A Marketing Feature of
The first year draw limit and the 60% rule
There are very few restrictions or limitations on a HECM (Home Equity Conversion Mortgage), which is a loan program that is also known as a reverse mortgage. However, there is one element of the HECM that does limit how much money you can take out at closing and for the 1st year after closing. Let me explain.

HUD (Housing Urban Development) has a restriction that does not allow homeowners to take out 100% of the available funds from a HECM unless it is to purchase a home or to pay off liens on the property. This is known as the 60% rule which limits the homeowner to accessing 60% of the initial Principal Limit (this is also known as the amount that you can borrow), or 10% above the mandatory obligations (this is a combination of mortgage balances/ liens and closing costs).
The 60% first-year limit on funds from a HECM is a critical safeguard implemented within the lending framework to ensure responsible utilization of home equity. This regulatory measure, mandated by HUD, serves as a protective mechanism for borrowers, preventing them from rapidly depleting their accumulated home equity. By restricting the initial disbursement to no more than 60% of the total eligible amount, borrowers are encouraged to exercise prudence and consider the long-term implications of their financial decisions. This limitation not only mitigates the risk of borrowers exhausting their home equity prematurely but also fosters a more sustainable approach to utilizing HECM proceeds, promoting greater financial security and stability in the later stages of homeownership.
So, let’s break this down in an example. If you own your home free and clear and you do not have a mortgage, you will only be able to access 60% of the initial principal
limit when you close your HECM and for the next 12 months. After 12 months, there are no restrictions on using the funds. For example, if you can borrow $400K (this is called your Principal Limit), you will be limited to the first $240K of the HECM at closing and for the first year after closing. The remaining $160K are your funds and will continue to grow in your Line of Credit (LOC), but you cannot access these funds until 365 days have passed since your HECM closing.
Due to this restriction, it is advantageous and recommended to get a HECM before you “need” it. This allows you to start that 1-year clock sooner and allows your available funds in the LOC to grow and grow. This also helps to ensure that when you need the money or you want access to the money, you will have access to 100% of the funds and you will not have to wait a year.
Alternatively, if you owe more than $240K in this example, you are allowed to borrow more than 60% to pay off all liens on the property and to pay for the upfront closing costs. Plus, you can also take out an additional 10% of the principal limit (that is another $40K in this example).
Lastly, if you are purchasing a
home using a HECM, you are allowed to use 100% of the initial Principal Limit at closing. So, assuming the client can qualify for a $400K HECM to purchase a new primary residence, the client can once again use 100% of the $400K at closing to purchase this new home.
It is important to understand that there are both fixed-rate and adjustable-rate options with the HECM loan program. However, this rule only applies to the adjustablerate option. Under the fixed rate option, you are required to take all the available funds at closing, and you cannot access additional funds in the future. In some cases, the available funds are typically less with a fixed rate as well which is why almost all HECMs use the adjustable-rate option today.

In the everevolving landscape of real estate and home design, trends come and go, but one thing remains constant: home buyers know what they want.
And in 2024, homebuyers desire a smaller, more intimate home and well-crafted spaces that withstand the test of time.
In a reversal of the 2021 quest for larger homes to serve as a work-for-home space, the average size of a new home is declining — dropping from 2,479 square feet in 2022 to 2,411 square feet in 2023, the smallest average size in 13 years, according to the National Association of Home Builder’s (NAHB) 2023 What Home Buyers Really Want study.
Homebuilders are responding in kind, with a signi cant number opting to construct smaller homes to cater to the demand for a ordability and practicality. irtyeight percent of homebuilders say they built smaller homes in 2023, and 26% report they plan to build even smaller homes in 2024 — in part to provide more a ordable homes.
While the square footage home buyers seek may be shrinking, they are not compromising on quality or amenities. Homebuyers are placing value on personalization,
authenticity and certain amenities. Features like laundry rooms, patios, energy-e cient windows, ceiling fans, garage storage, a full bath on the main level and hardwood ooring remain at the top of their wish lists, according to the NAHB survey. Additionally, eliminating formal dining rooms in favor of eat-in kitchens and incorporating outdoor replaces and kitchens underscore a preference for spaces that facilitate comfort and socializing.
Technology features — security cameras, wired home security systems, programmable thermostats, video doorbells, multizone HVAC systems, and energy management systems — are growing in popularity.
A notable trend emerging in
2024 is the desire for handmade features and traditional materials that portray a timeless style and can be a sustainable choice when renovating, as highlighted by the 2023 U.S. Houzz Kitchen Trends Study. Homeowners are gravitating towards handmade tiles, custom bathroom vanities, and other one-of-a-kind details that exhibit a feeling of uniqueness. Natural wood stains and warmer neutral tones are replacing the cool grays and stark whites of previous years, creating environments that exude warmth and tranquility, reports Houzz.
Quiet luxury is the hot design trend for 2024 — and it’s expected to last into the future, according to homeandgardens.com. is trend is de ned by sustainable, natural materials, classic and timeless
elements, artisanal handmade pieces, and quieter, muted color palettes that feature browns, greens and blues.
In fact, designers point to the most notable trend as the exodus of cool grays and stark whites toward warmer neutral tones, including beiges, creamy o -whites, and rich browns. ese tones provide a calm, welcoming environment. Blue and bold, saturated jewel tones are popular color choices this year.
As the housing market continues to evolve, one thing is clear: the de nition of luxury is no longer con ned to square footage or extravagant features. The Group Real Estate names Wynn Washle new board chair

GREELEY – The Group Inc. Real Estate Board of Directors has named 25-year veteran Washle Washle, Ph.D., to serve as board chair. Before he began his real estate career on July 1, 1999, Washle earned a doctorate from Virginia Tech and ran a private practice in marriage and family therapy for 10 years. He was also president of The Teamwork Group, a consulting and training company focused on helping companies with their expansion while developing their leadership and management skills; Washle’s background is directly applicable to The Group, which plans to expand east and south from its current base in Fort Collins and Loveland.

