Use Your Fireplace Safely This Winter By Mark Gallagher, President Acadian Home Builders Association Your home’s fireplace can provide a cozy gathering spot for your family during the cooler months, but it’s important to follow a few guidelines to ensure everyone remains safe. The National Association of Home Builders’ MyHome Press has published a handbook for home owners, “Home Maintenance Made Easy,” and the excerpt below contains helpful advice on how to safely build fires and maintain your fireplace. Wood Burning Fireplaces To maintain your fireplace, use a chimney cleaning professional at least once every five years (two years if you use it frequently). If you are in a newer home with a fresh air vent to supply the fireplace with combustion air, open it and the damper before you start a fire. Then remember to close both when you are not using the fireplace so warm air will not escape in the winter and cool air will not escape in the summer. Building and Extinguishing the Fire A wood-burning fireplace should be equipped with andirons (or a grate) and a well-fitting screen. It may have glass doors as well. Build fires on the andirons or grate— not directly on the fireplace floor. Seasoned hardwood is the best fuel. Do not burn pine logs in your fireplace; they contain a tar that can start a fire in the chimney if it accumulates. It’s also important to never use kerosenee,, gasoline, charcoal lighter fluid, or other highlyy flammable liquids to start a fire. w Begin with a small fire to allow the components of the fireplace to t heat up slowly. Burn kindling and newspaper under the grate; stackk two to three layers of logs with air space between them, placing thee largest logs to the rear. You can burn one sheet of paper atop the stack to help the chimney start to draw.

If the fire is still burning but you are finished enjoying it, close the glass doors, if you have them, to prevent heated air from being drawn up the chimney (until you can close the damper). But don’t close glass doors over a roaring fire, especially if you are burning hardwoods like oak or hickory; the heat could break the glass. When you close the doors over a burning fire, open the mesh screens first. This prevents excessive heat buildup on the mesh, which might warp or discolor it. Be sure the fire is out each night before you go to bed. Gas Fireplaces A gas fireplace provides the comfort and style of a wood-burning unit, but requires far less maintenance. Many gas fireplaces are also far more efficient than woodburning and as a result, produce less pollution. Gas fireplaces may have a chimney or may vent exhaust gases (mainly water vapor and carbon dioxide) directly outside without a chimney. Others are ventless; there is no flue. If your gas fireplace is vented, the flue or vent should be closed when the fireplace is not in use. Use the same safety precautions with a gas fireplace that you would with any other gas appliance.

GENERAL COUNSEL CASH PURCHASE HAS PROS & CONS Q: I RECENTLY INHERITED APPROXIMATELY $200,000.00 FROM A RELATIVE WHO PASSED AWAY, AND I WOULD LIKE TO USE THIS MONEY TO PURCHASE A HOME. WILL I SAVE MONEY BY PAYING CASH, INSTEAD OF BORROWING MONEY TO PAY FOR THE HOME? A: Paying cash for a home has benefits, such as eliminating the need to pay interest on the loan and many closing costs. Since many of the closing costs incurred with the purchase of a home are associated with obtaining a loan, such as lender fees, application fees and processing fees, you should be able to save a considerable amount of money by paying cash for your home.

Paying cash may also be more attractive the seller, so if you are looking at home that is highly sought after, cash may win the bidding war. The seller doesn’t have to worry about a buyer backing out due to financing being denied. You also have the flexibility of closing faster, which may also be an attractive bargaining point for the seller. Home financing has its benefits too. You should leave yourself with plenty of liquidity in the event that the home requires repairs or you want to renovate. It may be tough obtain a home equity mortgage down the road as you don’t know what your credit score may look like in the future, how much the home will then be worth or other factors that determine approval for a mortgage. Not having a mortgage can affect or negate a homestead exemption if you find yourself in debt in the future. Finally, paying cash has some tax implications that you want to consider. Mortgage interest rates are tax deductible in most cases. As always, I recommend that you find a competent real estate agent, with whom you are comfortable, to help guide you through the home buying process. Not only will this make the process easier, but it may save you from making a mistake which could be quite costly. Good luck!

BENEFITS OF HOME INSPECTION Q: I RECENTLY BOUGHT A HOUSE IN LAFAYETTE, AND A COUPLE OF WEEKS AFTER THE CLOSING, I DISCOVERED SOME WATER DAMAGE AND MOLD BEHIND ONE OF THE BATHROOM WALLS. THE PROPERTY DISCLOSURE FORM COMPLETED BY THE SELLER INDICATED THAT HE HAD NO KNOWLEDGE OF THESE PROBLEMS, AND I DID NOT HAVE AN INSPECTION DONE PRIOR TO PURCHASING THE HOME. CAN I GET THE SELLER TO PAY FOR REPAIRING THESE ISSUES? A: We get this question a lot, so pay attention readers! Based on the situation you describe, it seems highly unlikely that you will be able to obtain compensation from the seller for the problems with your home. Though there is no guarantee that an inspection would have revealed the water and mold problems in your home, it would have been wise to have an inspection done prior to purchasing the home. Had an inspector discovered the problems you describe, the cost of repairs could have been negotiated with the seller prior to purchase. Had the seller been unwilling to make reasonable allowances for the necessary repairs, or if the cost of repairs exceeded a certain amount, the purchase agreement would likely have allowed you to simply walk away from the deal. Since the standard property disclosure form used in Louisiana, which was presumably the same form completed by the seller of your home, does not require the seller to have specific knowledge of every aspect of the home he is selling, it is permissible for a seller to truthfully indicate that he has no knowledge of whether or not certain conditions or defects exist in the home. Though you could attempt to pursue the seller in court, you will likely have a difficult time proving that he knew or should have known that the water and mold issues existed, based on your description of these problems. If you fail to prove that the seller knew or should have known of the water and mold problems, such that he did nothing wrong in completing the disclosure, then he will not likely be found liable to you. On the other hand, if the problems were readily apparent, at least some responsibility for detecting these problems will be placed upon you. Also, since the home you purchased was presumably not a new construction, the sale document for the home likely contained a provision that the home was sold to you “AS IS”, meaning that you were purchasing the home in its present condition and with any defects it may have had. As indicated above, there is no guarantee that a prepurchase inspection would have revealed the water and mold problems in your home. However, having an inspection done would have given you a chance of detecting these problems.
