Instead of competing with everyone, we decided to go with the “niche” marketing plan and provide for a specific type of client.

PROPERTYNC MAGAZINE AT THE 38TH LEFKOŞA INTERNATIONAL EXHIBITION OF T.R.N.C. The exhibition is not for a specific sector or product group, it is an opportunity for companies to launch new products rather than sell them. Propertync Magazine had a 12 metre stand at the exhibition which is organised yearly by the TRNC Ministry of Economy and Energy and was held between the 6th to the 15th of June. Joining us this year on our stand were Kibris Development and Arredo Kitchen and Furniture.

The opening ceremony has begun by the attendance of Acting President and Speaker of the Assembly Sibel Siber, Prime minister Özkan Yorgancıoğlu, The Turkish Ambassador of TRNC Halil İbrahim Akça, Deputy Prime Minister and Minister of Economy, Tourism and Sport ministry Serdar Denktaş, Mayor of Nicosia Kadri Fellahoğlu, Deputy Manager of Export Department of Turkey Ministry of Economy Özgür Volkan Ağar, and other Ministers and members of parliament. The 38th TRNC International Fair which is organized by The Deputy Prime Ministry, Economy, Tourism, Culture and Sports Ministry’s Office of Industry was held at the Atatürk Culture Park and Exhibition Avenue in Nicosia. The grand opening has begun with national anthem and performance of TRNC Youth Department, Folk Dance Group. Despite cultural and social activities, many other activities were organized at the fairground which covers an area of 5000 m2 outdoors and 3000 m2 indoors.

-15 Haziran 2014 tarihleri arasında Lefkoşa Fuar Alanı’nda gerçekleştirilen KKTC Uluslararası Fuarı, Cumhurbaşkanı Vekili ve Meclis Başkanı Sibel Siber, Başbakan Özkan Yorgancıoğlu, Türkiye’nin Lefkoşa Büyükelçisi Halil İbrahim Akça, Başbakan Yardımcısı Ekonomi Turizm Kültür ve Spor Bakanı Serdar Denktaş, bazı bakan ve milletvekilleri, Türkiye Ekonomi Bakanlığı İhracat Genel Müdürlüğü Genel Müdür Yardımcısı Özgür Volkan Ağar ve Lefkoşa Belediye Başkanı Kadri Fellahoğlu açılış da yerini alması ile başladı. Başbakan Yardımcılığı, Ekonomi, Turizm, Kültür ve Spor Bakanlığı’na bağlı Sanayi Dairesi Müdürlüğü tarafından bu yıl 38. si düzenlenen Fuar da oldukça renkli anlar yaşandı. Saygı Marşı eşliğinde saygı duruşunun yapıldığı, İstiklal Marşı’nın okunduğu fuar açılışında, Gençlik Dairesi Müdürlüğü Halk Dansları Topluluğu da bir gösteri sundu. 3 bin metrekare kapalı ve 5 bin metrekarelik açık alanda sosyal ve kültürel etkinliklerin yanısıra birçok eğlence düzenlendi. KKTC’den 90 firma, kurum ve kuruluş; Türkiye’den ise 34 firma temsilcisi’nin katıldığı ve fuarı binlerce kişi ziyaret etti. Belli bir sektörü veya ürün grubunu esas almayan, çeşitli ürünlerin birlikte sergilendiği fuarda, mal ve hizmetlerin satışından çok, ürünlerin tanıtımı yapıldı.

PROPERTYNC DERGİNİZ 38. K.K.T.C. ULUSLARARASI FUARINDAYDI! ‘‘K.K.T.C. Ekonomi ve Enerji Bakanlığı’nın düzenlediği ve 6-15 Haziran 2014 tarihleri arasında Lefkoşa Fuar Alanı’nda gerçekleştirilen KKTC Uluslararası Fuarı’nda bizler de Propertync dergisi olarak yerimizi aldık. Kibris Development ve Arredo firmaları da dergimiz standının aracılığıyla tanıtımlarını yapıp broşürlerini dileyen ziyaretçilere dağıtmış oldular.

