Q: WE RECENTLY BOUGHT A HOUSE IN LAFAYETTE. WE HAD A HOME INSPECTION COMPLETED AND THERE WERE NO REAL ISSUES. NOW WE HAVE FOUND OUT THAT WE HAVE FOUNDATION PROBLEMS AND THE FOUNDATION REPAIR WILL COST AT LEAST $10, 0000. IS A FOUNDATION ISSUE SOMETHING THAT SHOULD HAVE BEEN COVERED BY THE HOME INSPECTION?
Q: WE HIRED A CONTRACTOR TO HELP US MAKE SOME IMPROVEMENTS TO OUR BACK YARD. HE BUILT A PATIO, STAINED THE CONCRETE, AND DID A LOT OF LANDSCAPING. WE WERE PLEASED WITH THE FINAL RESULT, BUT THE CONTRACTOR’S ORIGINAL BID WAS CONSIDERABLY LESS THAN HIS FINAL BILL. ACCORDINGLY, WE REFUSED TO PAY A PORTION OF THE BILL. APPARENTLY, WHEN WE DIDN’T PAY HIM, HE DIDN’T PAY ONE OF THE SUPPLIERS, AND THEY PLACED A LIEN ON OUR HOUSE. WE EVENTUALLY RESOLVED MATTERS WITH HIM, HE PAID THE SUPPLIER, AND THE LIEN HAS BEEN REMOVED. WILL THIS LIEN, EVEN THOUGH IT HAS NOW BEEN REMOVED, HAVE ANY EFFECT ON OUR CREDIT RATING?
A: It depends. During an inspection, the inspector will review readily accessible exposed portions of the structure of the home, including the roof, attic, walls, ceilings, floors, windows, doors and foundation, as well as the HVAC system, interior plumbing and electrical.

While the purpose of the home inspection is the help you learn as much as you can about the condition of the property, and minimize the possibility of unpleasant surprises, unexpected costs, and post-purchase headaches it is not a guarantee of any kind on the condition of the property. The first thing you should do is review the contract with the home inspector. You are looking for confirmation that you obtained a home inspection versus a warranty evaluation, and the home inspector was licensed. Licensed home inspectors are required to carry a minimum of $3 , in Errors & Omissions Insurance, which protect both the client and the real estate agent in case the inspector inadvertently misses or omits a major defective system component from his inspection report. The contract should have also outlined what the home inspector duties and obligations were in relation to the inspection of the home, and whether the foundation was a part of the inspection. Also, review the inspection report for any comments related to the inspection of the foundation. You only have one year to file an action for damages against your home inspector from the date of the inspection, so if you feel as though he misses a major part of the inspection then you should consult with an attorney as soon as possible to preserve any action you may have. Of course, homeowners want any materialman’s lien promptly removed once payment has been made. In your case, this seems to have happened. Now, on to your question. All three of the credit-reporting agencies - Experian, Equifax, and TransUnion — sift through public documents for state and federal tax liens. And, as a general rule, a tax lien will have a serious negative impact on a borrower’s credit rating - an impact that can last for years. However, none of the credit-reporting agency looks for materialman’s liens, so these types of liens are not reflected on a person’s credit report. Most of the credit reporting agencies think of a materialman’s lien as an insurance policy that the contractor holds, not necessarily a debt the consumer owes. Accordingly, they are not considered derogatory pieces of information, and should not have a negative impact on your credit score. There is however, one caveat. Several years ago, creditreporting agencies did look for materialman’s liens. Therefore, it is possible an old one could still turn up on your credit report. This is why it’s a good idea for anyone who had one of these liens in the past to check their reports. The credit-reporting agencies all provide free copies of your report — and it’s important to review all three because they’re not the same.

Often times, when subcontractors or supplies don’t get promptly paid for work they do on someone’s home, they will file a materialman’s lien. It’s their way of making sure you will eventually pay up.
