In The News: Monarch Bank slated to become Chemical Bank April 1; Two locations to close, but employees to stay Chemical Bank, which announced in November that it would be buying Monarch Bank, is now shooting for an April 1 acquisition closing date, pending Monarch Bank shareholder approval at a March 26 meeting. “In addition to expanding our banking and products services, we are excited to bring Monarch Bank into the Chemical Bank family,” said First Vice President and Director of Marketing for Chemical Bank John Hatfield of the Midland office. “We will be communicating with our customers about any and all changes.” Chemical Bank is planning the conversion of customer accounts in May. Superintendent earns highest rating from MPS Board At its work session on March 9, the Marshall Public Schools’ Board of Education conducted its annual evaluation of Superintendent Randy Davis and unanimously voted to evaluate Davis at the Highly Effective (top rating) in each of the areas evaluated. “I am pleased that the Marshall Board of Education and the Marshall administrative team value my leadership in this way,” said Davis. “The work we are doing together on behalf of our students, families and communities is leading the way on a number of initiatives in our region and across the state. Chasing that missing hour So, have you all adjusted to daylight saving time after surrendering (begrudgingly) that precious hour we must wait more than seven months to get back? Mother Nature delivered the warmer weather right on time, just as we turned our clock ahead to “summer time,” at least that’s what they call it in Europe. It was a veritable heat wave last week as temps were finally above normal, climbing into the 50s for the first time in what seemed like two years (actually, it felt like forever) under brilliant sunshine. Fear not, because for those who love to hang on to winter, the forecast calls for some more of the white stuff (and I don’t mean sunscreen) by the end of next week. Last week’s warm weather was perfect timing as spring sports practices got underway and some of the kids were able to hold their first practices outdoors for a change, minus the gloves, hats and longjohns. Not to be left out, I’m sure the mosquitoes and other insects are ready to make their return as well. Stand by. A more serious problem with springing forward, however, is the increase in traffic accidents the first week and the increased likelihood of serious injury while on the job. In a November 2009 HR Magazine article by Rita Zeidner, she references that Christopher Barnes and David Wagner, doctoral students in organizational behavior at Michigan State University, analyzed injuries reported to the Mine Safety and Health Administration between 1983 and 2006. On the Monday following the switch to daylight saving time, employees, on average, had 40 minutes less sleep, had 5.7 percent more workplace injuries and missed 67.6 percent more workdays because of injuries than on other days, they found. That finding proves to us what we’ve known all along: we should just sleep in on Monday for that extra hour or three. That way, we’ll come in refreshed on Tuesday, more productive and safer because we chose to sleep in. To paraphrase an old hotel chain’s commercial, never underestimate the importance of a good night’s or good day’s sleep. Until next week, may the good news be yours.

Ninth in a series. To conclude the series reviewing bankruptcy is a discussion of two relatively little-known reorganization options – those under Chapter 12 and Chapter 13 of the Bankruptcy Code. Chapter 12 cases are specifically designed for family farmers and family fishermen who are in debt and need the protection bankruptcy laws provide, while Chapter 13 matters are known as “individual debt adjustment” bankruptcies. In this series, I have already discussed the three major bankruptcy options under the Code. Chapter 7 bankruptcies are those which result in the total dissolution of an insolvent corporation – in this vein, think of now-defunct companies like Midway Airlines, Bennigan’s, Steak and Ale, Circuit City and Hollywood Video. Chapter 9 bankruptcies are reorganizations for debt-ridden municipalities – Detroit’s bankruptcy is the most recent, and
largest in value, of these actions. And Chapter 11 bankruptcies are reorganizations typically employed by corporations in trouble, like GM and Chrysler in recent years’ past. Family farmer s and fisher men: Chapter 12 bankruptcies were designed by Congress to make the bankruptcy process for family farmers and fishermen with a regular annual income easier and less expensive than Chapter 11 proceedings. A bankruptcy under this chapter requires the debtor to propose (and have accepted) a repayment plan to make installment payments to creditors over a three- to fiveyear span. Under the code, “family farmers” and “family fishermen” can apply to either (a) individuals (or husband and wife) or (b) corporations or partnerships. For individuals or married couples to qualify for Chapter 12 protection, (1) the individual or couple must be engaged in family farming or commercial fishing, (2) debts must be less than about $4 million for farming and $2 million for fishing, (3) fixed debts must substantially come from farming (at least 50 percent) or fishing (at least 80 percent), and (4) more than half of the individual’s or couple’s gross income must come from farming or fish-
ing. For corporations or partnerships, the conditions on inclusion in Chapter 12 are similar, except that more than half of corporation or partnership stock or equity must be owned by one family or its relatives, and no corporation stock can be publicly traded. Individual debt adjustment: A Chapter 13 bankruptcy, called both an “individual debt adjustment” and a “wage earner’s plan,” is similar to one under Chapter 12 in that a three- to five-year installment repayment plan is the centerpiece. The main distinction between the two types of reorganization, aside from Chapter 12’s focusing on farmers and fishermen, is that Chapter 13 actions are meant for debtors with smaller debts. An individual is eligible for Chapter 13 protection if his or her unsecured debts are less than about $380,000 and secured debts are less than $1.2 million. A secured debt is one that is attached to collateral that the creditor, as a last resort, can liquidate so as to be paid. Mortgages and auto loans are examples of secured debts – if you fail to pay your mortgage or auto loan, the bank can sell your house or car and get paid from the proceeds. Unsecured debts, then, are debts that have no attached collateral.