Fuarda, Kıbrıs’a özgü el sanatları, hediyelik eşyalar, inşaat ve yapı malzemeleri, mobilyalar, banyo ve aksesuarları, gıda ürünleri, temizlik malzemeleri, zirai aletler, alkollü- alkolsüz içecekler, hazır giyim ürünleri, bilgisayar ve aksamları, kimyasal ürünler, tıbbi ilaçlar, kozmetik ürünler, çocuk oyuncakları, ve pek çok diğer dallardan firmalar katıldı.

Over 90 firms, establishments and companies from TRNC and representatives of 34 firms from Turkey exhibited at the show and there were thousands of people visitors. The exhibition is not for a specific sector or product group, range of goods and products including art and crafts specific to Cyprus, gifts, construction and structural materials, stucco decoration products, kitchen, sitting room and bedroom furniture, bathroom and white goods, consuming goods, cleaning products, agricultural goods, cosmetics, children’s toys, bicycles and much more products presented at the exhibition.

Yerli Ürünlere ilginin bir hayli yüksek olduğu fuarda, Türkiye Cumhuriyeti standında Türkiye de değişik sektörlerde hizmet veren sanayi kuruluşlarının tanıtımı yapıldı ve ürünleri sergilendi. Arredo Mutfak ve Kıbrıs Emlak firmaları da dergimiz ile birlikte Fuarda bulundular. Tanıtımlarını gerçekleştirme fırsatı bulan Arredo ve Kıbrıs Emlak, ziyaretçilerinden gelen ilgi ve alakadan oldukça memnundular.

Beside of High demand of domestic products at the exhibition, representative firms from Turkey from different industries represented their Made In Turkey range of goods and services in Turkeys’ stand.

Propertync dergisi olarak katıldığımız KKTC Uluslararası Fuarı’nda bizlerde katılımcılar ve ziyaretçilerle buluştuk ve onları bilgilendirme fırsatı bulduk.

Joining us on our stand were companies Arredo Kitchen and Kıbrıs Real Estate, to meet and to inform their audience and represent themselves to the visitors. Arredo Kitchen and Kıbrıs Real Estate were pleased with the interest they received at the exhibition. As Propertync magazine, we distributed both our newspaper and magazine at the show. Copies of “Yapı Katalaoğu” the first and the only structural catalogue of Cyprus were also distributed to anyone who wished to have a copy. We were pleased to give information about real estate industry, and inform the visitors our activities.

Necat was born in 1972 and qualifying for the Fulbright scholarship, gave him the chance to graduate from the department of Finance and Multinational Management at the Wharton School, University of Pennsylvania. From there he went on to Istanbul and worked at the Coca Cola Company. After 4 years in Turkey, he was awarded another scholarship to attend Anderson School, California to acquire an MBA degree. While in America he successfully passed the CPA (Certified Public Accountant) examinations and then came back to North Cyprus. Ertuğ Ertuğrul, born in 1970 graduated from the faculty of Architecture at Istanbul Yıldız Teknik University in 1992 and was awarded a scholarship to attend the Architectural Association School of London. Between 1994 and 2002 he worked with Behruz Çinici and Tuncay Çavdar, then in 2002 he returned to North Cyprus. Since the start, our aim has always been to reach the “elite customers”, people who care about high quality, aesthetics, luxury, details and comfort. Our aim was never to be the most profitable company nor the biggest company, besides, this thought would not be matched with “niche marketing” ideology which we support as a company. Switching to “mass production and marketing” by increasing the turnover unnecessarily means drawing away from the quality and details. Necat ve Ertuğ Ertuğrul birlikte Distinctive Properties Ltd. şirketini 2004 yılında kurdu ve 2005 yılında faaliyete başladık. Şirketimiz bugüne kadar ağırlıklı olarak Girne merkezde apartman blokları inşa etti. Bunun yanında Tatlısu’da denize sıfır bir proje, Lefkoşa’da ofisler ve yine Girne Merkez, Karaoğlanoğlu ve Edremit’te olmak üzere villalar yaptık. Müteahhitlik Belgemiz olmasına rağmen hiçbir zaman dışarıya müteahhitlik hizmeti sunmayı tercih etmedik. Necat Ertuğrul 1972 yılında doğdu. Müşterilerimize satış sözleşmesi ile birlikte maintenance sözleşmesini imzalamalarını şart koşuyoruz. Çünkü biz yaptığımız binalarla gurur duyuyoruz ve teslimattan sonra inşaatçı firma olarak ortadan kaybolmaktansa projenin ileriki yıllarda da güzel ve estetik görünmesini arzu ediyoruz. En maliyetli malzemelerden biri olan cam kullanımından (tuğla sıvaya kıyasla) çekinmeyip daha modern, ferah ve aydınlık mekanlar oluşturduk. Yukarıdaki detayların bileşiminden Kyre-nia Court apartman blokları doğdu. Sonuçta Kıbrıs küçük bir Akdeniz adasıdır. Hollanda gibi denizi doldurmadığımıza göre inşaat yapılabilecek arazi kısıtlı. Biz bu kısıtlı kaynaklarımızı çok kısa bir sürede çok ucuza peşkeş çektik. Halbuki yapılması gereken yurtdışındaki kaymak kesime yönelik projeler ve pazarlama idi.

