Chief, volunteers at odds over ordinance By Laura McFarland News Editor

POWHATAN – A proposed ordinance change at the Powhatan County Board of Supervisors meeting last week brought to the forefront possible tension between the county’s fire and rescue chief and volunteer rescue squad. Chief Steven Singer spoke during a public hearing at the meeting on Monday, April 6 about amending county code related to revising provisions related to the formation

and composition of the Powhatan County Fire and Rescue Department and the responsibilities and authority of the fire and rescue chief. The amendment to the ordinance would officially form the fire and rescue department and lay out its makeup. It also defines the roles, responsibilities and authority of the chief and newly formed Senior Policy Group within the department. The topic most under debate about the amendment was the issue

of bringing the Powhatan Volunteer Rescue Squad under the authority of the chief. Currently, he does not have direct oversight of the department. After a presentation by Singer and a lengthy discussion involving him, board members and others, the board voted 3-1 in favor of deferring the decision until the supervisors’ next meeting. POWHATAN – When it comes to preserving local history, the biggest challenge faced by the Powhatan County Clerk of the Court’s office is time. Decades and even centuries of the county’s history are being lost incrementally as the ravages of time take hold on the historical records entrusted there, according to Teresa Dobbins, clerk of the Powhatan County Circuit Court. Whether it is land deeds, wills, marriage certificates, board of supervisors records or other documents, if something were to happen to many of them, a huge portion of the county’s history would be lost since no other copies exist, she said. “This is the history of Powhatan that we are at risk of losing. Every day we waste we lose a little of that history,” she said. The clerk’s office started a push when Dobbins came into office in 2014 to do what it could to preserve that history through restoration, preservation and digitization efforts, she said. The process is slow going and can be expensive, two of the biggest hurdles the effort faces. “It doesn’t seem like a monumental task but it is,” Dobbins said. Cerullo joins commonwealth’s attorney’s office By Laura McFarland News Editor

POWHATAN – A month into the job as Powhatan County’s deputy commonwealth’s attorney, Rob Cerullo is fitting well into his new post. Cerullo, who began the position on March 2, said he is enjoying that his

new job has a slower pace than his role as one of two organized crime prosecutors in the Henrico County commonwealth’s attorney office. Cerullo “You can really focus on the cases and make sure you are

Two crash fatalities occur just days apart By Laura McFarland News Editor

POWHATAN – Two fatal car crashes only days apart last week have left many people in Powhatan County reeling. The death of an as yet unidentified man on Sunday, April 5 in Powhatan County was followed on Tuesday, April 7 by a crash in Henrico County in which driver Amanda R. Carlton, 38, of Powhatan County was killed. Sgt. Steve M. Vick of the Virginia State Police said on April 7 that the person involved in the April 5 crash still had not been identified by the Office of the Chief Medical Examiner for autopsy, examination and positive identification. It could be five days to two weeks before the identity is released, he said. That wreck took place at 12:43 a.m. on April 5 in the 1500 block of Walkers Ridge Road in Powhatan. A pickup (possibly a Ford) was traveling north on Walkers Ridge Road when it ran off the road to the left, struck a parked 2010 Toyota Corolla and continued on, striking a tree. At that point it caught fire and became fully engulfed. The driver, who was the sole occupant of the pickup, died at the scene. Trooper W. Boelt is investigating the crash, which remains under investigation. Speed is considered a factor. The April 7 crash occurred at 5:50 a. m. on Interstate 64 westbound at the 197 mile marker, Vick said. Carlton was killed when the 2014 Hyundai Elantra she was driving, traveling west on Interstate 64, ran off the left side of the road, struck the guardrail, spun around and came to rest sideways in the left travel lane. A 2003 Chevrolet pickup traveling west was unable to avoid striking the Hyundai on the driver’s side. Vick said Carlton died at the scene. She was wearing a seatbelt. The driver of the 2003 Chevrolet pickup, Joseph E. Huggins, 65, of Quinton, was transported to MCV with nonlife threatening injuries. He was wearing a seatbelt. Trooper R. J. “I think the biggest transition is you learn who your judges are and your defense attorneys are,” he said. “You get to know them and who they are and what they expect.” Cox said he couldn’t be happier to have hired someone for the position who could hit the ground running without needing a great deal of guidance. Cox was elected commonwealth’s attorney in a special election on Feb. 10 but had served in the office since he was sworn in on Dec. 1, 2014. He took over when Bob Beasley became a General District Court Judge in the 11th Judicial District. In the interim months before the special election, Cox’s former mentor, Dennis Collins, served as an assistant commonwealth’s attorney to lighten the caseload. Cox said he didn’t want to hire someone only to have him or her lose the job if he wasn’t elected. Cerullo already has competently handled a jury trial and cases in both the general district court and the circuit court, Cox said. Since the two share the entire load of the office equally, that versatility is important, he added. “There is no ‘I will handle the tough cases and you do the easy ones.’ It is an equal split here. That is the way it has to be. We have too many courts going on at the same time,” Cox said. Cox said he isn’t surprised how well Cerullo is doing given his background, which is similar to Cox’s own. Both men started as police officers before becoming attorneys. Cerullo earned a bachelor’s degree in history from Mary Washington College and then was hired by the Chesterfield County Police Department in 1993. Having grown up hearing stories about his great-grandfather, a New York City police officer killed in the line of duty in 1936, Cerullo said he thought it would be an exciting job that let him earn a living while making a difference at the same time. After working on patrol for three years, he was promoted to narcotics detective. The first time he ever came to Powhatan County is when his police department loaned him to the sheriff’s office to go undercover to purchase drugs in the area, he said. Cerullo worked with the department full-time for nine years before deciding in 2002 to attend law school at the University of Richmond. “When you are a police officer, you work the case and then hand it off to the prosecutor to get it done. I saw that and thought it was something I could do and would be good at,” he said. While in school, Cerullo continued to work part-time with the police department. After graduating in 2005, he clerked for a year for Judge Henry Hudson, U.S. District Court, Eastern District of Virginia. Cerullo was then hired as an entry level assistant commonwealth’s attorney with Henrico County, where he worked his way up in the office for the following nine and a half years before coming to Powhatan County. It was while he was a police officer that Cerullo met Cox, who was an assistant commonwealth’s attorney in Chesterfield County at the time. Knowing Cerullo’s background as a police officer as well as his reputation as a good prosecutor among members of the legal community was important to Cox. Being a former police officer gives a prosecutor a special insight into cases, he said. “There are some very upset people in Henrico County because of his loss to that office. them. This serves the simultaneous purpose of preserving the information in case something ever happens to the original documents and giving people online access to them. Lewis is working her way back in time with the county’s deed books, which go back to 1777. Since she was hired, she has scanned and indexed the pages spanning from July 1976 back to August 1975, which is roughly five books. With those books, the pages can be separated out and scanned individually without causing damage to the books. That won’t be possible once she gets to the older books, which are bound copies, she said.

