REAL ESTATE AGENTS ASSOCIATION OF FIJI THE establishment of Fiji’s first Real Estate Agents Association has been a welcome development in a flourishing industry with over 130 certified salespersons.. And more notably, a move that meets aims by the Trade Ministry to transform local real estate into a respected and well regarded industry. Following its registration by an interim committee earlier this year, the association elected its first team of office-bearers, headed by Khelvin Realtors principal, Vyas Deo Sharma. “So far, we’ve already had two executive committee meetings, where we have established two sub committees advisory and general purpose,” the former Parliamentarian said. “Their roles would be to assist the executive committee where it will be required in order to have a smooth transition of the Association. “ Sitting as Vice-Presidents are Sakeo Lelekilagi (Golden Water Real Estate), CJ Shergill (Raine & Horne) and Aren Nunnink (Ki-Maren Real Estate), who respectively represent the Central, Western and Northern divisions. Anand Gounder (IROK) was voted in as General-Secretary, with the post of Assistant General-Secretary going to Shashi Prasad (Jet Set) and Romil Prakash (Excellent Realtors) as Treasurer, while Sam Mani (Paradise Realtors), Sohan Lal and Mohammed Ahmed make up the committee membership. “We have also formed Divisional committees for the West, Central
and Eastern and North, whose primary role is to get the objectives of the Association sailing smoothly in their divisions and to inform the executive committee on their progress.

Sharma has noted that a focal point of the association has been to combat unlicensed agents and the infiltration of foreign agents operating in Fiji on holiday and work visas without the necessary permits and authority of the REALB, an ongoing issue that has been raised at several workshops organized by the Board.
Prior to an organized front, agents have usually had to individually lodge complaints with industry watchdogs, the Real Estate Agents Licensing Board (REALB), which had continually lobbied for agents to form an association that would improve their representation.
As the Minister highlighted, while the Government has taken steps to make housing affordable for Fijians, it is the duty of real estate agents to work within the ambits of the law and ensure that the industry is clean of unscrupulous dealers.
And as noted by Trade Minister, Faiyaz Koya at the inception of the association’s committee and it’s first AGM, this industry forms an important part of the Fijian economy.
“This was the basis for the introduction of the Real Estate Agents Act in 2006. The Act essentially regulates the real estate industry in Fiji, in terms of licensing agents and their sales staff. The Real Estate Agents Licensing Board (REALB) in this regard, has been adequately resourced by the Fijian Government as part of its commitment to clean-up the real estate sector.”
“The growth of the real estate industry is closely linked to the performance of the economy – a strong economy leads to strong growth in the real estate industry.” With an increasingly great demand for housing, particularly in major urban centres, Koya has noted the various policy changes undertaken to ensure the availability of affordable residential properties to ordinary Fijians. These have included a grant scheme under the First Home Buyers program to encourage home ownership, applicable to individuals or couples with an annual income or joint annual income up to $50,000. Additionally, the Government’s national budget has increased funding for affordable homes from $25 million to
The Trade Minister has reiterated the need for industry stakeholders to make a collective effort to work together, be familiarized with rules and procedures of property transactions and ensure the protection of consumers’ rights. “The Ministry aims to transform the industry into one that is respected and well regarded. However, we cannot achieve this alone - it has to be a collective effort between real estate agents, salespersons, the regulating agencies and of course the consumers themselves – everyone has a part to play in this journey.”.

Foam Fire Extinguisher • suitable to fight liquid fires (petrol/ diesel). Pictured below is the Foam Fire Extinguisher which is identified by a black band and Foam Type written on the fire extinguisher.
Alarm Signaling Equipment (ASE) A fire alarm monitoring system that receives an instantaneous fire signal to alert the NFA and the building occupants of a fire in the building. Building owners are advised to contact the NFA on how to install this equipment. Pictured below is the ASE.
Fire extinguishers It is very important that all property owners keep fire extinguishers. There are four different types of fire extinguishers and each fire extinguisher has its specific use. It is also very important that the fire extinguishers are installed at the right place in the building and visible to all the staff. Water Fire Extinguisher • used to extinguish fires on combustible solid substances such as plastics, paper, wood etc. Pictured below (left) is the Water Fire Extinguisher which is identified by Water Type written on the fire extinguisher.
Carbon Dioxide (CO2) Fire Extinguisher • mostly used to extinguish liquid and electrical fires but should not to be used in closed confined space. Pictured below is the Carbon Dioxide Fire Extinguisher which is identified by a black band and Carbon Dioxide Type written on the fire extinguisher.
Smoke Alarms Smoke Alarms give out an instant warning signal after detecting a smoke in the building. Smoke Alarms can be fitted onto the ceiling at strategic points. They can detect fires in their early stages and give you those precious minutes to enable you and the rest of the occupants in the building to evacuate the property safely. Pictured below is the Smoke Alarm.
Dry Chemical Fire Extinguisher • used on combustible solid substances and liquid fires like oil, kerosene and electrical fires. Pictured below (right) is the Dry Fire Extinguisher which is identified by a white band and Chemical Type written on the fire extinguisher.
Fire Blankets Made up of fire-resistant material. Fire Blankets are especially placed in the kitchen area to put out hot cooking in the pot or frying pan fires. Pictured below is the Fire Blanket.

