‘We have fully recovered from the recession’ economist tells county leaders With Calhoun County jobless rates back to 2002 levels, the county’s current unemployment of 6.2 percent is a big improvement from the peak 12 percent recession level, according to senior economist George Erickcek of the W.E. Upjohn Institute for Employment Research. “You’re seeing that the county lost about 3,800 jobs during the recession but has gained about 4,300 jobs so we fully have recovered from recession,” he announced Jan. 15 at the annual Economic Update for Calhoun County. “Very few metropolitan areas can say that in the manufacturing sector they have basically recovered from the great recession.” See story on page 34
‘It’s been a remarkable experience’: Starr Commonwealth’s Martin Mitchell looks back on 45 years Starr Commonwealth President and CEO Martin Mitchell gave something of a surprise 64th birthday announcement on Jan. 5, that he would retire on his 65th birthday. Mitchell says he is proud of Starr and the organization’s accomplishments. “The next generation, there is so much potential, so many ways we can reach out to children,” he said. “Reaching more kids, but earlier. That part is very exciting, but there is that recognition at some point that I won’t be directly involved in the process. But, everyone knows that I’ll be a lifelong supporter of Starr and be involved in ways that I can to be as helpful as I can.” See story on page 14
U.S. Congressman John Conyers shares importance of holiday of MLK holiday To celebrate the legacy of Martin Luther King Jr., local officials, clergy and residents gathered last weekend at several “Advancing the Dream” events including the annual Martin Luther King Jr. Prayer Breakfast on Jan. 17. The keynote speaker for the event was U.S. Rep. John Conyers Jr., who was instrumental in establishing the Martin Luther King Jr. Holiday Act of 1983. “The MLK holiday is not just a day off, but a day of reflection,” Conyers said. “I keep thinking about where we would be without Martin Luther King Jr. coming forward with what he said and did and lead...The reason I think he was the greatest person of the 20th century is because he was not just an intellectual, he was a leader as well.” See story on page 32
Marshall native appears on TV drama Chicago Fire Marshall native Christa South Hamranova, a 2000 Marshall High School graduate, was recently featured on the NBC prime time drama Chicago Fire, which follows the lives of the firefighters and paramedics working at Chicago Fire House 51. “Being on the show was a great experience,” Hamranova said. “...It was a little surreal, and I really feel lucky for the opportunity.” See story on page 24

Columns With free speech comes responsibility, too Editor’s Corner by John Hendler In case you missed it (and if you didn’t miss it, you may have wished you had), Secretary of State John Kerry brought along legendary singer James Taylor to Paris to sing You’ve Got A Friend to show the French that we stand united with them in the battle against Islamic extremists, even though the White House didn’t send a high ranking official to the Paris solidarity march which featured many world leaders following the murders at Charlie Hebdo earlier this month. There Kerry awkwardly stood, waiting for a minute or two before Taylor began to sing, the first few seconds not heard because of microphone problems. At first glance, one would think they were watching a Saturday Night Live skit. I’m sure the soothing voice of Taylor reassured our allies and had the terrorists quaking in their boots. When you’re down and troubled and you need a helping hand and nothing, whoa, nothing is going right, Close your eyes and think of me and soon I will be there, to brighten up even your darkest nights Were Dionne Warwick and friends not available to sing That’s What Friends Are For? Wouldn’t it have been better to bring Journey along to sing Don’t Stop Believin or better yet, Tom Petty to sing Won’t Back Down? Well I won’t back down, no I won’t back down You could stand me up at the gates of hell, but I won’t back down Now, that would have shown our allies and enemies that we really mean business. The entire cringe-worthy scene involving Taylor in Paris reminded me of my elementary school music teacher, who in 1972, when African-American children were bussed to our school, made us sing the Three Dog Night song Black and White as the kids came off the bus. At least in that case over 40 years ago, we were kids just trying to make other kids feel welcome and our way of life was not being threatened by fanatics who are more than willing to die for the cause, no matter how long it takes. Yes, time have changed, but not all change necessarily means things are more dangerous today than when I was a kid 40-plus years ago. Last week, parents in a Maryland suburb of Washington, D.C. have been accused of neglect for letting their 10-year old and 6-year-old kids walk around their neighborhood without adult supervision. Apparently Child Protective Services were notified by some neighbors who saw the children walking from local playgrounds, two blocks and one mile from the children’s home. I used to walk home alone from school when I was 6 and 7 years old. My school was just under a mile from my street, where my mother would wait for me at the corner every afternoon. I think it’s a parent’s job to assess when their kid is ready to cross the street on their own or walk to and from school and a playground on their own. On the other hand, there are derelict parents that don’t seem to care what their kids do, so I can understand the need for CPS or other authorities to step in when the situation warrants. If only life weren’t so complicated. Until next week, may the good news be yours.