Letters Mary Lands annual vigil postponed until later date To the Editor: March 12 marked 11 years since Mary Denise Lands went missing, and it has indeed been a sad period in which Cliff and Anita Marshall have suffered in a way that no one else can understand unless you have lost a son or daughter in such a horrific tragedy. The Marshall family have lost their beloved daughter, a victim of domestic violence and all they have left are photographs, personal items and memories of their wonderful times together. If Mary were alive today, she would be 49 years old. Last year, Craig Kempf graciously permitted us to hold Mary’s 10th year tribute at his facility in Marshall, which was a God-send, espe-
cially with the unexpected snowstorm that occurred earlier in the morning. Despite the adverse weather, we still had a good turnout of local officials including members of law enforcement and representatives of SAFE Place Shelter. Unfortunately because of a personal situation the Marshalls could not attend, although they were with us in spirit. This year, especially because of the problematic late winter weather, we have decided not to hold Mary’s tribute on March 12, although Mr. Kempf did agree to again permit us the use of his comforting home in Marshall. To make it easier on everyone, Cliff and Anita would like to wait until the warmth
of spring and return to the Brooks Memorial Fountain in Marshall to hold Mary’s 11th Anniversary Memorial Tribute. That date will be announced in the near future. The Marshalls and I are more committed than ever to bringing their daughter home to a proper resting place. Time will not alter our commitment. Since I volunteered to help the family in 2004 there have been hundreds of thousands of features read about Mary‘s disappearance, with millions of Internet viewing related to her life. We maintain, as we have done so for over 10 years, that there are one or two individuals who have the information that can help us bring Mary home. We also have no doubt that
Marshall Public Safety Director Jim Schwartz and the law enforcement community are totally dedicated to solving this case, and it will be solved. We vehemently believe that 2015 will be the year that this will occur, and the person/s responsible for the disappearance and murder of Mary Denise Lands will be held accountable in a court of law. Press releases Two new Family Division referees appointed Calhoun County Chief Circuit Judge Conrad J. Sindt announced March 9 the appointment of two new Family Division Referees. Former Calhoun County Assistant Prosecuting Attorney Marc Crotteau will begin his duties with the court on March 16, replacing former Referee Tina Yost-Johnson who resigned earlier this year to accept a position with the Calhoun County Prosecuting Attorney’s Office. Referee Crotteau holds a BA degree from Michigan State University and is a graduate of the Northwestern
School of Law of Lewis and Clark College. Prior to his service as an Assistant Calhoun County Prosecuting Attorney, Crotteau was employed as an Assistant State’s Attorney with the State’s Attorney’s for Baltimore City, Md., and as an Assistant Attorney General for the Michigan Department of Attorney General. David A. Makled, a private practice attorney from Hastings, will begin his duties with the court on March 27 and will replace Referee Steve Keller who is retiring on May 1. Referee Makled holds a
BGS degree from the University of Michigan and is a graduate of the University of Michigan Law School. Prior to conducting a private practice, Makled served as an Assistant Barry County Prosecuting Attorney. According to Chief Judge Sindt, both of the new referees were determined to be the top applicants from a field of applicants who responded to the court’s open application process. “The court is pleased that Marc and David will be joining our staff. Based on a review of their qualifications
and interviews with me, the family division judges and court administration staff,” Sindt said. “We are confident they will meet the high standards of the court and handle their assigned caseloads professionally and timely.” Family Division referees conduct hearings in juvenile delinquency, child protective and domestic relations matters involving child custody, parenting time and child support. The hearings result in either determinations or recommendations to a Family Division Judge concerning the matter presented.

