Top Ten Tenant Complaints and How to Address Them By Paul Smith

A

group of tenant advocates recently compiled a list of the top ten complaints tenants have with their landlords. Their list may surprise you. Below are the complaints and some suggested strategies for addressing them. Because this list came from the experiences of low income tenants, you may need to take some of these things with a grain of salt. However, there is still value in understanding how we are perceived and in considering how to change those perceptions. 1. Poor communication I find it fascinating that of all the complaints that could have been number 1, a nebulous complaint like "poor communication” was the biggest. However, few complaints are as easy to deal with as this one. The biggest part of this complaint seemed to be lack of understanding of the rules and expectations. Tenants don't think landlords do a good enough job explaining our expectations. A couple of suggestions to help you communicate better: - read through the lease with them at the beginning and address the terms and conditions they are renting under - consider sending them letters at least seasonally with reminders of expectations such as yard work, snow shoveling, spring and fall “fyi”'s etc. - don't assume they understand basic things like how a garbage disposal works, how to plunge a toilet or that they are responsible to maintain things like furnace filters and smoke detectors. Record Breaking UAA Education Conference & Trade Show By Gavin Gilbert

T

he April 2014 Fair Housing Education Conference and Trade Show was a smashing success. Not only was lunch 10x better than previous years, but it was also the most attended trade show in UAA history! Around 1,200 attendees were able to experience educational classes from experts, visit over 100 vendor booths and socialize with numerous individuals in the Apartment Industry. "I thought the entire trade show was very well set up. Vendors were friendly, classes were very informative and the food was great. I would give it a 10" Said Darren Kasparian with Overlook Point Apartments. Those who were not able to attend “Utah’s biggest multifamily housing event of the year” will have another opportunity next April as we continue to strengthen the rental housing industry through our annual trade show. UAA Receives National Government Affairs Award By Paul Smith

he Utah Apartment Association will receive the Paragon Award for best government affairs program in the Nation from the National Apartment Association at their annual conference in June. The

The 2014 Paragon Award for government affairs acknowledges the efforts of UAA staff, committees and members who operated the best government affairs program in the country in 2013. The NAA recog-

Top Ten...continued from front page to be successful - do regular (quarterly) inspections and talk about what they are doing right and wrong. Inspections are a great opportunity to have two way communication because you can ask them what issues they are having and can explain to them anything they need to improve Doing some or all of these things will go a long way to closing the communication gap and helping tenants better understand the expectations. 2. Barriers to entry and anxiety during the application process. The second highest tenant complaint is the costs and steps involved in the application process and the anxiety associated with finding a new place. Many tenants live very close to the edge and complain about the costs of applying. A couple of tips are: - explain the purpose of fees and deposits in a way that explains the benefits to them, not to you. For instance, the application fee helps run criminal checks so they can be protected from having criminals as neighbors. Or the deposit shows they are serious and locks the place in for them so you don't look at anyone else while you are checking them out. - give an answer to all applicants within 24 hours - sign a lease quickly and explain what else they need to have done on move in day.

These things will help lessen the anxiety of tenants and increase their trust in you. 3. Deposits not being returned. Easy complaint to fix. Send the depositor an explanation of charges to the last known address (their apartment) or forwarding address within 30 days. NO EXCEPTIONS. If you haven't finished the work, send an estimate. If you are deducting for charges, be clear about them and breakdown the work. For instance, instead of saying $200 for patching and painting walls say $15 for patch over fireplace, $10 each for 5 patches in the hallway, $75 for paint and painting the hallway and $60 for paint and supplies painting the wall above the fireplace. The more specifics you put the less likely they will be disputed. Also use pictures to illustrate the damage. If you had to clean red spots from carpet, show photos of before and after. 4. Landlords not enforcing rules with other tenants. It bothers tenants when their neighbors seem to be able to get away with almost anything, or when the landlord has their "favorite tenant" they treat preferentially. This is tricky because sometimes it’s hard to be in the middle of tenants who are bugging each other or to know what's really happening. Also, it’s hard not to have favorites, especially with long term customers who are

