Requiring Renter’s Insurance By L. Paul Smith, UAA Executive Director

C

ar owners know that they must have insurance to drive and homeowners carry coverage to protect their possessions, however, according to a recent Apartments.com survey of renters, 58% of respondents indicate they do not have renter’s insurance. 20% of renters nationwide say they are required by their landlord or property manager to carry renter’s insurance. Survey results indicate that more renters would like their management company or landlord to require renter’s insurance for all renters. More than 36 % of respondents say they would be more inclined to rent an apartment that requires renter’s insurance.

Why should a landlord care about renter’s insurance? “Most tenants think their landlord’s policy covers their stuff, so when there is a fire or flood and they learn that their personal possessions weren’t covered by the landlord’s policy, they are very upset,” says Scott Fausett with Farmers Insurance. He recommends that owners require renters insurance. Scott is not alone in recommending owners require renters insurance. Many attorneys recommend this policy, for a significant reason – most of the liability issues landlords have are caused by tenants. Requiring tenants to insure for their own mistakes and actions not only makes sense, but it reduces the exposure and liabilities facing property owners, property managers, and employees. continued on page 6

he National Apartment Association reports that the Utah Apartment Association now represents over 96,000 units in the state of Utah, an increase of 21,000 units - up 27% over one year ago! "I'm so pleased that we grew so much this year in the number of units we represent. It just adds clout politically when we are on Capitol Hill to be able to say we represent so many units," said Steve Randall, 2014 Chairman of the Utah Apartment Association Board of Directors. "It also shows that people are noticing what the apartment association does for them." Hal DeRoos chair of the UAA Membership Committee says one of

the reasons for the incredible growth this year is the membership committee has been identifying target companies for membership, and the staff and committee members have been seeking out companies, urging them to support the UAA. "If you aren't a member yet, let us come talk to you. You will be impressed with all we do.” Hal says the UAA has focused this year on three areas. First, large apartment management companies.” The largest 25 apartment management companies have a combined 60,000 units,” says Hal. “Second, the UAA has focused on new construction. In the past three years there have been almost 10,000 new units built. Many of these are managed by companies who are already members. So these units were

in some cases easy – All we had to do was send a bill”, says Hal. “Third, the UAA has been working on bringing in residential property management companies who focus on managing single family homes for clients. One new member, Horizon Property Management in Orem, manages 300 units (mostly

Ask The Director: Tenants Getting Divorced Dear Paul, I have been renting to a couple for about 16 months (they just signed a new, year long lease 3 months ago). I was talking to the tenant next door to them and she told me that they are getting divorced. What should I do? Jeremy W. Dear Jeremy, First, I would advise you to not get in the middle of their divorce, which is likely to be messy and emotionally charged. Your only responsibility as a landlord in such situations is to be professional and courteous to both

parties. Hopefully your tenants are able to reconcile, but if they aren't then it is likely that at least one will want to move out. Here are some situations that you might face: • One tenant moves out, but the lease is kept intact and the rent keeps coming in. If this happens, then don't worry about what is going on. • One tenant wants out of the lease. If the tenant who is staying can afford the rent on their own, then get in writing from all parties that you

are canceling the old lease, and sign a new lease with the tenant who is staying behind. Make sure to cash out the deposit to both parties (let them work out who gets what) and take a new deposit from the remaining tenant. • Both tenants want the other one to move Unless they mutually agree who gets to stay, you are under no obligation to pick sides. Let their lawyers work it out. Until then they are both liable to see that full rent is paid every month. • Both tenants want out of the lease (or the one who wants to stay can't afford the rent). As with any other tenants who want out of the lease, you are under no requirement to let them leave. If you would like to work with them, you can offer to let them move out if they “replace themselves” by finding you a new qualified tenant to move in. Once the new tenant has signed a lease, you can authorize them to leave.

