Centre Approves Over Rs One Lakh Crore Worth Highway, Shipping Projects to TN New Delhi Port Wings News Network nion Minister of Road Transport and Highways, Shipping, Water Resources, River Development and Ganga Rejuvenation Mr Nitin Gadkari has said that the Centre has approved projects of value of more than one Lakh crore rupees for Tamil Nadu. These projects will cover the Highways, Shipping and Port and for finding a permanent solution to the irrigation and drinking water requirements of the state.

The Minister was addressing a joint press conference with Tamil Nadu Chief Minister Mr Edappadi K. Palaniswami after a review meeting of Central and State government.

Rs 40,000 CRORE WORTH ROAD, HIGHWAY PROJECTS Mr Gadkari, announced 40,000 crore rupees worth of road and Highway projects approved at the meeting held on 23 November.He outlined the proposed projects with details of the financial outlay.

Corridor budgeted at 1000 crore. He also said that Tambaram- Vandalur ,Vandalur -Guduvanchery section of the Highway will be upgraded to 8 lane Highway with a budget of 72 crores which will also solve the traffic congestion at the Tambaram -Perungalathur bridge.

Government Grants Logistics Sector “Infrastructure” Status New Delhi Port Wings News Network he Logistics Sector has been granted Infrastructure status.

The need for integrated Logistics sector development has been felt for quite some time in view of the fact that the logistics cost in India is very high compared to developed countries.

High logistics cost reduces the competitiveness of Indian goods both in domestic as well as export market.

Development of logistics would give a boost to both domestic and external demand thereby encouraging manufacturing and ‘job creation’. This will in turn be instrumental in improving country’s GDP. The inclusion of “Logistics Sector” in the Harmonized Master List of Infrastructure Subsectors was considered in the 14th Institutional Mechanism (IM) Meeting held on 10 November, 2017. It was recommended by the Institutional Mechanism and subsequently approved by the Union Finance Minister, Mr Arun Jaitley.

“Logistics Infrastructure” is included by insertion of a new item in the renamed category of ‘Transport and Logistics’, with a footnote stating that “Logistics Infrastructure” means and includes Multi-modal Logistics Park comprising Inland Container Depot (ICD) with minimum investment of

Rs. 50 crore and minimum area of 10 acre, Cold Chain Facility with minimum investment of Rs.15 crore and minimum area of 20,000 sq. ft, and/or Warehousing Facility with investment of minimum Rs. 25 crore and minimum area of 1 lakh sq ft.

Exporters Expect More From the Government on Supports

B

owing to the pressure from the exporters, the Directorate General of Foreign Trade (DGFT) had an order few days ago by which rates for incentives under the Merchandise Exports from India Scheme (MEIS) for two subsectors of Textiles Industry that is readymade garments and made ups have been enhanced from two percent to four percent of value of exports.

Though the notification will be for the period of 01 November 2017 till 30 June 2018, it has certainly initiated the much needed debate on exporters-centric policies than government-dictated ones.

The Commerce Ministry strongly believes that until issues concerning exports are addressed a mid-term review of the foreign trade policy (FTP) will be meaningless. Commerce Minister Suresh Prabhu has written to Finance Minister Arun Jaitley raising concerns and seeking quick remedies.

The five-year FTP (2015-2020) had laid down a stiff target of $900 billion of annual exports by 2020 but lack-lustre performance in the last two-and-a-half years, will compel the government to bring it down drastically.

Prabhu in that letter, which could be clearly stated as forecast, has stressed on improving usability of the scrips earned under the MEIS — the most popular incentive scheme for exporters covering more than 7,000 items — as post-GST the scrips can be used for payment of only customs duties.

This has reduced the premium on the scrips (valued at 2-5 per cent of export amount) as earlier it could be used for payment of all input taxes such as central excise duty and service tax.

The Commerce Minister proposed that the MEIS scrips should be allowed to be used for payment of GST. He also proposed that the rate of MEIS be increased from 5 per cent to 7 per cent for labour-intensive sectors such as leather, footwear, handloom, handicraft, Ayush, marine products, electronic components and the MSME sector, which suffer the most during a downturn.

