The GST Council, headed by the Finance Minister Arun Jaitley, pushed for big reforms in its 22nd meeting held in New Delhi on 6 October to introduce more flexibility in the recently introduced GST system.

Welcome Course Correction on GST Implementation

W

ithin three months after its mega midnight launch, the government seemed to have read the reaction from the ground on flawed implemntation of its ambitious Goods and Services Tax regime, and the ‘climb down’ was more evident on 6 October, when the GST Council decided to cut its own vision by staging major rollbacks in the interest of stakeholders.

Despite knowing the fact that the GST system was a flawed one in its design and highly convoluted, Modi’s battery of ministers and the government’s ‘expert’ economists tried hard to convince the trade as well as the common people that GDP will accelerate after the implementation of GST. However, within just three months after its launch, the government and its battery of departments involved in disseminating the GST is good system, now gone silent. As anticipated, they may have read the reactions that are all over the place and become albatross on government’s neck.

With no option left for the government to convince the already agitated trade community, GST Council bowed to the demands and accepted roll back of few measures to douse the raging economic fire. Enhancing exemption limit under composition scheme and making provision for quarterly instead of monthly returns for businesses up to 1.5 crore are the two major compromises the GST Council had to acquiesce to in its 22nd meeting.

These decisions will help almost 90 per cent of the businesses out of monthly compliance and will leave GST regulations applicable to only 10 per cent assessees. No surprise if even biggies are moved to quarterly returns soon. Quarterly returns will make real-time invoice matching and tax credit delivery impossible, thus making the GST similar to the predecessor system except for higher taxation on consumption.

Furthermore, GST Council has also tweaked the GST rates for the third time in just three months, which says a lot about the flawed implementation of GST. Now, the obvious question is standing before the so-called economic experts of the Narendra Modi-led government as a rock why they couldn’t see (if not foresee) the problems that they see now.

The government sensed the danger and design flaws from the much-touted GST in August month itself, when they were forced to announce extension of GST return filing dates. According to media analysts, it was the collapse of politics and economy in tandem.

DailyO reported that a recent ground survey report of revenue department on GST has thrown the government into a state of panic. The survey, first done in Gujarat, revealed the dire state of GST implementation and huge loss of business on the ground.

Political circles also echoed the same panic with a special input on how traders are building a silent nationwide campaign against the Modi government. After Rahul Gandhi’s road show in Gujarat and feedback from RSS, BJP was more than convinced that GST might take a serious toll on its electoral fortunes in at least the immediateSample state polls.

TEXT GST is probably the only big economic reform introduced by the government in recent history, but it has become an embarrassment for the rulers mainly due to its flawed system.

Whatever said and done on GST, there is still time with the Government to set records straight on this new taxation system, and only the future will judge whether Modi learned anything from this episode.

RELIEF FOR SMALL AND MEDIUM ENTERPRISES Presently, anyone making interstate taxable supplies, except interState job worker, is compulsorily required to register, irrespective of turnover. It has now been decided to exempt those service providers whose annual aggregate turnover is less than Rs. 20 lacs (Rs. 10 lacs in special category states except J & K) from obtaining registration even if they are making inter-State taxable supplies of services. This measure is expected to significantly reduce the compliance cost of small service providers.

To facilitate the ease of payment and return filing for small and medium businesses with annual aggregate turnover up to Rs. 1.5 crores, it has been decided that such taxpayers shall be required to file quarterly returns in FORM GSTR-1,2 & 3 and pay taxes only on a quarterly basis, starting from the Third Quarter of this Financial Year i.e.

October-December, 2017. The registered buyers from such small taxpayers would be eligible to avail ITC on a monthly basis. The due dates for filing the

quarterly returns for such taxpayers shall be announced in due course.

Meanwhile, all taxpayers will be required to file FORM GSTR-3B on a monthly basis till December, 2017.

All taxpayers are also required to file FORM GSTR-1, 2 & 3 for the months of July, August and September, 2017.

