Q: CAN THE PRESIDENTIAL ELECTION (AND OTHER ELECTIONS) REALLY BE RIGGED?
BIG DOLLAR INTERNET PURCHASES MAY NOT BE WISE
A: I am not sure what you mean by “rigged”, but Louisiana law has safeguards in place to protect the election process and the integrity of the election. In fact, the Secretary of State recently issued a Letter to Voters ensuring the integrity of the upcoming election.
Q: I RECENTLY PURCHASED A CAR OVER THE INTERNET FROM A USED-CAR DEALER IN NEW ORLEANS. THE CAR WAS ADVERTISED AS BEING IN “PERFECT CONDITION.” AFTER I PURCHASED THE CAR, AND TOOK DELIVERY OF IT HERE IN LAFAYETTE, I QUICKLY DISCOVERED THAT IT NEEDS ABOUT $3,000 TO $4,000 IN REPAIRS. WHAT IS MY RECOURSE? DOES THE LOUISIANA ATTORNEY GENERAL HELP OUT IN CASES LIKE THIS?
While voter fraud is not unheard of, especially in the history of Louisiana, the Louisiana legislature has laws in place to prevent interference with the elective process. First of all, the voting process is public, meaning that the elections in America are held in public places, such as school cafeterias, gymnasiums, and other community areas. The ballots and voting machines are in plain view of those assembled. The ballots, voting machines and other materials for the elections come into the polling place under lock and seal, remain in the same room throughout the day, and are not removed until the election is over. Once voting is completed, the machines are removed and are again under lock and seal to avoid tampering with the results.

Furthermore, the persons who run our polling places on Election Day and during early voting are not government bureaucrats but every day private citizens, just like you and me. They check voters in, confirm their IDs, and keep detailed records. These people take their job on Election Day very seriously. Once your vote is cast, these officials cannot tamper with the results. If your concern is voter intimidation during early voting or on Election Day, we have laws have been enacted to protect the voter from intimidation, harassment, confusion and undue influence when a citizen enters the voting area. It is illegal for any persons between the hours of 6:00 a.m. to 9:00 p.m. during early voting and on Election Day within 600 feet of a polling place to solicit a vote for or against a candidate, to handout, place or display campaign cards, pictures, or other campaign literature of any kind, to place political signs, pictures or other form of campaign advertising. Voters will not be harassed or coerced in any way once they arrive at a polling place. Stay tuned for next week’s article on voting machines and the protections in place to prevent tampering with the results. And please remember, that your vote counts! Early voting is currently underway and runs through Tuesday, November 1st. Election Day is November 8th.

A: To start, you should contact the dealer you bought the car from to see whether or not he will refund your money or repair the car at his expense. I would imagine you’ve already tried this, or you wouldn’t be writing me with your question. You do have a few options; however, none of them are all that great. One, you could hire a lawyer who specializes in consumer law to represent you. Sometimes having a lawyer make a demand on your behalf can produce results. Of course, if your lawyer’s informal demands fall on deaf ears, you may very well wind up having to file suit against the car dealer. And, the contract you signed to purchase the car might contain a binding arbitration clause. This means the dispute would be settled informally by an arbitrator. You don’t get a trial, and chances are, you won’t be able to appeal the arbitrator’s decision. Your second option is to file a complaint with the New Orleans Better Business Bureau or the Louisiana Attorney General’s Public Protection Division. You can check out the New Orleans Better Business Bureau’s website at www.neworleans.bbb.org for more information. They also have a section on Lemon Law, which may apply to your situation. You can find out more information about the services offered by the Attorney General’s office by calling their Consumer Information Line at 1-800-351-4889 or by visiting their website at www.ag.state.la.us. Just click on Public Protection then Auto Fraud. Generally, the Attorney General’s office only takes on these types of lawsuits when doing so would benefit and protect the public. Before deciding which dealers to pursue, staff members consider the severity of the case, the costs and the likelihood of collecting penalties and restitution, and the likelihood of the same thing happening again. As you have learned, buying a vehicle sight unseen over the Internet can be very risky and unsatisfying. Unfortunately, you didn’t get what you bargained for, and you now own a car that needs substantial repairs. To top that off, you are 130 plus miles away from New Orleans, and the dealer has your money. The next time you purchase a vehicle over the Internet, it may be best to have an independent company inspect the car before you buy.