However, exporters feel that the government should also incorporate the embedded tax and announce the revised ROSL and Duty Drawback rates as this lifeline support are desperately needed to bring back the exports growth and boost the confidence of garment exporters to take up fresh orders and sustain in the global business.

Industry sources said that the government should first hold discussions with the industry on duty drawbacks, take into account the actual duties paid and ‘only then work out the drawback rates’. For instance, for processed fabric, GST for the fabric is 5%. But, input tax rates are higher. So, there is accumulation of input tax credit that is not Sample refunded. This TEXT is not covered under the drawback either.

With exports falling, there is concern around debt levels. In the case of yarn, monthly exports have fallen to 90 million-100 million kg compared with 120 million kg-140 million kg seen in 2014. Though a chunk of this went to China, about 30 million kg reached markets such as Latin America. Now, exports to China are declining and ‘there is barely any export to new markets’.

Cruise Ship MV Seven Seas Voyager Visits Mormugao Port Panaji

SEVEN SEAS VOYAGER arrived at Mormugao Port on 20 November 2017 and was berthed at the cruise berth terminal on its arrival. The vessel sailed in from Mumbai Port with high end guests of different nationalities.

The officials of the GTDC, Govt of Goa, were present at the cruise berth terminal to receive the guests and they were given a warm and traditional Goan welcome. Goan folk dances, and music with a live brass band in attendance was the highlight of the pageantry at the MPT cruise terminal. The cruise ship arrived with 545 pax and a crew of 445 on board.

The cruise liner brought in high end guests from USA (208), Canada(70), UK(62), Australia (49), Germany(30), Switzerland (34) as well as from Mexico, New Zealand, Brazil, Norway, Spain and Ireland.

On disembarking, the visitors were taken for a sight- seeing tour of Goa’s famous tourists locations of churches, temples, beaches in the north and south Goa, spice gardens, Panjim city etc. The ground arrangement for sight-seeing tours was handled by M/s. ITB. Luxury coaches and tourists taxis were at the disposal of the visiting guests to take them around sight-seeing in Goa. The arrangements for sightseeing tours in and around Goa were

handled smoothly by the local tour operators without any loss of time. The Port authorities rendered all support and cooperation for smooth handling of the cruise passengers. The tour operators and other stakeholders involved in handling the cruise liners at the terminal are happy with the facilities provided by the Port.

With the smooth functioning of the pre-paid taxi counter managed by GTDC, at the cruise terminal there is no room for any complaints from the trade.

MANSA Aggrieved Over JNPT’s Restriction on Entry -Exit for Users Mumbai

Port Wings News Network ort users at the Jawaharlal Nehru Port Trust (JNPT), a leading container handling port located near Mumbai, have raised discontent over the newly introduced permit systems for entry and exit at the port with steep restrictions.

As per the circular issued by the Central Industrial Security Force (CISF) to port users, they would stop issuing temporary permits more than three times to the same individual.

Further, it is now believed that JNPT Officers have now refused to give more than two dock entry permits for longer duration per ship operator leading to undue hardship

to users, a letter addressed to the chairman of JNPT by Mumbai and Nhava Sheva Ship Agents Association (MANSA) said.

“The step taken by JNPT Officials would increase the avoidable multiplication of work and undesirable frequent contact of the Officials with the public/trade which may not be in consonance with the

There is a need for simplification and transparency,” the letter said. Globally, security at ports are maintained with alertness and vigilance through CCTV coverage and not by closing the access to port users, the letter said.

CISF in its letter had said that in view of security scenario and for better security of port property and operation, is has been decided to strictly enforce provisions of Port Facility Security Plan (PFSP) for renewal of short term passes.

Mr. Chandilya started his career with lngersoll Rand as its Business Development & Marketing Manager and rapidly rose to the position of Commercial Business Unit Manager Asia Pacific based at Shanghai and subsequently as company’s General Manager based at Kuala Lumpur.