Preserving history When Dobbins came into the office, three of the deed books had already been restored. Noticing the deteriorating condition of many of the older books, she got an estimate on the effort to preserve and restore and then digitize them. Even with a little bargaining thrown in, the total cost for all those services for four books was $8,717, she said. Then in the fall, Dobbins found out an anonymous historical society was looking to donate money to a group who hadn’t accomplished

much restoration yet. She said she was interested and later found out the Jamestown Historical Society had chosen Powhatan County as the recipient. The donation was for the restoration and preservation of the books, and since it is cheaper to have everything done at once, Dobbins paid to have them digitized at the same time. The results were awesome, Lewis said, as the preservation addressed so many of the internal and external issues historical documents face. These particular documents were written on pulpwood paper with acidic ink, a combination that does not do well over time, she said. With age the ink begins to create holes in the paper, discolors it and makes it brittle. The records room isn’t climate controlled, so a combination of temperature changes and air pollutants affect the documents, Lewis said. Additionally, since all of the documents are public records, people come in and handle the books, which causes damage because of the oils in their hands, and make copies in a way that isn’t good for the spines, she said. “I can also say that the fact they are bound books and the fact the pages aren’t able to be pulled out makes them an issue to ever be made electronic,” she said The restoration process addresses those is-

sues by restoring the pages as much as possible, treating them to remove the acidity and placing them in sealed sleeves that can be separated out from a book for examination and copying easily, she said. Having the books done is wonderful, Dobbins said, but by no means is the work done in the office. As part of her job, the clerk’s office also will be applying for grants this spring from the Library of Virginia, Lewis said. The focus is not always on land books as some will books and order books are in worse condition and more in need of repair, Dobbins said. Some of the historical documents the clerk’s office stores won’t be eligible for the grants, so the office will find other ways to pay for them, she said. The clerk’s office is funded in large part by the state compensation board and collects a technology trust funds fee on civil and land recordings,

she said. That pays for software for the land record systems and can also fund digitization, restoration and preservation. Since the county collects secure remote access fees for people researching its records online, the more documents that are available, the greater the possible revenue, she said. “My vision for this office is to eventually be completely digitized,” she said. One effort that could help that is if the office could get qualified volunteers who would be interested in helping with the digitization effort, Dobbins said. The code change also lays out Singer’s duties, which include establishing and enforcing departmental regulations, taking control of station operations related to the provision of fire and rescue services and hiring and appointing and terminating officers, staff and volunteers of the department. The Powhatan County Fire and Rescue Senior Policy Group is made up of the district/EMS chief from each recognized volunteer company and one career fire and rescue employee appointed by Singer, he said. The group will be consulted prior to the issuance of any regulations or policies. After the presentation and throughout the discussion, David Williams, District 1, expressed interest in how other localities, naming specifically Chesterfield County, had accomplished bringing their volunteer organizations together. He asked to see examples of other policies and have information on how they evolved into what they are today. Larry Nordvig, District 2, said that while he wasn’t trying to accuse Singer of anything, he wondered if a change like this might open the departments up to having abuse because there is more power at the top. “I am not in any way accusing or hinting, but for the record, could you tell me how you are going to incorporate that tradition of input and a voice of the volunteers,” Nordvig said. Singer pointed to the senior policy group, which will meet at least once a month to discuss proposed policies and have the opportunity to take them back to their respective departments for discussion before bringing them back to the group. Since Singer started work with the county on Dec. 1, two policies have gone completely through that vetting process, he added. The code changes under question arrived to the volunteer members in early January before they were brought to the board of supervisors and have gone through the senior policy group at least twice, Singer said. The only recommendation at the time was by rescue chief Allen Beach to change the name from fire and rescue to fire and EMS so it

