Terms to Know Before You Close By Mac Gibson, President Acadian Home Builders Association Closing (or settlement) is the process which passes ownership of a property from seller to buyer. Closing on a new home can be very confusing. Home buyers are usually required to sign an endless pile of documents, most of which are written in terms not used outside of the housing industry, which can be complicated to understand. Before you go to settlement, there are certain important items you should know so that you can get the best possible terms for yourself in the deal. Ask a lender for a copy of the HUD pamphlet, “Buying Your Home: Settlement Costs and Helpful Information.” Most lenders are required to provide their loan applicants with a copy of this document under the Real Estate Settlement Procedures Act (RESPA), but you will be able to shop more wisely for closing services if you have read the pamphlet before you apply. It provides a good description of the closing process and explains most of the expenses you will encounter. When you apply for a loan, the lender is required by law to provide you with a good faith estimate of settlement costs. Shortly before closing, you will be told exactly how much you owe so that you can get a bank check. A personal check is generally not acceptable. In some instances, you may have money returned to you instead of having to pay. Before you go to settlement, familiarize yourself with the following important settlement terms. Appraisal Fee – An appraisal is an estimate of the fair market value of your home. Appraisals help both the lender and the buyer to determine if the sales price is consistent with the actual value. An appraiser inspects the house and the neighborhood and makes an estimate based on the price of comparable houses and other factors. The appraisal provides no guarantee that the property is free of defects. Lenders insist on an appraisal to see how much they could recover by selling your house if you default. The fee for this service may vary depending on the specific characteristics of your house. Attorney’s Fees – If the lender requires an attorney to draw up any of the settlement documents, you may be charged a fee – a flat amount or a percentage of the loan. If you hire a lawyer to assist with the settlement, you will have to pay an additional fee at or immediately following settlement. Earnest Money – Earnest money is a deposit paid to a seller to show you are serious about buying a house. Your receipt for this payment is called a binder. If you buy the home, the earnest money is applied to your downpayment. If not, the earnest money is returned, minus expenses for processing. Be sure that you understand the refund procedures before you make a deposit. Escrow Fees and Accounts – Escrow involves having a third party hold funds and/or documents until you and the seller complete settlement. Depending on the circumstances of your loan, you may be asked to make monthly payments to an escrow account after you purchase your home. Money in the account may be used to pay taxes, insurance, and any other regular assessments as they fall due. Such accounts serve a similar purpose to withholding income tax from your paycheck; by putting aside money each month, you avoid large annual or semiannual payments. You may be charged a fee for the service. In some states, escrow accounts draw interest. Loan Origination Fee – A lender will charge a fee for the cost of processing the loan, usually calculated as percentage of the loan amount.
$500. Points are tax deductible if they are paid separately and not deducted from the loan amount. For VA loans, you can be charged a maximum of one point, but the number of points can be higher for FHA and conventional loans. On a 30-year loan, each point that you pay reduces your interest rate by roughly 1/8 of a percent. You may be faced with a choice between two mortgages in which one has lower monthly payments but involves paying more points up front. Annual percentage rate calculation includes buyers’ points, so ask for the APR to help you make your assessment. Keep in mind that an APR is calculated on the basis of the total life of the loan. For a 30-year loan, the APR is a 30-year composite figure. If you sell your new home after a few years, the average annual cost of your points will be much higher than is reflected in the APR. If you plan to move soon, you might be better off with a loan that has a slightly higher rate but fewer points. Recording Fee – Because title is changing hands, the transaction must be recorded with your city, parish, or other appropriate branch of government. The fee covers administrative costs. State and Local Transfer Taxes – Some jurisdictions levy taxes on the transfer of property or on real estate loans. Settlement Costs Between Buyer and Seller – Your builder may have already paid the annual property taxes on your new home. When title changes hands, you must reimburse the builder for a proportional share of the taxes and any other prepaid costs. Title Search and Insurance – A title search involves having someone look through public records to see if anyone else has a claim to your property. A lender does not want to lend you money only to learn in the event of foreclosure that somebody other than you has a prior claim to the property. You will normally be required to purchase lenders’ title insurance to guard against a faulty title search as well as hazards that even the most thorough search will not reveal – such as a forged deed that does not transfer title, a claim by a previously undisclosed relative of a former owner, or a mistake in the records. For a one-time premium at closing, title insurance will clear up title problems, pay the lender’s legal