After a successful stint of seven years at lngersoll Rand, he joined Egon Zehnder in Singapore as its Principal Management Consultant where he worked till April 2013.

From Egon Zehnder Mr. Chandilya joined AirAsia India as the Chief Executive Officer based at Bangalore and worked with AirAsia lndia from May 2013 to April 2016.

Media Report: V O Chidambaranar Port Hires SBI Caps to raise Rs 2,000 Cr Mumbai

Port Wings News Network eading business daily The Hindu Business Line as reported that the governmentowned V O Chidambaranar Port Trust (VOCPT) has hired SBI Caps Ltd to raise dollar-denominated external commercial borrowings worth Rs 2,000 crore to part-fund a ₹3,462-crore channel-deepening and breakwater construction project to help larger ships to call at the port located in Tamil Nadu’s Tuticorin district.

DREDGING TENDER “We are planning for a dollardenominated ECB of Rs 2,000 crore and the balance will be funded from our internal resources,” Mr I Jeyakumar, Chairman, V O Chidambaranar Port Trust, was quoted as saying by the daily.

“SBI Caps has been mandated to raise the dollar loan,” he said, adding that the dredging tender will be issued by end January 2018 and the breakwater construction will begin

by April 2018 after environmental clearance and the Shipping Ministry approvals. It is a project aimed at optimisation of the port’s inner harbour in which dredging and breakwater construction will be bundled together, he stated.

VOCPT will add to the growing list of state-owned ports that have or are in the process of raising dollar loans at lower rates to fund

expansion plans. Jawaharlal Nehru Port Trust (JNPT) and Kamarajar Port Ltd have separately borrowed dollar loans in the past year, while Deendayal Port Trust (formerly Kandla Port Trust) has hired SBI Caps to tap the ECB market.

INNER HARBOUR OPTIMISATION PLANS VOCPT has a water depth of 14 metres allowing ships with a draft of 12.8 metres and cargo carrying capacity of 60,000 tonnes to call.

It plans to increase the depth of the dock basin area to 16.5 metres and approach channel to 17.2 metres to enable fully-loaded Panamax vessels with a capacity of 130,000 tonnes and requiring a draft of 15.2 metres to dock. The doubling of the ship parcel sizes calling at the port will cut logistics cost by 30 per cent, according to Shipping Minister Nitin Gadkari.

The inner harbour optimisation plans also involve increasing the length of the approach channel from 3.8 km to 10.04 km and widening the port entrance from 153 m to 230 m to allow safe entry of larger size vessels.

The port trust also proposes to construct six new berths in the inner harbour investing ₹250 crore, besides modernising the existing nine berths and NCB-I and NCBII for handling coal, construction materials, general cargo, containers and clean cargo with ₹600 crore.

The port trust has also budgeted Rs 2,000 crore for installing mechanical cargo handling system for container terminals, bulk cargo and general cargo berths, apart from developing a container parking yard.

FOREIGN CURRENCY BORROWINGS Gadkari is pushing the dozen major ports to go for low-cost foreign currency borrowings by leveraging their dollar denominated foreign currency earnings which provide a natural hedge to the ports.

This will eliminate the requirement of hedging the foreign exchange risk and will reduce the cost of borrowing.

Vessel-related charges or socalled marine charges such as port dues, berth hire and pilotage are paid by ships calling at a port.

Vessel-related charges for foreigngoing vessels are denominated in dollars, but collected in rupees after applying the prevailing exchange rate, according to a practice followed since 1991.

Cargo-related charges at ports such as wharfage, crane hire, storage, warehouse, demurrage and estate rentals are denominated and collected in rupees.

Gadkari reckons that the dozen ports can use their dollar earnings to borrow money at 3-5 per cent from overseas instead of high cost rupee loans with interest rates of 12-14 per cent from the domestic market.

DGFT Enhances MEIS Scheme for Two Subsectors of Textiles Industry New Delhi Port Wings News Network he Directorate General of Foreign Trade (DGFT) has issued Public Notice no. 42 on 24 November by which rates for incentives under the Merchandise Exports from India Scheme (MEIS) for two subsectors of Textiles Industry, that is readymade garments and made ups have been enhanced from two percent to four percent of value of exports with effect from 01 November 2017 till 30 June 2018.

