CONVERSATION WITH
Loots attorneys By Benito Mamaile
Who is Jacques Loots? Jacques Loots grew up in the small town of Grootvlei in Mpumalanga. Is the 3rd child in the family and when I was in Grade 9 our family moved to Vereeniging. I studied at North West University in Potchefstroom for a year where after I decided that I need to get practical experience while I completed my degree. I then registered at UNISA and completed my LLB degree while working at Langenhoven Attorneys in Vereeniging. I was admitted as attorney in October 2013. In June 2014 I opened my own practice which initially was run from a home office. After two years in 2016 it was necessary to move the office away from home and get a dedicated office space and as such I currently run Loots Attorneys from 231 General Hertzog Road in Three Rivers, Vereeniging. I am happily married and I am the proud father of 3 boys all under the age of 4 years which of course means that I am very busy both at the office and at home. Why did you choose to become a Lawyer? As one grows up we have a lot of different answers to the question of “What will I be when I grow up? I always thought that I will go into science like my father but that changed in High School when I realized that I do not like chemistry at all. I was then torn between two choices being Computer Programming and Law. I then realized that I am a person that needs interaction with other people as that is where I get my energy from and as we as lawyers work with people on a daily basis that was the obvious choice. Today I am very happy with my decision as I daily meet new people and have the added advantage of working for myself.
What motivates you daily as a Lawyer? As I like people I like to help them with solving their problems. I always like to hear the different perspectives that clients have on their problems as well as their unique way of attempting to resolve the situation. I like to bring people together in order to attempt to reconcile them and to resolve their issues in an amicable manner. I believe that if you treat a client with the necessary respect and truly listens to his needs and address them with the resolution thereof, they will be clients for life and will return if they encounter another legal issue down the line. What is the mission of Loots Attorneys? I believe that legal services must be affordable as well as accessible. I therefor assist older clients as well as clients who have difficulties with transport by seeing them at a location that they can access easily or at their homes. I also see my corporate clients at their offices as it helps me to get a clear perspective on their issues as I can experience it on site and communicate with as many individuals as is necessary to get a full perspective. This also assist the clients as they do not need to leave their businesses in order to obtain legal advice. I have a very hands on approach and therefor I like to do as much of the work myself as I can manage the quality of work. I also believe that clients must have access to the best available legal advice. I have a network of other lawyers that I work with on a referral basis. This is in effect that should a client have a specific legal problem which falls outside of our legal expertise, I can arrange that the client is assisted by a specialist in that field in order to ensure that the client get the best possible legal assistance. As the legal field is so extensive, I believe that you have to be honest enough to admit to a client if a matter falls outside of your area of expertise and then rather refer the client to someone with the necessary knowledge. What do you think makes you stand out from all the other lawyers? I believe that the personal assistance that I provide to clients and the open line of communication with my clients is something that clients have learned to appreciate. I also believe that clients need to be assured that you listen to their problems and that you will actively seek to assist them therein. Clients must be able to rely on your honest opinion and advice. I also try to be affordable in order to make legal assistance more accessible for clients with limited resources. We will be participating in the National Wills Week from 11-15 September 2017 being an initiative of the Law Society of South Africa wherein we will assist clients with drafting a free will during this week. Please see our full page article on the importance of a will in this issue on page 6. What advice do you have for aspiring lawyers? Make sure that it is something that you really want to do and don’t do it because of what you see on Television. Being a lawyer comes with a great burden of responsibility. It is therefore important that you understand that you will need to tend to the problems of your clients over and above the challenges that you may experience in your personal life. You must have a passion for people and be willing to listen to their issues and treat them with the necessary respect. I would also suggest that they try to study part time and start working at a law firm while they are completing their studies, the practical experience will be invaluable to them when they enter into the legal profession.

featured More about Loots Attorneys L
oots Attorneys is owned and run by Jacques Loots an admitted attorney. Jacques completed his degree at UNISA and completed a course in Advanced Labour Law at the North West University. We are based in Vereeniging and strive to focus on the needs of every individual client as we have learned that every client has specific needs and that there are no “copy and paste solutions to problems where people are involved. We currently manage the property portfolios of various clients can therefore assist clients with all aspects with regards to property related matters. We also have various estate agents that exclusively refer their clients to us for assistance with purchase and sale agreements, rental agreements, property transfer advice and all other property related queries.
