Law firm adds new faces Fleming and Associates increases legal options for clients

By offering a diverse range of legal counsel in an honest, respectful and transparent manner, Fleming and Associates, Barristers & Solicitors, provide clients in all corners of Powell River with the necessary support and guidance required to navigate the ever-changing legal landscape. Consisting of lawyers Ian Fleming and Laura Berezan, as well as an experienced team of legal assistants, the general civil law practice located at 4571 Marine Avenue recently added to its combined experience and knowledge by bringing in a pair of new staff members. “We had the opportunity to add Barb Egglestone to our group,” says Fleming. “She has a lot of experience that fits well with the other services we provide.” Egglestone brings an array of expertise to the firm in the management of wills and estates, trusts and financial matters. “We will be able to offer clients a little bit more than we have in the past,” says Berezan, “just because of Barb’s knowledge and experience.” Another new addition is Robert Hainsworth, who spent time with the firm in 2015 as part of the Rural Education and Access to Lawyers Initiative, a program that addresses shortages of lawyers practicing in small BC communities. “Robert was here as a summer student and we convinced him to come back,” explains Fleming. After his first stint in Powell River, Hainsworth completed studies at Osgoode Hall Law

School in Toronto and passed the bar examination as part of his articling period with Fleming and Associates earlier this year; the apprenticeship runs through May 2017. “Because we are a general practice firm, I have been able to do a lot of things, more so than many of my classmates from law school,” says Hainsworth, adding that although he likes litigation and going to court, for now he is learning everything. “I’m looking forward to getting up to speed and taking on new clients.”

Also helping to provide service to the firm’s clients are legal assistants Stephanie Rumley, Sharon Schmitz, Michelle Foort and Angelina Williams, while Linda Cosentino handles bookkeeping duties. Personally, Fleming’s main focus is helping people injured in motor vehicle accidents with their recovery and dealing with the Insurance Corporation of BC. In addition, his general litigation practice includes contract disputes, matrimonial matters and civil suits.

Fleming suggests that people involved in an accident should call a lawyer as soon as possible to find out about their legal rights. “For a person who has been injured, there are a lot of matters to deal with, things they need to address,” says Fleming. “First of all, getting medical help, assistance, treatment and therapies, but secondly, ensuring their legal status and rights are advanced clearly and certainly.” Fleming helps clients with the report to their insurer and guides

them on each step to take afterward. Initial consultations for accident victims are free of charge, allowing them to gain strong legal advice at the very beginning of the recovery period. “It sure doesn’t hurt to call a lawyer and receive some appropriate legal advice; it’s a good place to start.” says Fleming. “We are very experienced and easy to get to. Often, people can consult us the same day if necessary, and we only act for claimants in these cases, unlike many other law firms. Because of this approach, we believe we maximize our clients’ recovery.” In addition to litigation, the firm offers a variety of solicitor services, primarily through Berezan. A specialist in non-profit and charitable law, she has been especially busy of late working with non-profit organizations to help them adjust to recent changes in government legislation that affects how they operate. “There is a significant change in the Societies Act legislation; it is a big focus for us.” says Berezan. “We are working with many nonprofit organizations in Powell River to help them adapt to that change.” Berezan also specializes in corporate and commercial, wills and estates, family and real estate law. To book a consultation or make an enquiry, call Fleming and Associates at 604.485.2771 or email reception@fleminglaw.ca. Information is also available on Facebook and at fleminglaw.ca.

Tribute band promises a night to remember highlighting the music of ABBA When ABRA Cadabra began more than a decade ago, the quartet decided early on they would never want to be known as musical impersonators. Instead, the Vancouver-based group comprised of Ryan Langevin, Jeanette O’Keeffe, Marlie Collins and Jonas Falle aimed to pay tribute to a band they loved. Now, with countless live shows under their sparkling belts, ABRA Cadabra

have perfected their act as a fresh, respectful and classy homage to the Swedish pop supergroup. “We are paying tribute to ABBA’s music and honouring them; we do it as ourselves and fans of the music,” says O’Keeffe. “It’s a nostalgic journey that we are taking people on, but it’s also such great music that we want to do it justice, so we take a lot of care in working out the songs and putting on a great show for people.” O’Keeffe says because ABBA’s music is so uplifting and timeless it is common for whole families to come out to ABRA Cadabra shows and enjoy their versions of hits songs such as “Dancing Queen,” “Fernando,” “Waterloo,” “Take a Chance on Me,” and the list goes on. “What I find so unique about ABBA’s

music is our audience ranges from young kids to grandparents, so we’ll do a show and there are three generations in the audience, all singing along to the songs,” she says. “That is the coolest thing for me to see, that it spans generations.” A clear distinction is made in the music industry between musical impersonators and tribute bands and O’Keeffe is proud to say ABRA Cadabra falls into the latter category. The show includes ABBA songs as well as some added bonuses to encourage audience interaction. “We make it clear from the get-go that we are not trying to pretend to be ABBA,” she says. “We share the music and the stories behind the songs, as well as information about ABBA that the audience would be interested in.” The group’s Powell River show has special importance, says O’Keeffe, as longtime ABRA Cadabra sound technician Alan Rempel now lives in Powell River and will be mixing sound at Evergreen Theatre that night. “Alan has been with us almost since the beginning and he’s just this wonderful guy who is responsible for us having such good sound,” she says, “so it will be a nice reunion for us.”

composition, leaving less food behind for rodents. Location, location, location Ensure areas near your composter are free from attractants such as pet food, bird feeders, garbage cans or fruit trees, as these may be the food source while the compost pile becomes the rodent’s condo.