The idea of having a vacation home can be very exciting. In fact, many Colorado residents do have vacation homes in ski country, or in the islands to get out of the snow. However, careful consideration is necessary regarding the disposal of the property once the family no longer needs it or ensuring its continuity within the family. For instance, if a couple with four children owns a vacation home, upon the couple’s passing, the property suddenly becomes co-owned by their four children. As subsequent generations emerge, the number of owners could grow significantly; within just three generations, there could be anywhere from 10 to 20 owners. Such a scenario often leads to varying opinions on how to manage the property. Some of the new owners might perceive the ownership as more of a burden than a boon. Therefore, investing time and effort into crafting a succession plan is invaluable.

Determining the title ownership structure is among the initial choices to consider. Amidst the thrill of acquiring a vacation home, many purchases are made without thorough deliberation on how to hold title. Joint tenancy or Tenants in Common are common choices, often serving the immediate need but potentially lacking foresight for the future. As time progresses, owners often overlook the importance of revisiting the title holding arrangement or establishing a succession plan.
There are many ways you can hold title beyond the two mentioned above. You will need an attorney familiar with estate planning and succession planning to help you decide which one is right for you and or your family. The state you live in, or where the property is located, might impact which form of ownership is used.
Here is a list of title possibilities:
• Trusts and General Partnerships
• The Close Corporation
• S Corporation
• Limited Liability Company
Each form of ownership has advantages and disadvantages. Here is a list of possible questions you can ask your attorney as you consider which form of ownership is right for you.
• Does the entity shield owners from claims of creditors?
• Can an owner file an action for partition of ownership?
• If the property is in a rental program, is there an ability to pass through taxable income and loss to the members of the entity?
• Can the entity hold an endowment to support the property?
• How are the governing documents amended?
• Tax treatments for the entity.
• What is the process if an owner wants out?
• Does the entity exist in perpetuity?
• Does the entity create agreements for usage, expenses, maintenance, supplies, cleaning, improvements, etc.?
Preventing the vacation home from being a burden
Upon the passing of the original owners of the vacation home, heirs may hold divergent perspectives on managing the property. Some may prefer not to have their inheritance tied to a vacation home, while others might perceive inheriting the property more as a financial burden than a gift. Often, the original owner’s intention was to preserve the property within the family so that subsequent generations could enjoy it as well. One strategy to retain the property within the family without imposing financial strain is for the original owners to establish an endowment fund to cover expenses. To implement this, it’s essential to identify the expenses involved and determine the necessary amount of funds to be allocated to generate
sufficient income to cover those expenses.

This weekend Boulder Creek Neighborhoods is celebrating the grand opening of their Limited Edition luxury home designs exclusively for Baseline, one of the most beautiful and sustainable urban-meets-nature communities in all of Colorado.
From 11 a.m. to 5 p.m. on March 16 and 17, the Iconic and Dynamic home models by the lifestyle builder Boulder Creek Neighborhoods will be available to tour, with baristas from Goodhart Coffee offering complimentary warm beverages and snacks between 11 a.m. and 1 p.m. both days.
Baseline is a master-planned haven for business, retail, education and natural well-being in a supremely walkable setting, located at the junction of I-25, Northwest Parkway (E-470) and Baseline Road in Broomfield and with easy access

With the winter thaw, so comes the red hot spring selling season! Typically a critical time for those looking to sell their properties prior to summer, it is more important than ever for home sellers to put their absolute best foot forward.
When it comes to properly preparing a property for sale, many experts argue that successful home staging is the key to the most lucrative sale. Staging is often seen as a key marketing tool as it relates to selling a property for the most amount of money in the shortest amount of time.
Stumped as to where to begin to get your home sale ready? Here are 7 expert home staging selling tips to help get you started:
Purge! The first aspect relating to preparing a property for sale relates to the removal of all excess. From extra furniture to clothing, now is the time to make your home feel as spacious as possible.
Create a basic marketing plan. A seller may need their real estate agent’s help with this one. The goal of this step is to simply decide who your target buyer is, as in some cases this may influence the staging process.
De-personalize. When a potential buyer walks into a property, it is important for them to feel that it could be their home. Everything from personal photos to religious references should be removed.
Neutralize. Even something as simple as repainting or replacing carpeting can be a deterrent for potential buyers. Taupes and grays are ideal colors to create a neutral, soothing color palette.
Hire a professional stager. When it comes to what is for most Americans their single biggest asset, you may want to trust the staging of your home to a professional. One can begin by researching local staging companies; some may specialize in a specific style or
geographic area. Additionally, The Real Estate Stagers Association is a great place to start when looking to hire a professional stager or staging company. Concerned about cost? Most professional stagers are able to work within various budgets.
Return a room to its intended use. For example, a bedroom currently used as a home office must be staged and styled as a bedroom. Create a timeline. When you place your property on the market can be critical in capturing the most amount of potential buyers. Earlier in the selling season is best.