We also attend to divorce matters for clients with the main objective being to assist the clients to reach a settlement agreement which is both fair and cost effective as prolonged litigation can cause financial difficulties for clients in a time when finances are especially limited. Divorce is a challenging time for clients as they need to prepare themselves to set up a life without the financial assistance of their spouses and need to tend to the maintenance of the children, it is therefore imperative that the parties come to an agreement quickly to save on legal costs and to ensure that clients have finances available to meet their obligations rather than pay legal fees. We assist our corporate clients with agreements needed in order to run their businesses efficiently. These agreements includes labour agreements, joint venture agreements, service level agreements, sale agreements etc. We also assist with advice and reviewing of contracts on clients prior to them signing in order to enable them to make informed decisions on the risks involved and to highlight the positives and negatives of each contract. We have also assisted various clients with disciplinary hearings and the review of their disciplinary procedures in order to ensure that they are both procedurally and substantially fair. For the individuals, we assist with issues they may have with regards to debt administration, wills and estates, divorces, maintenance, employment agreements and property related questions and concerns.
You must have a passion for people and be willing to listen to their issues and treat them with the necessary respect.
The layout of our offices ensure that the privacy of clients are ensured and each matter is treated with the highest regards to the confidentiality and privacy of the client in order to ensure that they are comfortable to discuss the more sensitive matters. budgeting
“ W e invented
money and we use it, yet we cannot … understand its laws or control its actions. It has a life of its own.” Lionel Trilling So much has been said and written about the subject of money and I thought of adding my voice with the hope that you will find value about this elusive subject. Every year our Minister of Finance stands up to present the budget and the state of the nations’ finances. Similarly, presentations without much pomp though, municipalities do likewise. At company levels, financial officers do a similar exercise and boards of directors and top management deliberate and take action on company budgets and financial statements. A picture emerges, indicating the financial state of the institution and where it’s heading. A question arises as to why we don’t seem perturbed about our personal financial planning and condition? Is hope the only strategy? Your financial journey begins when you embrace the concept of budgeting and living according to that blue print. Create a spreadsheet or find a free App online to assist you to compile your budget. Take note that this process is not just about placing figures on the columns but is a basis for your financial well being. Put your mind and heart into it and take ownership even if the situation looks hopeless.
Budgeting “Money is like a sixth sense without which you cannot make a complete use of the other five.” W. Somerset Maugham The following are some of the benefits derived from budgeting and living according to your budget; • • • • • •
Helps you to understand your income and expenditure Provides clarity as to where your money is going A control tool for your cash flow Provides a basis to evaluate your financial state A basis to develop your financial plan A tool to control your debt burden
WWW.BUSINESSXPOSURE.CO.ZA
Your Income There are others who prefer to create a budget on a month by month basis, but you can compile one over a period of twelve months. Complete your anticipated salary cash flows. If your earnings are commission based, break these down for the coming twelve months basing that on the previous earnings. At a glance you can see what you anticipate to earn this year. If you don’t like the figures, maybe it’s time to start thinking how you intend changing that.
Expenses Now the spending begins, at least on paper that is. Split your expenses into two categories namely fixed and variable costs. Your fixed expenses could include mortgage repayments, rent, motor vehicle repayments, etc. And your variables will include groceries, electricity, Dstv, air-time, fuel, etc. Add these up to establish your total expenses and work out the surplus or deficit from your income. The condition of your financial life starts to show now. When it comes to taking action on your budget, it will be much easier to make changes on your variable expenses like cutting off newspapers, downgrading Dstv, join a lift club, etc. Your financial discipline will show by how you deal with your expenditure items. The money that you will ‘recover’ from this action can immediately go towards reducing your debts or building up your savings or investments. Whilst at this, you may start thinking about other ways of augmenting your income, start a part time business, do weekend jobs, etc. This might be easy to do for some but I strongly recommend that you get your expenses under control prior to worrying about your income.

budgeting
The only liabilities you need are those that help you to acquire wealth producing assets in support of your financial goals.
continued from previous page
Where is your money going? It can shock you once you establish what you are spending your money on, weekend splurges, takeaways, all these unnecessary expenses may surprise you when you see the real figures. Living on budget will limit your expenditure as you start spending only as planned or in some cases simply avoiding the expenditure. It is only through the use of a budget that you can understand or see where your money is going.
