THE TRUTH IN LENDING ACT Q: MY HUSBAND AND I WOULD LIKE TO REFINANCE OUR HOME LOAN. WE HAVE TALKED WITH A FEW LENDERS, BUT WITH THE VARIOUS FEES AND CHARGES, IT IS HARD TO TELL EXACTLY WHAT WE ARE PAYING FOR. WHERE SHOULD WE LOOK FOR A BREAKDOWN OF ALL THE CHARGES? I JUST WANT TO BE SURE THERE AREN’T ANY HIDDEN CHARGES AND THAT WE ARE GETTING THE BEST DEAL.

A: The Truth-in-Lending Act requires most lenders to disclose to you (the borrower), the terms and costs of its loan plans. In general, the Truth-in-Lending Act applies to individual and businesses that offer or extend credit to consumers, assuming the credit is subject to a finance charge or is payable by a written agreement in more than four installments. The Truth-in-Lending Act applies if the credit is primarily for personal or household purposes and if the loan is for more than $25,000 or is secured by an interest in real property. You need to be able to compare the cost of borrowing to paying cash, and the costs of borrowing from different lenders. To ensure that consumers can do that, the federal government requires lenders to disclose certain costs and terms of their loans. The terms and costs that the lender must disclose include the annual percentage rate (APR), points and fees, the total of the principal amount being financed, and the terms of the loan, including the payment due date, whether there is a penalty for prepayment, and late payment fees. The Truth-in-Lending Act also requires lenders to disclose the total amount of finance charges, whether or not the loan is assumable, the loan application fee, and any annual or one-time service fees. If the loan is a variable-rate loan, the lender must disclose the features of the loan, including the highest rate the lender can charge over the life of the loan, how the interest rate is calculated, and your resulting monthly payment.

NOT ALL APPRAISALS ARE EQUAL Q: MY WIFE AND I ARE IN THE PROCESS OF GOING THROUGH A FAIRLY AMICABLE DIVORCE. TO GET AN IDEA OF WHAT OUR HOUSE IS WORTH, WE BOTH HAD APPRAISALS DONE ON THE HOME. ONE OF THE APPRAISERS SAID OUR HOUSE IS WORTH $300,000, WHILE THE OTHER SAID IT IS WORTH CLOSER TO $250,000. HOW CAN THEY BE SO DIFFERENT, AND HOW CAN WE TELL WHICH ONE IS CORRECT? A: It is not uncommon for two appraisers to give the same property a different valuation; however, $50,000 is a pretty substantial difference. Typically, the more experience an appraiser has, the more likely they are to give you a really accurate appraisal; however, that’s not always the case. There are a few things you and your wife can do to determine which appraiser’s number is more accurate. First, both of the appraisers no doubt based their valuation of your home on an inspection of the property and on what comparable houses have sold for recently. The appraisal should include a list of the comparables the appraiser uses, so you can drive by those “comps” to see if you agree that they’re comparable. And, if the appraiser who provided the lower number picked houses you think are not as nice as yours, you might have grounds to be suspect about his number. Second, you can send each appraiser the other’s appraisal report with a request that he explain how he arrived at his figure. There may be things that one appraiser did, or took into consideration, that the other didn’t. Finally, consider hiring a third appraiser to review the first two reports and weigh in with a value. 5 Tips to Prepare Your Home for Sale

5. Do a Thorough Cleaning
Working to get your home ship-shape for showings will increase its value and shorten your sales time. Many buyers today want move-in-ready homes and will quickly eliminate an otherwise great home by focusing on a few visible flaws. Unless your home shines, you may endure showing after showing and open house after open house — and end up with a lower sales price. Before the first prospect walks through your door, consider some smart options for casting your home in its best light.
A clean house makes a strong first impression that your home has been well cared for. If you can afford it, consider hiring a cleaning service. If not, wash windows and leave them open to air out your rooms. Clean carpeting and drapes to eliminate cooking odors, smoke, and pet smells. Wash light fixtures and baseboards, mop and wax floors, and give your stove and refrigerator a thorough once-over.
1. Have a Home Inspection
Pay attention to details, too. Wash fingerprints from light switch plates, clean inside the cabinets, and polish doorknobs. Don’t forget to clean your garage, too.
Be proactive by arranging for a pre-sale home inspection. For $25 to $4 , an inspector will warn you about troubles that could make potential buyers balk. Make repairs before putting your home on the market. In some states, you may have to disclose what the inspection turns up.
2. Get Replacement Estimates
If your home inspection uncovers necessary repairs you can’t fund, get estimates for the work. The figures will help buyers determine if they can afford the home and the repairs. Also hunt down warranties, guarantees, and user manuals for your furnace, washer and dryer, dishwasher, and any other items you expect to remain with the house.
3. Make Minor Repairs
Not every repair costs a bundle. Fix as many small problems — sticky doors, torn screens, cracked caulking, dripping faucets — as you can. These may seem trivial, but they’ll give buyers the impression your house isn’t well maintained.
4. Clear the Clutter
Clear your kitchen counters of just about everything. Clean your closets by packing up little-used items like out-of-season clothes and old toys. Install closet organizers to maximize space. Put at least one-third of your furniture in storage, especially large pieces, such as entertainment centers and big televisions. Pack up family photos, knickknacks, and wall hangings to depersonalize your home. Store the items you’ve packed offsite or in boxes neatly arranged in your garage or basement.
