H

ere is a list of four resolutions that property managers should have on their list for 2014. None of them are difficult or require an immense amount of work, and all of them would bring rewards throughout the coming year. Start the New Year off organized. An organized landlord is a more profitable landlord. File your documents and paperwork logically and neatly in a file folder with brackets on each side of the folder. Two-hole punch the top of each document and file them in a way that works for you. Some landlords put all “pre-move in” documents on one side, and all other documents on the other. Being organized is simply a good business practice. Whether you manage one rental unit or a thousand, being organized and consistent will make you a better landlord and put more of the profit in your pocket. Aim for more work/life balance. Build down time into your schedule. When you plan your week, make it a point to schedule time with your family and friends, and activities that help you recharge. JACKSON, Wyo., Dec. 27, 2013 -A Wyoming federal court jury awarded $28.2 million to a Casper, Wyo. woman who was poisoned by carbon monoxide from an outdated and unmaintained furnace in her apartment, The Spence Law Firm said today. The legal team for Amber Lompe from The Spence Law Firm, of Jackson, Wyo., alleged that the Sunridge Apartments owner and manager ignored warnings that the complex’s 30-year-old fleet of 96 furnaces was dangerous and needed to be maintained or replaced. Wyoming law requires landlords to provide tenants safe housing, including safe and working heat. Ms. Lompe was poisoned by her

furnace in 2011, causing a permanent brain injury that affects her memory, concentration, processing speed, attention, and multi-tasking. She has also suffered from chronic headaches and sleep problems related to the brain injury. Unable to work and attend college as before the injury, she will require numerous medications and other treatment for the rest of her life, doctors testified. On Thursday, U.S. District Court Judge Alan Johnson entered the judgment of $2.7 million in compensatory damages and $25.5 million in punitive damages against defendants Sunridge Partners, LLC and Salt Lake City-based Apartment Management Consultants, LLC, which manages apartment complex-

es in 13 states. Lompe was represented by Tyson E. Logan, and G. Bryan Ulmer, of The Spence Law Firm LLC, of Jackson, Wyo. Tyson E. Logan said, “The jury's verdict here sends a message that in Wyoming, we expect more from landlords. We won't allow businesses to put profits over people, where people's lives are at stake. I hope this verdict will make all of our communities safer in the future.” The three-week trial included evidence that Sunridge apartment tenants were not warned after maintenance employee suffered carbon monoxide poisoning and was sent to a hospital emergency room in October 2009. Apartment Research Market Report West Coast Buyers Increase Competition for Area Assets

T

he Wasatch Front apartment market will perform well through the remainder of the year as vacancy, though nudging upward, remains at historically low levels, allowing operators to increase rents. All submarkets in the region experienced rising vacancy during the last four quarters, with rates ticking up at least 100 basis points in all areas. Developers nearly doubled completions in the last 12 months, and despite strong job growth over the last year, supply additions outweighed positive net absorptions. Additions to stock will slow in the fourth quarter, allowing operators time to fill vacant units before a new wave of projects come online in early 2014. With another 2,300 apartments scheduled for delivery next year, and

continued improvement in the region’s single-family housing market, additional softening may occur

in suburban submarkets. Vacancy rose 140 basis points in the last year in South Salt Lake City/Murray/

Employment: 3.9% increase in total employment

Employment will expand 3.9 percent in 2013 as approximately 41,000 jobs are generated. The increase will push employment in the metro 5.3 percent above the pre-recession peak. Last year, nearly 36,700 positions were added.

Construction: 2,300 units will be completed

Builders will complete 2,300 units this year, expanding stock 2.9 percent. Completions during the year will be made up of nearly 2,000 market-rate apartments, with seniors, student and affordable housing projects rounding out deliveries. In 2012, builders completed 1,300 units.

Vacancy: 40 basis point increase in vacancy

Additions to supply will exceed demand for apartments this year and vacancy will reach 4.5 percent by year end, up 40 basis points from the end of 2012. Vacancy dipped 30 basis points last year.

Rents: 2.8% increase in effective rents

With vacancy remaining tight, rents will grow 2.8 percent in 2013 to $845 per month, slowing from the 3.1 percent growth in the prior year.