When chairman Bill Melton, District 4, opened the public hearing up to further comment, Beach spoke in opposition of the change. The rescue squad has served the county well since 1956 operating independently and in a fiscally responsible way, Beach said. He talked about the squad’s willingness to transition to billing customers despite the hassles it caused and its efforts to go after grants to supplement its needs instead of always asking the county for funds. Grants helped pay for items such as two new ambulance units, 10 ECG monitor/defibrillators, seven power cot stretchers, 10 laptops for the training center and 14 laptops for the ambulance units to input patient information, he said. Of the $978,084 those and other items cost, the county’s contribution was $233,447, he said. He added that if the county had paid for all of the time volunteers donate, it would equal out to more than $1.4 million in the last four years alone. Beach called into question Singer’s intent to cooperate with the volunteers to improve the system. He pointed to a decision the board made in March to add a new paid Advanced Life Support (ALS) provider during nights and weekends, hours typically handled by volunteer members, saying it was suggested the squad is “deficient in our level of care that we supply to the citizens.” Given the rescue squad’s attempts to be “good stewards of the county’s and citizen’s money,” Beach said he wasn’t sure why “there was a request for additional paid hours for staffing in the fire office to do a job that is currently being done by the Powhatan Volunteer Rescue Squad Leadership at no cost to the county.” Beach asked the board of supervisors to postpone the code changes to allow the rescue squad to have more input and said the squad still wants to remain a separate operating EMS agency. Jason Cox, a member of the rescue squad, also spoke, saying Singer’s presentation only touched the surface. He took issue with the idea of the

chief possibly circumventing the authority of the state and of Dr. Joanne Lapetina, who donates her time to act as the squad’s Operational Medical Director, by adding another authority over the squad who can give directives. He also questioned the chief having authority to enact policies and standard operations procedures without sufficient time for the volunteer chiefs to review them.

He said that in his experience in field and operations positions, the unification made them more efficient and that “the ability to serve the citizens was greatly enhanced once we became one.” Bailey made the point that what the department is today is the result of an evolution over time. Floyd Greene, Powhatan County’s emergency management and 911 coordinator, said in his many years of diverse experience in the field he has seen many transitions similar to what is being proposed, so Powhatan is not unique. Some of those transitions have occurred in Powhatan’s own history, he said. The benefit of having a central organization that has oversight is it ensures all citizens are treated fairly and equally, Greene said. “It behooves the county to make sure that the same service is being provided at Point A in the county as it is at Point B in the county. All of us get the same amount of service,” he said. Even once the amendment is adopted, it will continue to change and evolve, he said. Everyone needs to stay focused on providing good service.

Further discussion “The members of the senior policy group are elected officials by each department from the membership,” Cox said. “We value their voices and their time, especially since we are all doing this for free. We would love for those voices to continue to be heard.” Cox said he was referencing the code changes in his examples but Singer later said the document to which Cox referred was an internal document related to creating policy within the department. He said that document was already approved by the senior policy group.

The county is looking to extend its contract services right now, which will provide for daytime staffing and ALS staffing over the next year. During that year, the county needs to take a hard look at those services for the long run and decide if it wouldn’t be better served having its own career employees. “Right now we are paying $25 an hour to our contract services for a person to drive an ambulance. I am pretty sure I can get someone working parttime a lot less than $25 to drive an ambulance around the county,” he said. In answer to questions from Tucker, Singer said the value of having all of the departments under one umbrella is having standardization of policies and procedures throughout the system, bringing the budgets together at one time and having information to make better decisions about personnel

moving forward. When asked to address opposition to the changes, Singer said that change is hard, especially for a group that is currently autonomous and can do basically what it wants. He said he also felt that right after he started the job, decisions were being made that moved more quickly that some people would like, especially the decision to hire a paid ALS provider during times volunteers usually handled. “I understand that pro-

cess moved very quickly and it was met with resistance by the rescue squad. That is why they tend to resist a lot of things that are coming forward, because they did not get a lot of say toward the ALS provider,” Singer said. He admitted the situation “was handled improperly and went too fast for the services and the system that we are looking to do here” and may have soured the relationship. Looking into the future, Singer said bringing

everything under one organization will give the departments better standards in relation to training, equipment and response times, but those benefits won’t be seen automatically. Tucker pointed out that Singer was hired to be a strategist and he appears to be doing what the county asked of him. “We may have made some stumbles along the way as too fast or not involving people. My perception is you are doing exactly what it is we

asked you to do, whether we like it or not,” he said. Melton said he thinks it is time to pass the policy and that the staff and senior policy group will continue to work on it over time to improve it. He called for a vote on the issue, but Nordvig made a motion to defer it to the board’s next meeting. While he is generally in favor of the ordinance, doubts were raised that, when coupled with the fact Hodge was not present to cast his vote, made him want to wait.