Due dates for filing the returns for the month of July, 2017 have already been announced. The due dates for the months of August and September, 2017 will be announced in due course.

The reverse charge mechanism under sub-section (4) of section 9 of the CGST Act, 2017 and under subsection (4) of section 5 of the IGST Act, 2017 shall be suspended till 31.03.2018 and will be reviewed by a committee of experts. This will benefit small businesses and substantially reduce compliance costs.

The requirement to pay GST on advances received is also proving to be burdensome for small dealers and manufacturers. In order to mitigate their inconvenience on this account, it has been decided that taxpayers having annual aggregate turnover up to Rs. 1.5 crores shall not be required to pay GST at the time of receipt of advances on account of supply of goods. The GST on such supplies shall be payable only when the supply of goods is made.

It has come to light that Goods

Transport Agencies (GTAs) are not willing to provide services to unregistered persons. In order to remove the hardship being faced by small unregistered businesses on this account, the services provided by a GTA to an unregistered person shall be exempted from GST. OTHER FACILITATION MEASURES After assessing the readiness of the trade, industry and Government departments, it has been decided that registration and operationalization of TDS/TCS provisions shall be postponed till 31.03.2018.

The e-way bill system shall be introduced in a staggered manner with effect from 01.01.2018 and shall be rolled out nationwide with effect from 01.04.2018. This is in order to give trade and industry more time to acclimatize itself with the GST regime.

The last date for filing the return in FORM GSTR-4 by a taxpayer under composition scheme for the quarter July-September, 2017 shall be extended to 15.11.2017. Also, the last date for filing the return in FORM GSTR-6 by an input service distributor for the months of July, August and September, 2017 shall be extended to 15.11.2017.

FIEO Hails Changes in GST To Support Exports

T

he Federation of Indian Export Organisations (FIEO), an umbrella body of exporters scattered across the country, has welcomed the changes announced by the Government consequent to the GST Council meeting held on 6 October in New Delhi.

In a media statement, Mr Ganesh Kumar Gupta, President, FIEO, said that these initiatives will address the problem of the exporters particularly micro & small segments.

Mr Ganesh Kumar Gupta stated: “The refund of GST for the month of July by 10th October and August

by 18th October will address the liquidity concerns of the exporters.”

The FIEO President also welcomed the decision to introduce e-wallet, mooted by FIEO, at the introduction of the GST which will provide a permanent solution to the liquidity problem of the export sector.

During the interim period, Government will provide exemption on inputs required for export production through advance authorization, EPCG and EOU Schemes. The Government has also resolved the problem of merchant

exporters by putting a duty of 0.1% on any supply from manufacturing to merchant.

“These are very pragmatic decisions that show the flexible approach of the Government, which will ameliorate the problem of export sector and will impart much needed competitiveness to exports,” Mr Gupta added.

The President of FIEO also complimented and thanked the Prime Minister Narendra Modi, Finance Minister Arun Jaitley and Commerce & Industry Minister Suresh Prabhu for these far reaching decisions, which will help in pushing exports on a growth path.

New Mangalore Port Registers Positive Growth

Kamarajar Port Organises “Swachhta Hi Sewa” Drive Chennai

Port Wings News Network o commemorate the third anniversary of “Swachh Bharat Mission”, the “Swachhta Hi Sewa” was observed in Kamarajar Port Limited (KPL) from 15 September 2017 to 02 October 2017.

During the period, Kamarajar Port has carried out various cleanliness activities to create cleanliness awareness among the employees of the port, as well as the public of those villages surrounding the port and students of various schools located in the vicinity of the facility.

According to a media statement, the observation commenced on 15 September with an introductory speech by Mr V.Krishnasamy, General Manager (Operations), KPL, about the cleanliness awareness and the activities of the observation of “Swachhta Hi Sewa” campaign.

A “Swatchh Oath” was administered to all the employees to dedicate themselves in the cleanliness activities and communicate the importance of cleanliness to achieve the Prime Minister of India’s target of “Clean India” by 2019.

