Get Your Home Winter Ready By Mark Gallagher, President Acadian Home Builders Association No matter what the weatherman says, you never know for sure what winter in Louisiana will be like. Some years we only get a few weeks of cold temperatures, and others bring sleet and freezing rain. No matter what, you want your home to be prepared for whatever Mother Nature brings. Winterizing your home is one of the most important duties of homeownership. Neglecting to do so can not only lead to more costly utilities and potentially significant repair bills, it can make your home less comfortable for you and your family. Here are some tips from the Federal Emergency Management Agency (FEMA) to help extend the life of your home and keep your family cozy during the cold winter months. • Insulate walls and attics, caulk and weather-strip doors. If it’s time to replace your windows, install double-glazed, energy efficient ones. • Clear debris from gutters so that they don’t fill with water that could freeze, adding weight that could damage the fascia board and cause leaks. • Trim tree branches that could potentially fall on al your home during a storm. Hiring a professional is strongly advised, especially if anyy branches are near power lines. • Have your heating equipmenntt and chimney professionallyy cleaned and inspected everyy year. • Insulate pipes with foam wrap or newspaper to help prevent freezing. Be sure you and

any other adults in the home know how to shut off the main water valve in case your pipes do freeze and burst. During the winter, it’s not uncommon for some people to rely on additional or alternate heating sources. With some devices – especially those not intended to be used inside the home – there is an increased risk of fire, electric shock or carbon monoxide poisoning if the necessary safety precautions are not taken. General guidelines include: • Keep fire extinguishers throughout the home, and teach all family members how to use them. • Never use a generator, grill, camp stove or other gasoline, propane, natural gas or charcoal-burning device anywhere inside your home, including the garage. • Space heaters should only be placed on a level surface and away from heavy foot traffic when in use, especially if pets or small children are nearby. It’s best to have space heaters that automatically turn off when a room reaches the desired temperature or in the event it is tipped over. Holiday Fire Safety Tips By: Pat Curry The holiday season is one of the most dangerous times of the year for household fires, so take note of these tips to reduce your risk. Residential fires during the holiday season are more frequent, more costly, and more deadly than at any other time of the year. The U.S. Fire Administration (USFA) reports more than double the number of open-flame fires on Christmas Day than on an average day, and about twice as many on New Year’s Day. And when those fires occur, they do more damage: Property loss during a holiday fire is 34% greater than in an average fire, and the number of fatalities per thousand fires is nearly 70% higher. When the source of the fire is a highly flammable Christmas tree, the toll in property and lives is even greater.

To keep your household from becoming a holiday fire statistic, here are some safety tips to follow: Cooking Cooking is the top cause of holiday fires, according to the USFA. The most common culprit is food that’s left unattended. It’s easy to get distracted; take a pot holder with you when you leave the kitchen as a reminder that you have something on the stove. Make sure to keep a kitchen fire extinguisher that’s rated for all types of fires, and check that smoke detectors are working. If you’re planning to deep-fry your holiday turkey, do it outside, on a flat, level surface at least 10 feet from the house. end. “Stacking the plugs is much safer when you’re using a large quantity of lights,” explains Brian L. Vogt, director of education for holiday lighting firm Christmas Décor. Extension cords should be in good condition and UL-rated for indoor or outdoor use. Check outdoor receptacles to make sure the ground fault interrupters don’t trip. If they trip repeatedly, Vogt says, that’s a sign that they need to be replaced. When hanging lights outside, avoid using nails or staples, which can damage the wiring and increase the risk of a fire. Instead, use UL-rated clips or hangers. And

Green up your holiday season by recycling old lights instead of trashing them. When the glow goes from your holiday lights, don’t chuck them in the trash can; look for a program that recycles them — or better yet, a program that pays you to recycle them. Then, you can use your cash to buy new LED holiday lights, which can use 90% less energy than incandescent holiday lights.

Here a few of the light-recycling programs we found:

• Minnesota’s Recycle Your Holidays program takes old holiday lights at 400 sites (and it’s happy to help you set up a collection point in your neighborhood). Vocational center workers with developmental disabilities disassemble the lights and the parts get recycled. • When you recycle a string of old holiday lights at one of CrownACE Hardware’s 17 stores in California, you get a $5 gift certificate redeemable toward a minimum $20 purchase of new holiday lights. • StLouisGreen.com wants to collect 50,000 pounds of holiday lights to recycle and plans to donate a portion of the proceeds to Operation Food Search to feed the hungry. Drop off at Wal-Marts in St. Louis and Illinois. • Elgin Recycling partners with over three dozen Illinois cities including Wheaton, Evanston, and Lombard to collect holiday lights and extension cords. Elgin strips the materials and recycles the copper and plastic parts. • Lowe’s home stores offer a convenient receptacle to drop off your old holiday lights for recycling, though it’s not offering any rebates or coupons. • If you don’t have a local holiday light recycling program, you can ship your lights to HolidayLEDs.com, which will send you a coupon good for a 25% discount on the LED holiday light sets it sells.