The estimated annual incentives will be Rs. 1,143.15 crore for 201718 and Rs. 685.89 crore for 201819. This measure will incentivise the exports of labour intensive sectors of readymade garments and made ups and contribute to employment

TIRUPUR EXPORTERS ASSOCIATION HAILS MEIS RATES HIKE FROM 2% TO 4% The Ministry of Finance has increased the Merchandise Exports from India scheme rates for Readymade Garments and Madeups from 2% to 4% for a period of 1.11.2017 to 30.6.2018 on 24 November 2017.

In a press release issued on 25 November, Mr Raja M Shanmugham, President, Tirupur Exporters Association said the announcement of MEIS increase is a relief to the ailing knitwear garment export sector and he thanked Mr Arun Jaitley, Union Minister of Finance, Smt.Smriti Irani, Union Minister of Textiles,

Mr Suresh Prabhu, Union Minister of Commerce and Industry and PMO office for this crucial support at this hour of crisis.

“INCORPORATE THE EMBEDDED TAX” Mr Raja M Shanmugham further said he has also requested to incorporate the embedded tax and announce the revised ROSL and Duty Drawback rates as these lifeline support are desperately needed to bring back the exports growth and boost the confidence of garment exporters to take up fresh orders and sustain in the global business.

Mr Raja M Shanmugham was hopeful that the Government would also consider the requisition immediately.

Cabinet Approves Agreement between India, Philippines on Customs Matters Mumbai

Port Wings News Network he Union Cabinet chaired by the Prime Minister Narendra Modi has approved the signing and ratifying of an Agreement between India and Philippines on co-operation and mutual assistance in customs matters.

The Agreement will help in the availability of relevant information for the prevention and investigation of Customs offences.

The Agreement is also expected to facilitate trade and ensure efficient clearance of goods traded between the countries.

This Agreement shall enter into force after the necessary national legal requirements for entry into force of this Agreement have been fulfilled by both the countries.

The Agreement would provide a legal framework for sharing of information and intelligence

the Customs authorities of the two countries. It would help in the proper application of Customs laws, prevention and investigation of Customs offences and the facilitation of legitimate trade. The draft text of the proposed Agreement has been finalized with the concurrence of the two Customs Administrations.

The draft Agreement takes care of Indian Customs’ concerns and requirements, particularly in the area of exchange of information on the correctness of the Customs value declared and authenticity of certificates of origin of the goods traded between the two countries.

Word Class Center of Excellence in Maritime and Ship Building to come up in Mumbai, Vishakhapatnam New Delhi Port Wings News Network world class Center of Excellence in Maritime and Ship Building (CEMS) is being set up by Ministry of Shipping in collaboration with Siemens and Indian Register of Shipping (IRS) under the Ministry’s flagship Sagarmala Programme.

DOMESTIC SKILL REQUIREMENT IN SHIP DESIGN CEMS will have campuses at Vishakhapatnam and Mumbai, and will provide industry-relevant skill development, equip students with employable engineering and technical skills in the port and maritime sector and contribute to the Government of India’s ambitious Sagarmala programme.

CEMS is being set up to meet the domestic skill requirement in ship design, manufacturing, operating and maintenance, repair and overhaul (MRO), and aims to become an international nodal centre in South Asia, attracting students from neighboring countries like Sri Lanka, Bangladesh, Thailand, Malaysia and Indonesia for skill development in the Port and Maritime sector.

This initiative also adds to the Make in India and Skill India efforts in the maritime sector. CEMS will provide skilled manpower to make vessels for inland waterways, ships, fishing boats and other ancillary manufacturing sectors.