The port area was divided into different segments and the

activities like cleaning, weeding out old records & disposal of furniture & scrap, renovation of toilets, painting the buildings, cleaning the roads, removing the unwanted vegetation, removing the garbages, cleaning and beautification of parks and beach cleaning are carried regularly from during the campaign.

To create awareness on cleanliness to the nearby villagers, cleaning the Panchayat Union School at Athipattu and cleaning the road from Athipattu Pudu Nagar to Athipattu Pudu Nagar Railway station was carried out on 22 September as one of the activities of the observation.

On 02 October, coastal cleanup day was organised in the North Breakwater area. The senior officers of the port, employees, CISF, Fire Service team, BOT Operators, stakeholders around 250 members actively participated in the event.

Subsequently, the valedictory function of the observation of “Swatchhta Hi Sewa” campaign of KPL was concluded. The General Manager (CS&BD) chaired the valedictory function and delivered the valedictory address. The event was concluded with a vote of thanks

by Dy General Manager (Civil) to the gathering of port officials, employees, BOT Operators and stakeholders, who have contributed their part to make the fortnight observation a grand success.

Swachhta Abhiyan Concludes at Mormugao Port Panaji

Port Wings News Network he annual Swachhta Abhiyan organized by Mormugao Port Trust (MPT) as part of a nationwide cleanliness campaign conducted from 15 September to 2 October 2017, concluded on 3 October 2017.

The closing ceremony was held at the main Administrative building.

Mr Deepak Naik, Chairperson Mormugao Municipal Council was the chief guest, while Mr G. P. Rai, Deputy Chairman, MPT, was the guest of honour. Mr J B Dhawale, Secretary, MPT, welcomed the gathering, while Smt. Vidhya Sawant introduced the chief guest. The Port Nodal Officer for Swachhta Abhiyan Mr M. Iddalagi presented a detailed report of the various activities conducted during the period.

Addressing the gathering of Port Officials, employees staff and students, the chief guest Mr Deepak Naik said: “The Port has always supported community endeavours and taken steps to implement the programs for benefit of society and success of Swacchta Bharat Abhiyan. We appreciate the gesture of MPT for having constructed two

toilets blocks with modern facilities at Headland Sada during this fortnight for the use of public. We need the support of every citizen to fulfill the vision of the Prime Minster for a cleaner and greener environment.

The MMC has so far succeeded in implementing door to door garbage collection in 80% areas under its jurisdiction.”

Mr G.P Rai, Deputy Chairman, MPT, in his brief speech stated: “Even though the Swachhta Abhiyan fortnight has ended, the spirit of the Abhiyan should continue and cleanliness should be an everyday affair. The Port will extend all support for initiatives

to fulfill the mission of a clean and green India. The campaign should not be restricted to just a few people, but everyone should make all efforts to be involved in the mission.”

Prizes were distributed to the winners of drawing, Elocution and Essay writing competitions conducted during the fortnight for the Deepvihar school children.

Cloth bags made by children of New Dawn Asha Deep Special School were presented to the dignitaries to carry the message of reducing usage of plastic bags.

Short skits focusing on awareness of Swachhta Abhiyan were presented by MPT employees.

Jawaharlal Nehru Port, located east of Mumbai in Maharashtra, and Kamarajar Port located on the Coromandel Coast about 24 km

north of Chennai Port in Tamil Nadu are the only two other ports that are named after individuals.

Both Nehru and Kamraj were Congress leaders and the former was country’s first prime minister.

Otherwise, all other ports in India are named after the places they are situated in, for instance, Paradip, Mumbai, Visakhapatnam, Chennai, Kolkata, Mangalore, Tuticorin, Krishnapatnam Port, Kochi and Mormugao.

Jawaharlal Nehru Port, also known as Nhava Sheva, is the largest container port in the country. Ennore Port, officially renamed Kamarajar

Port Limited, is the 12th major port.

The latter is a corporate port.

An official release today said ports in India are generally named after the city or town in which these are situated. However, the government, in special cases, after due consideration, have renamed the ports after great leaders in the past.