Williams agreed, adding he wanted to give Singer more time to work on the issue with the rescue squad. Singer said he would do that but added he didn’t see the rescue squad changing its stance on wanting to remain autonomous. Refinancing could save county $1 million plus By Laura McFarland News Editor

POWHATAN – The Powhatan County Board of Supervisors is hoping a refinancing of two of its loans will mean a significant amount of savings in the future. The board heard a presentation on Monday, April 6 that was an update on information it had already received about refinancing two loans. Kyle A. Laux, first vice president of Davenport & Company LLC, the county’s investment firm, gave the board an update on the refinancing, which is moving forward soon. The board voted unanimously to approve a resolution to have the county’s Economic Development Authority issue its lease revenue refunding bonds to refund outstanding lease revenue bonds. Barry Hodge, who represents District 3, was not present. The county plans to refinance lease revenue

bonds that were used for Flat Rock Elementary School and Huguenot Public Safety Building, Laux said. The refinancing of the remaining $23.9 million on those bonds will take advantage of the county’s high credit ratings and the market’s low interest rates. The financing strategies Laux laid out would allow the county to refinance for significant savings without extending the final maturities of the loans, he said. The 2010 bond would have had a rate reset in 2025, but this refinancing will lock in the rate through the end of the bond. The estimated savings for the county might be between $1 and $2 million, depending on the interest rates at the time of the refunding at the end of April, Laux said. The county has set a minimum net savings amount of 3 percent as a “safety mechanism,” and if the refinancing doesn’t reach that amount, it won’t move forward.

If that were to happen, the only risk is with the ratings agencies who will give ratings on the bonds, Laux said. If they provided a finalized rating, whether or not the refinancing moves forward, there will be a transaction fee with them, roughly estimated at $60,000. Laux said the ratings were expected to come back by today (April 15), the refunding bonds would be sold on Wednesday, April 22 with interest rates locked in on that day, and they would be closed on Thursday, May 7. Other business handled at the workshops included: Adopting the 2015 Personal Property Tax Rate. The board of supervisors voted unanimously to keep the personal property tax at $3.60. The only change recommended was to reduce the personal property tax for disabled veterans and volunteer

fire and rescue workers from $1.80 to $0.0001, which is the lowest amount it can be. Pat Weiler, county administrator, said because the rates stayed the same or went down, the county was not required to advertise the rate adoptions. The treasurer’s office is preparing to print bills for invoices that are due in June. Authorizing the purchase of a fire tanker for Powhatan Volunteer Fire Department Company 2 for $500,000. The board heard a presentation during its workshop on Monday, March 30 from a committee that worked on the project for more than a year. The county determined that it would be fiscally prudent to make a down payment of $125,000 on the fire tanker and enter into a $351,236 lease purchase for a total cost of $476,236 for the fire tanker and total equipment cost of $23,764.

The new tanker will replace the 1992 model the station is currently using. Raising the salary of Powhatan County’s commonwealth’s attorney, Richard Cox. The board ended its meeting with a closed session. After it came out of closed session, it voted unanimously to increase Cox’s salary by $11,700 annually effective April 1. Cox’s present salary was $117,173. Amending the board of supervisors’ bylaws to address closed meeting protocol. The Board has expressed a desire to add language to its bylaws to address closed meeting protocol that the board will follow. Tom Lacheney, county attorney, said the protocol states if there is going to be a closed session, the board members receive the information at the same time as the agenda schedule, no less than seven calendar days before the meeting.

Contributed Report The eighth annual Powhatan County Earth Day celebration will help jumpstart the spring festival season on Wednesday, April 22 on the Courthouse Green. The event, which will be held from 4 to 7 p.m., will feature more than 20 earth-friendly businesses and civic organizations, fun activities for children, and the sale of Brunswick stew and grilled sausages with all the fixings. People should also be sure to bring a chair so they can sit and enjoy the live music. The day’s activities start at 2 p.m. with a tree planting and blessing at the Powhatan County Public Library. The native Red Maple (Acer rubrum) is the eighth tree donated by Watkins Nurseries. Powhatan’s seventhand eighth-graders are participating by entering the Earth Day poster contest. Wear jeans in stance against sexual assault By Laura McFarland News Editor

A few years ago this writer had a very uncomfortable conversation with a man who truly believed that if women wear clothing that covers much of their body, they are protected from those who would want to harm them. This discussion on modesty and the way women and even girls dress today left a bad taste in the mouth. It was an old argument – one that has shattered all too many women’s lives. Showing a little cleavage or leg or wearing form-fitting clothes does not mean you are putting out a sign that says you want to be sexually assaulted. That idea is as reprehensible today as it was during that conversation. Unfortunately, it has too often been successfully used against women in court cases and everyday life in a way

that means after being victimized once by an attacker, they then have to endure being targeted once again by a family member, friend, official or courtroom. Christine Trotta, domestic violence program coordinator for the Powhatan County Department of Social Services, recently brought a couple of things to my attention. The first is that April is Sexual Assault Awareness month, a fact too many people do not realize. The second is that county employees have been invited to participate in a very simple yet worthwhile endeavor in the recognition of Denim Day, which takes place on Wednesday, April 22. This national movement is in its 16th year of having people wear blue jeans as a statement of solidarity against domestic violence and sexual assault. Denim Day grew out of a