Ask The Director: Dear Paul I recently had a new tenant move in on the first and I gave her a concession of one month free rent for signing a two year lease. On the second of the month one day into the lease she told me that she had joined the Army and had to move and break the lease. She handed me a copy of her orders and told me I could not charge her for anything because she was going into the military. Do I have to let her out of the lease? Can I deduct unpaid rent and re-renting fees from the security deposit? Can I charge for the first month free concession? Your clarification on this would be much appreciated. Troy G. Dear Troy, Thank you for your question.

An active-duty servicemember, can end a lease with permanent change of station (PCS) or deployment orders over 90 days under the Servicemembers Civil Relief Act (50 USC App. §§ 501-597b) (SCRA). Even if the SCRA clause is not in your lease, a landlord is still obligated to honor this federal law once given proper written notice and a copy of orders. Some military renters sign leases longer than their expected duty assignment because they know they can break a lease under the SCRA. For example, a servicemember could sign a 12-month lease knowing that they will only be assigned for six months. This is legal, but not always the most ethical decision. In your situation you would let the renter out of the contract, do not

back charge for the upfront concession and only deduct actual damages to the apartment, probably none so you would return it all. Once a tenant notifies you they are getting a permanent change of station (PCS) or deployment orders and gives you a copy of the orders, you cannot collect future rent on a contract with time on it or concisions given from them.

Provo’s New Parking Ordinance by Taylor Smith On December 17th the Provo City Council unanimously voted in favor of a new ordinance that bans “predatory towing” that might have a major impact on how apartment owners manage parking for their tenants. The new law requires that towing companies either have a request made by a property owner to tow or boot a car, or a standing contract with a company that meets new city requirement, which enables the towing company to freely check for illegally parked cars. The new guide-

lines go into effect in 2014, with the “call to tow” option beginning in February. According to the Deseret News, Mayor John Curtis and city officials have been working for nearly two year to amend the ordinance to address “increasing concerns about non-consensual towing” created by the previous amendment allowing contract towing in 2005. Rising interest rates have encouraged investors in the metro to bring more properties to

market in order to take advantage of buyer demand and low cap rates. These listings are being met with a high degree of interest as investors from the West Coast scour the region for value-add deals. Limited availability of value-add listings is encouraging some flexibility among first-time entrants to the market as their attention shifts to Class C deals trading at cap rates in the high-6 to low-7 percent range. You may even be able to leave work earlier if you make a conscious effort to limit the time you spend on the web and social media sites, making personal calls, or checking your bank balance. Rethink your errands. Consider whether you can outsource any of your household chores or errands. Could you order your groceries online and have them delivered? Hire a kid down the street to mow your lawn? Order your stamps online so you don't have to go to the post office? Even if you're on a tight budget, you may discover that the time you'll save will make it worth it. Get moving. It's hard to make time for exercise when you have a busy schedule, but it may ultimately help you get more done by boosting your energy level and ability to concentrate. Try to exercise at least 30 minutes 2-3 times per week. Don't assume that you need to make big changes to bring more balance to your life. Set realistic goals, like leaving the office earlier 1 night per week. Even during a hectic day, you can take 10 or 15 minutes to do something that will recharge your batteries. Increase Productivity. Move just one routine task online such as creating an online maintenance request form for your tenants. Print fewer checks and pay bills online or sign up for online bank statements. While you may have many other resolutions set for 2014, definitely consider these as they are simple to implement and will no doubt benefit your business moving into the New Year. Executive Director's Report Letting Landlords Decide By L. Paul Smith, Executive Director Utah Apartment Association

Every January the Utah State Legislature meets for the 40 day legislative session. You might ask, what do they do during that time? The answer for our industry depends on how proactive we are in defending our interests. There have been years, in the mid 1990's for instance, where the legislature’s actions caused severe detrimental impacts to rental housing. The last ten years, however, have been the opposite - as we have become good at defending our interests and advancing our interests things have been much better. During those times, the legislature has sped up the timeframe for evictions, limited rights of cities to do rental inspections, strengthened our rent control and fee prohibition statutes, and passed a standardized Landlord-Tenant Law (the Utah Fit Premises Act). One of our priorities this year is undoing one detrimental impact the