The Ministry of Shipping’s financial contribution is towards capex for procuring of machinery, creation of classrooms, workshop and labs etc., and is a one timenon recurring grant of 50.07 crore. An equivalent amount has been raised by Indian Register of Shipping. The land and building for Vishakhapatnam campus has been provided by Indian Maritime University (IMU) and that for Mumbai campus by IRS. CEMS will be run by Siemens for two years and thereafter by a Special Purpose Vehicle (a Section 8 nonprofit Company) promoted

by IRS. Siemens will handhold this SPV in the third year. CEMS will have a unique hub and spoke delivery model providing industry relevant courses and creating a self sustaining platform. The training will be of two types: full time and co-curricular training (i.e along with regular courses in ITI and polytechnics and engineering colleges). The centre would operate on an open technology platform and provide scalable, modular and independent self learning interactive modules based on Digitally Advanced Interactive System. The total capacity of the COE is 10,512 students per year and the centre will offer paid courses for both domestic and international students but with fees far less than the current fees in the market.

It is expected that CEMS will become a global hub for quality skill development in the port and maritime sector and provide skilled manpower for India’s ship building and repair industry.

APM Terminals Inland Services Inaugurates ICD in Pune Mumbai

According to a media statement, the new facility, which is over 12 acres in area, can handle more than 60,000 containers annually.

Reconstituted WCO-UPU Committee Focuses on Implementation of Advance Electronic Data Exchange Chennai

Port Wings News Network ver 50 experts from Customs administrations and postal operators representing various WCO and UPU regions met in Berne from 16 to 17 November 2017 under the framework of the WCO-UPU Contact Committee to discuss Customs-Postal issues.

NEED FOR STRENGTHENING COOPERATION Opening the meeting, Mr. Abdelilah Boussetta, Director UPU International Bureau and Mr. Luc De Blieck, Deputy Director WCO, underscored the need for strengthening cooperation between Post and Customs at the national level. Given the growing digital and E-Commerce environment and security concerns, Posts and Customs were requested to prioritize the exchange of advance electronic data in order to enhance postal supply chain safety and security and improve facilitation of rapidly increasing volumes of postal items.

Building upon the work done by the previous Committee and armed with the ground level information concerning the preparedness of postal operators and Customs administrations in terms of capturing, exchanging, and using data in an electronic format, the newly reconstituted Contact Committee embarked upon developing comprehensive guidelines providing, among others, a step-by-step approach towards the implementation of electronic

exchange of data between Posts and Customs.

COMPLIANCE WITH CUSTOMS DECLARATIONS It urged postal operators and Customs administrations to expedite the establishment of electronic data interface using the joint WCO-UPU Customs-Posts EDI Messages in order to avoid a fragmented approach. In this regard, it noted the important development with regard to the feasibility of interface between the UPU Customs Declaration System (CDS) and the ASYCUDA systems being used by many Customs administrations and related pilots.

In addition, noting the importance of data quality, the Committee examined draft Guidelines on improving compliance with Customs declarations including best practices on the electronic data capture. The Committee also adopted the updated WCO–UPU Postal Customs Guide, as a reference source on PostalCustoms issues.

The Committee recognized the need for providing tailor-made capacity building and technical assistance in a cohesive manner and acknowledged the ongoing initiatives that included the WCO Mercator programme and the UPU SECUREX and ORE projects. It also noted the need for high-level engagements between policy makers from Customs and Posts around the world to discuss and explore strategic and policy issues and their Implementation in a standardized and harmonized manner, and agreed ‘in principle’ to organize a joint global strategic conference in December 2018.

Rai, and other senior executives of the port administration. The talks were cordial and explored opportunities for business partnership in the shipping sector between the two countries. The delegation was received by the Dy. Chairman Mr G. P. Rai at the MPT Administrative building.

EXPLORING OPPORTUNITIES TO FORGE BUSINESS PARTNERSHIP The discussions centered around exploring opportunities to forge business partnership with the Norwegian enterprises and the Port Authority and Shipping Industry by extending knowledge and expertise in the shipbuilding industry. Interacting with the high level delegation, consisting CEOs of renowned Companies in Norway, the Dy. Chairman Mr Rai, extended all support and co-operation from the Mormugao Port in building a progressive working relationship with the Norwegian Government in the Port sector. The representatives of the Norwegian Companies expressed keen interest in the

sectors of dry docks, ship repairs, VTMS, Maritime and Marine Engines, fishing products, and inland waterways in Goa to further develop the shipbuilding industry and port sector in the state.