5. Task Lighting Once, the only way to shed light on kitchen tasks was by hard-wiring under-cabinet lights — an expensive and messy task. But you can add lighting under and inside cabinets with battery powered, peel-and-stick LED lights. Of course, battery-run lights are not as bright as their hardwired cousins. But at about $8 each, you can afford to buy several and scatter them around. LED light bulbs last for thousands of hours of use.
1. Handsome Hardware Knobs and pulls are kitchen jewelry that can dress cabinets up. Note that cabinet hardware can get very fancy and expensive — costing $30 and up for a single ornate knob. But you’ll get a huge bang for a few bucks by buying 10-packs of simple, contemporary hardware at big box stores for less than $20 (that’s $2 a knob!). To save time and money, replace 1-hole hardware with 1-hole upgrades; 2-hole with 2-hole. That way, you won’t need to drill or patch. 2. Pretty in Paint Nothing updates old cabinets as quickly as fresh coat of paint. Painting cabinets yourself is cost-effective — a few gallons of paint, sandpaper, cleaner — but the process is time-intensive. You can paint most cabinet surfaces, but proper prep is key to success. For laminate and melamine finishes, be sure to rough up the surface with 150-grit sandpaper, and apply a good bonding primer before topping it off with the color of your choice. If you’re going to dive into this DIY project, keep these tips in mind: Lighter-colored paints will make your kitchen seem bigger. 3. Molding Miracles Crown molding adds a touch of class to the tops of tired cabinets for less than you’d expect. Three-inch, primed composite crown molding with a dentil design costs as little as $20 for 8 feet. It’s easiest to add molding when you’re repainting cabinets; that way you’ll get a perfect match. If you order matching wood molding from your cabinet’s manufacturer, be prepared for a color difference between new molding and older cabinets. Natural wood cabinets (especially cherry) will darken with age. 4. Fancy Glass Change the glass insert in a cabinet door, and you change the look and feel of your kitchen. Not all cabinet doors are candidates for a changeover, however. You’ll need the kind of door with a removable panel. Check the backs of your doors to see if the center panel can be taken out. Types of glass inserts are limitless — contemporary, bubbles, raindrops on water, antique — and cost $7 to $9 per square foot. So, you can change the look of a 2-door, 30-inch-by-24-inch cabinet (about 5 square feet of glass) for between $35 and $45.

Q: I HAVE RECENTLY ACCEPTED A TEACHING JOB IN TEXAS, BUT ITS ONLY FOR TWO YEARS. I PLAN TO KEEP MY HOUSE IN LAFAYETTE AND RENT IT OUT. WHAT CAN I DO TO OFFSET THE DIFFERENCE BETWEEN MY RENT IN HOUSTON AND THE INCOME I GET FROM MY HOUSE HERE IN LAFAYETTE? DO I HAVE TO PAY TAXES ON THE RENTAL INCOME SINCE I HAVE TO RENT IN TEXAS WHERE I AM BEING TRANSFERRED?
Q: MY COUSIN LIVES IS TRYING TO BUY A HOUSE IN YOUNGSVILLE. APPARENTLY, HIS CREDIT IS NOT GREAT AND THE LENDER HAS TOLD HIM HE NEEDS TO HAVE A CO-SIGNER. HE HAS ASKED ME IF I WOULD BE WILLING TO DO THIS. I AM REALLY HESITANT TO AGREE, WHAT ARE THE PROS AND CONS OF THIS?
A: You do have to pay taxes on your rental income, even though you will be renting a second residence in Houston; however, you will be able to write off the mortgage interest, property taxes, and any homeowner’s association dues on your Lafayette home. You can also depreciate your property in Lafayette and deduct the cost of maintenance and repairs as well as any costs you incur in renting it. And, that’s not all. If you rent your house in Lafayette at a loss, and that is a possibility, there may also be a tax benefit. Please note, however, that this is complicated so you should ask your accountant before filing your taxes. Since you plan to be in Houston for a few years, you will be there too long to write off your living expenses as temporary. Nevertheless, if you employer does not pay your moving expenses, you can deduct them on your taxes.

It would be wise to create a separate checking account to keep track of your Lafayette residence’s income and expenses. Keeping good records of any expenses will also help you at tax time.
A: The biggest potential con to you is huge. If your cousin fails to pay his mortgage, the bank will look to you to make the monthly mortgage payments, even though you are not living in the house. A lender is not required to look only to the resident of the property for repayment. Anyone who is considering co-signing on a loan for someone, regardless of whether it’s a child or sibling, should realize that he or she becomes personally obligated to pay back the entire amount of the loan if he or she signs the promissory note. Another potential con is that the mortgage will show up on your credit report as an obligation and may limit your ability to get a loan on something you want to buy. Depending on the size of the mortgage your cousin is contemplating taking on, this could mean your lender decides you have maxed out your potential credit. And, of course, another con is the potential risk to your relationship if the deal goes south. Of course, you can try to insure against this by having your cousin sign an agreement with you, stipulating that you name will also be on the deed to the property. And you can make sure this occurs at closing as well. If your name isn’t on the title, and your cousin defaults, you really have no way to go to court and sell the house. Also, any agreement between you and your cousin should stipulate who is responsible for paying the property taxes and for maintaining the property. Presumably, since your cousin will be living in the property, these things will be his responsibility. You might also want the agreement with your cousin to address what happens if either of you gets married or if one of you dies. Finally, if your cousin doesn’t agree to this document or isn’t very forthcoming about his financial situation, I would not agree to the deal. I would walk away. Don’t forget - this is a business transaction, even if he is family. Don’t let your emotions cloud the deal.