legislature caused in the 1990's. In the 90's Utah's legislature made us one of only 13 states that require landlords to work with housing authorities by making source of income a protected class. In most of the United States working with housing authorities is optional, if a Housing Authority has good polices, good customer service, and cares about the interests of the landlords, they have no problem finding places to house their tenants. But, if the housing authority's rules and practices are severe or ridiculous, landlords are not required to work with them, and many don’t until they clean up their act. Back when Utah's legislature made source of income (working with housing authorities) a protected class, there were two major differences that made the situation more acceptable. First, the Federal Government guaranteed the condition of the rental unit for tenants on housing. this meant that if a tenant did damage, then the Government would pay to repair it or pay to have it repaired when they moved out. Second, there was a rule that any tenant that owed a previous landlord

money would be ineligible to ever receive government housing again. Unfortunately, both of these rules have been changed. Landlords are on their own when a government housing tenant damages their property. Because many are on fixed incomes or government checks (disability or SSI) which cannot be garnished, the reality is landlords will never recover any money if a housing tenant does damage. While the Utah Apartment Association believes that good low income tenants deserve quality housing, we don't believe that government force should be applied to make landlords take risks that they are uncomfortable with. So, this session we are asking the legislature to allow landlords who don't want to work with certain housing authorities because of their unreasonable polices or practices to opt out. We know this will upset some people who think that landlords should take government money with any and all strings attached. But even doctors who don't want to deal with bureaucracy, regulations and the fee schedule imposed upon health care providers by Medicare

can opt out of the Medicare system. This doesn't mean that patients are unable to be served, it just means that they get served by people willing to jump through the government’s hoops. We want the same thing for landlords. The changes to the Utah Fair Housing Act that we are requesting will be modest. The UAA will still encourage landlords to work with good tenants who are on housing assistance, and to work with good housing authorities. But if Landlords don't want to jump through the hoops imposed by government for taking government money, or if they don't want to take risks on tenants who have fixed incomes through government checks and who are ungarnishable if they move owing money – they shouldn't have to. As we go through this process, we invite everyone's feedback. President’s Message Membership, Education and Culture In 2014 the theme for the Utah Apartment Association will be "Membership, Education and Culture". Membership In 2013 UAA membership grew again to approximately 3,500 members, representing about 80,000 rental units. In my opinion, this growth has come because what the UAA does is incredibly valuable. Our legislative advocacy, our pool of resources, our legal agreements and screening services, and our ability to quickly help landlords solve problems - these make us an extremely valuable asset for landlords in Utah. In 2014 I'm asking every member to help us work to double in size. How can we possibly double in size in one year? It's easy! Each of us just have to go out and find one new member for the association. If you are a large apartment community or management company, odds are you have three to five vendors whom you work with regularly that are not yet

members of the association. I encourage you to invite them to join the UAA for two reasons. First, to support the organization that supports you. Second, to open up new business opportunities for them by networking and meeting other potential clients. If you are an independent owner with one to ten rental units, you probably know another three to five landlords who are not yet members. Tell them how valuable the UAA is to you, invite them to join to support the UAA and take advantage of the resources and tools that are there for them, and simultaneously help the organization grow so that it can better support you as well. Education In 2014 the UAA will focus on education more than ever before. Education separates the best from the rest. Those of you that have taken UAA education classes, such as the good landlord trainings, or have attended our luncheons, conferences or evening meetings, know that education can change your business for the better. This year, we will provide free education to our apartment community and management company

This class has three hours of cutting edge, new ideas and the newest innovations for apartment communities. If you are a real estate professional (i.e. have a real estate license, or own or manage real estate as your profession) you will want to take advantage of the new UPRO designation series. I'm currently half way through teaching the 32 hours of UPRO (Utah Professional Rental Operators) training classes, but you can register at any time in the cycle of classes. The material we cover is phenomenally valuable and useful. Graduates will receive the UPRO designation, and will be able to market their accomplishment and prowess as a rental professional. For the Utah Apartment Association this means growing participation and creating pride. Participation means members attending meetings, conferences, classes, serving on committees, etc. It also means proudly displaying your membership in the UAA on your properties, promotional materials, and on your business cards. In 2014 we will also have a series of UAA shirts, hoodies, and other logoed items that we would like you to use to help promote the UAA and show pride in your association. As the culture of the UAA grows we will only become a more dynamic organization attuned to the needs of our members. This year I encourage you each of you to focus on growing membership, utilizing educational opportunities, and helping to shape and adopt the UAA culture. Happy New Year!
