Serving as a well-informed introduction to the resort’s property portfolio, this publication is also designed to showcase the other charms that Quinta do Lago, enjoying its 40th anniversary this year, has to offer including its spectacular setting and lifestyle benefits. Thanks to the resort’s continuing quality Quinta do Lago has coped admirably well during the trying times presented by the current economic.There have been only marginal changes to property prices and plot prices have remained steady. Our portfolio has expanded to include properties ranging in price from €250k to €10mn, while San Lorenzo North, with its exceptional location and investment potential, proves an obvious attraction. Joost’s expertise within the highend real estate market and holiday industry is matched only by his passion for the Algarve. Travel and foreign destinations came very naturally to Maria Chapman, working in the UK for several years for a tour operator before heading overseas. Few can boast such a loyal relationship with a destination as Madalena Bota, who has worked in Quinta do Lago in one form or another since 1985. Her intimate knowledge of the resort and her obvious admiration for it has been used to the full since she joined the property management and rentals team. Madalena is a natural born communicator and can think of nothing better than meeting people and fulfilling their every property need.
Former golf pro and golf academy operator, Jamie Robinson was naturally attracted to the Algarve, Europe’s top golf destination. Having arrived in the region 18 years ago, Jamie has built a career, a family and a life here. Following his golfer’s instinct, Quinta do Lago was never far off the radar, with Jamie homing in on its real estate excellence six years ago. His experience and perspective of the local real estate market ensure a balanced view of investment possibilities.

The smaller zone of Atlântico Sul, between the Quinta do Lago Hotel and the beautiful lagoon of the Ria Formosa Nature Park, features seafront properties with spectacular views, ideally placed to take full advantage of the Atlantic’s presence. Water plays as much a role as golf in the areas below roundabout 5. Reflected in the name of the resort, where ‘Lago’ translates to “Lake”, the main lake area, with stunning views over the water to the lagoon beyond and eventually to the sea, is one of Quinta do Lago’s most exclusive locations. Close to the Ria Formosa and the beach, and served by the water sports centre and the Casa do Lago restaurant, properties here are high on the list of resort favourites. Zones located around the lake include Lago, Beira Lago, and at the lake’s southern end, Palmeiras.

Inside or on the edge of the front nine and back nine of San Lorenzo Golf Course, one of Europe’s finest golf challenges, the remaining resort zones have a choice of attractions, both sporting and natural. As the course works its way down to the lagoon, taking in some of Europe’s finest golf holes, the prime golf front properties of Atlântico follow it, enjoying some of the resort’s best sea views. To the north, Atlântico Norte properties hug the manicured fairways of San Lorenzo, while to the south, watching over the final six holes of the course, São Lourenço occupies the secluded South Eastern tip of the resort. And finally, just above, and right in the middle of the San Lorenzo layout, the 21st and most recently released of zones, San Lorenzo North, with its large, excellently located plots, some of which are still available for purchase.

A number of resort zones radiate out of the popular central area surrounding roundabouts 3 and 4, generally positioned around the fairways of both Quinta do Lago North and South. The facilities located in this part of the resort, including the golf clubs, tennis club, driving range, post office, bank, Koko Lane Café and much more, combined with the central location, make property hunting in this area particularly alluring. Quinta do Lago’s geography develops from North to South along the central axis of the ‘Avenida André Jordan’ and its numbered roundabouts. Between roundabout 1 and 2, near the entrance to the resort, the Zona Noroeste occupies the North Eastern sector of the resort, just south of Quinta Shopping. Featuring mature plots, this is a quiet, secluded corner of the resort, with convenient access to the nearby shopping centre. The majority of plots back on to the fairways of Quinta do Lago North golf course. Pinheiros Um enjoys the same benefits, this time on the other side of the 9th and 10th holes. Completing this quiet part of the resort, the properties of Golfe Norte, which flank the 5th hole of Quinta do Lago South course. Roundabout 2 is also home to the new complex housing Quinta do Lago Real Estate, the Active Q Gym, a deli bar, a hairdressers & beauticians and an interior design outlet. Cross the Avenida André Jordan, following the golf course layout we find the same feeling of calm and seclusion in the zones of Cávado and Gondra.