Ben dağdaki bir villanın dağ ve deniz manzarasına sahip olmak istiyorum ama evime giderken 10 tane kamera ve 30-40 dakikalık trafik çilesine katlanmak istemiyorum diyenlere ve şehir merkezinin café, restoran gibi attraksiyonlarını sunmasına rağmen şehir merkezi kaosunu hissetmek istemeyen müşteriler için ideal bir bölge. Hem ideal hem rakipsiz çünkü söz konusu bölgedeki ana yol üzerindeki tek boş arsa! Bir de Girne merkez dışında ev yapanlar veya satın alanlar bilir. Yüzme havuzunun, bahçenin, çimlerin, sulama sis-teminin etc derdi hiçbir zaman bitmez. Halbuki çağımız insanı daha “ben” merkezli. Yukarıda da bahsettiğim gibi son 3 yıldır şirketimiz faaliyetlerine ara verdi. Sektörde halen en büyük problem mimari ve kalite yönünden zayıf projeler. Sadece dış binanın belli bir kesimini farklı bir renge boyayarak “creative” mimarlık yaptığını zannedenler var. Bu arada bu 3 yıl zarfında Kyrenia Court’ların bir sürü takliti piyasayı doldurmuş. Burda Ertuğ Ertuğrul’un bir mimar olarak katkısının altını çizmek isterim. Sonuçta Ertuğ ülkemizin önde gelen mimar-larındandır ve onun mimari yeteneği ve tecrübesi olmasa şirketimiz bugünkü konumda olmazdı. Tower 34 projesi böyle bir piyasaya bir nebze bir tepkidir. Gerek lokasyonu, gerek mimarisi gerekse kalitesi ile piyasaya yeni bir nefes getireceğini umuyoruz. Tower 34 projesi sosyal ve mimari detayları ile piyasadaki apartman sektörünün ezberini bozacağına inanıyoruz.

However, as time passes without results, this will effect negatively on sales. If there is no peace agreement at the end of the negotiation process, I believe things in Cyprus will never be the same. Our company will proceed with its vision and aim. Our projects will continue in the centre of Kyrenia, these projects will have excellent features and will definitely contain nice surprises for our clients. We provide a small storage space for each apartment in the basement, automatic remote control curtain system, and rubbish chute. Because details are important to us, we placed iron fixtures on the roof for satellite company installations. This way there will be no damage to the floor isolation. These details seem unimportant, but are crucial for buyers, and it is these details that we value. Distinctive Properties Ltd. strive to provide high quality, with minimum maintenance through the use of smart architectural designs in the right locations. We stay away from the castle-like apartment designs and go for a more aesthetic and minimalist but modern designs. In my opinion, the mistakes were done in the beginning. Cyprus is a small Mediterranean island that has a limited construction area. I believe many of these sources have been bribed in very unsuitable ways, instead of this we need to create good, quality projects for developing countries’ investors and market them.

