ental professionals are in the business of managing their rentals; Rent Dynamics is a company that handles common problem areas to help owners and managers be more successful. O
n February 7th, in front of 500 peers in the rental housing industry, Gordon D. Walker, who currently serves as the director of the Utah Department of Housing and Community Development, received a Lifetime Achievement award to thundering applause and a standing ovation. “I have been to a lot of these (Lifetime Achievement Award) presentations over the years and I can’t think of anyone more deserving of this than Gordon,” said Gloria Froerer, National Apartment Association Board member from Utah who presented the award.

Legislature Passes Equality for Rentals and HOA’s
he 2015 Legislature has passed a bill supported by the Utah Apartment Association that equalizes the playing field for rentals and landlords in HOA’s. Commonly called community associations, HOA’s (Home Owners Associations) and PUD’s (Planned Unit Developments) have the power to regulate and restrict the activities of owners in those developments. This sometimes leads to abusive practices that discriminate against renters and landlords. The 2015 bill HB 98, sponsored by Gage Froerer (R), Huntsville was the second part of a two year strategy to prohibit certain practices within HOA’s. What Were the Problems? of rental housing units in community associations. They have noticed in recent years a bias developing in policies and practices against renters and landlords. In 2014, the UAA supported a bill that prohibited community associations from requiring copies of credit reports on tenants (this violated federal law and provided sensitive information to unauthorized board members and managers). It also prohibited a practice that was growing in popularity where the board of a community association required preapproval of a tenant before the landlord could sign the lease. This was particularly problematic because community associations do not generally understand Fair Housing liability and ramifications. Imagine if a board denied a tenant with the last
name Hernandez or a single mother with children, and they claimed discrimination. The owner would have had the liability as well as the board. So we could not let that happen. But the worst problems were more complicated to fix than we could squeeze into the first years bill, so the UAA and CAI (Community Associations Institute) agreed to work throughout the summer to create a viable solution. The problems was this: A) associations began charging higher fees or dues to landlords who rented their units than to owners who lived in their units, and B) associations began restricting renters access to amenities or privileges that they allowed owners to use. Practical v. Legal – A practical solution to a problem tenant will probably be much faster and cheaper than the legal solution. However, Contact Us if you’re stuck with a deadbeat tenant. You’re better off in the hands of an attorney. Here are some practical tips to avoid or deal with a problem tenant. • Contracts – Detailed contracts are absolutely necessary to protect yourself and your investment. I’ve successfully evicted tenants based on an oral agreement (nothing in writing). But it is always easier to handle situations based on a well-written contract that protects you and your property. Use your UAA account download free copies of rental applications and rental contracts. • Communication – A landlord who communicates with their tenant (especially at the first sign of a problem) is much more likely to stay on top of potential issues. If
you communicate with your tenants to understand any questions or concerns they have they, you will be in a much better position to handle problems before they develop into serious disputes. • Consistency – If you are consistent with your tenants, they will learn what to expect from you. For example, if rent is due on the 1st and late if after the 5th, a consistent phone call on the 6th will do wonders to keep a client on track. Worst case scenario, you are updated in a timely manner to determine whether eviction will be necessary. However, it is up to the landlord to determine how to handle each situation. One of my clients would send an eviction notice (Three Day Pay or Quit Notice) to the tenant when rents were only one day late. That may be a little extreme, but he said that he warns his tenants that he’ll do this when they sign the lease and that all of his tenants pay their rent on time and in full.

Lifetime Achevement ..continued from front page sion, Mr. Walker has developed and implemented several acclaimed and innovative programs. Key among them is his management of the Olene Walker Housing Trust Fund, which provides seed money for affordable housing projects in Utah. Under Gordon, the Olene Walker Housing Loan Fund has streamlined application processes and effectively increased the loan fund from $42 million to over $124 million. In 2014 alone, over $172 million was leveraged with other sources of funds to help construct or rehabilitate 972 units of affordable housing throughout the state of Utah. The production rate from the Olene Walker Housing Loan Fund has averaged 750-800 multi-family units and 100-125 single-family units per year over the past five years. One of Gordon’s passions has been solving Utah’s homeless problem. He has been the driving force behind the state of Utah’s plan to end chronic homelessness. By putting the highest priority on our state homeless funds, supporting those efforts and keeping the State Homeless Coordinating Committee focused on the housing first model, the state has been able to reduce chronic homelessness by 72%, and in fact approaching functional zero. It is because of the collaboration and effort between the Olene Walker Housing Loan Fund Board and the homeless efforts to build housing. Mr. Walker has supported the construction and
rehabilitation of housing and providing services for the chronic homeless through projects like Palmer Court, Sunrise Metro and Grace Mary Manor. In addition, he has helped create projects for veterans including Freedom Landing and Valor House. He has and continues to invest in best practices to remove barriers to housing and supporting collaboration throughout the state. As he talked about homelessness in his acceptance speech the audience became silent. “Every year,” he said. “There is a little vigil held in Pioneer Park for the homeless who have died that year. This last year, there were 72 homeless individuals who passed away. Now that may seem like a lot, and it is – it’s too many. But one thing I noticed this year is that the average age of the individuals who were deceased had increased from 48 to 54 years old in the past few years. I believe that is because of what we are doing. We now have a system in Utah where we offer and give every homeless person who wants one, a home. We provide services to them on site, like drug counseling and job assistance. And just by doing that, life expectancy for people who experience the hard life on the street has increased by six years. Six years because of what we’ve done.” Neither Gordon’s nor the audience’s eyes were dry at this point. “What an honor it has been to work with so many caring people