After district title, MHS falls at regional By JOHN HENDLER Editor The Marshall High School girls basketball team’s 21 game winning streak and season came to end on March 10 after a 3735 loss to undefeated Plainwell in a Class B regional semi final played in Hopkins. Marshall ended the season with a 22-2 record. Marshall, which had won the district title over Harper Creek, 36-26 on March 6, showed signs of nerves early with its errant shooting and turnovers. As a result, the team trailed 18-8 at halftime. “I thought we played timidly in the first half,” said coach Sal Konkle. “I'm not sure if it was nerves or Plainwell's size, but we did not play well in the first half.” The second half was a different story as Marshall clawed its way back, pulling to within one point, 26-25, following Jill Konkle’s 3pointer with just over six minutes to play. But Marshall would get no closer as Plainwell was able put open up a three to five- point lead in the final moments. Trailing by five in the closing seconds, Marshall’s Logan Kiessling hit a 3pointer just before the buzzer, but it was too little, too late. “We turned things around in the second half, but obviously, it wasn't enough,” said Konkle. “Despite the loss, it was a great season. I am very proud of the girls. We will miss our four seniors. Chelsea (Tobias) and Logan have been a huge part of our program for four years. They are both threeyear varsity players. As I told the girls, every ending is a new beginning and we have a bright future ahead of us. I am already looking forward to next season.”

Marshall loses heartbreaker to Harper Creek, 75-74 By JOHN HENDLER Editor With a five point lead and just 13 seconds to play, it seemed that the Marshall High School boys basketball team had pulled off the upset over rival Harper Creek in the first round of a Class B district tournament. Following a pair of Marshall free throws by Drew DeVine to make it 74-69, Harper Creek's Kylen Watkins' lay up with nine seconds left cut the deficit to three points. On the ensuing Marshall inbounds play, the Beavers were able to come up with the ball and TraVon Johnson was fouled, sending him to the line to shoot two free throws with five seconds left. Johnson made the first to make it 74-72, but missed the second. A scramble ensued underneath the basket where the Beavers' Jack Thompson got the ball to Watkins, who sank the fateful threepointer for what appeared to be the win, 75-74. Following the shot, the Harper Creek players ran onto the court to hug Watkins and then celebrated with the student section. Among the chaos, officials pointed out that .4 seconds were still on the clock, giving the Redhawks one last chance. Montez Brewer's half court shot at the buzzer hit the back of the rim and fell off to the side, and just like that, Marshall’s season was over. “It was an amazing performance by our guys,” said Marshall coach Nick Dent. “I am so proud of the way they prepared for this game and the way they executed the game plan. For 31 minutes and 50 seconds they did everything the right way and put themselves in a position to knock off one of the best teams in Class B on their home floor. Harper Creek,, as good teams do, found a way to win and I credit them for that. We are still a very young team and we sure learned a lot Monday night.” Tyler Torrey led Marshall with 22 points as the Redhawks ended the season with a 9-12 record.

7th Annual Don Weberling Classic is March 27
Throughout the Michigan Indoor Track Series over the winter, Marshall High School senior Bryce Blanchard was able to qualify for the state meet in five events. Along with his teammates from Concord High School, Blanchard qualified in the sprint medley relay, distance medley relay, and the 4 x 400 meter relay. He also qualified in two individual events, the 200 meters and the 400 meters. The state indoor track meet was held at Eastern Michigan University on Feb. 28 where Blanchard competed in three of the five events he qualified for. Along with his relay teammates from Concord, they took home a 6th place medal in the 1,600 meter sprint medley relay with a time of 3:49.05 and they finished 14th overall in the 4 x 400 meter relay with a time of 3:41.47 Blanchard also took home a 7th place medal in the 400 meters with a time of 51.99
The 7th Annual Fred Weberling Classic Tournament will take place on Friday, March 27 at 6:30 p.m. The five-person team entry fee is $100 and entries close March 26, or when the tournament is full. Teams may be five men, five women or mixed. “We love hosting this event for the Weberling family,” said organizer Sue Hutchings. “Fred was such a great friend to the bowling community and each year this event is a reunion of his family, customers and fellow bowlers.” The format includes three games all bowled on the same pair of lanes. Bowlers need not be certified or have a league average to participate. All prize money will be paid out at the conclusion of