Being one of the top countries in the world engaged in Shipping and Marine activities, the visit of the Norwegian delegation to Goa attaches much importance considering we have a vibrant shipping presence in this tiny state situated on the west coast of India. The delegation which

has ship building and other shipping and Marine related activities on its agenda, has come at the opportune time when the Ministry of Shipping, Transport and Highways Government of India, is extending full support in the development of port infrastructure under the Sagarmala project for port led prosperity.

Mr Vipin Menoth, Traffic Manager MPT gave a detailed overview of the Port, the infrastructure, the projects under way and the future developmental projects that are being taken up to meet the demands of the ever growing shipping trade. The Port Management emphasized on their commitment to focus on exploring the use of alternate source of energy such as solar energy and wave energy in building a clean energy port. A few delegates showed their keen interest in setting up ancillary units, to support the dry docks in the port as well as the inland waterways transport. The queries raised by the delegates were answered to their satisfaction of the delegates present. H.E. the Norwegian Consul General, expressed her deep satisfaction on her visit to the Port and the detailed overview that the Port Management presented to the delegation. She expressed her desire to come back again and follow up on the promises and take the initiative forward.

Customs Code (UCC) and the IT preparedness. The WCO provided the latest information concerning the work done by the Joint WCOICAO Working Group on Advance Cargo Information (JWGACI) and the potential way forward. The Contact Committee set up a group comprising Customs and postal operators to carry out further work on the identified issues that could be presented to the JWGACI for its consideration, when finalizing the envisaged concept of operations.

RELEVANCE OF AUTHORIZED ECONOMIC OPERATOR The implementation the WCO SAFE Framework of Standards and the UPU security standards S58 and S59 in a harmonized manner was another area that requires close cooperation between Customs and postal operators. In this context, delegates discussed the relevance of Authorized Economic Operator (AEO) status for postal operators and the challenges related to the compliance to the AEO criteria and requirements, and noted that postal operators when implementing advance electronic data exchange and complying with UPU security standards would have a better chance of acquiring the AEO status.

E-Commerce was a recurring theme through the meeting that involved discussions on the work being done by the WCO and the UPU and exploration of opportunities for further collaborative work for faster clearance and delivery of

E-Commerce parcels, while ensuring compliance to various regulatory requirements. In the similar vein, the expeditious implemenation of the WTO Agreement on Trade Facilitation (TFA) involving postal operators including through National Committees on Trade Facilitation (NCTFs) was well noted as a potential way forward.

Furthermore, some Customs administrations highlighted the growing misuse of the postal chain by criminals for illicit trade and measures being taken by them to curb this phenomenon. To this end, in order to provide an easily accessible list of prohibited and restricted articles in the postal chain, a group was set up to develop such a list in a user-friendly format.

Delegates also shared some recent initiatives including the preliminary positive outcomes of the Postal-Rail project on the movement of postal items by rail from China to Europe and the Australia-New Zealand Green Lane pilot. Additionally, the use of Big Data, predictive analytics and new technologies (e.g., artificial intelligence, machine learning) to effectively leverage voluminous data residing in Postal and Customs domains for effective risk management and efficient service delivery were also discussed.

Going forward, the Contact Committee adopted its work plan with tangible deliverables to support the identified priorities in terms of improving postal chain security and efficiency.

Tata Motors Ships 240 Trucks to Bangladesh from Kolkata Port Kolkatta Port Wings News Network fter Ashok Leyland, it is now the turn of Tata Motors to use coastal shipping services to export trucks to Bangladesh. India controls the commercial vehicles market in Bangladesh, with Tata Motors at the forefront.

The coastal shipping initiative will help the auto-maker bypass the congested land border route through Petrapole-Benapole and optimise market potential in Bangladesh.

A vessel carrying 240 trucks was flagged off by the Kolkata Port Trust (KoPT) Chairman, Vinit Kumar, from the Netaji Subhash dock.