1998 Italian Supreme Court decision that overturned a rape conviction because the victim wore tight jeans. An 18-yearold girl was sexually assaulted by her married 45-year-old driving instructor. He was convicted but on appeal the Italian Supreme Court overturned the decision, with one judge arguing that because the victim wore very tight jeans, she had to help him remove them, and by removing the jeans it was no longer rape but consensual sex. Enraged by the verdict, women in the Italian Parliament protested by wearing jeans to work the following day. In 1999, Peace Over Violence developed the Denim Day campaign in response to the case and the activism it sparked. In the local recognition of the day, county employees may make a $2 donation to the coun-

ty’s domestic violence program and receive the privilege of wearing blue jeans to work that day. This is a noteworthy idea and the county should be commended for inviting its employees to participate. Some people might look at it as just another opportunity to have a casual dress day and that is their choice. But, hopefully, at least once during the day the presence of these simple denim pants will sink in with both wearers and the people around them as a message that sexual assault cannot and should not be swept aside as a non-issue. In fact, it would be wonderful if we could take it a step further. Instead of only lauding county employees for participating in this initiative, what if it became an event all of Powhatan County could support? If you are a business owner or work at a business where your employers might be open

to participating in Denim Day, why not consider it? Even if you will be home all day, there’s still the opportunity to wear jeans and make a donation to the county’s domestic violence program or another program that helps victims of sexual assault and domestic violence. A few dollars – and surely Christine would want me to point out that larger donations are more than welcome – may not seem like much to one individual but if hundreds or even thousands of Powhatan County residents became involved in Denim Day, both by wearing jeans and donating money to the program, it could have a real impact on people’s lives. Denim Days is an observance that deserves the support of all Powhatan County residents. While wearing jeans on that particular day designates its significance, we should never forget that “no means no.”

In years long past, the declaration of Spring Break evoked a sense of excitement and unbridled energy unequaled by few events in my life. The annual respite from responsibility usually meant a trip to Florida where other youths gathered for a week of frolic and immature behavior. No doubt, the annual rite of passage had its detractors even then, and its reputation often shocked the general public. I can’t remember my mother ever actually endorsing one of my escapades. There also was a prevailing permissive sense by authorities who looked the other way as we crowded their streets and took over different beaches in Florida. As many Spring Breaks passed and my expertise regarding the escape improved, my choices for Spring Break also evolved. I spent my first Spring Break in Daytona Beach as a junior in high school. It was a different environ-

ment, and, as naïve first-timers, we were easily overwhelmed. As the years passed, the trips progressed farther South to Fort Lauderdale, the proverbial capital of sun and fun during Spring Break. It was a unique blend of hippies and fraternity types gathered for the same week-long goal of fun and sun. By far, my best collegiate Spring Break trip was spent in Key West in the early 1970s. The small island was still a largely undiscovered cove of creative and off the grid residents mixed with a large military presence. The culture was changing as the large Naval Base that dominated the small island for years began to close. Lazy days relaxing by the sun at the submarine slips gave way to fruity drinks and warm breezes at night, and the week passed too quickly. We became part of a community centered around a small hamlet called Boyd’s Campground on the causeway, and formed relationships that, in some cases, lasted a lifetime.

Snap back to the future, and I was not shocked to see a Fox News report citing the potential hazards of college kids on Spring Break. The network has become an annual permanent feature in Panama City, Florida, for years, as they expose the sins and sensation of Spring Break 2015. A reporter seemingly tried to keep a straight face as she listed the increased number of arrests, assaults and other elements that donate to the image of Spring Break today. Question is: Do the increased arrests and skimpier bikinis equate to a Spring Break that is deteriorating in to a Burning Man event? I don’t think so as I tweak my limited memory for thoughts of my days wasting away a week away from campus. I couldn’t help but asking almost aloud as the report continued, “What exactly did you think was happening at Spring Break?” I’ve got a sneaky suspicion the masses of kids on break today are probably doing the same sort of things we

did decades ago. And in even a more stark realization of what Spring Break means to me today, I’m preparing for a week of activities with my kids that don’t involve mass drinking, all night parties or the hint of a beach. We’ve planned things like a day at the park, a trip to the mountains and a most anticipated trip to Southern Season for milk shakes. I don’t begrudge or judge the students who probably do things on Spring Break they wouldn’t in their normal routines. After more than seven decades, Spring Break is becoming as American as apple pie. For those who are annoyed by the rituals performed at beaches around the country as spring arrives, perhaps they should turn their heads. As we prepare at my house for a less exciting Spring Break, what happens in Florida stays safely away, and, for years now, out of mind. Like the man said, “They have their way of partying, and we have ours.”

Bearing no fruit shouldn’t mark the end for apple tree By Drew Jackson Richmond Suburban News

If something can’t perform its stated function, does it become something different? This is an argument I’ve been having with my dad for years, one rooted, well, in the roots of a tree. For as long as I’ve known, my parents’ yard has been a row of two-story pines, two maples and a dogwood that just hangs out by itself. About 20 years ago, they added an apple tree more or less smack dab in the middle of the back yard. I had big plans for this tree. Once it was strong and tall enough, I would construct a tree house in its branches, from which I would navigate the snares and pitfalls of middle school. I would visit my parents in the main house for dinner and for Thurs-

day night viewings of the hit late 1990s medical drama, “E.R.”, but would otherwise live my life perched in the tree. I quickly learned how slowly trees grow, far slower than grass growing or paint drying and something more along the lines of countless tides beating rocks into sand. I calculated the tree being approved for occupants around the time I turned something called 25. Don’t worry, I turned out fine. Dreams of tree houses are easy to replace with video games. Though it is an apple tree by name, it is not one by profession. I can’t recall consuming a single apple having fallen from its branches, though it provided ample shade for the family dog. In the years its limbs were laden with blooms (future apples), late frosts wiped them out. In most years, though, it was