In this case you can re-rent it immediately and deduct/charge them any charges related to re-renting the unit (including lost rent) until it is either re-rented or the lease ends. One last thought: if one party is a victim of domestic abuse, you must allow them out of the lease with payment of 45 days rent as a cancelation fee. You can then evict the perpetrator and charge them rent until you get a new tenant. I hope everything works out for you and your tenants. Good luck! L. Resident Retention Leads to Increased Profitability By Taylor Smith, UAA Administrative Assistant

M

any landlords get so involved in the Asset Management part of their business that they forget that they should also be engaged in customer service. Keeping tenants happy is difficult, but it is important. How does keeping tenants happy affect your bottom line? Well, because turnover is the largest cost that landlords face you can end up losing lots of money if you don’t find a way to manage it. Turnover costs come in two ways: lost rent because the place is sitting empty while you are trying to find a new tenant, and turnover expenses (including direct costs like advertising, cleaning, maintenance and labor costs, and indirect cost to you in time and energy to get the place re-rented). According to estimates, the average turnover can cost between $2,500 and $3,500 dollars. This is even scarier when you consider that the average turnover rate in Utah (according to a study done by the National Apartment Association) is almost

78%! Now, some of that is not preventable. Some tenants move because they are getting married, going into the military or to school, are moving to another state for a job, or are buying a house. However, somewhere in the neighborhood of 70% of tenants move because they aren’t satisfied with where they are living or because they got a better offer somewhere else. The key to keeping these tenants is convincing them that you are the best landlord they will ever have. To do that, you should know what tenants want from you and what they want to get out of the property. According to recent survey of tenants, the top 5 things that tenants say they want are: • A responsible and dependable Landlord • A safe and secure place to live • An attractive building to live in • An apartment in good condition • A sense of community where they live

The same survey also looked at the top 5 complaints from tenants, which include: • Maintenance not being done • Landlord not communicating with them • Neighbors causing problems • Safety concerns • Rent/Deposit/Fees being too high Considering how you can better communicate with your tenants

There are also numerous other ways that you can get your tenants to renew their lease that are simple and yet effective. Upcoming Good Landlord Class Schedule Announced By Taylor Smith, Utah Apartment Association

T

he Utah Apartment Association has announced the dates and times for sixteen Good Landlord classes along the Wasatch Front. This is in an effort to help those who need to complete the class before the end of the year in order to receive a discount on their business license. Designed several years ago as a compromise to prevent cities from charging extreme disproportionate impact fees, the Good Landlord Program has been a fantastic success. Cities, some of which were skeptical that training landlords rather than just charging them would work, have seen significant drops in the number of crimes committed in rental properties – which has in turn translated into fewer police and other city resources taken up by rental properties and significant savings to the taxpayers. Tenants now have access to many more trained and professional landlords who are better at maintain-

ing their properties. Neighborhoods have become significantly less hostile to landlords, who they now can trust to maintain their properties and not rent to tenants who will cause problems and decrease property values. The biggest beneficiaries, however, have been the landlords. In addition to a certificate which they can use to get a discount on their business license (which is sometimes a significant discount), landlords get timely training and updates on what has changed regarding the laws and best practices in the Rental industry. The class also includes information on resources available to landlords that they can use to save significant amounts of money and prevent problems. And perhaps most importantly, the class is specifically designed to help landlords minimize their losses, increase their profits, and significantly limit their risk – annually saving landlords and property managers hundreds of thousands of dollars

throughout the state. It is a testament to the value of the class that a great many landlords and real estate professionals in communities throughout the state that do not require business licenses have taken and benefited from the Good Landlord class. We are proud to continue

President's Message: You the Members Run the Utah Apartment Association Steve Randall, President Utah Apartment Association The Utah Apartment Association is classified by the IRS as a “501 C-6 Trade Association”. A trade association, also known as an industry trade group, business association or sector association, is an organization founded and funded by businesses that operate in a specific industry. According to Wikipedia. “An industry trade association participates in public relations activities such as advertising, education, political donations, lobbying and publishing. However, its main focus is collaboration between companies, or standardization. Associations may offer other services, such as producing conferences, networking or chari-

table events or offering classes or educational materials. Many associations are non-profit organizations governed by bylaws and directed by officers who are also members.” The part I want to focus on is that the UAA is governed by bylaws and directed by officers who are also members. In November, the 2015 UAA Board will be installed. That board will consist of thirty-three UAA members who come from diverse backgrounds. There will be landlords who own and manage single family homes and small rental properties. Others will own and manage large apartments. Some will be vendors who provide products and services to the industry. Many have multiple years of experience and great expertise in property management. And though they are a diverse group they will unite as one entity

to plan, direct and fulfill the mission of the Utah Apartment Association, which is that we should stay “Utah’s leading advocate and resource for the owners, real estate professionals, developers, management teams, suppliers and service providers dedicated to quality rental housing.” On the board, no one person has more power than the other. Even the board chair has no authority to make decisions or act for the board except that granted them by the board. There will occasionally be differences on the direction to proceed, how to allocate the precious funds of the association, and how to allocate the limited time of staff and volunteers. But they will be resolved because each board member will shed any personal agenda and learn to work as a team for the benefit of all members. The UAA does have a small staff but the strategic plan, our

