ARBOR NATURE UPDATE
ArborNature Situation Update When ArborNature and the Town were unable to come to a reasonable solution following the June 2018 meeting when the Town voted down leasing a 4-acre parcel at the end of Summit Drive to ArborNature, ArborNature filed a Motion to Compel the Town to implement the original Settlement Agreement and on February 19, 2019 the Judge ruled in favor of ArborNature. At the direction of Board Present Doug Bolton, General Manager Lance Pyle and Board Task Force member Risa Prince have been working with Town officials on alternative solutions. A proposal was submitted and discussed with Town staff on March 4. Here are some the key elements of the proposal. For a full copy, click here. Mitigation Plan for ArborNature on Summit Drive 1. Town will construct a solid sound mitigation enclosure/wall designed and proven to mitigate
noise from neighboring properties. The mitigation enclosure is to be place near the source of the sound. There needs to be clear operating standards and sound monitoring plan for the Summit Road site. Also, Town will plant dense vegetation as secondary sound barriers around/near the properties (Ferguson Road, Dillon Road, et al) within 0.5 miles of the site. 2. Town will adopt DHEC Regulation 61-107.4 Solid Waste Management for all commercial indus-
trial waste processors, regardless of business size, as part of Town LMO. ArborNature must comply with all DHEC and adopted Town requirements for an industrial solid waste processing operation including feed stock size and amount of/management of processed material. 3. Town will communicate with the County and FAA on the type of business that will be operating
near the airport. Develop and codify maximum emissions parameters that will not impinge on Airport operations due to dust and debris. 4. Town will enforce LMO Sec 16-6-102 Wetland Protection for this parcel including establishment
of buffers along the perimeter to protect the adjacent wetlands from impact due to the proposed site development. 5. Town will test water runoff quality from this parcel (monthly for 10 years) which feeds into Fish
Haul Creek. Any remediation of violations of water standards shall be ArborNature’s responsibility. 6. Town will complete a comprehensive investigative report and hold a public hearing on how a
wholesale nursery operation received approval for industrial waste processing. The report must include what actions have been taken on those who have permitted the change in operations and what procedures have been implemented to ensure LMO is being fully enforced. 7. Town will revise Proposed Noise Ordinance to modify terms for Commercial waste processing
operations. Hours of operation must be restricted to 9 am to 4 pm Monday through Friday and include all activity on the site (grinding, loading/unloading, all equipment – grinder, backhoe, trucks, feedstock and byproduct management, et al). This has already passed the first reading of Town Council 8. Town will not grant access to property other than via Gateway Circle to Summit Drive. There will
never be direct access to the site from Dillon Road.

ArborNature Situation Update continued 9. Town will inspect Summit Drive road condition quarterly, and should there be road damage or
erosion caused by the additional traffic due to ArborNature’s activity, ArborNature shall be responsible for reimbursing the Town’s cost to repair this roadway. 10. Town will ensure all trucks delivering material to and removing material from the site must
comply with LMO tarping requirement. ArborNature is responsible for compliance, whether using its own or third party trucks. 11. Town will pass Ordinance prohibiting bulk off island waste from being transported onto island. 12. Town will establish due date and scope of Development Plan to be submitted by ArborNature for
the Summit property. Town will develop acceptance criteria and hold public meeting to review the Development Plan. 13. Town will complete comprehensive LMO compliance review on the Leg O’Mutton property
owned by Adam Congrove to ensure 100% compliance prior to approving the proposed zoning variance. This must include Environmental Assessment to ensure no residual contaminants exist. Town will ensure remediation plan for property defects if required is complete before granting final zoning variance. 14. Town will conduct comprehensive review of ArborNature’s and affiliated businesses’ licensing
requirements to ensure that only the licensed operations will be conducted on the Summit property. Town will conduct periodic site assessments (quarterly for a period of ten years) to ensure ArborNature is operating within its licensing and zoning parameters on the Summit property. 15. Lease and sale agreements must include assurances that all other Town Ordinances are met by
ArborNature prior to granting occupancy to the Summit Road site. Lease and sale agreements must include site remediation plan to restore site to pre-lease/pre-sale condition, including conformance with Town’s LMO standards for tree coverage on the property, should ArborNature discontinue lease or sell the site. The Town staff were receptive to researching and investigating these proposals. Lance and Risa are currently waiting on a written response from the Town to decide how to proceed to best protect the interests of the Association and our Landowners.
Bylaws Update A Task Force of Landowners has been working to update the Association Bylaws. Their work is now done and it is in the hands of the Communications Committee to prepare the documents, similar to the process used for the Covenants update vote in 2015, for a Landowner vote later this year. An explanation of proposed changes will be provided to Landowners in ample time prior to voting.