Evaluating your financial state There is a quote I read somewhere to the effect that a lot of people immediately after payday discover that they have more month at the end of the month than money at the end of each month. Maybe it is the reason why a lot of people get very anxious when payday draws near! This invariably leads many to incur credit card debt and become perpetual clients to micro-lenders. All of these non productive debts cause disastrous financial consequences. The interest rates and charges are high and place a strain on your cash flows and finances. Once you understand what is happening on your finances, it will be easier to start taking corrective action
by Morgen Moyo A Yearly Wealth Check “It is better that a man should tyrannize over his bank balance than over his fellow citizens.” John Maynard Keynes When last did you review your assets and liabilities? What impact did you have over your financial health this year? You need to conduct a yearly wealth check, grow your assets and limit your liabilities. The only liabilities you need are those that help you to acquire wealth producing assets in support of your financial goals. Know your figures and continually work on your numbers. The real value of money is derived from prudent investing and this must reflect on your personal balance sheet. Draw up a spread sheet listing all your assets and liabilities showing current values and calculate your net asset value, i.e. [Total assets – Total liabilities = Net asset value]. All your financial decisions must positively affect it. Your role is to grow this figure on a yearly basis and this is what you are worth in financial terms. Once you have done both your budget and yearly wealth check it becomes easier to develop your financial plan. Where do you wish to be financially in the next 5, 10 or 20 years?
Financial Plan “Despite what the media may lead us to believe, there is no such thing as overnight success.” Jason Lee A lot of people get lost when you start talking about a financial plan. But, again how can you attain financial security without a ‘road map’? Through your budget you can start allocating money towards savings and investments. This action leads a way to build capital over time. Once you have built a capital base, other opportunities will become available and you can start impacting on your financial destiny. As always, I advise that you approach a financial planner to assist you.
Conclusion Now that you know what your monthly surpluses look like, it’s time to save and invest. In case you are laden with debts, all hope is not lost, consciously start repaying those debts. Your financial situation will never improve until you start taking action by doing the uncomfortable, stick to your budget and goals. When the ‘test sheet’ comes at the end of the year, the results will show. All the best wishes as you take control of your financial destiny.

it’s never coming back. Instead learn from it for next time. BUY YOURSELF SOME NEW ITEMS: clothes, get your hair done, and

Golf & Personal mastery
Malethola Matube
Progressive Women In Golf
Golf is a lifestyle that transforms lives through enabling personal mastery. It is one game that enables individuals to discover who they are and want to better themselves. Known as a sport of leisure and as a gentleman’s game, golf is one of the most popular, well-received sports worldwide. Played on a large outdoor course covering anywhere between 30 and 200 acres, the object of the sport is to propel a small hard ball into a series of ‘holes’ with as few strokes as possible, using a variety of wood or iron-tipped sticks called golf clubs. SOME OF THE TOP 10 BENEFITS OF PLAYING GOLF ARE: Exposure to the outdoors – The nature of playing golf on courses as large as 200 acres requires players to be outdoors. Basking in nature provides us many health benefits for our mind and body. Studies have shown that constant exposure green areas relaxes the body, reduces stress and can aid in alleviating anxiety. Furthermore, exposure to sunlight allows the body to soak up vitamin D from the sun, promoting bone growth in youth and reducing the risk of depression, heart disease and certain cancers. Fosters relationships – Golf is a very socially enjoyable sport. It can be a great way to keep in touch with friends, provide opportunities to meet new people and help connect a community. Since golf is a game of that is not as highly intense or competitive as soccer or basketball, there is plenty of down time and silence for interacting with fellow golfers. Studies have even shown that a great number of business deals are closed on the golf course! Strengthens the bladder – This one is a bit surprising but it certainly deserves noting. Those frequent visits to your friendly course beer-cart girl can give your bladder a run for time. The longer you learn to hold it, the more you strengthen the capacity of your bladder. And, as noted by some women golfers, it’s also an effective way to strengthen leg muscles, especially in the quadriceps. Those crouching maneuvers used by those who can’t “hold it” are a unique way of doing leg exercises.