It said, “By renaming Kandla Port as ‘Deendayal Port, Kandla’, a grateful nation would be remembering the invaluable contributions made by one of the greatest sons of India, Pandit Deendayal Upadhyay. This will inspire the people of Gujarat, particularly the youth, who may not be fully aware of the contributions made by the great leader.”

Mangalore Port Wings News Network ew Mangalore Port Trust (NMPT) during the first half of the fiscal 2017-18 handled 19.54 million tonnes of cargo as against 17.49 million tonnes handled in the corresponding period of last year and thereby registered 11.72% growth.

With this trend, the port is expected to cross 40 million tonnes mark by the end of the current financial year.

GLOBAL AND DOMESTIC CHALLENGES FACED BY EXPORTERS The deliberations flagged global and domestic challenges faced by exporters. Many options and suggestions were proposed to overcome such challenges. GST related issues regarding working capital blockage, delay in refunds

and usability of MEIS/SEIS scrips were raised by exporters.

In the context of mid-term review of the Foreign Trade Policy, exporters requested inclusion of more products under MEIS and Interest Equalisation Scheme and increase in the rates of incentive and interest subvention rates. The meeting also provided inputs for a new export strategy focusing on integrating India into the Regional/ Global Value Chain, focus on high and medium technology sectors of exports, revisiting the focus area approach and unleashing the potential of services such as tourism, professional services and e-Commerce.

HUGE POTENTIAL FOR SHIP BUILDING AND SHIP REPAIR INDUSTRY Speaking on the occasion Mr

In his address, the Home Minister said that it is his second visit to A & N Islands within six months. He said the Home Ministry’s Advisory Committee on A & N Islands had held a meeting to discuss and sort out various problems and issues of the Islands recently.

PROJECTS CONTRIBUTE TOWARDS DEVELOPMENT OF THE COUNTRY’S ECONOMY Mr Singh lauded the efforts of Shipping Minister Mr Nitin Gadkari and said that development projects like the ones inaugurated on the occasion contribute towards development of the country’s economy. He stated that under PM Narendra Modi’s dynamic leadership, India which now figures in the top ten economies of the world, will emerge as one of the top three economies by 2025-30.

He said, these islands have a huge potential for ship building and ship repair industry. He said, the Ministry is focussing on ‘Make in India’ programme under the Sagarmala Project. Efforts are on to bring in new technology for manufacturing ships in the country.

14 NEW SHIPS WILL BE ADDED IN A & N ISLANDS Speaking about the shipping sector, Mr Gadkari said, most of the ships in A & N Islands are old and need to be replaced. He announced that 14 new ships will be added in A & N islands by 2020. The Minister further stated that under Sagarmala Project around Rs 4 lakh crores have been earmarked for port-road connectivity, port-

rail connectivity, modernisation and mechanisation of ports.

He further stated, India’s 7300 km long coastline and rivers have potential for big-scale development of cost effective waterways transportation which will bring down logistics cost significantly and also be a convenient mode of transportation.

Speaking about power generation in A & N Islands, he said diesel generated power causes environmental pollution and needs to be replaced. Instead, development of hydel, solar and wind power in A & N Islands must be explored. As a step towards curbing pollution caused by diesel power generation, plans are being made to set up LNG and CNG based power in the Islands soon.

PROMOTE TOURISM WITHOUT DISTURBING THE TRIBAL The sea route to Baratang that was inaugurated on 6 October will provide an alternative to the

National Highways-4 route that linked Baratang to Port Blair, passing through the Jarawa Tribal Reserve. This sea route will thus help promote tourism without disturbing the tribal areas.

The project for extension of wharf in Hope Town will allow berthing of bigger vessels than is possible at the moment. The wharf is used for movement of petroleum products, and berthing of bigger vessels will increase the availability of products and bring down logistics cost. The project is expected to be complete by February 2018.

