Your Home Inspection Checklist By David Anderson, President Acadian Home Builders Association After the excitement of having your offer on a house accepted, the reality of the home-buying process often sets in with the long list of items to complete before closing day. And at the top of your to-do list should be scheduling a home inspection.
what components and systems may need repair or replacement. The inspector will examine the home’s exterior, including steps, porches, decks, chimneys, roof, windows and doors.
Although not required by law, many lenders do require a home inspection, which helps protect the large investment you are about to make. You’ll want to learn as much as you can about the physical condition of the home before you buy it, to ensure it’s a sound investment. And while an inspection cannot guarantee the condition of a home, the inspector can alert you to items that need repair or any safety concerns.
Inspectors also look inside the home to examine the attic, electrical components, plumbing, central heating and air conditioning, basement/crawlspaces and garages. A home inspection will not include cosmetic issues that do not impact the working condition of the home.
Here are a few things to keep in mind about the home inspection process. 1) Schedule the Inspection Quickly It is the buyer’s responsibility to schedule and pay for the inspection. You should schedule the home inspection as soon as you can after your offer has been accepted. This ensures you’ll have enough time to request repairs or to get out of the contract if the inspector discovers a deal-breaker for you. When choosing an inspector, your realtorr may have a recommendation or youu can find one through the American an Society of Home Inspectors. 2) Inspection Describes thee Basic Physical Condition of a Home An inspector’s job is to examine the current condition of a house. This includes pointing out

Q: WHAT EXACTLY IS MY LENDER REQUIRED TO DISCLOSE REGARDING MY NEW HOME PURCHASE AND MORTGAGE?
A: The federal law you are referring to is Real Estate Settlement Procedures Act (RESPA), and it contains anti-kickback provisions which seek to eliminate abusive practices such as payment of kickback fees which drive up cost of the product to consumers. In accordance with RESPA, it is illegal for a person to give or receive a thing of value for the referral of settlement services in connection with federally related mortgage loans. To rise to the level of a RESPA violation all five elements must be present. The “thing of value” is broadly defined to be virtually anything one receives in consideration for making a referral, such as money, commissions, trips, discounts, low interest rates, iPad, free advertising, marketing, football tickets, etc. “Referral” is any conduct intended to influence the selection of a particular settlement service provider. “Agreement or understanding” does not need to be in writing or articulated, and may include a practice or course of action where the receipt of the thing of value is understood. “Settlement services” are anything done by Title Agents; Attorneys, Real Estate Agents; Mortgage Brokers; Banks, including but not limited to title searches, credit reports/ appraisals, origination of loans, title insurance, etc. “Federally related mortgage loan” is any loan secured by a first or subsequent lien on one to four family residential property.

A real estate agent who sends all of his/her closings to one title attorney in exchange for free advertisement on social meeting is clearly a violation of RESPA. The agent and the attorney offering the free advertising can face penalties such as fines (not more than $10,000), imprisonment (not more than 1 year), liability to the person charged for the settlement services involved in the violation in an amount equal to three times the amount of any charge paid for the settlement service, court costs and attorney fees. All providers of settlement services should ensure that they are aware of RESPA and have safeguards in place to prevent a violation.

This document gives you the details of your loan, including the key terms, and how much you are paying in fees and other costs to get your mortgage and buy your home. It should not contain any significant changes from your Loan Estimate other than those you may have agreed to. The Closing Disclosure is five pages, and will contain the following information: The first page has the most important facts about your loan, such as the terms (loan amount, interest rate, monthly principal & interest), projected payments, and costs at closing, including the cash required to close. You will need to have that money with you at the date of closing. The second page should include closing cost details, such as loan costs Lender’s Origination costs to make the loan, along with the application fees, and fees to underwrite your loan. Underwriting is the lender’s term for making sure that your credit and financial information is accurate. Discount points, which is additional money you pay up front to reduce your interest rate. Services you shopped for, such as your closing agent. Services your lender requires for your loan, such as the appraisal and credit report. Other costs such as property taxes, homeowner’s insurance premiums, any portion of our total mortgage payment you must make before your first full payment is due, and flood insurance (if required). Page 3, will have the calculation cash to close, and a summary f the transactions; Page 4 has the Loan Disclosures; and Page 5 has the loan calculations, other disclosures, contact information, and the Confirm Receipt signature requirement. You should review this document very carefully on receipt and be sure that it is correct, and that you understand everything in the document. Be sure that you understand what you are expected to pay over the life of your loan and at closing.