like you who genuinely want to serve and help people and provide them housing to extend their lives and give them stability in the tumultuous world,” he said. “Gordon Walker is one of the finest men I know,” said Price Mayor Joe Piccolo, co-presenter, with Gloria, of the award. Mayor Piccolo serves as Chair of the Olene Walker Housing Trust Board. “He truly cares about others and works every day to help others.” Mr. Walker is the past national President of the Council of State Community Development Agencies (COSCDA), an organization representing all fifty states on policy matters with the federal government. He currently serves as the Director of the Housing and Community Development Division for the State of Utah, where he serves as Chairman of the Permanent Community Impact Fund Board and provides counsel to the Utah State Homeless Coordinating Committee and the state’s Olene Walker Housing Loan Fund Board. Another area Walker has been instrumental in leading the charge is on Transit Oriented Development. During 2014, The Olene Walker Housing Loan Fund collaborated with the private sector to create a Transportation Oriented Development Fund.
The fund is a collaborative effort between the Olene Walker Housing Loan Fund and various lending institutions in Utah. The Olene Walker Board committed $5 million towards this fund, and the fund has received commitments of over $30 million from private banking institutions. The banks are using the fund as an opportunity to invest Community Reinvestment Act Funds into the local community. Mr. Walker is frequently asked to speak at national conferences and is recognized as a leader in bringing together state, local, and community leaders to collaborate in solving difficult issues. Separate from his responsibility with the state, he is very active in the community. He serves as Chair of the Planning and Zoning Commission of Cottonwood Heights, Utah, and he has also served as Governor of the Society of Mayflower Descendants in Utah. Mr. Walker has been quoted as saying “My biggest accomplishment is my family, and my real dream in life is to improve the lives of others”. Mr. Walker is married to former Senator Carlene Walker. They have four children and 13 grandchildren.

These are some of the best leads” Rich says by setting up a 24 hour call center to answer calls and rent apartment units when owners and managers are unavailable, Rent Dynamics can turn more calls into leases and make apartment communities more money. He cites an example that the Rent Dynamics team just leased 100 apartments for a new property in Oakland that was in a time crunch in order to qualify for tax credits before the end of the year – those are calls and leases the staff otherwise would have missed or taken longer to convert! “Some owners and managers dismiss call centers right off the bat assuming this service may be too cost prohibitive,” says Clint Reeves, VP of business development for Rent Dynamics. “But the reality is that if we can help you rent just one more apartment than you would have on your own it would more than pay for our services. So Rent Dynamics created a texting tool to help apartment managers communicate with their residents. “The way it works,” explains Rich, “is apartment communities sets up automatic text reminders for residents on such things as rent reminders and facility closings. These reminders keep tenants up to date. Also, properties can send other alerts – invites to community events, notification of food drives or a notification of a lost pet. It’s also a great way to communicate in an emergency. Residents can reply by text to ask a question, put in a service order, etc., and the call center staff will respond immediately. It increases resident satisfaction levels and reduces work for the community,” he says. Every spring, our industry celebrates Fair Housing month in April. This year, on April 29, 2015 the Utah Apartment Association will be hosting our annual Fair Housing Education Conference and Trade Show. Each year hundreds of rental housing owners, managers, developers, personnel, service providers and suppliers converge on the South Towne Expo Center for the largest event of its kind in Utah. There will be over 26 classes and seminars
presenting the hottest topics and strategies for succeeding in rental housing. The keynote lunch speaker this year will be David O’Leary, a cancer survivor and the winner of the Amazing Race Season 24 All-Stars. David, along with his son Conner competed in Season 22 of the Amazing Race. With only a few episodes to go, while he and Conner were in the lead, David tore his Achilles tendon. Doctors told him he had a three day window to have surgery or he would never walk the same again. They stayed in the race as long as possible, but had to drop out while in the lead. This heart
break was only temporary, however, because as fan favorites, they were invited back for the Amazing Race All-Stars. Fan favorites throughout, they took a lead early and like the cancer survivors they both are, they fought through their second Amazing Race and were rewarded with victory. David is a real estate investor who owns rental housing communities both here in Utah and all over the United States. He will be talking about what he learned about life from the Amazing Race. Paul Smith, CAE Executive Director, Utah Apartment Association It would be tempting and understandable for anyone unfamiliar with Apartment Associations in this country to discount the Utah Apartment Association, and Utah, as a prominent place for a viable, large, and professional rental housing association. I assure you, however, the Utah Apartment Association is one of the top apartment associations in the country. Let’s look at the numbers: UAA has: • 3,398 Members (2nd largest apartment association by members in the nation, only LA larger) • 95,924 Units (26th largest in the nation, much higher than the 48th largest population center should have) • 78,589 of those units belong to companies/communities with more than 50 units (over 400 companies)
• We grew 27% in 2014 alone UAA is larger and has more apartment communities participating in the association than much larger markets including: Pittsburg, South Florida (Miami/Fort Lauderdale), Nashville, Las Vegas, Cincinnati, Jacksonville, and Detroit. Most of those cities are large enough to have Pro-football teams and yet Salt Lake City and the Utah Apartment Association have a larger membership of Apartment Communities. If you ask anyone at the National Apartment Association, Utah is held up as one of the premier associations in the country. In addition to having such incredible representation of the large communities, the UAA has a huge representation among independent owners and property managers who manage single family homes. We have about 2,500 members who have less than 10 units. This makes us the most balanced rental housing association in the country. Over the last few years we have gone to great lengths to include and involve property management companies that manage single family
homes. Currently we have over 150 such companies that manage about 10,000 units. We provide specialized services and education for this group. With the combined strength of large apartment companies, independent rental owners and single family property management companies, we have the widest possible grass-roots advocacy program in the country. Perhaps most striking we have over 1,300 attend our annual Fair Housing Education Conference and Trade Show, a HUGE attendance for our size market. We have 500+ attend our annual Tribute Awards. Those two events are generally attended
by members with large apartment communities. Last year we had over 3,500 attendees of our independent rental owner meetings and classes so that shows you our massive participation on both ends of the scale. The UAA is truly a juggernaut of a rental housing association, thanks to our members and volunteers who work so hard to share the benefits of the association. New IRS Repair Regulations By Charlotte Clark, CPA Squire Tax Services