great tenants. But a few guidelines include: - try, to the best of your ability, to be fair between tenants - enforce rules and don't make overt exceptions for certain tenants and not others - deal with every complaint fairly and ask offending parties to comply with your rules and be respectful of each other 5. Interior maintenance. A quarterly inspection is a great tool here. Not only will you find the regular items that are wearing out and you will have to fix anyway, but you will also find damages by tenants you can fix immediately and charge to tenants. Inspections are also a great way to re-clarify expectations and strengthen your relationship with the tenant. They will realize you care about the property and them as a customer and appreciate it. 6. Exterior maintenance. Often tenants don't understand who is responsible for the yard and blame the landlord if it looks bad or the sprinklers aren't working (even when they haven't told you there was a problem). Help them understand their role in exterior maintenance. When you do drive-by inspections, look for problems that are your responsibility such as paint, siding and roofs. If you aren't going to do something about an issue immediately, explain your plan. For instance, it's not in the budget this year but next year you are planning on painting the soffit and fascia, etc. 7. Unfair rent increase. You run a business, so charging the maximum you can seems only logical. But raising rents drastically without explaining why to the tenants can cost you money when they move out and the unit sits empty. A couple of rent increase tips: - try to tie increases in rent to improvements and increases in value. For instance, explain that since you are replacing all the windows this spring, and this will lead to lower heating and cooling bills/ the $50 rent increase is fair because the windows cost $3,000 and besides, their utilities will go down. - consider not increasing rent on good tenants if they lock in long term leases. Explain you could charge more but you like them and will keep their rent as it is if they will commit to you for a longer period of time. - whenever you do raise rent spend time making sure you explain

to them that you wish you could keep it lower but everyone's rents are going up and if they move they will likely pay even more somewhere else. 8. Excessive restrictions (micromanaging lifestyle). Some landlords expect too much. They micromanage everything. A tenant has to make sure they maintain the property and don't upset the neighborhood. You should have reasonable rules and enforce them, but consider a ‘live and let live’ philosophy on most things that your tenants do. A couple of suggestions include: - on inspections, don't do it more than quarterly. Be in and out and not invasive. - on cleaning. Don't panic too much about basic clutter like dishes in the sink and clothes on the floor. Only worry about things that cause long term damage to the property like changing motorcycle oil on the living room carpet or using the countertop as a cutting board. 9. Lack of landlord flexibility (too by the book). Part of the reason for this is fair housing. We have to be consistent. When a tenant has a special request it is ok to listen and see if there is some way to work with that specific tenant in a way you would work with any tenant. You can be flexible, just be consistent in the things you are flexible with. The issue tenants think landlords are most inflexible on is working with them on late rent. We know that if we let a tenant pay "late" without a penalty, next month they pay "later". But often you can salvage a customer and compensate yourself for the inconvenience by working out payment terms and charging a late fee of no more than 10% per month. Treat everyone equally and don't let them get more than two weeks behind, but sometimes working with them saves you the trouble and cost of a vacancy and earns you significantly more than late fees for being slightly flexible. 10. Poor customer service. Return all calls quickly. Address all maintenance issues promptly. Talk nicely to them (not down to them). Regularly thank them for choosing to do business with you. If you accept tenants feedback on these ten problem areas and try to address them, not only will you have happier tenants, you will have less cost and fewer problems.

"This is just affirmation of what we already know, that the UAA government affairs program is just phenomenal and protects our industry in so many ways," said Steve Randall, UAA President. In the last decade, the UAA government affairs program has saved owners millions of dollars in fees and cost association with hostile government regulation, and has made Utah one of the very best states in which to do business. Some of the major accomplishments include: 1) Passing a Rent Control and Prohibition Statute so cities can no longer tell landlords what they have to (or cannot) charge for application fees and how to set rents. 2) Prohibiting cities and health departments from requiring safety ret-

rofits to older properties that would have cost hundreds (or thousands) of dollars to landlords who own these properties. 3) Forcing cities to allow utilities to be paid by either landlords or tenants. In the past cities had required landlords to pay the all utilities, which meant higher cost to landlords and no consequence for waste on the part of the tenant. 4) Prohibiting cities from dismissing landlords from the Good Landlord programs (with the discount on the fees) based on number of police calls. 5) Prohibiting cities from charging inspection fees to landlords. 6) Reducing the number of rental inspections being done by clarifying the law so cities can inspect only at initial licensure and when there is cause or complaint.

