Many buyers today want move-in-ready homes and will quickly eliminate an otherwise great home by focusing on a few visible flaws. Unless your home shines, you may endure showing after showing and open house after open house — and end up with a lower sales price. Before the first prospect walks through your door, consider some smart options for casting your home in its best light. 1. Have a Home Inspection Be proactive by arranging for a pre-sale home inspection. For $25 to $4 , an inspector will warn you about troubles that could make potential buyers balk. Make repairs before putting your home on the market. In some states, you may have to disclose what the inspection turns up. 2. Get Replacement Estimates If your home inspection uncovers necessary repairs you can’t fund, get estimates for the work. The figures will help buyers determine if they can afford the home and the repairs. Also, hunt down warranties, guarantees, and user manuals for your furnace, washer and dryer, dishwasher, and any other items you expect to remain with the house. 3. Make Minor Repairs Not every repair costs a bundle. Fix as many small problems — sticky doors, torn screens, cracked caulking, dripping faucets — as you can. These may seem trivial, but they’ll give buyers the impression your house isn’t well maintained. 4. Clear the Clutter Clear your kitchen counters of just about everything. Clean your closets by packing up little-used items like out-of-season clothes and old toys. Install closet organizers to maximize space. Put at least one-third of your furniture in storage, especially large pieces, such as entertainment centers and big televisions. Pack up family photos, knickknacks, and wall hangings to depersonalize your home. Store the items you’ve packed offsite or in boxes neatly arranged in your garage or basement. 5. Do a Thorough Cleaning A clean house makes a strong first impression that your home has been well cared for. If you can afford it, consider hiring a cleaning service. If not, wash windows and leave them open to air out your rooms. Clean carpeting and drapes to eliminate cooking odors, smoke, and pet smells. Wash light fixtures and baseboards, mop and wax floors, and give your stove and refrigerator a thorough once-over. Pay attention to details, too. Wash fingerprints from light switch plates, clean inside the cabinets, and polish doorknobs. Don’t forget to clean your garage, too.

GENERAL COUNSEL INVESTIGATE OPTIONS BEFORE BUYING PROPERTY THAT IS NOT ZONED FOR YOUR INTENDED USE Q: I AM INTERESTED IN BUYING A BUILDING IN LAFAYETTE, BUT I DON’T MY INTENDED USE IS PERMITTED UNDER THE LOCAL ZONING ORDINANCES. WHAT CAN I DO? A: You may be able to get the zoning changed or perhaps the Lafayette Planning and Zoning Commission could grant you a variance or exception so that you can use the building the way you would like to. In order to get a variance or have the zoning changed, you will have to file an application with the Lafayette Planning and Zoning Department.

Since you don’t want to buy the property if you won’t be able to use it the way you want to, there are a couple of ways you can proceed and still protect yourself. You could sign a purchase agreement, but include a clause in the purchase agreement that that makes your obligation to close on the property contingent upon your being able to change the zoning or getting a variance from Planning and Zoning Commission your intended use. Another possibility is for you to purchase a short term option to buy the property from the owner. Then, you can investigate the possibility of a getting a variance or getting the zoning changed. If you are able to accomplish what you want during the option period, you can exercise your option and buy the property.
IS A LEASE-PURCHASE OPTION RIGHT FOR YOU? Q: WHAT IS A LEASE OPTION? WHAT RISKS AND BENEFITS DOES THIS TYPE OF TRANSACTION ENTAIL FOR THE BUYER AND THE SELLER? A: A lease option basically means you are leasing or renting property with an option to buy it at a future date. The future price of the property should be fixed at the time the lease-option is signed. And, you must exercise the option to purchase within a certain period of time. In most instances, the buyer pays a fee for the option to purchase at some point in the future. This amount can vary depending on the type of property at issue, and the ultimate purchase price. In some cases, option money is applied towards the down payment if the buyer ultimately decides to exercise the option. In other cases, it is not. A lease option might be used when the seller is having a difficult time selling the property. Sometimes, a seller can actually get a higher price with a lease option than they could if they were selling it in a normal transaction. And, if a seller is having a hard time selling the property out right, at the very least, a lease option may cover their mortgage payments so they don’t have to come up with extra money each month to pay their monthly mortgage payments. And, if the buyer is later unable to exercise the option, they get to keep the option money. Most of the time, however, individuals who attempt to buy a home via a lease-purchase option rarely end up buying the house. This usually has to do with the reason they are trying to buy, via a lease-option, in the first place. Oftentimes, a buyer can’t qualify for a conventional home loan so they try a lease option thinking that they might be able to qualify sometime in the future. Frequently, even after a period of time has passed, they still can’t qualify - whether it’s because of poor credit, income to debt ratio, or lack of money to make a down payment. And, if they are unable to exercise the option to purchase, they lose the option money they put down.