ADDITIONAL SHIPPING PROJECTS The construction of additional approach jetty and extension of existing jetty at Neil Island would help in accommodating more than one ship, which was not possible earlier. Dredging upto 5m would help in berthing higher draft vessels , especially cargo ships. This would enable abundance supply of vegetables and other cargo to and from the island. The project would hence help in economic development of the area by promoting tourism and would also help in optimal utilization of available resources. The project is expected to be complete by March 2018.

The extension of Dry Dock – II at Port Blair will help augment the available ship building and ship repair facilities. The project is expected to be complete by September 2019.

Milaha Launches NVOCC Tracking App for Smartphones in Qatar Chennai

DP WORLD To Develop Infrastructure And Logistics Blueprint For Mali

DP World Group Chairman and CEO, Sultan Ahmed Bin Sulayem, met with the President of Mali, Ibrahim Boubacar Keïta, last week to discuss a trade and logistics master plan to unlock the resource rich country’s economic potential.

The plan includes a transportation and logistics strategy with electronic customs processes, replicating DP World’s successful model with Dubai Trade at its flagship Jebel Ali Port and Freezone in Dubai. Regional trade in West Africa connects through ports such as DP World Dakar in Senegal to international markets.

Maritime Cook Islands Celebrates World Maritime Day 2017

The Cook Islands celebrated World Maritime Day at Avatiu Harbour and the IMO theme for this year was ‘Connecting Ships, Ports and People’. The theme highlights the vital inter-connectivity between the three principal components – ships, ports and people – in contributing to the maritime economy.

Unifeeder Operates World’s First Shortsea Container Vessel with LNG Chennai

Double Digit Demand Growth for Freight Continued in August: IATA New Delhi Port Wings News Network he International Air Transport Association (IATA) released data for global air freight markets showing that demand, measured in freight tonne kilometers (FTKs), increased by 12.1% in August 2017, compared to the same period a year ago. This was the fifth time in six months of doubledigit gains on the previous year’s performance. Demand is growing at exceptional speed when compared to the five-year average growth rate of 4.4%.

GREW BY 4.7% YEAR-ON-YEAR Freight capacity, measured in available freight tonne kilometers (AFTKs), grew by 4.7% yearon-year in August 2017. Demand growth continues to significantly outstrip capacity growth, which is positive for industry load factors, yields, and financial performance.

STRONG PERFORMANCE OF AIR FREIGHT The strong performance of air freight demand corresponds with the pick-up in global trade. World trade volumes grew 4.2% in the first seven months of 2017 compared to 2016, their strongest performance since 2011. This is consistent with rising export orders, which are currently around their highest levels since March 2011, and upbeat business confidence indicators.

Signs that the peak of the cyclical growth period may be near also continue. The global inventory-tosales ratio in the US, for example, has stopped falling. This usually means that re-stocking to meet demand (which gives air freight a boost), is ending.

The outlook for air freight remains strong. With several months of double-digit growth in 2017, the current IATA forecast of 7.5% growth in air freight demand for 2017 appears to have significant upside potential even if we are approaching a cyclical peak.

ANOTHER STELLAR PERFORMANCE IN AUGUST Alexandre de Juniac, IATA’s Director General and CEO, said, “Air cargo had another stellar performance in August. Demand for air cargo grew at a doubledigit rate for the fourth month in a row - outperforming demand

for passenger travel for the fourth consecutive month. Rapid growth in cargo demand means that cargo capacity is now growing in response to real cargo demand rather than automatically as carriers responded to passenger demand. The pace of capacity growth, however, has slowed even as freighter fleets are being utilized more intensely.

Overall, that should be good news for much beleaguered cargo yields.”

REGIONAL PERFORMANCE All regions with the exception of Latin America posted double digit freight growth in August 2017.

Asia-Pacific Asia-Pacific airlines’ freight volumes grew 11.3% in August 2017 compared to the same period a year earlier, and capacity increased by 5.7%. Demand growth was strong on all the major routes to, from and within Asia-Pacific, consistent with strong export order books for the region’s manufacturers.

Seasonally-adjusted international freight volumes increased in August after a slight dip in July and are now almost 6% above the volumes reached following the 2010 postglobal financial crisis bounce-back.