just a tree, a lush, verdant tangle of bark and leaves. In an attempt to figure out the tree’s inability to live up to its name, my dad has interrogated extension agents, lawn and garden salespeople, orchard owners, practically anyone who’s ever enjoyed an apple. He’s tried to balance nitrogen levels in the soil, he’s watched trimming videos on YouTube. I’m sure he’s prayed. All to no success. Years without blooms have put a target on the tree. In recent years, other fruit trees have joined the yard — peaches, more apples and a couple cherries. There’s a two-trellis grapevine that churns out enough fruit for a year’s supply of jam. These are all overachievers — skinny, diminutive twigs, dwarfed by the veteran apple tree, but always full of fruit. So my

dad wants to rip the old tree out. This spring it is once again bloomless, but, in my mind, blameless. Unless one is operating a commercial orchard or trying to ward off a tree disease, what’s the harm in a classic shade tree? I think part of me craves the underdog story of the tree, that maybe, against all odds and good sense, next spring will bear the prelude to summer apples. Maybe there’s a montage where the younger, more active trees teach the old one how things are done today; it starts to believe in itself once again and it claws its way back to productivity, going down in history as a model photosynthesizer. Employees to wear jeans in solidarity By Laura McFarland News Editor

POWHATAN – Powhatan County employees will have the opportunity to get casual for a good cause at the end of the month. The county is sponsoring a Denim Day event for its employees on Wednesday, April 29 that will allow them to wear jeans to work in exchange for a $2 donation to the Social Services Domestic Violence program, Christine Trotta, domestic violence program coordinator and the event organizer, said. While county employees are the focus of the campaign, donations to the department will be gladly accepted from anyone, she said. This is the county’s first time participating in the national event, which is being held to recognize April as Sexual Assault Awareness Month, she said. “I am hoping it increases awareness of sexual assault awareness month and increases awareness of the program we

have,” she said. “We have served hundreds of families in Powhatan since we began in 2008 and we want to keep providing that.” One of the services the domestic violence program offers is providing gift cards to help people with transportation and food costs, Trotta said. A few hundred dollars can give a good amount of gift cards to help provide transportation or to get food and other necessary items, she added. There has continued to be increased awareness of sexual assaults and domestic violence, but many incidents still go unreported, especially in rural areas, she said. “It is important for the people in our county to know there is a place they can go to receive support,” Trotta said. For the past 15 years, Peace Over Violence has run the Denim Day in L.A. and USA campaign on a Wednesday in April in honor of Sexual Violence Awareness Month. The campaign was originally triggered by a ruling by the Italian Supreme Court where a rape conviction was overturned because the justices felt that since the vic-

tim was wearing tight jeans she must have helped her rapist remove her jeans, thereby implying consent. The following day, the women in the Italian Parliament came to work wearing jeans in solidarity with the victim. Peace Over Violence developed the Denim Day campaign in response to this case and the activism surrounding it. Since then, wearing jeans on Denim Day has become a symbol of protest against erroneous and destructive attitudes about sexual assault. The rape prevention education campaign asks community members, elected officials, businesses and students to make a social statement with their fashion by wearing jeans on this day as a visible means of protest against the misconceptions that surround sexual assault. A stroke away from Olympic immortality Powhatan High School junior Casey Fanz is on the precipice of history. The 16-year-old swimming phenom will attend the Olympic Trials in Omaha next summer for a chance to represent the USA at the 2016 Olympic Games in Rio de Janeiro. By Mike Schoeffel Sports Writer

When Casey Fanz finished the race that qualified her for the 2016 Olympic Trials, she admitted to being a little disappointed. “I touched the wall, and when I glanced at the scoreboard, I looked at the place, not the time,” she said. “I finished fourth, so I was automatically bummed because I wanted to win.” “It was definitely awesome,” she adds. “But I wish I would have won.” That race, the 50M freestyle, took place on the final day of NCSA Junior Nationals in Orlando at the end of March. Fanz needed a time of 26:19 to make the cut for the Olympic Trials. She just snuck under that cut-off time. It

was a landmark moment for Fanz, a 16-year old junior at Powhatan High School, who has been slashing her way through the pool for nationally-renowned Poseidon Swimming for almost five years now. She is currently the most prolific female swimmer at the Richmond-based club, boasting a whopping 17 records between the 11 and 16year old age groups. (Fun fact: The second most prolific female swimmer currently at Poseidon is Meghan Burton, who holds 15 records). Yet despite an evergrowing list of accomplishments, Fanz remains humble and focused. She is careful to temper her expectations every time she enters the pool, even as she passes milestone after watery milestone with

Monty’s Time

A niece to three legendary Powhatan High School athletes, Montiera Johnson wrote her own chapter in school (and family) history – and became one of the most decorated female athletes in PHS history along the way. By Mike Schoeel Sports Writer

You could say Montiera Johnson was born into a life of athletics. Her uncle, Shawn Minor, is one of the finest athletes the school has ever known. A 2010 PHS graduate, Minor was a four-year starter in football, basketball, and track. Standing at only 5’7�, he was simultaneously an athletic phenom and a physical anomaly, a natural born athlete whose legend first started to bloom when he threw down an effortless dunk in front of the entire student body at a pep rally his freshman year. He went on to set the school high jump record (6’10�), a mark that still stands to this day. He was skilled on versatile on the football field, where he racked up 2,257 all-purpose yards (third most in school history) in four years, playing quarterback, running back, and wide receiver. Perhaps the peak accomplishment of Shawn’s prep career, however, was becoming the all-time leading scorer for the boys’ basketball program.