LET’S TALK TRASH Has your backyard composter become a haven for rodents? It is no surprise that as temperatures drop, critters look for a warm, dry place to bed down. Rats and mice can be attracted to backyard composters because of the cozy heat created as food and yard waste breaks down. Access to nearby snacks only sweetens the deal. For people ready to wave the white flag and give up composting altogether because of pests, here are some tips that might save the day and prevent kitchen scraps from entering the landfill. Composter maintenance If you already have a pest problem, avoid putting meat, fish, eggs, cheese,

eggshells and seasoned leftovers in your composter. Keep these items separate, freeze where possible, and bring them to the community composting dropoff location at the Town Centre recycling depot, or to a neighbour’s pest-resistant bin instead. Avoid dumping and running Add a layer of carbon-rich material (dry leaves, wood shavings, sawdust, shredded newspaper/cardboard) each time you add kitchen scraps. This reduces attracting odours. Breathe life into your pile Turning your pile with a gardening fork or poking holes with a stake will speed the process of de-

Rodent-proof option Rodent-proof composters are an added precautionary measure that can be taken. Some local inventions include Laurie Chamber’s critter-proof stone composter and Bert Baillie’s converted freezer composter. A Vancouver Island-born invention is the locked, metal Speedibin, which comes with a screened base. Indoor composting Try taking composting inside by building your own worm bin or trying bokashi fermentation. Whatever the choice, tossing food scraps in the garbage is best left at the bottom of the list of options. A well-stocked garbage bin can attract even larger furry friends.

You forget, we forgive Powell River Public Library should always be a place where our community feels welcome. Last year it became clear to us that one of our policies was keeping people out of the library; often for good. Overdue fines piled up when a few books disappeared under the bed, didn’t move FOR YOUR when residents did or were REFERENCE left in a locker at school. Those By Rebecca Burbank reasons prevented people from coming back to the library, so we decided to say no to overdue fines. Library staff have had the pleasure of surprising patrons all year with news that their overdue fines have been forgiven. Since January we have been wiping fines from patrons’ accounts when all overdue materials are returned and there are no outstanding fines. Sorry, we do still have to charge when the book is eaten by the dog, dropped in the bathtub or left on a plane. The response from the public for our fine-forgiveness program has been so positive, and removing fines makes our daily interactions much more positive as well. It also allows people to donate a few dollars to the library on their own terms. This October, in addition to getting the building permit for the library’s new location, I am thankful for the ability to remove a barrier that kept many people away from library services.

WHAT PEOPLE ARE SAYING ABOUT POWELL RIVER KINGS DREAM LOTTERY In 2014, I received a gift of a lifetime when my father-inlaw bought me a Powell River Kings Dream Lottery ticket. On January 9, 2015, I was flabbergasted when my name was called out as the winner of the grand prize of $50,000. I had never won anything that big in my life and to win that much money was just over the top. The winning came at an opportune time in my life as we purchased a new home and needed the money to finish a basement suite for my father and mother-in-law. Some of our money will go into savings and some for a family holiday in Las Vegas. We are huge supporters of the Powell River Kings and will continue to support the Dream Lottery. There are no better odds for raffle tickets. Can’t wait to buy my next one. Dan and Roseann Dupuis, 2015 Grand Prize Winners

By Paul Martiquet Ask yourself this question: Is a heart attack more likely for a man or a woman? For a long time the common belief has been that heart disease is a man’s problem. This is very misleading, but almost understandable, because research has usually focused on men’s experiences. Cardiovascular disease (CVD), which includes coronary heart disease, strokes and heart failure, has been identified with men partly because they tend to have heart attacks at an earlier age (65 years versus 72 for women). Women’s risks have been discounted for various reasons, but CVD is the leading cause of death among women, just as it is for men. Since 1980, overall coronary death rates have fallen by at least two-thirds. This huge improvement is attributable to reductions in risk factors via lifestyle