North America North American carriers posted an increase in freight volumes of 11.7% in August 2017, and a capacity increase of 3.7%.

Seasonally-adjusted international freight volumes remain strong. The strength of the US dollar has boosted the inbound freight market over the past few years. Data from the US Census Bureau shows a 12.7% increase in air imports to the US in the first seven months of 2017, compared to a slower rise in export orders of 5.8%. Despite the US dollar remaining strong by historical standards, its slight decline since the start of the year is expected to start to help rebalance trade flows.

Europe European airlines posted an 11.8% increase in freight demand in August 2017 and a capacity increase of 5.1%. Double-digit growth in international demand has now

been recorded in 10 of the past 12 months. Concerns that the recent strengthening of the euro may have affected the regions’ exporters have not materialized. In fact German manufacturers’ export orders are growing at their fastest pace since early-2010.

Middle East Middle Eastern carriers’ year-onyear freight volumes increased 14.1% in August 2017 and capacity increased 2.8%. The strong pick-up in demand largely reflects favorable comparisons to a short-lived weak patch in demand in 2016 rather than an acceleration in the current demand trend. Seasonallyadjusted international freight volumes have maintained their solid upward trend. However, amid strong competition from other region’s carriers particularly on the AsiaEurope route, the Middle East carriers are not seeing as strong a pickup in the seasonally-adjusted traffic trend as other region’s carriers.

Latin America Latin American airlines experienced a growth in demand of 8.5% in August 2017 and capacity increased by 9.3% compared to the same period in 2016. International freight volumes increased by 9.5% over the same period. This is close to a seven-year high and well above the five-year average rate of -0.1%.

Seasonally-adjusted international freight volumes grew strongly for the sixth consecutive month in August, however they remained 4% lower than their peak in 2014. Despite this, seasonally-adjusted demand has been trending upwards at an annualized rate of about 20% over the past six months. The pick-up in demand reflects signs of economic recovery in the region’s largest economy, Brazil.

Africa African carriers posted the largest year-on-year increase in demand of all regions in August 2017 with freight volumes growing 29.4%. This is a slight slowdown from July but still more than three times the fiveyear average pace of growth of 8.8%.

Capacity increased by 5.9% over the same period. Demand has been boosted by very strong growth on the trade lanes to and from Asia which increased by more than 67% in the first half of the year.

According to a media statement, this service is an extremely competitive alternative to road transport transiting through Spain thanks to its reliability and to the reduction of the environmental footprint.

The first departures are scheduled simultaneously on 21 October in Tangiers and Marseille.

3 DIFFERENT ROTATIONS FOR OPTIMIZED SERVICE The Morocco Express is composed of 3 loops between Morocco and the South of Europe: Loop 1: weekly service on a fixed

day, available throughout the year. It connects Casablanca and Tangier to Marseille with 3 departures per week from Morocco on a ship with a capacity of 180 trailers.

Loop 2: weekly service on a fixed day, available throughout the year. It connects Tangier to Marseille and Genoa with 2 departures each week from Southern Europe on a ship with a capacity of 180 trailers.

Loop 3: weekly service on a fixed day, available from November to April. It connects the port of Tangier to Port-Vendres with 1 departure per week from Tangier on a ship with a capacity of 65 trailers.

CMA CGM also offers a complete door-to-door service, with rail connections to Marseille, Genoa and Port-Vendres.

AN OFFER COMBINING RELIABILITY AND RESPECT FOR THE ENVIRONMENT This new service allows the loading of goods transported in trailers or containers, on specific roro ships (Roll-on, Roll-off) between Morocco and Southern Europe.

This mode of transport combines: Reliability: • Faster: only 36 hours separate Tangier and Marseille, for example • More secure: less risk of delay and accidents on the way • Simpler: ships suitable for transporting trailers • More regular: with several departures per week for each loop Environmental compliance: the Morocco Express service reduces CO2 emissions by 43% compared to road transport transiting through Spain.