Port Royal has many great features, including wonderful beaches, amenities, historical sites, natural beauty, and wildlife. There are lovely habitat areas throughout Port Royal for nature’s creatures to live. On a daily basis Landowners witness the spectacular wildlife throughout the Plantation. In sharing our home with these creatures we all need to be respectful of the environment we live in. You may see the harmless American White Ibis poking around, or a friendly deer from time to time. However, it is essential to be on the lookout as you do your landscaping, take a walk, go to the beach or fishing, etc. for wildlife that might not be as nice as the Heron looking for fish for his next meal. Here are a few examples of wildlife that deserve respect and caution from all of us. Alligators live in the waters around the community. It is important to understand that these age-old creatures see things a little different. Small things along the pond edge may appear very appealing to a gator, so it always best to keep pets and children away from the water's edge. Also, remember it is against the law to feed or harass an alligator. According to the South Carolina Department of Natural Resources (DNR), there are many different varieties of snakes in SC and some are venomous. The Eastern Diamondback Rattlesnake, Timber Rattlesnake, Pygmy Rattlesnake, Copperhead, Coral Snake and the Cottonmouth/Water Moccasin are a few to be on the lookout for here on the Island. Recently in the Island Packet, there have been reports of coyotes on the island, and there have been unconfirmed reports that a coyote was spotted in Port Royal. In the event you encounter a threatening creature on your property, you can contact one of the local critter management companies to assist with relocation. Also, please contact Security to file a report for the Association records. If you spot something on the beach, historical areas, common property, etc., please call Security and provide as much detail as possible. It is helpful if you can send us a photo. We are lucky to share our island with many different varieties of wildlife; just keep in mind that some may be more friendly than others. It is always important to be on the lookout, respect natural habitats, and keep your pet on a leash. The leash restrictions not only protect you and other Landowners, but also protect your pet from other animals.

DwellingLIVE has a free application for both Apple IOS and Android phones. Simply search “Dwellinglive� in your application settings or App Store, look for the icon seen here and install the application. The user name and password you use for the dwellingLIVE website are the same ones you will use for the smartphone application. Once you are logged into the application, you can enter your guest and contractor passes directly from your phone. All pass and guest information will be seen by the gate officer within minutes. The application also allows you to restrict an individual from coming to your property under your account. The application is easy to use and is the best way for you to take care of your guest and contractor passes. How to Avoid a PAB Violation Recently the PAB has had to deal with several instances of Landowners doing exterior work to their homes without requesting and receiving PAB approval for these projects. Such actions are considered PAB Violations as defined in Section 3.1.4 of the PAB Guidelines and may result in administrative fines, significant mitigation and/or the required removal of the project.

PAB approval for exterior changes to your home may be necessary depending on the type of change. Review section 1.5 of the PAB guidelines to determine if PAB approval is needed. If you are not sure, please call or email me for clarification or questions. If project plans were submitted to the PAB and approved, keep in mind that any changes to those approved plans must also be reviewed and approved by the PAB before those changes can be implemented. Whether it is during construction of a new home, additions, or other construction projects, changes that are made without approval may also result in fines, mitigation, or removal and delay return of any escrow deposit you may have made. Many, but not all, contractors working in Port Royal Plantation are aware of this requirement. If there is any question, please call or email me to avoid a potentially costly violation. PAB violations can be costly and time consuming and neither the Landowner nor PAB enjoys dealing with violations. Please take the time to ensure you are following all applicable guidelines. Remember, the PAB was established in the Port Royal Plantation Covenants and the mission statement is “…. to ensure the orderly development of an aesthetically pleasing and harmonious residential community in Port Royal Plantation that preserves the natural beauty of the environmental setting, as well as the value of each property owner's investment.”

MAINTENANCE CONNECTION Scott Kunkle, Director of Maintenance
It’s that time of year when oak trees drop their leaves and litter our lawns, roads, and landscape beds. As this occurs Landowners and landscape contractors perform leaf cleanup. If the property is along a drainage ditch, pond or lagoon they often blow the leaves into these waterways instead of either mulching them or picking them up and disposing of them properly. This causes an increase in sediment buildup in the drainage ditches and blockages that prevent positive water flow. The leaves also decay and turn into nutrients, which causes more algae to grow. The following is taken from the Town of Hilton Head Island Municipal Code: Sec. 14-1-214. - Prohibition of illicit discharges. (a)
It is unlawful for any person to throw, drain, run, or otherwise discharge to any component of the town's municipal separate storm sewer system or to the waters of the state, including streets, highways, right-of-ways, or to cause, permit or suffer to be thrown, drain, run, or allow to seep or otherwise discharge into such system, any organic or inorganic matter that shall cause or tend to cause pollution or blockages to such waters, as provided for in this chapter.
If the Town’s Code Enforcement issues a summons, the fine is $1,087.50. We are requesting all Landowners that live near these drainage ditches and lagoons to please ask their landscape contractors to not blow any leaves, grass clippings, or other yard debris into these waterways. This will save time and money, while protecting our waterways. The swimming pool was recently drained because we were losing water, so we had a leak detection company do some testing and discovered water leaks around three of the lights in the pool wall. We drained it so repairs could be completed and, while we had the pool drained, we did some of our own routine maintenance. We apologize for any inconvenience that this may have caused. This year Landowners will notice new furniture on the pool deck. We are replacing all the old strap-style furniture with all new sling-style chaise lounges and chairs. The chaise lounges are a little higher and have arms on them. We also purchased new 18-inch end tables and we will be installing a few umbrellas to provide some shade over the chaise lounges and chairs. We researched many different styles and types of pool furniture and looked at what other local resorts and properties are currently using. We hope you enjoy them.