From the positioning of the various building phases and amenity clusters, right down to the location of each individual property, and from the early 70s until to the present day, the resort’s planning has been as meticulous as it is successful. BUYER’S GUIDE CONSTRUCTION CONTRACTS – BETTER TO BE SAFE THAN SORRY There are many issues that can – and often do – arise regarding the interpretation and implementation of a contract between the builder and the owner of the property being built. In general terms, most common problems derive from delays and defects in the construction and failure to comply with what was agreed between the parties. MAIN POINTS OF THE CONTRACT: A construction contract should define very clearly the timeframe of the project for each stage and for final completion and handover. Equally important are the conditions of payment: how much is to be paid and when – and whether the prices quoted include VAT or not. The budget figures should always be taken into account. CHANGES TO THE CONTRACT: Another relevant aspect is the treatment given in the contract to changes to the project as originally commissioned or any new works requested by the owner. In order to avoid any conflicts in the future, these changes or new requests should always be confirmed in writing, with specific confirmation that the changes in the works (or the new works requested) will imply a change in the final price and an indication of new prices. These additional clauses should be signed by both parties. DEFECTS IN CONSTRUCTION: There are specific periods in which to complain about defects in construction, as well as asking for compensation. In case of defective construction, the owner has the right to request that the defects be corrected, if possible. If they cannot be corrected, the owner can request a reduction in the price paid, the termination of the contract or even, in certain circumstances, a new construction. These rights do not exclude the possibility of asking for compensation. IN CASE OF DISPUTE: We advise these contracts to include an arbitration clause, in order to give the parties an option of going to arbitration in case of conflict. This is a better alternative to the judicial courts, in several perspectives, mainly because of the confidentiality and speed of the proceedings (the maximum timeframe for a final decision - the award - is of one year). A significant advantage is that arbitrators normally have specific knowledge of the issues presented to them, which the judge of a judicial court generally does not have. An arbitration court can have one single arbitrator or a team of three, although the former option is more cost-effective. The arbitration clause should stipulate if the arbitration is ad-hoc or institutional, the number of arbitrators, the place of arbitration, language to be used, applicable law and the possibility of an appeal (please note that if nothing is said, the rule is for the non possibility of an appeal). These are the main minimum points to be included in any arbitration clause. Depending on the type of contract and construction and potential disputes that may arise, it is possible – and, indeed, advisable – to include various other clauses as well. PORTUGUESE TAX REGIME FOR NON-HABITUAL RESIDENTS INTRODUCTION The regime for non-habitual residents was implemented by Decree-Law no. 249/2009, September 23rd, having been in force since tax year 2009.1 RESIDENCE IN PORTUGUESE TERRITORY i)General rules Taxation in Portugal (mainland and Islands of Madeira and Azores) of income obtained by individuals is treated at the level of Personal Income tax (further referred as IRS) and is based on the criterion of residence, as defined by the IRS code. While non residents are only subject to taxation regarding income obtained in Portuguese territory, residents are taxed on their total income, including income earned or paid outside Portugal. Except for situations where one of the 64 Treaties for the elimination of double taxation (further referred as DTT) signed by Portugal is applied, individuals who, in each tax year, meet one of the following requirements, will be considered residents in Portuguese territory,: • If they have remained in Portuguese territory for more than 183 days, consecutive or not; • Having remained in the country for less time, on the 31 December of the tax year concerning the income, own or rent property that may lead to assume the intention of using it as their permanent residence. • Work as boat or aircraft crew Work, provided they work for entities who, on 31 December of the relevant tax year, have residence, headquarters or effective direction in Portuguese territory; or • Perform functions or commissions abroad with public nature, at the service of the Portuguese Government. Family members are also considered residents in Portuguese territory, provided that, in that household, whatever person is responsible for them also resides there. The status of resident may be, however, rejected in such a case by the spouse that has not remained for more than 183 days, consecutive or not, in Portuguese territory, by providing evidence that there is no connection between the majority of the spouses’ economic activities and the national territory. ii) Non-habitual residents Under this regime, individuals may register as non-habitual residents when the following cumulative conditions are fulfilled: • If they become tax residents in Portugal; • If, at the moment of their registration with the national tax authorities, they demonstrate their former tax residence and effective taxation abroad, upon presentation of a residence certificate; • If they have not been taxed in Portugal as tax residents in the previous five years. TAXATION OF NON-HABITUAL RESIDENTS’ INCOME An individual who is classified as a non-habitual resident in Portugal acquires the right to be taxed as such for a period of 10 consecutive years2, renewable, provided that, in each year of application of the regime, he/she is