Walk down the main hall at Powhatan High and you’ll find physical proof of Shawn’s Legend: enclosed in a glass case is a black-framed photograph of Minor in a black tie, next to a two-paneled basketball with the words “Shawn Minor. School Record. 1,188 Career Points. 2006-09� printed in bold, black ink. Johnson has seen her uncle’s display. She’s internalized it. Used it as inspiration. “Shawn has influenced me in a big way. I really don’t think he knows how much,� said Johnson. “I would walk past the record board in the main hallway and see his name and all the things he’s accomplished.� But Shawn isn’t Johnson’s only familial athletic predecessor. Johnson has two other uncles – Kevin Minor (Shawn’s brother) and Ray Brown – who have taken on almost mythic status in Powhatan athletic lore. Kevin Minor, like Shawn, was a three-sport star. He threw the game-winning touchdown in the 2003 state championship game that sealed the only perfect season in Powhatan football history. Brown was also a football standout, a powerful running back who holds both the single game and single season school records for rushing yards. He could hold his own on the track, too – he broke Shawn’s record in the 100 meter before walking across the stage to snatch up his diploma. This was the legacy of athletic success Johnson walked into when she entered PHS in the fall of 2011. Shawn had graduated a year and a half before. Kevin had been out of school for nearly a decade. Brown had moved on to the football team at Averett University. These halls were hers now, and her family’s athletic tradition rested in her hands. She held the pen – how she decided to write what will likely be the final chapter was entirely up to her. She wrote it well.

She earned a starting spot on the varsity basketball team right off the bat, scoring 221 points and leading the team in steals (44). At the end of the season, she was named Most Improved Player. “She came in and made a big impact her freshman year,â€? said longtime Powhatan girls basketball coach Paulette Bowman. “She learned on the fly. It didn’t really take her much time to adjust to the varsity game. And then after that, she continued to improve. She would do anything to help the team.â€? Having a chance to start her freshman season showed Johnson that her coach saw potential in her from the beginning, she said. “A lot of people don’t get the opportunity to start on a varsity sport for four years. But me getting that chance‌took me through a lot of learning experiences,â€? said Johnson. Bowman would continue to play a major role in the development of the promising young athlete. When spring of 2012 rolled around, Johnson, a track star in junior high school, had second thoughts about going out for the track team. She strained her meniscus in the long jump as an eighth grader, and as she put it, “didn’t think I would have the guts to do it again.â€? But Bowman, who also coaches track, told Johnson to give it a shot, employing the long-held wisdom that an athlete should play every possible sport in high school to keep from having regrets later

in life. Eventually, Johnson agreed. It turned out to be a prosperous decision. As a freshman, Johnson overcame the fear of injury to earn all-state honors in the long jump. A great achievement, all things considered. But her sophomore year with the track team produced one of the greatest stories in PHS athletic history. Going into the state meet, Johnson was a favorite to win a state title in the long jump. But when the big day came, she realized she was missing a valuable piece of equipment. “I left my track shoes at the high school,� said Johnson. “I had to jump in Bowman’s sneakers, which were two sizes too small.� Thankfully, Johnson is accustomed to filling shoes. She never missed a beat, and by day’s end captured a state title in the long jump and broke two school records. “You can’t teach that,� said Bowman. “That’s just the type of athlete she is.� Over the next year and a half, Johnson continued to expand her legacy. Her junior year saw her collect all-state honors in the long jump and triple jump for the third time. On the basketball court, see LEGACY page 4B

Powhatan: are you ready to ride? Fifth annual Powhatan Historic Bike Tour benefits Free Clinic of Powhatan Contributed Report Six years ago, a group of Powhatan bicyclists came up with an idea to organize a tour to not only showcase their county’s beautiful country roads, but, more importantly, to raise money for a worthy cause – The Free Clinic of Powhatan. After months of planning, organizing and recruiting volunteers, the Historic Powhatan Bike Tour was created.

“The first year, the Powhatan bike tour had just over 100 participants,” Maureen Moslow-Benway, the tour co-director, said. “The tour has grown each year and now has several hundred riders. Even better, over the course of the past four years, the bike tour has raised more than $25,000 for the Free Clinic.” The course was selected with both safety and scenery in mind. Cyclists have their choice of three different ride lengths—31, 62 or 100 mile rides, all of which traverse bucolic country roads. The Historic Powhatan Bike Tour begins with an all-you-can-eat pancake breakfast at a popular Powhatan institution: The County Seat Restaurant located right in the heart of the Courthouse area.

One of the most unique aspects about the Powhatan Bike Tour is that the majority of the rest stops are located at special historic sites along the course. For example, the riders’ first rest stop is at Mosby’s Tavern, a beautiful historic farm that was a meeting place for militia at the onset of the Revolutionary War. breaking chapter to the book of Brown, Minor, and Johnson. Down went Shawn’s record, and along with it the girls’ scoring record, too, which had been held by Kali Brown. Johnson said she has never felt more proud than when she surpassed those two milestones. “Breaking Shawn’s and the women’s record were the biggest moments of my high school

career,” she said. “It was something I’ve wanted to do since the day I saw Shawn’s ball and picture in the main hall at Powhatan High.” The records solidified what Bowman already knew – that Johnson was one of the best players in the history of the girls basketball program. “She’s definitely in the top five, if not the best, that I’ve ever coached,” said Bowman.