he IRS recently finalized mandatory regulations to distinguish capital expenditures from supplies, repairs, maintenance, and other deductible expenses. Every business that acquires, produces, or improves tangible property will need to address these new rules on their 2014 U.S. federal tax filing. These new rules are complex. These rules employ an entirely new process in determining when expenses can be deducted vs. capitalized. Using text to engage residents sooner in the renewal process has streamlined the procedure for us, and has ensured that we provide consistency in contacting each expiring lease. 5. Improves Online Reputation. Texting is a great channel to ask residents to share their experiences. We’ve also combined texting with a service partner’s reputation management services to create campaigns that sniff out and fix problems, as well as recognize staff members for going the extra mile. 6. Sends Community Updates. We hold many community events throughout the year and texting has been a great way to promote them and get people involved. It helps each resident feel personally invited and lets them know that we care about them individually. 7. Saves Time and Resources. Our office staff spends way less time posting notices on doors and making individualized phone calls to residents. What took hours to communicate before can now be communicated to everyone in a matter of a few minutes. 8. Tackles Both Big and Small. Whether it’s a significant change in company policy or an individualized message, the texting application we use makes it easy to target one person, one building, one community, or the entire portfolio in minutes. 9. Making these surveys more accessible has doubled participation while drastically reducing the lag in response times. we met multiple times throughout the year with CAI to come up with a mutually agreeable compromise. We finally achieved that in November. HB 98 was then written and became one of the first bills through the legislature this session. Because of the process of getting all the stakeholders on board including: landlords, renters, community associations, the realtors, the homebuilders, etc. there was no opposition, and in all the hearings and votes, the total tally was 142-1 for this measure. What the Bill Does: The bill, in essence, prohibits the following: • Associations charging any higher fee or due to a renter occupied unit than to owner occupied units • Associations must allow renters the same privileges as owner occupants •
Melanie Ledingham, broker with Ledingham Properties which manages 600 single family rentals, was one of the proponents of this bill. “I can’t tell you how much this bill was needed. In recent years, our rentals and HOA’s have received all sorts of letters from boards demanding higher fees and instituting different rules on our renters. Some of the most abusive examples include one HOA charging us $50 per month adUTAH ditional dues per rentals and another charging a $500 turnover fee whenever a new renter moved in.”
Wayne Knudsen, with RealtyPro Salt Lake, says one HOA he works with charges a $600 deposit from each tenant he moves in and only gives back half when they move out. “It’s ridiculous what these HOA’s get away with. They are completely biased against renters and landlords”, he says. In addition to the unfair and abusive fees, managers like Wayne and Melanie have also seen rules and restrictions on renters tightened down. For instance, while owners in some complexes can have pets, renters have been prohibited. Owners can use the pool and tennis courts, but renters cannot. Owners can have guests use community parking, but renters can’t. These rules were unacceptable and discriminatory to renters and so we fixed them. Future Relationship with Community Associations Because we have worked so hard with community associations and their representatives, we are confident that if further problems occur, we will be able to resolve them.