NEW INDUSTRY RULES PROPOSED WITH sprawling property developments rising around the country, a housing stock outdone by prevailing demands from new generation buyers and incoming legislations, Fiji’s real estate industry continues to undergo a period of substantial change and growth. Realty branch managers, agents and salespersons have been at the forefront of these changes and undertaken several consultative workshops organized by industry watchdogs, the Real Estate Agents Licensing Board for their direct input on proposed regulatory measures. As noted by the Permanent Secretary for Lands & Mineral Resources, Malakai Finau, such workshops have been the best ambit for property professionals to educate themselves on the regulatory requirements and functions of various industry stakeholders and to improve service delivery on both individual and industrial levels. “Property professionals such as real estate agents, valuers, property developers and estate managers all play a pivotal role in developing our housing industry,” he outlined. “Therefore, the onus is on you to provide your services in an ethical manner while maintaining the highest level of professional conduct to effectively contribute in our nations evolving into socio-economic maturity as a developing state.” Legislative proposals are centred on the draft Real Estate Agents Regulations 2017, which seeks to include governing
codes for professional practise, ethics and conduct, regulation of real estate agency work, prescribed real estate agency agreements and continuing professional development.

Additionally, real estate agents and salespersons are disallowed from handling any money for or on behalf of any party in relation to the sale or purchase of properties situated in Fiji, with offenders liable on conviction to a fine up to $10,000 or imprisonment not exceeding 6 months. However, agents and salespersons are still able to deliver crossed account payee cheques or cashier’s orders on behalf of any party, in favour of another party to the transaction and still entitled to remuneration or reimbursement for the management, repair or renovation of property, as due under a written contract or authorisation.
While an open market has given vendors and agents the discretion of deciding payable commission, consultations by the REALB have included discussions on standardizing this, although there has generally been opposition, with agents noting the varying lengths of time and effort given to various listings. And given the low inventory of available housing, agents continue to feel the pressure of providing and negotiating the sometimes-tricky agreements between landlords and tenants.

ALLOTMENT PROCESS BY TLTB AS the centre of all economic activity, agriculture, transport systems and tools of communications, land is an essential mark of wealth and power that few assets can match..
“Schedule A lands are mataqali lands that have been become extinct during the first formal land enquiry in Fiji (by Ratu Sukuna) and Schedule B lands these are unclaimed land during the first formal land enquiry in Fiji (by Ratu Sukuna),” confirmed the TLTB’s corporate communications office.
In Fiji, ownership is divided into Native, Freehold or State (Crown) leases, with each offering varying degrees of duration and tenancy conditions.
This allotment process is to determine the rightful owner(s) and claimants of land and returning it to them.
The Fijian Government’s Lands Ministry administers some 18,000 State leases that cover about four per cent of the country’s total land mass, whereas Native land retains traditional ownership by indigenous Fijian landowning units, and accounts for about 93 per cent of Fiji’s total land mass. And as opposed to individual ownership, Native land is communally owned by extended families (known as tokatoka), clans (mataqali) and tribes (yavusa). An initial Native Lands Ordinance was enacted in 1882, with a Native Lands Act in 1905. In 1936, over 80 per cent of land in Fiji were surveyed and registered under their customary owners, and by 1940, a new administration system for native land was established, known as the Native Land Trust Board, presently known as the I Taukei Land Trust Board (TLTB). These efforts were spearheaded by the late statesman, Ratu Sir Lala Sukuna, and now, some 77 years later, the TLTB’s Reserves Department is geared to complete an allotment process of Schedule A and Schedule B lands by 2018.
According to the TLTB’s Reserves Commissioner, Mosese Ratubalavu, the TLTB is trying to complete the return of all Schedule A and Schedule B lands from the State to landowners by next year. It’s been a lengthy process that began in 2000, when the allotment work was handed over by the Lands Department and formalized through Gazette Notice 1/12/2000, while the reservation of land had been ongoing, under Section 15 of the iTaukei Land Trust Act Cap 134. “This is important as this serves to secure the welfare of the iTaukei landowners by facilitating its purpose to ensure that reverted Schedule A and B lands are judiciously and effectively allocated to iTaukei (native) landowners,” he said. “This is bonded under the iTaukei Land Trust Act Cap 134 (Section 19) and the iTaukei Land Trust (Amendment) Act No 12 of 2002,” he said. “Reserves Department works under this law to ensure that land is reverted to the right parent communal units as well as ensuring that the landless units and the communal units with insufficient land are also catered for,” he added.
Ratubalavu noted that there were 157 parcels of land that are yet to be allotted, with an area of approximately 52,437.50 acres. “Like any other positive initiative as such there are always challenges faced like communication breakdown between landowners and the Provincial Office resulting in non-appearance of claimants, thus meetings are adjourned and rescheduled for another later date, and multiple claimants on one particular lot.” Other challenges can be attributed to geographical location, with overseeing the whole of Fiji and field inspections often merged with reserve sittings (or bubului), and thus resulting in limited inspections. Additionally, the TLTB has to contend with a backlog of allotment cases, due to unforeseen circumstances and confused communal units challenging allotment findings, which is either Holdings or Reserves. Given the sensitive and sentimental ties associated with native land for indigenous landowners, this allotment process is a critical course to determining ownership by landowning units and hopefully settles claims by warring factions.
