Entry-level Homes Making a Comeback By David Anderson, President Acadian Home Builders Association Waist size. College tuition. Kidney stones. Many things in life don’t get better as they grow bigger. Often times, the best things comes in small(er) packages. In recent years, the tiny-home trend has taken that philosophy to the extreme. But it hasn’t quite caught on with mainstream America. The overwhelming majority of home buyers still prefer to own an abode with ample space in which to live, relax and entertain. The median size of homes built in 2015 was bigger than ever, and the portion of those homes with four or more bedrooms grew to 47 percent. But so far in 2016, the median home size appears to have reached a plateau, leveling off after several years of gradual growth. In fact, the first half of 2016 saw median square footage of single-family homes decline — ever so slightly — from 2,465 to 2,392. Some might assume that any decline is a negative sign. However, economists know that this is a positivee step in the post-recession cycle off economic recovery. “History has shown us th thiss pattern before when the t country was recovering froom previous recessions,” saays NAHB Chief Economist Robeert Dietz. “When the recessioon began, production of larger,r, high-end homes ramped upp because the buyers of those

homes typically had fewer credit constraints than the would-be buyers of more modest homes. But this recent decline in home size indicates that smaller homes are increasingly popping up as the economy strengthens and more entry-level buyers return to the market.” An expanding market of entry-level homes in many areas of the country typically includes increased production of townhomes, which range considerably in size and price but are often times smaller and less expensive than single-family homes. Townhomes make up a relatively small share of the new homes being built, but what many of them offer — medium-density, “urban village” neighborhoods with conveniently located amenities — is very appealing to a large number of buyers from all age groups. SALE OF PROPERTY FOR A VERY LOW PRICE MAY PROVE PROBLEMATIC Q: I HAVE FOUND A PIECE OF PROPERTY FOR SALE FOR A VERY LOW PRICE, WHICH I AM CONSIDERING PURCHASING. BUT IT SEEMS TO BE A LITTLE TOO GOOD TO BE TRUE. THE SELLER IS NOT FROM THE AREA, AND I THINK MAY HAVE INHERITED THE PROPERTY. AM I IN THE CLEAR IF I BUY THIS PROPERTY FOR THE ASKING PRICE? THE SALE IS FINAL, RIGHT? A: It depends on how low the price is on the land. In Louisiana, if you purchase the land for less than half its fair market value, the sale may be subject to a claim of lesion. A contract of sale may be annulled on the grounds of lesion.

If in fact lesion is claimed, the seller can demand return the land or an additional sum to supplement the purchase price. Though the seller may be able to “go back on the deal” you should keep in mind that it is up to you, as the buyer, whether to supplement the purchase price or return the land to the seller. Lesion must be determined by ascertaining the value of the land at the time of the sale. For example, let’s assume that the land in question was worth $40,000 at the time of the sale, and is worth $80,000 six months after the sale. Let’s also assume that you paid $35,000 for the land. Under this hypothetical situation, the seller would not be entitled to claim lesion, since the land was sold for over half its fair market value at the time of the sale. As far as finality of the sale, a claim of lesion is subject to a one year peremptive period. This means that the seller only has one year to bring an action under a theory of lesion. In other words, if the seller does not bring an action for lesion within one year of the sale, he will lose the right to do so. If you sell the property during the one year period, you could be liable to the original seller for the amount of profit you receive in the sale to a third party.

There certainly appears to be an error in fact in that you thought you purchased a house with 2600 square feet of living space, when actually there was only 2006 square feet. However, according to the facts you provided, the seller does not appear to have been involved in the listing error. To maintain an action against the seller, you will have to provide evidence that the seller knew or should have known that you were misinformed about the living area. This error seems to be unilateral as it was unknown to both you and the seller and the error was attributable to the real estate agent. There is also the issue of damages. You mention that an appraisal was done on the property, but your question does not provide information related to the sale price. The appraisal was based on the appropriate square footage and if you paid at or below the appraisal value then a court is likely to determine the price you paid was fair. Aside from having a little bit less square footage than you though, what are your damages? From the limited facts provided, it does not appear you have grounds to rescind the sale of the home. You may consider an action against the real estate agent; however, there is likely a “Limitation of Liability” on the Purchase Agreement to absolve agents, brokers, and sellers from liability for any such errors.