“There’s absolutely no doubt about that.” Shawn noted that he didn’t think the apple had fallen too far from the tree. “I see a lot of me in her game,” said Shawn. “We are not the tallest family in the world, so we learned to adapt and find various skills that would help us succeed as much as possible when the odds are against us.” Due to tendonitis in both her knees, Johnson won’t have an opportunity to pursue a fourth

consecutive all-state selection in track and field. Instead, she’ll spend the spring and summer months weighing her college options. As of now, she has it narrowed down to Eastern Mennonite University and Virginia Union University. She knows she wants to play basketball at the next level. If everything falls into place, she may do track as well. As for what keeps her fire burning, it’s all about maintaining the respect

of those she loves most. “Making my family proud [keeps me motivated],” she said. “And becoming a role model to a child wanting to be something in their life. As I grow, my dreams expand. I notice the bigger my dreams, the harder I have to work to make them become reality.” One thousand, two hundred and sixty nine. Maybe it was once a dream. But now she knows the number by heart, because it’s all hers.

ment is scheduled to take place. “We have a lot of good events coming through the county this year,� said Woodel. “It’s a good thing to see.� The Area 6 softball tournament will be the first of those events, and according to tournament director Doug Chaffins, 10 teams from Area 6 – which includes the counties of Chesterfield, Goochland, Powhatan and New Kent – will participate in the daylong competition. Twenty games are expected to take place throughout the day, and the action is expected to last from 9 a.m. until about 4 p.m. A special skills division will be available for individuals who aren’t physically able to play competitive softball. Around 150 coaches, players, volunteers, and umpires are already on board, and many will be making the trek to Powhatan from other locales within Area 6. Woodel points to the large influx of people as a big time positive for the local economy, especially since that number doesn’t take into account family, friends, fans, and additional people that will enter the county to watch the games. “It’s nice to finally have a local tournament,� she said. “The revenue dollars that are created by bringing large tournaments in will have a positive economic impact on the county.� The majority of the registered teams hail from Chesterfield, but Powhatan will boast one team of its own. If all goes as planned, the Area 6 tournament may become an annual event in Powhatan. “It’s a big deal,� said Chaffins. “We want it be something special for the kids and the community. It’s also an opportunity for us to show off this wonderful facility we have here.� “And, of course, we’re looking to win,� he added with a grin.

COUNTY OF POWHATAN, VIRGINIA PUBLIC HEARING PROPOSED ANNUAL OPERATING BUDGET AND REAL ESTATE TAX RATE FOR THE FISCAL YEAR ENDING JUNE 30, 2016 (FY 2016) The Board of Supervisors of Powhatan County will hold a public hearing for the purpose of public information and fiscal planning regarding the annual operating budget for the fiscal year ending June 30, 2016 (FY 2016). The hearing will be held on Monday, April 20, 2015, at 7:00 P.M. in the Village Building Auditorium, 3910 Old Buckingham Road, Powhatan, Virginia. The public hearing is for the purpose of allowing the public to question and comment on the proposed annual operating budget and proposed tax rate for real property. All citizens are invited to attend and share their views on the proposed budget within such reasonable time limits as shall be determined by the Board of Supervisors. A summary of the proposed annual operating budget is available for public inspection from 9:00 A.M. to 5:00 P.M. weekdays at the County Administrator’s Office at 3834 Old Buckingham Road, Suite A, Powhatan, Virginia and on the County’s website at www.powhatanva.gov. The hearing is being held in a public facility believed to be accessible to persons with disabilities. Powhatan celebrates horse lovers Celebration of the Horse fundrasier set for May 2 Contributed Report

All things equine will take center stage at a new spring fundraiser at Belmead in Powhatan County. The new Celebration of the Horse fundraiser will take place on Saturday, May 2 on the historic property. Proceeds from this event will support the FFA and 4-H youth programs in the county, as well as maintenance of the roads of FrancisEmma, which are utilized by the equine community, farmers and other visitors. The event will be hosted by Powhatan Farm Bureau, Powhatan FFA Alumni and Belmead Stables and Riding Club. FrancisEmma is located at 5004 Cartersville Road, Powhatan. There will be a $5 parking fee

per car load. The rain date for the event is May 3. The main attraction for the day will be a horse show featuring 19 classes in Western, English, Hunter and Dressage at Belmead Stables and Riding Club. There will be opportunities for novice riders on up to advanced riders, and all ages are welcome. Nicole Zoet-Oostermeyer has volunteered to be the Dressage judge. To kick off the horse show, a Parade of Breeds Class will begin at 9 a.m. The parade is free to enter, according to event chair Rose Borkey. “We want to showcase your wonderful horse and his breed. Come on out and show off your wonderful steed,” she said. “We’re having a fantastic intermission entertainment.” There will be exciting speed demonstrations by Powhatan youth Lexie Akins and Elizabeth Jones. Both are members of High School Rodeo and Foal’N Around 4-H Club. In addition, Caitlin Reamy of Foal’N Around 4-H Club will present an obstacle course demonstration with

several miniature horses. Marty Adams, equine nutritionist for Southern States, will be a featured presenter for the day. Check Facebook for specific topics and times. For nonriders, there will be plenty for the whole family to enjoy. Along with the horse show, the event will feature a silent auction, raffle, Belmead Mansion tours and food for sale. For the children, the minis will be available for petting and pictures. All types of vendors will be on-site for the day as well.