nizable as a heart attack, women will often dismiss them or wait longer to seek help. Doctors, too, may not always recognize a woman’s symptoms, which delays treatment. Women can take steps to reduce chances of cardiovascular death and heart attack, and yes, men can take these steps, too. Step one: do not smoke. Also, know your blood pressure and blood cholesterol levels and keep them under control. Choose a hearthealthy diet with lots of vegetables, fruits, nuts, beans and whole grains, and fish rich in omega-3 fats. Cut back on the sodium in your diet. Become and stay active, which in turn will help control weight. Know your family history. You cannot do anything about it, but it should provide a warning of potential for heart disease and may trigger some of the actions to reduce the risks. None of these suggestions are new or especially surprising, but have you considered making even one change that will reduce your risk of a coronary event? It could be of great benefit and may make the second change easier. You deserve it, don’t you? For example, while risk factors are common to both genders, they can vary in degree. Take diabetes: it increases the chances of CHD for both, but increases the risk more than twice as much for women as for men. And high blood pressure is more strongly associated with heart attacks in women. There are also differences in how heart attacks occur. At its simplest, a heart attack is caused by plaque buildup and clot formation in the coronary arteries, which block blood flow to the heart. Blockages form differently in women: they are more likely to develop in smaller branches of coronary arteries and be less severe, but are equally dangerous. We all know the symptoms of a heart attack include left-central chest pain, but fewer women exhibit this classic symptom. Instead, women are more likely to report other symptoms, including fatigue, weakness, shortness of breath, dizziness, palpitations, nausea and pain in the jaw, neck or arm. These can all be mistaken for a panic attack. Because symptoms may not be instantly recog-

THE LAW CORNER Q. I am married and my wife and I have one child. If I die without a Will, what will happen to my estate?

RASPBERRIES

A. Section 21 of the Wills, Estates and Succession Act states that when a person dies without a Will and leaves a spouse and one or more descendants of the deceased and the spouse, then the estate must be distributed as follows: the spouse receives the household furnishings and the first $300,000 of the estate. Any amount in excess of $300,000 is divided, half to the spouse and half to the descendants. If you had other children who were not descendants of both you and your wife, then your wife would receive a smaller share and the remainder of the estate would be divided, half to your wife and half to your children. If you have questions about estate planning, please contact my office.

Edward “Ed” Lawton Edward “Ed” Lawton, formally of Fruitvale, BC, passed away on September 13, 2016, in Powell River. He was born on September 17, 1938. Ed is survived by his wife of 49 years Edith, son David (Shelly) Lawton, daughter Roseann (Dan) Dupuis, grandsons Brian (Amanda) Lawton, Dave (Tia) Lawton, Mathew Lawton, Micheal Lawton, Lucas Dupuis and Andy Dupuis, greatgrandson’s Jacob, Waylen, Casen and Benjamin and dogs Patches, Bruno and Lady. Ed was a caring husband, father, grandfather, uncle, greatgrandfather and friend. He was preceded in death by his son Christopher, sisters Rose-Mary and Lucy and brother David. Ed was active in politics in Fruitvale for more than 20 years. He participated in bowling, golf, curling and cross-country skiing. He moved to Powell River in 2010 to be closer to Roseann and her family. Ed spent the last few years battling Parkinson's disease and in the end he grew tired of the fight. We would like to give a big thank-you to the fourth floor nurses and support staff at Powell River General Hospital for treating our dad with respect and kindness. Thank you to the home support workers who came to the house to take care of our dad as well. A celebration of life will take place at 1 pm on Saturday, October 15, at Fruitvale Hall, 1968 Main Street, Fruitvale.

Lloyd Walter Anderson Lloyd Anderson of Powell River passed away on Saturday, October 1, at the age of 95 in Powell River. He was born on Savary Island to Louis N. Anderson and Lulu Irene (née Palmer) on September 6, 1921. Lloyd’s father was one of the first settlers to the island. Lloyd started school in Galley Bay, then later at Tenedos Bay, Salmon Bay and Toba Inlet. After the death of his father, Lloyd, at age eight, moved to Lang Bay where he attended Stillwater School. He completed grade 10, then, at the age of 16, he went to work as a logger, millworker and millwright. For many years, Lloyd worked for Morton Industries at Lang Bay. Lloyd had a brilliant mind and was always inventing things. His harmonica playing always delighted his grandchildren as they played the “spoons” along with him. His happiest memories were in his little yacht, running back and forth between Westview boat harbour and Lang Bay, catching fish after a day at work. Lloyd was predeceased by his parents and first wife Edith, stepsons Larry and Terry Gouthro, his second wife Hazel and siblings Jimmy, Andre, Terrance, Sylvia, Pearl and Julie. He is survived by stepdaughter Melodie Thomas, her two children and seven grandchildren; stepdaughter Virgina Saul, daughter-in-law Carol Gouthro, grandchildren Dawn (Ed), Corinne (Norm) and Larry (Darlene) and their children. Lloyd also leaves behind many nieces, nephews and longtime friends John Mayer and Bob Monteith. Lloyd’s family and friends will miss his “Happy, happy” attitude and his warmth and kindness. He was a true inspiration to all those who knew him. Lloyd’s family wishes to extend our sincere thanks to the wonderful caring staff at Willingdon Creek Village and to Dr. Schweitzer for Lloyd’s care over the years. There will be no service as per request.

Powell River Villa home game

Fans still talk about the glory days of Powell River Villa soccer club, when it was a Vancouver Island Soccer League powerhouse during the 1990s. Founded in 1973, Villa won the prestigious Jackson Cup in 1996/1997 and 1999/2000. Its fan base was large and loud. Today, the team is working hard to bring back those heady days with a new coach, supporters club and a growing fan base coming out to Timberlane Park to watch the games. DAVE BRINDLE PHOTOS