considered a tax resident in Portugal. The non-habitual resident’s tax regime includes two separate sets of rules: (i) one which is applicable to foreign source income, exempted and (ii) one which is applicable to income obtained from employment or selfemployment, from a Portuguese source, taxed at a special (reduced) rate of 20%. i)Exempt income Income from employment and pensions3 obtained abroad will be exempt from IRS provided they are taxed in the country of origin, in accordance with any double taxation treaty (DTT) signed between Portugal and the relevant country, or, in the absence of a DTT, if such income cannot be regarded as having been obtained in Portugal and, or, in the absence of a treaty or convention, such income is taxed in the State of origin and may not be considered as having been obtained in Portuguese territory. Finally, income from self employment (which arise from activities of high added value, with scientific, artistic or technical nature4), royalties, capital income5 (5), property income and capital gains are exempt from IRS , provided that, in general, they can be taxed in the country of origin, in accordance with any DTT between Portugal and the relevant country, or, if there is no DTT, provided that: (i) the income should not be considered as having been obtained in Portugal and (ii) the income hasn’t been obtained in one of the jurisdictions with more favorable tax regimes contained in the list approved by 6 the Tax Department. ii) Income taxed at a reduced rate Income from employment and self-employment, obtained in Portuguese territory or abroad (the latter only when they do not qualify for the exemption referred to above) shall be subject to a special tax rate of 20% instead of the regular IRS tax rates, which are progressive up to a maximum of 46.5%, provided that, in both cases, such income is obtained from activities of high added value, with scientific, artistic or technical nature. iii) Options conferred by this Regime Non-habitual residents whose income is exempt may, in most cases, opt to credit to the IRS the tax paid abroad. However, whenever this option is followed, such income will be taxed at the regular IRS tax rates or any other applicable special rates, depending on the nature of the income. Non-habitual residents whose income is taxed at a special rate of 20% may still opt for the general taxation regime of IRS. However, those who chose this option and that, simultaneously, receive income which is exempt under this regime, should take into account that this option implies that the latter must be taxed at the regular IRS tax rates, which means that, in practice, this regime may not be used partially but “as a whole”. PRACTICALITIES Registration requests from taxpayers, for the application of the non-habitual residents’ regime, are made upon submission of an application to the competent Tax Office, addressed to the Direction of Services of Taxpayers Registration (DSRC), whereby it must be demonstrated that all legal requirements demanded by the tax authority 7 for the granting of such regime are fulfilled. The declaration of income obtained by taxpayers, who
are covered by this regime, is done annually, upon the filling and submission of the “IRS Model 3” declaration and its annexes, with the specificity of the mandatory filling in of Annex L, which is specific to the non-habitual residents’ regime. Annex L should be submitted individually by each 8 earner who is registered as a non-habitual resident. 1 The tax year coincides with the civil year or calendar year. 2 However, if the individual does not benefit of this regime for the total period of 10 years, the non-habitual resident can benefit of the missing years to complete that period, provided he is considered a tax resident in Portugal. 3 Provided that, when they are a result of contributions, they have not been deducted for personal income tax purposes (IRS) on previous employment income. 4 The list of activities is contained in “Portaria” no. 12/2010”, of 7 January, and includes, amongst others, architects, engineers, artists, accountants and tax consultants, doctors and dentists, as well as certain liberal and technical professionals. LEGAL INFORMATION - BUYING AND SELLING PROPERTY Once you have found a property you wish to purchase, it is very important to have all the information about the necessary steps in the buying process. We hereby send you some information regarding the main issues, in order to negotiate a convenient deal. It is very important to clarify since the first moment what is included in the price agreed, as well as exchange and completion dates and, if you are being assisted by an agent, to ask the agent for a written document (reservation deal or letter of intent). Please note, however, that all documentation should be reviewed by lawyers, and therefore we recommend that you have an English speaking lawyer representing you. NON-RESIDENTS If you are a non-resident, you will need to apply for a Portuguese tax number (número de contribuinte) from the local Tax Office (Finanças). Since 1 January 2012 it is no longer mandatory to appoint a tax representative (as it was before), as long as you are from one of the European Union countries or from the EEA (European Economic Area). It is also advisable to open a bank account as it is required to pay any costs related to the property. Once again, your lawyer will be of great help to guide you through all bureaucratic procedures.
