ACADIAN HOME BUILDERS ASSOCIATION

2016 Grand Prize Winner Announced have been long-time supporters of the project and stated that they just wanted to give back to the community, never expecting to win anything.

The name of the 2016 Home for the Holidays Grand Prize Winner was finally drawn on Wednesday, December 7th during a live broadcast on KATC-TV 3. This year’s lucky winner is Mark Mahaffey of Morse, LA.

Home for the Holidays is an annual project by the Acadian Home Builders Association (AHBA) and KATC-TV3 in which a high-end home is raffled off for charity. The 2016 Home for the Holidays was located in The Village at Broussard subdivision and valued at over $430,000. It was designed by Trahan Architecture & Planning and built by Mark Gallagher of Mar-Key Builders using donations of materials and labor from AHBA members.

The following day, Mr. Mahaffey, his wife Cathy, their children, grandchildren and other family members were given a personal tour of the Home for the Holidays. Mark and his family were absolutely amazed and so grateful to have won the home. They

This year’s event was big success with over 5,000 tickets sold. In early February, proceeds from the Home for the Holidays will be distributed to local nonprofit organizations including Faith House, Healing House for Grieving Children, Lafayette Habitat for Humanity, and St. Michael Center for Veterans, a shelter of Catholic Services of Acadiana. Home for the Holidays has been able to give over $1.7 Million to these adopted charities in the last eleven years.

AHBA and KATC would like to thank the people of Acadiana for their overwhelming support during this year’s raffle house project. How to Inspect Windows and Doors to Stop Air and Water Leaks By: Lisa Kaplan Gordon Take a close look at your windows, doors, and skylights to stop air leaks, foil water drips, and detect the gaps and rot that let the outside in. You can perform a quick check with a home air-pressure test, or a DIY energy audit. Luckily, these inspections are easy to do. Here’s how to give your house a checkup:

How to Pinpoint Window Problems

Air and water can seep into closed widows from gaps and rot in frames, deteriorating caulking, cracked glass, and closures that don’t fully close. To stop air leaks, give your windows a thorough inspection: •

Give a little shake. If they rattle, frames are not secure, so heat and air

conditioning can leak out and rain can seep in. Some caulk and a few nails into surrounding framing will fix this. •

Look deep. If you can see the outside from around -- not just through

-- the window, you’ve got gaps. Seal air leaks by caulking and weather stripping around frames. •

Inspect window panes for cracks.

Check locks. Make sure double-hung windows slide smoothly up and

down. If not, run a knife around the frame and sash to loosen any dried paint. Tighten cranks on casement windows and check that top locks fully grab latches. •

Some older windows can be repaired and save you money over new

windows. However, if you think you’ll automatically gain energy savings, think carefully -- there may be other, cheaper ways to cut utility bills, such as sealing air leaks.

WE ARE ON FRIENDLY TERMS WITH THEM AND WOULD LIKE TO BUY THE LOT, OR IF POSSIBLE, LEASE A LARGE PORTION OF THE LOT SO THAT WE CAN EXPAND OUR SIDE PATIO AND GARDEN. ANY SUGGESTIONS ABOUT HOW WE SHOULD GO ABOUT THIS, AND HOW TO DECIDE ON A FAIR PRICE? A: If both parties are in agreement, it’s relatively straightforward. The most important thing is for both you and your neighbors to think this plan through very carefully before committing to anything in writing.

If you decide to lease the lot instead of buy it, there are a few things you should consider. First, are there any restrictions on what you can do with the property? I know you said you wanted to expand your garden and patio, but that can mean different things to different people. For example, are there any limitations on what you can and cannot plant? Can you pour a cement slab for your patio, or do you have to use a more temporary surface like brick or stone pavers? Can you erect structures on the lot, such as a greenhouse or shed? You will also need to decide how long the lease is going to run, and whether or not a security deposit is going to be required. And, are you going to be required to return the property to its original condition (i.e. remove the garden and patio and replant grass) when the lease ends? As for rent, one way to calculate it would be to start with a percentage of the assessed value of the land. To make it legal, you should reduce your agreement to writing. You should include a legal description of the land and a reference to the portion of the lot you are leasing – if you are not leasing the entire tract. You should be able to get the legal description of the lot from the cash sale that your neighbors signed when they bought the property. The tax assessor may also be able to give you a legal description of the property if you have a street address and the full name of the current owner.

If you decide to purchase the property from your neighbor, there are some different things to take into consideration. First, if you are not going to buy the entire lot, you will need to check the city’s lot size restrictions to make sure that carving off a section of your neighbor’s lot doesn’t make it so small that it violates your area’s minimum lot-size rules. If you live in a planned subdivision, you will need to check with the homeowner’s association and review the subdivision restrictions to make sure there isn’t anything that would prohibit your purchase.

If there are no problems there, the next step would be to hire a surveyor to survey the neighbor’s yard and write up new legal descriptions of your enlarged yard and your neighbor’s smaller one. Then, you and your neighbor will need to draft a purchase agreement – including the two new two legal descriptions and have it recorded at the parish courthouse. An experienced real estate attorney can help you with this. And of course, you will need to agree on the sales price and map out how property taxes will be affected by the sale. MAKING PAYMENTS DOESN’T MAKE IT YOURS Q: MY AUNT BOUGHT A CAR A FEW YEARS AGO AND SHORTLY THEREAFTER, SUFFERED A STROKE. BECAUSE OF HER MEDICAL CONDITION, SHE WAS UNABLE TO WORK AND COULD NO LONGER AFFORD THE CAR. I BEGAN DRIVING THE CAR AND MAKING THE PAYMENTS ON THE CAR, BUT WE HAVEN’T FORMALLY CHANGED OWNERSHIP. WHAT WILL HAPPEN IF MY AUNT DIES WHILE I AM STILL PAYING ON THE CAR? A: You need to sit down with your aunt and talk with her about who owns the car. It sounds like you are in a situation where you’re making payments on a car that isn’t legally yours. A private understanding between you and your aunt may not mean anything if she dies and the car becomes part of her estate. What happens to the vehicle after her death also depends on whether or not your aunt has a will. When it comes to the car’s registration, you should be able to get the car re-registered with both of your names on the title. You will need to contact the Department of Motor Vehicles to see exactly what you have to do to get your name on the title. Also, keep this in mind. Even if you are the only licensed driver of the vehicle, the owner is still financially responsible for liability and damages if the car is in an accident. If your aunt owns the car, then she is required by Louisiana law to maintain liability insurance on the vehicle. If she still owes money on the vehicle, she is also probably required by the lien holder to maintain collision insurance on the vehicle. Also, it is not clear how much money you or your aunt have invested in the car, so, if you have invested a lot of money, you especially need to work out the ownership issue with her.