7) Requiring due process if a city wants to dismiss a landlord from a Good Landlord program. 8) Requiring the city give separate notice of every separate code violation and time to cure before taking further action. 9) Requiring cities send notice of any violation not just to the county records address but to a property manager as well, ensuring something is done about it—not that the notice sits in an unchecked PO Box. 10) Convincing Salt Lake City to reduce their high fee from $342 per unit down to $85 per unit. 11) Taking away the right of cities

to write their own Fit Premises Acts or landlord/tenant law by writing a state law all cities must comply with. 12) Requiring cities to accept each other’s Good Landlord training certifications, reducing cost and hassle for landlords, especially those with properties in multiple cities.

re you tired of tenant complaints about their units being too hot in the summer time? Many landlords are, but they are also tired of the rising maintenance costs on those old cooling systems. So which is worse, having unhappy tenants with high utility bills or losing profits constantly updating your cooling systems? Luckily there is a win-win solution for both you and your tenants. If you upgrade your existing evaporative coolers (aka swamp coolers) to qualified premium evaporative coolers now (or

By Steve Randall, President Utah Apartment Association I was thrilled to attend a record breaking Fair Housing Conference and Trade Show this past month. It took more than the efforts of UAA staff to pull off such a successful conference. It took a committee of committed volunteers, and hundreds of vendors who put time into providing a quality experience at their booth. In addition, dozens of instructors spent hours preparing and teaching new information and best practices. Thanks to everyone

who did such a fabulous job. This year the UAA has a goal to raise a record amount of PAC money so we can continue to be an effective advocate for property management. This effort will take all of us. The executive Committee and I have been studying how other associations with outstanding PAC donations do it and I have observed some things which I want to share. Associations who are good at PAC fundraising have good staff, just like we do, but they don’t rely solely on their staff. They assign a core group, usually the government affairs committee, and charge them to conduct fundraising events and meetings.

One association I know has a meeting where 400 people attend a lunch and they raise $50,000. The way they do it is: First, a core group of people commits to attend and get 5 others each to attend. Second, companies that contribute make sure they attend, bring checks and they also invite their competitors to come and be involved as well. They challenge people and make it a competition. Third, they constantly educate others about the association’s accomplishments and importance to their business. This year I would like to ask for

your help. I would like to ask you to attend one of our fundraisers and not just bring a check, but bring your peers and their checks too. Also, talk about the successes of our industry and how essential the UAA is to our continued success in business. I would also ask you to challenge landlords and property managers you know to participate and contribute. Tell them how much you contribute and ask them to do the same or more. Together is the way we will be even more successful than we have been in the past.

Among other things Bill spoke about the basics of making yourself trustworthy and ethical business leaders and how to avoid complaints. This, as well as the advice and experience of others, allowed attendees to walk away from the Education Conference with an even higher bar to set than before. Even though individuals left well informed and prepared for leadership responsibilities does not me we didn’t have fun. In fact, it was just the opposite. This year’s Fair Housing Education Conference and Trade Show was themed ‘rent-a-palooza’ (music & rock theme). Exhibitors and attendees dressed up in all different styles of wardrobes from 80’s hair-band attire, to 70’s bell bottoms. Sharing in many laughs as well as picture taking. The vendors at the Trade Show did an exceptional job at creating an exciting yet informative environment. In the mist of all the ‘rock and roll’ individuals were entered into drawings, played games, got massages and even shot paint ball guns as they learned about what vendors had to offer, and how the vendors companies can aid their

businesses. At the end of the night, many individuals received thousands of dollars’ in prizes and everyone walked away with a smile. The 2014 Fair Housing Education Conference and Trade Show was outstanding. All of the goals were met and exceeded. Individuals had a great time, and came away more informed and prepared than before. “As a Supplier/Vendor supporting the Utah Apartment Association, I was both impressed and excited to see this years' Trade show and education conference so well supported. The History of the UAA Newspaper

I

n June of 1937 a somewhat skeptical board of directors authorized the publication of The Apartment Journal (the forerunner of this newspaper) on the condition that the publication be completely supported by advertisements. By the time the

100th issue was published in November of 1945, the Journal had proved its worth, with a circulation that had grown to include most apartment offices in the Wasatch front, every hotel and motel in Utah and Nevada, all of the realtors in Ogden, Provo and Salt Lake, as well as “several hundred other persons.” In an era dominated by print media the journal became a major source of income for the association, and one of its most time consuming tasks. Times are changing, but what is not changing is that the UAA will continue to bring useful and valuable information to you, whether through our newspaper, website, e-mail updates or social media accounts.