The vessel is expected to reach Mongla Port in Bangladesh in approximately two days.

In October, Ashok Leyland used shipping services for transporting 185 trucks from Chennai to Mongla. According to sources, while the initial shipping cost remains high, the charges are expected to reduce with an increase volume.

The bigger savings would come through reduction in travel time.

In a recent report, BusinessLine identified that export consignments wait for two-to three weeks at the Petrapole border gates primarily due to capacity constraints of the Bangladeshi customs.

Trade facilities A parallel study by Dhaka-based South Asian Network of Economic Modelling (SANEM) confirmed that trade facilities at

Petrapole-Benapole border need capacity expansion to reduce trade costs.

Sources say, there is a demand for 3,0003,500 trucks a month in Bangladesh, against which Tata Motors supplies about 2,000 a

month, through the land route.

Tata Motors is trying to shore up its supplies in Bangladesh by sending approximately 1,000 vehicles a month through coastal shipping. A second consignment of 240 Tata trucks is scheduled to be flagged off from the Kolkata port on 27 November.

According to Kumar, using the coastal routes will result in both time and cost savings to users. The port authorities are in negotiations with automobile exporters to popularise the shipping route.

“We are in talks with Eicher Motors to promote the shipping route to cater to the Bangladesh market,” Kumar told BusinessLine.

Bar Leadership Summit on Reforms in Indian Legal Services Sector New Delhi Port Wings News Network he Indian National Bar Association (INBA) in collaboration with the Department of Commerce, Ministry of Commerce and Industry, and the Centre for Trade and Investment Law (CTIL), Indian Institute of Foreign Trade organized the ‘Bar Leadership Summit on Reforms in the Indian Legal Sector’ in New Delhi recently. The Minister of State for Human Resource Development (Higher Education), Mr Satya Pal Singh graced the occasion, senior officials from the Government of India and several leading lawyers and professionals from the legal sector were also present.

The Minister for Commerce and Industry, Mr Suresh Prabhu who addressed the Summit through a video message emphasized on the growing importance of Alternative Dispute Resolution (ADR) and encouraged the legal community to increasingly make use of this mechanism for enhancing the ease of doing business.

Mr Satya Pal Singh in his inaugural address, stressed on the importance of law as an enabler of

justice and spoke on the importance of the impartiality and neutrality of the judicial system in India. He noted that the justice system should focus on the difficulties faced by victims in particular.

The Secretary General of INBA, Mr Kaviraj Singh who introduced the theme of the Summit, highlighted the dramatic changes that have taken place within the legal sector in India in the last two decades and identified the three major areas which the Summit should focus on, (i) the conduct of arbitration in India; (ii) reforms in the Indian legal regulatory sector; and (iii) the liberalization of Indian legal services.

The President of INBA, Dr. Subhash C. Kashyap welcoming the gathering, highlighted the importance of initiating discussions on much needed reforms in the legal sector.

Law Secretary, Ministry of Law and Justice, Shri Suresh Chandra said India has huge potential to increase the size of the legal market, which is around $9bn Dollars at present. He suggested that reforms in this sector could tie in with the Prime Minister’s agenda of “reform, transform and perform”.

Department of Commerce, Ms. Sangeeta Saxena, highlighted the need for diversification of services exports and the particular importance of the legal services sector in boosting India’s overall performance in services.

President of the Supreme Court Bar Association (SCBA), Mr R. S. Suri, noted that the “gulf of understanding between the Bar Council of India, State Bar Councils and the government need to be bridged” and that frequent consultations and deliberations are needed in reforming this important sector.

Head, Centre for Trade and Investment Law, Prof. James Nedumpara, spoke about the need to introduce major challenges in the curriculum in law schools in India to enable young Indian lawyers to become ‘global Indian lawyers’ and avail opportunities in the rising global corporate sector.

The discussions ended with a presentation on the myths and realities surrounding the debate on liberalization of legal services. The Summit on the whole agreed on the need to reform the legal sector to align itself with the new global realities in the profession.