Binanın 10 katlı olacağı göz önünde bulundurularak beylerin daha az yorulmaları için her kata çöp şutu (waste chute) yerleştirildi. İleride takılabilecek klimaların mimari estetiği bozabileceği düşünülerek tüm klima-lar fiyata dahil edildi ve kompresörleri arka cephede gizlendi. Çoklu elektrik anahtarlarını bir yere toplamaya yara-yan grid sistem uygulaması kullanıldı. Isı yalıtım sistemi (mantolama) kullanıldı. Balkonlar ahşap deck kaplama olarak düşünüldü. Ön balkon alınları aluminium composite kaplama yapıldı, bu aynı zamanda binanın ileride daha uygun fiyata ve kolaya boyanabileceği an-lamına gelir. Balkon altları compact lamine kaplandı. Daire içerilerindeki tüm zeminler (ıslak zeminler hariç) parke yapıldı. Uzaktan kumandalı perde sistemi altyapısı düşünüldü. Banyolarda buharlı havanın aynalarda yarattığı pusuyu engelleyici elektrikli ayna ısıtıcısı kullanıldı. Apartmanlar ve zemindeki dükkanlar için ayrı araba girişi düşünüldü. Audio ve renkli video intercom sistemi kullanıldı. Doğu ve batı cephelerinde, pergolalar ve buzlu camlarda kendine özgü desen (signature) dizayn edildi. Ahşap desenli aluminyum hudut korkulukları kullanıldı. Mutfak worktopunda gizli pop-up elektrik prizi yerleştirildi. Landscaped bahçeler yaratıldı. Her daire balkonunda küçük ambarlar yer-leştirildi. Her mekanda bahçeli villalarda olduğu gibi yere kadar sürme cam düşünüldü yani her odadan (bahçe gibi) balkon ve teraslara ulaşım sağlandı. Şirketimiz faaliyete başladığı yıllarda müşterilerimizin %90’ı İngilizlerdi. Avrupalı yatırımcılar günden güne azaldı. Bunun yerini biraz arap ülkelerinden ve İran’dan gelen yatırımcılar doldurdu. Ama yine de şu anda alıcıların aslan payını Türkiyeli ve yerli yatırımcılar almakta. Kıbrıs barış süreci ülkemizin emlak ve inşaat piyasasını doğal olarak olumlu etkilemektedir. Bunun sebebi sözkonusu sürecin spekülatif satışları tetiklemesidir. Görüşmeler uzadık sonra ve elle tutulur ilerlemeler kaydedilmedikçe bu satışlar da doğal olarak azalacaktır. Ancak görüşmeler başarısız olursa kimse ülkemizin “Annan Planı” öncesine dönmesini beklemesin, çünkü artık köprünün altından çok sular geçmiştir… Şirketimiz en başta belirlemiş olduğumuz vizyon ve hedefler çerçevesinde ilerleyecektir. Girne şehir merkezinde piyasaya farklı projeler kazandırmaya devam edeceğiz. Hem konut hem ticari müşterilerimize sürprizlerimiz devam edecek…

t was 22 November 2004 when I got a phone call from The Times Newspaper in the UK. The reporter wanted to get my opinion, as a solicitor, about THE ORAM’S CASE, which I had no idea about. As a matter of fact until that day nobody in Cyprus knew what Orams case was about. I asked the reporter to brief me about the issue - it was about an expatriate family occupying Greek Cypriot property in Kyrenia. They were ordered by the Greek Cypriot Court to demolish the house that had been built by them on the land, return the plot to the Greek Cypriot owner and pay nearly £10,000 as damages. The article was published in The Times, together with my opinion which was very straight forward;