Volunteers Needed Twelve volunteers are needed to help set up and man refreshments stations. Six able-bodied volunteer runners are needed to transport soda, water and wine to beverage stations. Volunteers will work one hour shifts. OUR COMMUNITY PR PLANNING STUDY UPDATE Marshall Fletcher A Planning Study Task Force has been formed to conduct an open and transparent Landowner survey. The last survey was taken in 2010. The Task Force includes six members from the Board of Directors, other Landowners from the community and our General Manager. The survey will be designed to determine Landowner satisfaction with the present state of our Plantation as well as obtain input about needs and improvements. We will also update the community demographic information. Our first step in this process will be to solicit Landowner input for developing the survey. Our goal is to compile this information based on feedback from the following public forums:

The information gathered from these sources will enable us to develop much of the content for the survey. The survey will be distributed in early summer via online and hard copy. We will maintain ongoing communication throughout the process. Our survey results will be shared with the Board and Landowners.
OUR COMMUNITY PR Mardi Gras
BIKE SAFETY Biking is a great way to get around and keep healthy, but it’s important to be safe. Remember, bikes have to follow the same signs and rules as cars. Keep your bike in good working condition. Make sure your tires have the right amount of air, handle bars should be tight in place, chains should not be rusty and the brakes should work smoothly. Always wear a helmet. This can help prevent serious head injuries and save your life.
On March 2 we held our first event at the new Beach House, the Mardi Gras party! The Ocean Room was beautifully decorated with dramatic centerpieces of painted branches, beads, sand and lights, and each table was adorned with colorful napkins and confetti flags. Many of our guests were in the Mardi Gras mood and arrived adorned in fun costumes, beads and masks. All this, set with a scenic Oceanview backdrop, made for quite a festive gala! The capacity crowd feasted on Mardi Gras themed food and homemade Hurricane cocktails while listening to the jazz band of Gino Fanelli, featuring Port Royal’s own Tim Jackson. Thank you to all those who attended and to the volunteer committee for their hard work to make the event so successful. Stay tuned for news on future events. We are currently working with the Board and Administration to host the upcoming Port Royal Beach House Official Opening on May 5th! Whippersnappers
If there are no sidewalks or bike paths, choose wide streets. Ride on a street whose outside lane is so wide that it can easily fit a car and a bike side by side. That way a car may zoom by you and avoid hitting you even if they don’t see you. Leave at least 3 feet of distance when passing parked cars to avoid getting hit if the door opens. Choose slow streets. The slower a car is going, the more time the driver has to see you. Learn your neighborhoods. Get a mirror and use it. If it appears a car doesn’t see you, you can hop off your bike and onto the sidewalk or roadside. Don’t ride against traffic - ride with traffic in the same direction. Here’s why. Cars pulling out of driveways, parking lots and cross streets and are turning right, are not expecting traffic to be coming the wrong way. They won’t see you and could run right into you. Over 70% of car-bicycle crashes occur at driveways or other intersections. Before you enter any street or intersection, check for traffic. Make sure you can be seen while riding your bike. During the day, wear bright colors. Avoid riding at night - but if you do you should absolutely use a front headlight. Also wear reflective tape and white or light colored clothing and ride only in areas familiar to you. Stay alert at all times. Watch out for potholes, cracks, wet leaves, drainage grates or anything that could make you fall. Use special care on bridges. Golf Course Paths Reminder: Do not walk, bike, or walk your dog on Port Royal golf courses. Walking, biking, or walking your dogs on the golf courses and golf course cart paths is not permitted at any time. The courses are restricted to only those actually playing golf. Besides being prohibited, it simply isn’t safe, even in the early morning or evening. Many golfers start very early or play quite late. Your chance of being hit by an errant golf ball is very real. It is very difficult for a golfer to see casual walkers or bikers along the tree lined cart paths. Recently, there have been reports of some Landowners allowing their dogs to run off-leash on the fairways, even sometimes during normal golfing hours. This is not only unsafe but it is also is a violation of our Rules & Procedures Section F. Animal Rules and Regulations prohibit allowing a dog to be unleashed anywhere on our common property or on golf course property. Please keep your dog on the leash anytime it leaves your residence, and comply with the rules prohibiting walking, biking, or dogs on the golf courses and/or golf cart paths.

The first meeting of 2019 was held in the Beach House as a pot luck. Thirty-one members and guests attended and the event provided a great opportunity to socialize and meet new members. I am happy to announce that we have every farm plot rented for 2019! Members have been busy getting their plots in good shape for the growing season ahead. On March 20 and 23 many members weeded and cleared the common areas around their plots and there are ongoing plans to do some much-needed renovations on the wooden boxes around the individual plots. Many thanks to all who have helped at these events and at other times. It is making the overall appearance of the Farm look very professional and well cared for.