India Signs Loan Agreement with World Bank for “Solar Parks Project” Mumbai

The project consists of two components viz. (i) Shared Infrastructure for Solar Parks (estimated total project cost of

USD 100 million, including USD 75 million in IBRD loan and USD 23 million in CTF Loan) and (ii) Technical Assistance (USD 2 million in CTF Grant).

The objective of the project is to increase solar generation capacity through establishment of large-scale parks in the country. The project will help establish large-scale solar parks and support the government’s plan to install 100 Gigawatts (GW) of solar power out of a total renewableenergy target of 175 GW by 2022.

United Arab Emirates – Qatar Dispute Reaches WTO

Qatar referred to its statements at the last DSB meeting on this matter and requested the establishment of a panel for a second time. It said the UAE had refused all consultations and had acted unilaterally, in gross disregard for the rights of Qatar and other members. The measures adopted by the UAE and some other members were discriminatory, prevented freedom of transit and frustrated the majority of trade between Qatar and those members, it said.

The United Arab Emirates regretted Qatar’s panel request. It, along with eight other countries, had been forced to take measures in response to Qatar’s funding of terrorist organizations, it said. This was not a commercial dispute; the measures had been taken to protect the UAE’s essential security interests in full conformity with WTO rules. The UAE could not agree to the establishment of a panel and said that the WTO had no authority to second guess a member’s determination of its national security interests.

Thai Airways Proposes first new order in six years to provide overdue replacements

Thai Airways is pushing forward with long-overdue widebody renewal as part of the first phase of a new fleet plan. The airline intends to phase out all of its remaining 747-400s, 777-200s and 777-300s – many of which are over 20 years old – by 2022.

The airline group plans to acquire, contingent on government approval, eight to nine narrowbody aircraft and approximately 20 widebody aircraft for delivery from 2019 to 2022. Thai Airways has not placed any aircraft orders in six years, and currently has no committed deliveries after a final batch of five A350s arrive in 1H2018.

Growth at the parent airline will be modest over the next few years as Thai Airways focuses on renewing its fleet and improving profitability. The rate of growth could accelerate next decade as part of a second phase in the new 10-year fleet plan that is not yet up for government approval.

Worldwide Flight Services Wins Five New Cargo Handling Contracts in France Chennai

Four of the contracts cover Paris CDG as well as handling at WFS’ other 11 cargo stations across France. Vietnam Airlines has renewed its cargo handling agreement with WFS, while CAL Cargo Airlines has appointed WFS to provide receiving points for cargo which is then trucked to Belgium to connect with its Boeing 747 freighter services ex

Liege. WFS has also won contracts for the whole of France from the Moldovan airline FlyONE for freight carried onboard its weekly Airbus A319/320 flights to Chi?inau International Airport as well as from the Italian carrier, Meridiana.

Air France has also chosen WFS as its cargo handling partner at three

As the country’s newest Pacific gateway port, APM Terminals Quetzal is ensuring exports of sugar, fruits and vegetables, coffee, grains, fertilizer, fish, cotton, textiles and tobacco which represent half of Guatemala’s exports are successfully handled to the highest quality standards.

1.57 MILLION TEUS IN 2016 With 16.5 million people, Guatemala has the largest population in Central America. The IMF has projected an annual economic growth rate of 3.2% for 2017 and 3.5% in 2018.

Guatemalan ports handled a combined 1.57 million TEUs in 2016, surpassing Costa Rica with 1.34 million TEUs for second place in Central America, after Panama, with its Canal-associated transshipment ports t Colon and Balboa, which handled 6.25 million TEUs in 2016, among the Central American nations.

APM Terminals Quetzal has a capacity of 340,000 TEUs and is a 85%/15% joint venture between APM Terminals and The IFC - World Bank. APM Terminals has invested USD 180 million in the terminal and has plans for an additional USD 145 million to be invested over a 19 year period. As part of the company’s community outreach efforts, APM Terminals Quetzal has plans to cooperate with the Municipality of San José on community projects, representing an investment of USD 500,000 a year in projects that will be evaluated jointly.