BOUNDARY DISPUTES ARE SOMETIMES TRICKY SITUATIONS Q: MY WIFE AND I OWN A HOUSE WITH A FEW ACRES OUT IN DUSON. WHEN WE BOUGHT THE PROPERTY, WE DIDN’T BOTHER WITH PUTTING UP FENCES BECAUSE THERE WEREN’T A LOT OF NEIGHBORING HOMES. NOW THERE ARE, AND A FEW MONTHS AGO OUR NEIGHBORS BEGAN LETTING THEIR DOGS ROAM ALL OVER OUR PROPERTY. THIS LED TO US PUTTING UP A FENCE. THE FENCE COMPANY TOLD US WE SHOULD GET A SURVEY FIRST. WHEN WE GOT THE SURVEY, WE FOUND OUT THAT OUR PROPERTY LINE WAS TEN FEET CLOSER TO OUR NEIGHBOR’S HOUSE THAN WE HAD ORIGINALLY THOUGHT. OF COURSE, OUR NEIGHBOR IS SAYING THAT THE SURVEY IS INCORRECT. WE WOULD LIKE TO RESOLVE THIS ISSUE, BUT DON’T KNOW HOW. THE LEGAL DESCRIPTION CONTAINED IN OUR CASH SALE, THE MOST RECENT SURVEY WE HAD DONE, AND EVEN THE OLDER SURVEYS SEEM TO BE IN OUR FAVOR, BUT OUR NEIGHBOR REFUSES TO CONCEDE THAT THE PROPERTY LINE IS WHERE THE SURVEYOR SAYS IT IS. A: Based on your version of the events, it seems like you have followed the proper procedure in determining the boundaries of your property. You could go one step further and ask the surveyor to place stakes on the corners of your property to clearly outline the boundaries. And, since your neighbor’s cash sale is part of the public record, you should get a copy of it and give it to your surveyor. The surveyor can then make sure that the boundary described in the neighbor’s cash sale matches the boundary described in your cash sale. If the descriptions match, your neighbor’s argument against your claim to the boundary is most likely a losing one. What is most puzzling about this is how you came to believe that your property boundary was off by ten feet. If you live in a rural area and have a rather large lot that doesn’t have clearly defined borders, this might explain it. However, most people know where their property begins and ends.

However, if, you and your neighbor had an understanding as to the location of the boundary between your properties, and this understanding existed between the prior property owners, you might be in trouble. There is a concept in real estate law called adverse possession that gives land that has over time, been openly used by another the rights to that property. It is generally hard to prove adverse possession between neighbors. Since you indicated that there was no fence, it will be even harder for your neighbor to prove it. And, who has been paying the taxes on that 10 foot strip for the past several years?

All of these issues taken together will give you a better picture of where the property lines are and whether the neighbor has any claim to the ten feet. Good luck. BUILDER’S MISTAKE SHOULDN’T BECOME YOUR EXPENSE Q: I SIGNED A CONTRACT WITH A LOCAL BUILDER HERE IN LAFAYETTE. I ALSO SIGNED TWO CHANGES ORDERS, THE LAST OF WHICH WAS FOR UPGRADES, INCLUDING GRANITE COUNTERTOPS AND HIGH END APPLIANCES. WE THEN PROCEEDED TO BUILD. A LITTLE OVER THREE MONTHS LATER, THE BUILDER CONTACTED ME AND SAID HE HAD MADE AN ERROR IN PRICING THE COUNTERTOPS AND APPLIANCES AND NOW HE WANTS ME TO PAY AN ADDITIONAL $8,500. HE IS THREATENING TO TAKE ME TO COURT IF I DON’T PAY THE DIFFERENCE. WHAT SHOULD I DO? A: To start, you need to hire an experienced real estate attorney to represent you. Based upon the facts as stated in your question, it would seem that you would not be obligated to pay any additional money to the builder. Essentially, it appears that the builder is trying to get out of a contract he no longer finds appealing. If the builder takes you to court, he would likely allege that the error in the contract was a mutual mistake, and that the contract needs to be rewritten to reflect the true intent of the parties. To be successful, he would have to prove the two of you agreed on a price for the countertops and appliances and then somehow, a different figure was inserted into the written contract by mistake. Based on how you described things, it doesn’t’ sound like that is the way things happened. Instead, it sounds like you agreed on a price, signed an agreement setting forth that price and the upgrades to be made, and later, the builder realized he had made a mistake and should have charged you more. If that’s what really happened, then you would likely prevail in court. Unfortunately, you now find yourself in a predicament – the house is halfway complete, and the builder is demanding more money. Challenging the builder during the construction phase is a recipe for all sorts of additional problems. For example, he may get mad and do inferior work, or he may even take shortcuts, leaving you with far bigger problems on down the line. On the other hand, you don’t want to fold and pay the $8,500 either. After all, the two of you signed the change order based upon a stated price, and you shouldn’t be forced to pay an additional $8,500 just because your builder wants to charge more after the fact. You might want to visit the tax assessor’s office to look at the map of the tax parcels in your area. If the tax parcel matches your property’s legal description, you can claim that you have been paying taxes on the ten feet in question, further weakening your neighbor’s claim of adverse possession.
