By the act of 1877, in the matter of payment of principal and in_terest of State Rel ief Bonds, it was provided that payment should be made from the Sinking Fund, and in order; that said bonds may be -paid promptly it is _recommended by t he State Treasurer that the balance in ·the State Bond Fund, together with the amount hereafter collected, be transferred to the Sinking Fund, and thus made available for the purpose for which it is _collected. REVENUE AND 'l'AXATION.

The assessed valuation of the taxable proper ty of the State in 1883 was $110,543,644.58, and in 1884 it was $123,615,886.95, showing an incr ease of $ 13,072,242.37. The pardoning power vested in the Ex ecuti ve b as bee n e x er cised by me in but one instance, that of Jacob Smith, of York eo unty, couv icted for the offense of shooting with intent to ki ll , a nd sen te n ced to t he State Penitentiary for the term of one year. En tering up on h is sentence F ebruary 5th, 1883, and a pardon issu ed the 20t h of S eptember . ' of the same year. In t his ca. e, the provocati on to cr im e was g reat, itnd while it does not justifY, yet Rerves to exten uat e, a nd m y action in the premi es was based upon the petitions of a la rge nurnbe r of t he cit.i zens of said county, fonrteen members of the Gra nd J u ry by >vh om he was indicted, and upon the reeommendation of the Prosec u t in ao- A ttorn ey, and the District J tidge who passed sentence upon h irn . The power of commutation has been used by me in two ea ses, viz. : George H art, under ·entence of death, from H all county, a nd J oh u R . Pol in , under sentence of death, from Cass county . In th ese tw o case the . entence of death was changed to imprisonment for li fe in the State Penitentiary. My action in this matter was d etermi n ed by letters fil ed by the Judge~ of the Supreme Court, who were un an imous in recommend ing that such action should be taken, a nd w it h the feeling that I would not be warranted in disregar d ing a recommendation com ing in such man ner and from such a source. In the matter of the remission of fines, I have acted in but on e in.stance. A t the October term, 1882, of the Gage county d istrict cou r t, one C. E . Gifford was fi ned one hundred and fifty dolla rs for t h e crime of selling intoxicating liquors without a license. I t appearin g later that the facts were not fully understood, and that he was entitled to relief upon the merits of the case, th e fi ne was rem itted u po u the recommendation of the Judge who imposed it.

Colby, Colonel commandiug 1st R egiment, and as appears from these various reports, the command i · in excellent . hap e and has sustained and improved upon its past high stanllard of efficiency. As an aid and to e n co urage t he work, the National Government loaned the Expos iti on m.a nngement one million dollars, and appropriated three hundred t h o usand dollars for the. purposes of a Government display. T here were under sale 461,407.14 acres of Educatioua l la 11d ~, t b e unpaid principal of which i. bearing six per ceut on $3,11 2 ,54 2 .5 6, and amounting to $186,752.55. There were . 1,160,267. 35 vf t he P e r manent Funds invested in securities the ann ual interest on which is $8-±,585.q8, making in all a temporary Fund fl'Om land rece ipts a l one of $43 2,257.45 per annum. There are still vacant and uoappraised 1,478,086.13 acres of Common School Lands, or abou t one-half of· the original grant. Result-s arrived at under the present Jaw have been p laced b efore you. I t now remains for you to decide what sl1all be t he future policy of the State regarding this great trust; and as to what that pol icy shou ld be you will find wide diversity of opin ion. H ere is room for your best thought. The entire subject of School L and L egislation is one to be considered with reference only to the best interests of the School Fund. The Constitution provides thaL our Ed ucational la nds shall not be soJd for less than seven dollars an acre nor for less than their appraised value. The Legislature has the power to increase th . minimum price of the.. ooe lands. This question, as well as that of strikinO' out t he sale clause, or if •sales are to be continued of striking out 0 the p rivate sale clause, and the further question of some met hod of appraisement in matter of sales whereby the School Fund may obtai n a more j ust valuation upon its lands, w.ill come before you for deci ston. While the legislation above r eferred to will afford a m easure of reli ef, the quest ioH of chief inte rest to th e people of an agricultural State like our own, is that of rates for the tran sportation of their pt'tK!uce and live stock. The demand for legislation of some kind looking to the .regulation of freight rates is general , and this demand . ltould not be unheeded by y ou.
