ALL OF WHICH ARE IN HIS NAME ONLY? A: You could probably go for several years without letting these companies know your husband has died. Chances are, as long as you keep paying all the bills, they’ll never know he died, and they’ll be
content to keep you as a customer. That said, it would be wise to contact each of your credit card companies and let them know your husband has passed away. They may require a copy of the death certificate or other documentation, but once they are satisfied that he is indeed no longer alive, they will remove his name from each of the accounts and put them in your name only. The other bills you mentioned, phone, utilities, etc. should be handled the same way.

HOW DO I GAIN OWNERSHIP OVER THE HOUSE SINCE MY FATHER DIDN’T LEAVE A WILL? A: Your biggest problem is that you own only one-fourth of the house. Since you didn’t mention a mother or stepmother, I presume your father was not married at the time of his death. That said, when he died without a will, the house you were living in passed to you and your four siblings in equal shares. In determining your rights, it is irrelevant that you have lived there for several years and that you have been maintaining the house since your father’s death. In order for you to gain ownership, you will first need to open your father’s succession. You may be able to do a small succession depending on the value of your father’s estate. This is a simplified procedure that will establish you and your siblings as co-owners. However, if your father owned other assets, this type of proceeding may not be available. Once the succession proceeding is complete, you can negotiate the purchase of the house from your siblings. To start, the four of you will need to agree on how much the house is worth. Then, you will need to pay each of them their one-fourth share. They may agree to owner-finance the sale,

meaning you could pay them over time without having to get a loan from a bank. However, don’t be surprised if they want their money upfront. If they do, you will need to secure a loan from a lender. If the four of you can’t reach an agreement on the value of the property, or they don’t want to sell their shares to you, it will need to be sold to a third party and the proceeds split four ways. Given your disagreements thus far, selling house may not be easy. And, if you decide to sell the house, the four of you will have to agree on other things, such as who to use as the listing agent, whether you can continue living there until the house is sold, how much to list the house for, how much to sell it for, and other terms of the sale. If the four of you can’t reach an agreement on your own, then any one of you can go to court and seek a court-ordered sale of the property. This last option is not a good one, as it will likely reduce the amount of money each of you will ultimately receive, and it will add a considerable amount of time to the sales process. When negotiating with your siblings, you can try to recover some of the expenses you have paid over the past two years, however, they may contend that you should have been paying them rent all that time. In the end, it may be easiest for the four of you to call it even agree that all of your expenses were about equal to what you would have paid them in rent. Finally, make sure any warranties, guarantees, and user manuals for the oven, refrigerator, dishwasher and any other items that will remain with the house are easily accessible.