RESERVATION DEAL OR LETTER OF INTENT It is normal to sign a reservation deal, in order to confirm you are a serious buyer, allowing the vendor to take the property off the market. Normally, you will be asked for a deposit cheque (commonly 10%of the price), which should not be presented for payment until all parties are ready to sign the Promissory Contract (usually up to 30 days after reservation). DOCUMENTATION Giving your lawyer a Power of Attorney to sign the documents on your behalf will make the whole process much easier but, for your knowledge, you must obtain the following documents from the vendor: • Certidão do Registo Predial (certificate issued by the Real Estate Registry; confirms the description and ownership of the property and advises whether there are any outstanding mortgages or other loans or encumbrances on the property). • Caderneta Predial (issued by the Tax Office; confirms the description and taxable value of the property). • Licença de Utilização (issued by the Town Council; confirms that the property is duly licensed for habitation or other purposes). • Plantas (plans of the property, as approved by the Town Council). • Ficha Técnica da Habitação (applies to all properties licensed for habitation purposes from March 30, 2004; provides comprehensive information about the property – builders’ details, materials used and equipment, suppliers, condominium rules, building guarantee, etc). • Identification of the vendor and his Portuguese tax number. ENERGY PERFORMANCE CERTIFICATE As of July 2008, all new houses are required to have an EPC before building can start, and a Certificate of Conformity is required before Habitation License is issued, after completion. As of January 2009, the need for an EPC will also apply to existing houses, if they are to be sold, bought or rented out. PROMISSORY CONTRACT Once all documents are available, the parties will normally enter into a promissory contract – a legally binding contract between vendors and buyers, under which the parties undertake to complete the transfer within a given deadline – signed in the presence of a Notary or other entity allowed to certify the signatures and the existence of the relevant documents. The promissory contract should be prepared or reviewed by a lawyer to ensure that all agreed items are clearly specified, thus reducing the risk of future problems. Basically, it normally includes the following: • Identification of the parties and their representatives (if applicable); • Identification of the property (registration number, description, details of construction license, etc); • Price agreed for the sale and terms of payment, including a down payment; • Deadline for execution of the final deed of transfer and any conditions parties must comply with; • Usage conditions of the property by the parties before the final deed is signed; • Collaterals – compensation due for any delays in the completion of the sale and remedies in case of default on the contract. Normally, parties agree in making a down payment, on account of the purchase price, upon execution of the promissory contract (frequently, it corresponds to the deposit made when signing the reservation deal). Such a down payment functions as collateral given by the purchaser and, also, as compensation standard in case of breach. Except otherwise provided, should the buyer default on the
Contract, the down payment will remain with the seller, but if the seller defaults, he is required to refund the buyer twice the amount of the down payment. FINAL DEED The final deed formalizes the completion of the purchase and sale. The balance of the price is normally paid at this stage. It can be executed by public deed before a Notary or, as of January 1 2009, by private deed, authenticated before any entity allowed to do so (notably, a lawyer). REGISTRATION Registering the purchase of a property in the Real Estate Registry is mandatory. The registry application should be filed by the entity before which the final deed has been executed. COSTS Costs related to the purchase (legal fees, notary, registration) are normally borne by the buyer. TAXATION Like in any country in Europe, in Portugal there are also several taxes related to property: possession, income, transmission, etc. To fill a correct tax return in Portugal can actually save you money. Always ask your lawyer to advise you in detail about every tax and duties you should comply with, as well as on the applicable rates, allowing you to take informed decisions. PROPERTY TRANSFER TAX Formerly known as Sisa, IMT (Imposto Municipal Sobre as Transmissões Onerosas de Imóveis) is payable by the purchaser and is levied, notably, when property is bought and sold. STAMP DUTY The transfer of property is also subject to Stamp Duty (Imposto do Selo), payable by the purchaser. AS OWNER After completing the purchase, you should contact the various utility companies. Your agent should be able to assist you all along this process. PROPERTY TAX IMI (Imposto Municipal Sobre Imóveis) is payable annually and is assessed based on the property taxable value. It is also important to verify if the previous annual payments were made, because the new owner may be considered responsible for this tax debt. PERSONAL INCOME TAX If you have income related to your property, you must report any earnings on an annual tax return, for IRS (Imposto Sobre o Rendimento das Pessoas Singulares) purposes. Non-residents can normally obtain double taxation relief through a foreign tax credit in their home jurisdiction. AS SELLER - CAPITAL GAINS TAX Capital Gains taxation is levied on the gain derived from the sale of a property. There are a few exemptions though: take advice as to whether you qualify for any of those, as well as to what costs are eligible for deduction. Be aware that only costs duly supported by proper invoices are deductible for tax purposes (informal receipts are not valid). OTHER COSTS - ANNUAL MAINTENANCE Condominium rates are normally due and cover the
maintenance and conservation of common areas, gardens, swimming pools, security, etc. This varies from property to property, depending on the level of service provided. In addition, you will need to pay for insurance and utilities (gas, electricity and water supply). It is usual to pay for these services by direct debit. LAWYER FEES Lawyer fees vary according to each situation. Always ask for a quotation. AGENT FEES Real estate agents are normally paid by the vendor. Always agree on the agent’s fees beforehand. Estate agency fees, properly supported by document, can be deducted as costs for capital gains taxation purposes. PROJECT MANAGEMENT To have a good project manager in place can avoid many worries and difficulties for you. He can appoint the architect, work with the design team, ensure the desired quality of materials, select the builder and mediate between you and the builder, ensure the control of quality, coordinate all suppliers and so on. A project manager may charge you a percentage of the total project cost for his services or a monthly fee for the duration of his services. VILLA MANAGEMENT All villas require ongoing care and attention, anywhere. We recommend you to select a management company to help you, keeping your property in good condition, especially while you are absent. In a clear sign of continuing investor confidence in Quinta do Lago real estate, sales have remained buoyant throughout the last 12 months, as proved by the selection of proper ties that have been sold within the resor t.