Martin Luther King Jr. King literally gave his life to fight against segregation and racism, but he should also be remembered for the fight he waged in defense of free speech and the guarantees that come with it in the U.S. Constitution’s First Amendment. King was assassinated in Memphis April 4, 1968. The day before he delivered an eloquent speech on our country’s freedoms, which has become known as, “I’ve Been to the Mountain Top.” “If I lived in China or even Russia or any totalitarian country, maybe I would understand some of these illegal injunctions,” King so powerfully remarked in that speech. “Maybe I could understand the denial of certain basic First Amendment privileges, because they haven’t committed themselves to
that. But somewhere I read of the freedom of assembly. Somewhere I read of the freedom of speech. Somewhere I read of the freedom of press. Somewhere I read that the greatness of America is the right to protest for right.” King gave his life for the things he believed in, just as the staff at the satirical Paris magazine Charlie Hebdo gave their lives earlier this month for the right to publish inflammatory cartoons of the Prophet Mohammed and other political and religious figures. As I watched the news films of all the marches conducted Monday in King’s honor, I wondered what Dr. King’s perspective on the Paris tragedy would be in light of his remarks on freedom of speech and his equally strong commitment to social responsibility. King was rock-solid in his belief that protest should always be nonviolent, and that prompted my recollection of how Pope Francis weighed in on the Paris attacks.
Though the pope defended free speech not only as a fundamental right, but also as a duty for the sake of the common good, he also took note that there are limits to free speech when it provokes others by insulting them, their family or their religion. “With freedom of speech comes responsibility,” said the pope, “and that caution and concern should be used before you drop a verbal bomb on someone.” In no way would that ever justify the brutal and cowardly murder of the 12 journalists in Paris. When Pope Francis made his remarks, he said violence in the name of God or any religion can never be justified. He called on Muslim leaders, in particular, to speak out against Islamic extremism and then went on to ask about limits when freedom of expression meets freedom of religion. Both Pope Francis and Dr. King would agree that both freedoms should be ensured and never imposed through violence. Amidst all of the
heated rhetoric is another important angle to consider, though: These radical Muslims are not fighting for the exercise or over-exercise of free speech. Instead, they are waging war on our way of life, beliefs and commitments to a life of peace. Their hit-and-run tactics send a message that their beliefs are the only truth. We need to rise up as a world of nations united in our efforts to stop this band of terrorists once and for all. Since the Sept. 11, 2001, attacks against America, we’ve seen the “Shoe Bomber,” the “Underwear Bomber,” and the bombing at the Boston Marathon. We’ve seen others and will continue to see others as radical Islamic extremists continue to attack innocent victims with their scourge. They’ve moved from the big hits like the attacks on the World Trade Center to small incidents that take less time to plan but still get national exposure and heighten anxiety.

Law that helps people...Chapter 9 bankruptcy, part II By GEORGE M. STRANDER Ingram County Court Administrator and Probate Register
Sixth in a series. Municipal bankruptcies under Chapter 9 of the Bankruptcy Code are unique in that they are designed for “municipalities” – i.e., states as well as state and local governmental units organized under state law – and not corporations or individuals. As you probably remember from your civics class, there is a special relationship between the federal government (including, for example, the U.S. Bankruptcy Court) and the states. It is this special relationship, which defines the uniqueness of Chapter 9 bankruptcies. The 10th Amendment: The Bill of Rights – the first 10 amendments of the U.S. Constitution – are typically described as a set of provisions aimed at securing certain rights of individuals vis-à-vis the federal government. Interestingly, the last of these amendments – the 10th – actually reasserts state sovereignty as well: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are re-
served to the States respectively, or to the people. This amendment recognizes that it was a group of sovereign colonies/states, each already with rights and powers, that came together to form our country and that by doing so each retained those rights and powers if not explicitly divested. Hence, the exertion of federal power of states always must pass the 10th Amendment test. The Great Depression and the Ear ly Chapter 9: Municipal bankruptcies were initially codified in Chapter 9 of the Bankruptcy Code in 1934 as a response to the dire fiscal circumstances in which many municipalities found themselves. Those municipalities suffering the greatest difficulties tended to be those that experienced “boom times” in the 1920s; many of these were located in California, Florida, and Texas. The U.S. Supreme Court struck down Congress’s first attempt at codifying municipal bankruptcy in Ashton v. Cameron County Water Improvement District (1936). Concerns about the imposition of federal power in violation of state sovereignty and the 10th Amendment were paramount in the court’s reasoning. A year after Ashton Congress tried again and the newly crafted municipal bankruptcy statute survived Constitutional review a year
later in U.S. v. Bekins (1938). Some have questioned how significant the statutory changes were between the 1934 legislation and the 1937 legislation and whether the difference fully accounts the Bekins court’s approval of the latter. Regardless of that debate, however, it is clear that Chapter 9 bankruptcy gives ample powers to the municipality – in keeping with its reserved powers – in defining the course of its bankruptcy. Municipal power s under bankruptcy: As we saw last time, only a municipality can file for Chapter 9 bankruptcy, meaning that bankruptcy cannot be involuntarily imposed on a state or local governmental unit. And as the bankruptcy case progresses the court has significantly less involvement in the proceedings than in cases of corporate bankruptcy. As the Federal Courts recognize (see www.uscourts.gov), the bankrupt municipality “has broad powers to use its property, raise taxes, and make expenditures as it sees fit.” Additionally, the municipal debtor can adjust contractual relationships and has great latitude in rejecting collective bargaining agreements and retiree benefit plans. We recently saw evidence of the municipality’s powers under Chapter 9 in the case of Detroit.