undan yıllar önce, 2004 yılının 22 Kasım akşamı Birleşik Krallık’ta yayınlanan “The Times” gazetesinden bir telefon aldım. Telefonda ilgili gazetenin editörü benden Orams Davası diye bilinen mesele ile ilgili hukuki görüşlerimi talep etmekteydi. O güne değin bende dahil hiç kimse “Orams meselesi” diye bir durumdan haberdar değildik. Editöre bu mesele ile ilgili bana kısaca bilgi vermesini rica etmiştim. Girne’de bir taşınmaza ev yapan İngiliz ailenin Güney Kıbrıs mahkemesince mahkum olup evlerinin yıkılması, araziyi esas sahibi olan rum’a iade etmesi ve tazminat olarak 10,000 İngiliz Sterlin’i ödemeleri ile ilgiliydi. Bu meyanda ilgili gazetede yayınlanmış olan benim hukuki görüşüm şöyle idi; “Kuzey Kıbrıs’ta taşınmaz almış olan yabancıların haklarının Kuzey Kıbrıs Anayasası tarafından garanti altına alınmış olduğunu ve bir gün

At that time, there were hundreds of cases submitted to the ECHR against The Republic of Turkey by the Greek Cypriots. Then in 2005 a miracle happened, a new law was introduced, 67/2005, the Law for the Compensation, Exchange and Restitution of Immovable Properties, which are within the scope of sub-paragraph (b) of paragraph 1 of Article 159 of the Constitution. Then immediately after this new law was introduced the TRNC Government set up the Immovable Prop-

O dönemde, Avrupa İnsan Hakları Mahkemesinde Türkiye Cumhuriyet’i aleyhine Rumlar tarafından yüzlerce dava dosyalanmıştı. Türkiye AHİM nezdinde aleyhine en çok dava getirilmiş olan ülkelerden biriydi fakat 2005 tarihinde bir mucize oldu ve Anayasanın 159’uncu Maddesinin (1)’inci Fıkrasının (b) Bendi Kapsamına Giren Taşınmaz Malların Tazmini, Takası ve İadesi Yasası, yani 67/2005 sayılı yasa yayınlanıp yürürlüğe girdi. Hemen akabinde Taşınmaz Mal Komisyonu kuruldu. “The Times” gazetesinde de yayınlandığı gibi nihayet artık KKTC’de Avrupa Hukuğuna tabi oluyordu. TMK’nın işleyişi ve kararları AHİM


PROPERTY CONSULTING erty Commission. As I had mentioned in the newspaper, finally European Law was to be applied in the TRNC. The Immovable Property Commission (IPC) was acknowledged by the ECHR and the judgments given were recognised by the European Court of Human Rights and all pending cases against Republic of Turkey were referred back to this Commission located in the TRNC. This was a huge success for the TRNC but most importantly for Turkey. At first, the procedure was efficient, fast and fair. The IPC was working very well and all cases were resolved within just a few months. The applicants were being awarded reasonable and acceptable compensations, which assisted in the trust given to the institution by the Greek Cypriot applicants, and due to this, the number of cases has risen to almost 6,000. There is a saying in Turkish. “Start doing something like a Turk but carry on and finish it like an English”. What an accurate saying that is, as now, due to the amount of applicants, the IPC is paralysed, and neither they nor the Government are doing anything to put things back on the right track. For most applicants, the process is now taking 3 to 4 years to finish. On top of that, it is also taking almost 1 year for the Government to pay for already awarded compensations to the applicants. Until 2013, the IPC was processing 10 to 12 applications, now they are doing just 5 to 6 cases. As the number of applications has risen, one would expect the IPC to be handling more cases than they were doing at the beginning. The Committee Members are tired, the staff of the IPC are tired but we, responsible solicitors, are not just tired but also frustrated. The only relaxed institution appears to be the Government as they are not employing more civil servants for the IPC or for the offices of the Government in charge of the IPC issues. You may ask “why should I care, I am not a Greek Cypriot, I am a Turkish Cypriot or a foreigner or an ex-pat living in the TRNC.” Well, you should care because when a Greek Cypriot is compensated by the Government, your property changes and becomes a Turkish title deed. It automatically becomes more valuable and undisputed no matter what happens with the Cyprus problem and you do not have to pay a penny. As a foreign property owner you know that what Orams family had to go through will never happen to you. You will never have to worry that what you have is Esdeger (exchange) property or not anymore. Many foreigner owned properties have been compensated by the TRNC, and there are many applications before the IPC so many more people could be compensated too. There is so much more to be said about the IPC and the Government, however the bottom line is that this cannot go on like this, because the day may come that ECHR may not find the IPC to be an accurate and acceptable court, and may indirectly abolish the only internationally recognized body of the TRNC which in turn may result in Turkey having to pay billions of pounds in compensation plus restitution of the properties back to their Greek Cypriot owners.

