DON’T DEPEND ON OTHER SELLERS’ ASKING PRICES TO DECIDE YOUR ASKING PRICE Q: WHERE CAN I GET INFORMATION ABOUT THE ASKING PRICES OF HOUSES THAT HAVE SOLD IN MY NEIGHBORHOOD DURING THE LAST SIX MONTHS? I HAVE FOUND INFORMATION ON THE SELLING PRICES, BUT WOULD LIKE TO COMPARE THE SELLING PRICES TO THE ASKING PRICES.

A: The only place I can think of where you can obtain information on the asking prices for properties in your neighborhood is from the Multiple Listing Service (“MLS”). To access the MLS, you need to be a member. Most licensed real estate agents are members of the MLS. If you have a real estate agent, you can ask your agent to obtain this information for you. But you should remember this - there isn’t really a concrete value in knowing the asking prices of the different homes in your neighborhood. Different sellers use different strategies when deciding on an asking price. And, oftentimes, properties start out over-priced to begin with. Comparing properly priced houses to over-priced houses, then lumping them together in some sort of analysis will, in all likelihood, skew your figures, and leave you knowing no more than you did when you started. By carefully examining your house and its features, and by taking into account the market and comparable sales, an experienced real estate agent should be able to help you decide on an appropriate asking price for your house.

Before writing a title insurance policy, the title company will check for defects in your title by examining public records, including deeds, mortgages, wills, divorce decrees, court judgments, tax records, liens, encumbrances, etc. If you purchase a policy of title insurance, and someone later files a lawsuit, asserting an ownership interest in the property you purchased, the title company will defend the action, subject to certain limitations. If the title company loses, it will pay you for covered losses up to the amount of your policy. In Louisiana, there are two types of title insurance policies. There are “lender policies,” which protect lenders, and “owner policies,” which protect the purchasers. Most reputable lending institutions will not loan you money to buy land or a house unless you purchase a lender property. Therefore, unless you pay cash for your house, in all likelihood, you will have to purchase a lender policy at the time of closing. If a claim is later made against your property that voids your title, the lender policy will repay the balance of your mortgage.

TITLE INSURANCE - IS IT REALLY NECESSARY?

A lender policy remains in effect for the life of your loan. However, if you refinance you house, even if it is with the same lender, you are usually required to buy a new lender title policy. This is because the older lender policy expires when the existing loan is paid off. Fortunately, most tile insurance companies offer substantial discounts on the new lender policy when you refinance.

Q: WHAT EXACTLY IS TITLE INSURANCE? WHAT DOES IT PROTECT AGAINST? DO I HAVE TO PURCHASE TITLE INSURANCE?

Owner polices insure property owners against the specific kinds of claims listed in the policy. You are not required to purchase an owner policy.

A: The term “title” refers to the ownership of a piece of real estate. A clear line of title makes you much less vulnerable to ownership claims from other parties and to outstanding debts of previous property owners.

Unlike a lender policy, which expires when your loan is paid off, an owner policy remains in effect as long as you own the property. Keep in mind, however, an owner policy only covers you up to the value of the property at the time you purchased the policy. It does not cover any increase in value of your property.

Title insurance is insurance that provides protection against title defects that were unknown to you at the time you purchased the policy. Title insurance only protects you from claims of ownership. Generally, it does not protect against boundary disputes with neighbors. Also, it does not insure against fire, flood, theft, or any other type of property damage or loss.

One last word of warning - Make sure you buy from a licensed title company. It is illegal to sell title insurance in Louisiana without a license. If you buy from an unlicensed company, and the company later goes broke, your claims could go unpaid.