Marshall House residents are still buzzing about their night in “A 1940’s Christmas” and how thrilled they are with the way Marshall House and the Marshall community treated them this Holiday Season. Our residents enjoyed the music of Jeffery Sylvester during their dinner, before taking to the dance floor, accompanied by The Pendill Connection jazz band and the ballroom dance couple Reka Holley and Brentton Fuller, who were on hand to show us some of their finer moves and teach our members a thing or two. This event would not have been possible without the incredible efforts of the local businesses who donated and all
of the volunteers that helped to make the night special for our residents. Linda has an unbreakable spirit We’ll make sure her arm stays just as strong It’s not the bone cancer that scared Linda, but the fact that it made her arm so weak she couldn’t hold her 8 year old grandson anymore. “I couldn’t mow the lawn, I couldn’t give massage therapy — that’s my passion! Boys varsity hits bump in the road After 6-0 start, Redhawks drop two straight, faced 7-1 Harper Creek Friday By JOHN HENDLER Editor Following its first loss of the season on Jan. 16 at Northwest by 26 points, the Marshall High School boys varsity basketball team dropped its second straight contest on Jan. 20 at home to Charlotte by a score of 7864 as the team fell to 6-2. “Charlotte is a quality opponent; they are a well coached, athletic team that can knock down shots,” said Marshall coach Nick Dent. The Redhawks led early but a Charlotte run at the end of the first quarter put the Orioles ahead 18-13. Marshall came back to take the lead on a couple oc-
casions in the second quarter, the last being 31-30 with 3:45 to play in the half, but that was the last time Marshall would have the lead. They trailed 43-35 at the half and 64-46 after the third quarter. Tyler Torrey led Marshall with 16 points. Next up for Marshall was the contest at 7-1 Harper Creek Friday night (Jan. 23). “Our defense has to improve if we are going to remain competitive against quality opponents,” said Dent. “When looking forward to Harper and the remainder of the season, improvement on the defensive side has to be the primary focus.”

Marshall swimmers place third at Loy Norrix Invitational By JOHN HENDLER Editor In a competitive field that saw four teams separated by just 41 points, the Marshall High School boys swimming and diving team placed third at the Loy Norrix Invitational on Jan. 17. Marshall’s score of 344 was just seven points behind runnerup Loy Norrix and 19 points behind winner Portage Northern. Sturgis was fourth with 322 points. Marshall’s two finals winners were Josh Turner in the 500-yard freestyle (5:02.85) and Levi Graves in the 100yard backstroke (58.17). Graves also had a second
place finish in the 100-yard freestyle (51.14), while Turner had a second place finish in the 200-yard individual medley, finishing out of the top spot by .67 seconds with a time of 2:07.87. Eron Hill had a second place finish in the 50-yard freestyle with a time of 23.92 seconds and finished third in the 100-yard butterfly with a time of 1:01.06. All of the Marshall relay teams had top three finishes. In the diving competition, Marshall diver O’Shea Swinton was second, scoring 270.15 points while Eli Arnold was third with 232.8 points. Ben Elyea posted two
consolation final first place finishes in the 200-yard individual medley and 100-yard butterfly. Also posting consolation final victories were Cam Foster in the 100-yard freestyle, Weston Quigley in the 500-yard freestyle and Jordan Gillett in the 200yard freestyle. Marshall hosted Sturgis on Jan. 22 and swims at the Haslett Invitational today, Jan. 24. Following a meet at Plainwell on Jan. 27, Marshall will be home for the last time this season on Feb. 10 versus Allegan.
