Home Financing 101 for First-Time Buyers By Mac Gibson, President Acadian Home Builders Association
T
he housing market in Acadiana is booming, and many first-time home buyers are planning to become home owners in 2015. However, stricter regulations put in place after the national housing crash and the long list of paperwork required to buy a home has left many prospective home buyers concerned and confused about the home financing process. Advance preparation is key when getting ready to buy a home. You need to decide how much to spend and which type of mortgage will work best for you, as well as understand the settlement process. Before you visit a sales office, model home or open house, you should take advantage of the many sources that can help you get prepared, and take some steps to ensure you’re in the best possible financial situation.
Be Realistic About What You Can Afford Figure out what you can comfortably pay on a monthly basis. Write down all your monthly expenses including loan payments, utilities, insurance, and credit cards and don’t forget food, clothing and entertainment expenditures. When determining the monthly payment you can afford, remember that in addition to the principal and interest, you will also be paying into escrows for property taxes, hazard insurance and possibly mortgage insurance or a home owners association assessment. Many real estate websites have mortgage calculators that are a great way to figure out what your monthly payments would be based on current interest rates and down payment amounts.
Pay Down Your Debts Debt that you carry on your credit cards will limit the amount of a loan a lender will be willing to give you. Lenders typically want to see a total debt service ratio that is less than 40 percent of your monthly income.

Pre-Qualify for Your Home Mortgage To ensure that the financing process goes smoothly, buyers should consider pre-qualifying for a mortgage and having a financing commitment in place before shopping for a new home. Buyers also may find that some home builders have arranged favorable financing for their customers or offer financial incentives. Pre-approval also enables you to quickly make an offer when you find a home, and is attractive to sellers who are considering multiple offers. A lender’s pre-approval would still be subject to a final verification of your credit and a satisfactory appraisal. Qualifying for a mortgage and saving up for a downpayment remain primary obstacles to homeownership. Recently Fannie Mae and Freddie Mac attempted to address this issue by announcing new low-downpayment mortgage programs geared primarily toward the first-time home buyer market. These lenders will now offer mortgages with 3% downpayments, allowing more creditworthy borrowers who lack the funds for a large downpayment to obtain a home mortgage.

Lafayette Consolidated Government will host a series of workshops geared towards professional groups including builders, developers, architects, engineers, realtors, and any other interested members of the public to learn more about the Unified Development Code (UDC). The workshops will be held prior to the Planning Commission’s scheduled consideration of adoption on March 16. As part of the initial contract for the comprehensive plan several years ago, LCG contracted for the development of a UDC which will, upon adoption, support the implementation of PlanLafayette. The workshops will cover the code in general, giving attendees an overview of the structure of the code. Then LCG staff will delve into the articles that the targeted groups are likely to be most interested, focusing on many of the changes from today’s regulations. The overview will then be followed by breakout groups where attendees can ask specific questions of LCG staff.

Energy efficiency: Home buyers are looking to cut utility costs, and energy efficiency appliances and products can be one way to do that. Low e-windows, Energy Star appliances, and programmable thermostats are more in demand among home shoppers. 4. Great rooms: These large open spaces that often merge dining rooms, living rooms, and kitchens continue to be in high-demand among home shoppers, according to NAHB’s poll of builders. “Great rooms are wonderful places where everyone in the family can sit around, or where the kids can do their homework while you get dinner ready,” Stephen Melman of NAHB told MainStreet. “Today’s great rooms are large, bright and just make you feel good being there.” 5. Taller first-floor ceilings: More home buyers want the first floor to stretch beyond the typical eightfoot ceiling. They’re asking builders for nine-foot ceiling heights. The taller ceilings can open up living rooms, dining rooms, and other spaces on the first floor. But home shoppers say they can do without the cathedral ceiling in the family room, which can be too costly to heat and cool. Also, they aren’t preferring the higher ceilings on the second floor, which many home buyers say they want to feel more cozy, Melman says.

Q: WHEN I SIGNED MY APARTMENT LEASE, I PAID A $250 PET DEPOSIT FOR MY DOG. SINCE THEN, MY DOG HAS DIED, AND I DON’T HAVE ANY PLANS TO GET ANOTHER ONE. I HAVE ASKED THE APARTMENT MANAGER TO INSPECT MY APARTMENT, AND ASSUMING HE FINDS NO DAMAGE, TO REFUND THE $250 TO ME, BUT HE WON’T. I HAVE LIVED IN THIS APARTMENT COMPLEX FOR OVER 5 YEARS AND HAVE NO PLANS TO MOVE ANY TIME SOON. IS THERE ANY WAY I CAN GET MY MONEY BACK WITHOUT WAITING UNTIL I MOVE OUT? A: Unfortunately, probably not. Generally, most leases don’t require the lessor to return a pet deposit to a tenant until the 30th day after the tenant vacates the apartment. This gives the lessor plenty of time to inspect the premises to determine if the pet did any damage. You should carefully review the terms of your lease to determine whether it contains this type of stipulation. If it does, you may be out of luck. If it doesn’t, try pointing this out to the management agency, and turn the tables on them. Ask them to show you the language that says they are allowed to keep your pet deposit despite the fact that you no longer have a pet. If you are able to point to specific language in your lease that prohibits them from keeping your money or they can’t, you have a better chance at getting your $250 back before you move out.

You also might want to try getting your money back next time your lease comes up for renewal. Depending on how desperate the complex is for tenants, you may be able to negotiate the return of your $250 at this time. You could also bluff and threaten to move out if they don’t return your money. You are definitely taking if a chance if you decide to go this route. The management company might relent and allow you to sign a new lease that doesn’t require a pet deposit, but they could also call you on your bluff and send you apartment hunting sooner than you anticipated.

PAY CLOSE ATTENTION TO THOSE INVOICES I CALLED MY ATTORNEY TO ASK A QUESTION ABOUT SEVERAL ITEMS ON HIS BILL.
IN THE
NEXT BILL, HE CHARGED ME FOR THAT CONVERSATION. IS IT CUSTOMARY FOR AN ATTORNEY TO CHARGE FOR THIS TYPE OF CALL? A: No, it is not customary for an attorney to bill you for a conversation you had to discuss questions you had about your bill. At least, that was not the consensus among several lawyers I informally asked. Most attorneys would not bill their client for this type of call. Even though most attorneys provide their clients with detailed monthly billing, this doesn’t mean every bill is always easy to understand or error free. Mistakes do happen, and a client shouldn’t be penalized for asking a question about a charge. This type of practice certainly doesn’t build client loyalty, nor does it make someone want to hire that attorney to handle another matter for them. It is possible - although unlikely - that your attorney was not aware that the call was billed to you. In some larger firms, bills go out before the attorney has a chance to thoroughly review them. Also, if you and your attorney discussed other matters during this call, he may have billed you for that portion of the call. If you don’t feel this was the case, you may want to call your attorney to see if the charge for the conversation was sent in error. Unfortunately, you run the risk of being billed yet again. I suggest paying the portion of the bill that is not in dispute and explain in a cover letter with your payment that you do not think it is appropriate to be billed for a phone call to discuss your bill. If he call him or send a letter and he still doesn’t remove the charge from your bill, I suggest you find another attorney, and quickly.