mission and goals, and ALL major decisions are made or supervised by the UAA board. In addition to board members, there will be another 150 UAA members who serve on committees like government affairs, events, membership and education. Committees also include a number of volunteers who will spend thousands of hours devoted to carrying out the work of the UAA. When researching renters insurance, properties should look for programs that offer: • Coverage for resident-caused water damage such as overflowing bathtubs or sinks. • Optional contents coverage for both burglary and theft occurrences. Many policies only cover burglary occurrences. • Resident liability coverage available as a cost-effective option for residents that may not own many possessions and do not want contents coverage. • Post-occupancy claims provide the property with the ability to submit claims for damage after a resident moves out and is usually available for 30 days after the resident vacates the unit.

Many insurance companies give discounts to landlords who can demonstrate that they require renters insurance, since so many claims on rental properties are resident caused. In addition, requiring renters insurance can allow owners to increase their deductibles, which also creates insurance savings. There is also a compelling customer service reason for requiring renter’s insurance. If a resident were to suffer loss of property because they had no insurance, even if they don’t hold a grudge and blame you for the loss, the expense of replacing all of their personal belongings will make it unlikely that they will be able to afford to stay. You may lose a good resident over something that could have been avoided. Requiring renter’s insurance can be in the best interests of not just landlords, but other residents and the tenant themselves. Every member of the Utah Apartment Association is a member of the National Apartment Association. If you aren't aware of all the NAA does to serve and protect our industry, you should learn more about it. The National Apartment Association is 75 years old this year. They provide federal advocacy, training and support for the rental housing industry. A couple of the most important things to know about them include: Federal Advocacy Intervention in our industry by the federal government can have disastrous and long reaching effects on rental owners. From Post office/ mailbox issues, to energy efficiency standards, from fair housing enforcement to tax regulations, federal issues have a huge impact on our business. The NAA works with Washington decision makers to blunt

and neutralize adversarial policies. Without their work, our operating environment would be much worse. Cameras Can Reduce Crime and Cost By Greg Cope, Addtech Controls

N

o matter where your properties are located, criminals may be lurking. One way to add security is through surveillance cameras. High Definition surveillance cameras conform to standards which can stand up in court as evidence, and surveillance cameras are no longer cost prohibitive and only for the high rent districts. According to the Utah Department of Public Safety there were an estimated 40,000 reported incidents of burglary, robbery, and vandalism last year in Utah. Many of those crimes happen on apartment properties. In apartments, cameras can have the effect of making residents feel safer, but they can also reduce property damage to the landlord. A California Center for Research in the Interest of Society (CITRIS) study found that cameras were very effective in reducing property crimes within 100 feet of the camera. Graffiti, property damage and theft are an extremely costly item on many apartment communities’ financial statements. A recent study by the Urban Institute found that, if monitored properly, video surveillance systems re-

duced crime at a cost effective rate. One example was in Baltimore, where cameras were installed in high crime areas and the cost savings in damaged property and victimization was $1.50 for every $1 spent. property only makes sense, and using a portion of that to upgrade and improve the property is a best practice that most landlords should follow. That being said, a tenant is far more likely to feel that a place is “home” rather than just a “house” that they happen to be renting if you involve them in the process of selecting what upgrades and improvements are goUTAH ing to be made. That doesn’t mean you should turn the process over to them or let them dictate what you will do, but rather means asking for their feedback and seriously considering it. Next, you might want to consider creating a budget for “ongoing marketing” for your current tenants. Mindy Williams from RentandRetain. com once told a story of an apartment community in Wichita, Kansas who arranged to have chocolates mailed to every tenants for their birthday. Once, they sent a Birthday Chocolate to a lady who had moved out. Since

the chocolates were mailed first class, the present was forwarded. Imagine receiving chocolate from the apartment community where you had just moved from! This resident was so touched that she moved back as soon as her lease was up. Finally, you should consider what gifts or concessions you might give to your tenants in order to convince them to lock themselves into a new lease with you. Some landlords do simple things, like take over a plate of cookies and a reminder to renew the lease. Others are more extravagant, offering things like a $50 dollar gift card, airline miles or even a rebate on the first month’s rent to the tenants who renew the lease. Ultimately, if you can keep the tenant even for one more year you can more than make up for the expense if you plan your gifts and concessions well.
