doing so, they also secure that same right to their spouse, minor children and adult dependent children, even if they pass on before the Veteran. Washington Veterans are served by Tahoma National Cemetery in Kent. “Tahoma” is a Native American word for Mount Rainier, which is visible from the cemetery. While other types of cemeteries may have sections dedicated to Veterans, only National Cemeteries are at no cost to the family. For Drennan and Ford Funeral Home to transport a casket to Tahoma National Cemetery from the North Olympic Peninsula area, we add a transportation fee of $400, which brings the total burial cost to just over $3,000 — far less than the expected $10,000.

Cemeteries owned by corporations are another public option. They are usually for-profit and employ commission-based sales staff.

Additional costs So far, we’ve talked about the funeral home fees. If cremation was all my friend wanted, the cost is still $1,990 ($1,790 prepaid). The only other additional expense is the death certificate, which Washington state charges $20 per certified copy. If the deceased is a veteran and the family provides a copy of their military discharge (form DD214), they will receive one at no cost. The number of certified death certificates a person needs varies. Think of it as your final business document. It allows your next of kin to cash out insurance policies, close accounts and transfer property. Always ask what discounts a funeral home offers. Our funeral home extends the discounted cremation price (even if no prepayment is made) to all of our patients of Volunteer Hospice of

Clallam County and Assured Hospice of Clallam and Jefferson counties. The reason for this discount is simple: the nurses at both hospices take care of duties that reduce our work load. They gather the necessary information to complete the death certificate and prepare the family by explaining what to expect in the immediate aftermath of a home death.

Evaluating funeral options All these options can be very confusing, especially since the average person makes funeral or cremation arrangements only a couple times in his or her life. Historically, funeral homes have taken advantage of this. In 1984, the Federal Trade Commission (FTC) enacted what it called its Funeral Rule. While any government regulation brings on costs that are passed along to the consumer, it did have important benefits for consumers who are looking at the costs associated with burial and cremation. The language used on those price lists is standardized. Having uniform disclosures that inform the consumer, such as letting people know that embalming is not required by law except in special circumstances, is one example. Standardized terminology also was established so the consumer could directly compare prices for services, such as “direct cremation,” between funeral homes. The best advice I can give you is this: Be wary of multi-page price lists with “package deals” that include multiple services and offer a slight discount. Although these can simplify your selection process, you usually end up paying for things you don’t need or want. A funeral home should be able to fit their prices onto a single sheet of paper that includes all of the required FTC language that makes the selection process easier, allowing the consumer to select only the services they want. Be wary of funeral establishments that advertise their low cost of cremation and put the dollar amount on the ad. To assess the accuracy of the ad, write down the amount quoted in the ad and call the funeral home. If the business won’t stand behind its advertised number as the amount you can write on the check before coming to see them, don’t bother. The business will most likely try to convince you to “upgrade” or otherwise spend more money than you want. A sales pitch at this moment is not what you need. Clallam County has one of the highest cremation rates in the country. Over 80 percent of the families I serve want to know how much cremation will cost and have the check made out even before they meet with me. My clients let me know if they want something more than the minimum. Even after the transaction has been completed, your funeral director should take time to answer your questions and let you know what else he or she can help them with that will not affect the contracted price. A large percentage of our clients do not attend a church regularly and need assistance in planning a celebration of life or memorial service, but they don’t always want to use our chapel. We have many clients who ask us to help arrange backyard barbecues and informal family gatherings. FUNERAL continues on page 19 >> ESTATE PLANNING

They can offer their experience as advice, but the final decision is yours. The amount you pay should not impact your quality of service. It is OK to get a second opinion.