Başvuru yapmış olan Rumlara kabul edilebilir tazminatlar ödenmekteydi ve bunun neticesinde TMK’ya şüpheyle bakan Rumların fikri değişmiş ve duyulan güven neticesinde başvuru sayısı altı bin’e ulaşmıştı. Ancak çoğu kez doğru bulduğum “bir işe Türk gibi başla İngiliz gibi bitir” sözünün ne kadar yerinde olduğunu unutmuşum. TMK huzurunda altı bin’i bulan başvuru sayısı Komisyonu paralize etmiş durumdadır ve bunun giderilmesi için ne Komisyon ne de Hükümetimiz herhangi bir önlem almamakta veya almak istememektedir. Önceleri aylar içerisinde neticelendirilen başvuruların neticelenmesi bugün 3-4 yılı bulmaktadır. Yetmezmiş gibi, KKTC’de haklarını aramış olmaları sebebi ile türlü baskılara maruz kalmakta olan Rumların durumunu ilgili bakanlıkların bilmesine veya bu durumların bilgilerine getirilmiş olmasına rağmen, tazminat ödemeleri yapılmamakta veya çok geç yapılmaktadır. Sadece geçmiş yıl içerisinde her hafta 10-12 başvuru neticelendirilirken artık 5-6 başvuru ele alınmakta ve başvuranlara önceleri hiç yapılmayan türlü zorluklar çıkarılmaktadır. İnancım odur ki başvuru sayısı ve personel eksikliği nedeniyle gerek Komisyon Üyeleri gerekse çalışanlar yorulmuş durumdadır. Ancak biz avukatlar olarak sadece yorgun değil aynı zamanda çok çaresiz ve oldukça endişeyle olayları takip etmekteyiz. Belki aklınıza şu soru gelebilir; “Bu mevzu beni neden ilgilendirsin ki, ben Rum değilim.” Ben Kıbrıslı Türküm veya ben KKTC’de mal satın almış olan bir yabancıyım.İlgilendirmeli, gerek Türk olun gerekse yabancı. Eğer KKTC’de malınız varsa veya mal satın almışsanız ve bu taşınmaz 1974 öncesinde Rum malı ise ilgilendirmeli çünkü TMK aracılığı ile tazmin edilen Rumların malları otomatik olarak piyasada Türk malı olarak nitelendirilen statüye girecektir. Devletimiz başvuru yapmış olan Rum’u tazmin ettiği anda elinizdeki taşınmazın değeri artacaktır ve bunun için, şu an itibarı ile, cebinizden bir kuruş dahi çıkmayacaktır. Yabancı iseniz “Orams” ailesinin yaşadıklarını asla yaşamayacaksınız. Hiçbir zaman malım eşdeğer statüsündedir birgün Rum Mahkemesinden biri gelip kapımı çalarmı endişesi hiçbir zaman taşımayacaksınız. Devletimiz birçok bu gibi malı tazmin etmiştir ve çok daha fazlası tazmin edilmeyi beklemektedir. TMK veya Hükümetimizin bu meseledeki tutumuyla ilgili daha pek çok şey söylenilebilinir ancak sözün bittiği ve söylenecek birşeyin kalmadığı noktaya gelmeden önce bu meselenin bu şekilde yürütülemeyeceğinin, aksi taktirde bir gün AHİM’in TMK’yı yeterli ve adil bir iç hukuk yolu olarak görmeyebileceğini ve bunun gerçekleşmesi halinde anavatan Türkiye’nin milyarlarca Sterlin tazminat ödeyebileceği gibi, Rum’a malını da iade etmek zorunda kalabileceğimizi bilmemiz gerekir.