Burns calories – Covering 30 to 200 acres means a lot of walking! Skipping out on the golf cart and walking the average course can cover a distance between five to seven kilometers. If you opt to carry your own clubs, you’ll burn even more calories, too! With all the walking, carrying and swinging involved, golfers can burn up to 1000 calories in a single game. Keeps your heart rate up – Playing golf can lead to quite a bit of exercise for your heart. As is the case with burning calories, the walking, carrying and swinging will increase your heart rate, keeping it pumping and increasing blood flow. Naturally, this will lower your risks for heart diseases and decrease levels of “bad” cholesterol.
Good for your brain – As your heart rate increase, so will blood flow to the brain, which can stimulate and improve nerve cell connections. This can delay mental illnesses such as dementia. While competing against others, golfers will also compete with themselves for personal best scores. This type of challenging boosts confidence and selfesteem, while the mental alacrity involved in tallying scores, improving strategy and fostering hand-eye coordination will keep the brain active in logical functions. Improves vision – It requires pretty good vision to zoom in on that round, little white ball that may be yards away. Golfers learn to hone in on small targets from long distances and even when the ball is on the tee, prior to their swing, golfers are presented with the opportunity to evaluate the keenness of their vision while improving hand-eye coordination. Low-risk injury sport – Golf is a leisurely sport and, compared to other sports, the overall risk of injury is low because it is not a contact sport. Though golf is primarily a sport of strategy, coordination and accuracy, there is some physical activity involved given the walking, swinging and pivoting. Golf is a low-risk injury sport but still provides just enough physical activity to keep the muscles engaged. Better sleep – Since you are getting quite a bit of exercise, your tired body will thank you at night when it’s time for some long deserved rest. Golfers will fall asleep faster and sleep more profoundly, and are able to remain in a deep sleep for longer periods of time due to the amount of energy expended. Deeper sleep is necessary for your body to regenerate cell and repair any muscles and tissues. Reduces stress – Golf helps to alleviate stress. Being in an outdoor area where you can interact with others who share your interests is a great way to forget any troubles. The pleasure of walking in an open and natural environment and spending time with friends places golfers in a good mood. This is because playing a round of golf can release endorphins – natural, mood-enhancing chemicals within our brains, making you happier and relaxed.

New models SAY HELLO TO THE NEW VOLKSWAGEN T-ROC CROSSOVER! By Ryan Bubear
T-Roc will be offered with a range of familiar turbocharged engines After a lengthy teaser campaign and plenty of speculation, Volkswagen has finally pulled the wraps off its new T-Roc crossover on the shores of Lake Como in Italy. Positioned below the Tiguan in the Wolfsburg automaker’s growing SUV line-up, the new T-Roc rides on the Volkswagen Group’s ubiquitous MQB platform (and shares much with the Audi Q2), with the brand describing the newcomer as a “lifestyle crossover with SUV characteristics”. VW says the T-Roc will be offered in front-wheel-drive form as well as optional 4Motion all-wheel drive, and will be the first Volkswagen SUV available in two-tone paintwork. The five-seater features a claimed luggage of 445 litres (which VW describes as class-leading), expandable to 1 290 litres with the 60/40 split rear bench folded down. The crossover measures 4 234 mm long (which makes it 252 mm shorter than the Tiguan), and it has a wheelbase of 2 603 mm, a width of 1 819 mm (excluding side-mirrors) and a height of 1 573 mm. So, what’s happening under the bonnet? Well, the new T-Roc will be offered with a range of familiar turbocharged engines: three petrol TSI engines and three TDI diesels. There will be a mix of manual gearboxes and seven-speed dual-clutch transmissions.

Styling highlights include a wide radiator grille with integrated dual headlamps (and a fresh lighting signature), a chrome element that runs from the A-pillars across the complete side roof-line all the way into the Cpillar and the obligatory dark plastic trim around the wheel arches and side sills, as well as the T-Roc’s front and rear. Inside, the brand’s Active Info Display will be offered, while various driver assistance systems will also be available, including city emergency braking and a lane-keeping function. Adaptive chassis control and progressive steering will likewise be offered, along with electric operation of the rear hatch and keyless starting. No word yet on timing of local introduction, but Volkswagen SA has confirmed that it does plan to offer the T-Roc in South Africa. VW in Germany, meanwhile, has announced that the new T-Roc, which will be built in Portugal, will hit initial markets in Europe in November.
