RPAC—A Tried and True Return on Investment As a REALTOR®, whether you’re engaged to assist in the buying and selling of commercial properties—as I am— or whether you spend your days helping people buy and sell residential real estate, the words “return on investment” are ones you hear quite often.
And that makes sense. Because although the last three years have taught
both consumers and investors that real estate is not a “get rich quick” scheme, the goal of investing is, indeed, to gain equity—a return—over time. One tried and true investment that pays excellent returns year in and year out is RPAC—the REALTORS® Political Action Committee. Because legislative and regulatory measures enacted by local, state, and national governments can and do have dramatic implications for REALTORS®, RPAC operates at each of those levels. RAR, VAR, and NAR each operate a REALTORS® PAC; and our contributions to RPAC are shared among these three organizations. When you make your voluntary “Fair Share” contribution, your funds support local members of council, members of Boards of Supervisors, Delegates and state Senators, members of the U.S House of Representatives and U.S. Senators. At each of these levels, your fellow REALTORS® sit as RPAC Trustees; they interview candidates and make funding decisions based on which candidates will best support the REALTOR® agenda. And the support of elected officials for the REALTOR® agenda is imperative for us and our clients. On behalf of our clients, we have fought hard to keep housing affordable by fighting against increases in cash proffers and recordation taxes. At the federal level, we fought for and secured home buyer tax credits, without which many families could not have realized the dream of home ownership. Currently, our lobbyists at the federal level are continuing their efforts to protect the Mortgage Interest Deduction. In addition to helping our clients, a number of the legislative changes we have pursued in recent years are designed to facilitate our daily business practices. For example, in this year’s General Assembly session, the REALTOR® lobby won passage of a number of measures including: one, legislation that protects us from liability, if we rely upon data provided by a public or governmental source; two, a bill that allows brokers and agents to store documents electronically; and three, a measure that prohibits POAs (Property Owners Associations) from charging fees related to inspections as well as the creation and delivery of disclosure packages, if these fees are not expressly allowed by the Code of Virginia. These are just a few of the many, many examples of how RPAC constantly and consistently works to protect and preserve your ability to earn a living. I cannot think of a more important, more valuable return on investment than that.

Ed Andrews Appointed as RAR Representative with Commission of Architectural Review Ed Andrews, Associate Broker at Long & Foster’s Strawberry St. office, has been appointed to the Commission of Architectural Review, the city's official historic preservation body, as the Richmond Association of REALTORS® Representative. The Commission of Architectural Review (CAR) reviews all exterior changes to structures within Richmond’s Old and Historic Districts and issues Certificates of Appropriateness for projects that meet certain criteria. The CAR also oversees the process for designation of Old and Historic Districts and assists and advises all parties involved in matters of historic resources relating to appropriate land use, zoning, and other issues. Scenarios featured in the MLS Cautionary Tales segment are provided to help interpret the CVR MLS Rules and Regulations and administer the quality of the listing data in the system. Scenario: A listing is entered into the MLS system, released prior to expiration, and then re-entered into the system. Explanation of Violation: A listing may not be released and then reentered as a new listing for marketing purposes. Some legitimate uses of these off the market statuses include, terminating a listing by mutual agreement with the seller; the property needs repairs or staging, or if the Seller is ill or has a personal reason why the property cannot be made available for viewing. Manipulation negatively impacts the listing database and distorts the accuracy of DOM and the property’s listing history. Governing Rule or Regulation:
Section 5.26 Manipulation of Days on Market: Withdrawal and re-entry of a Listing as a marketing tool or in an attempt to alter or reset the days on market information is prohibited. Sellers do not have a unilateral right to require CVR MLS to remove a Listing from Active status without the Listing Participant’s concurrence. However, when a Seller can document that his exclusive relationship with the Listing Participant has been terminated or released, CVR MLS shall remove the Listing from Active status at the request of the Seller. Violation & Fine: A fine of $250.00 is assessed for violations not corrected within the time frame specified in the courtesy warning letter. Recent Violations: 35 warning letters have been sent over the past month regarding this violation. The Tempo MLS System is checked on a daily basis for listings that are in violation of the CVR MLS Rules & Regulations. Notifications received from members reporting listing violations are also an extremely valuable source of quality control. egal validity was afforded electronic signatures over ten years ago when the Electronic Signatures in Global and National Commerce Act, or the e-Sign Act of 2000, was passed. That law enforced the legality of electronic signatures for use in e-commerce and other contractual agreements. Today, as REALTORS® and consumers are becoming increasingly comfortable with the security and authenticity of digital signatures, MLSs and Associations are rapidly embracing this technology, and CVR MLS is no exception. Authentisign, an e-signature tool integrated within the existing electronic forms Instanet Transaction Desk platform, is now available to all CVR MLS subscribers as a general member service. The service allows agents and brokers to electronically place signature and initial blocks on almost any type of transaction document.

The Validity and Use of Electronic Signatures in Virginia The federal Electronic Signatures in Global and National Commerce Act (ESIGN) along with the Virginia Uniform Electronic Transaction Act (UETA) govern the use of e- signatures. The laws were established to create a framework to enable completely electronic transactions. based on three core principles: 1. A record or signature may not be denied legal effect or enforceability solely because it is in electronic form. 2. If a law requires a record to be in writing, an electronic record satisfies the law; and 3. According to UETA Section 7; ESIGN Section 101 (a), if a law requires a signature, an electronic signature satisfies the law. In Virginia, the parties to the transaction must consent to conduct any transaction electronically. This consent may be contained

within the transaction document or obtained separately. Whether the parties agree to conduct a transaction by electronic means is determined from the context and surrounding circumstances, including the parties’ conduct. The parties must either have a written agreement separate from the purchase or listing agreement to conduct the transaction by electronic means or the consent must be conspicuously displayed and separately agreed to with the contract document. It is important to note that a party to a transaction who agrees to conduct a transaction by electronic means may refuse to conduct other transactions by electronic means and the parties’ rights under UETA and ESIGN may not be waived by agreement. To assist in obtaining the proper authorizations, the following language has been added to the CVR MLS purchase and listing agreements. New Purchase Agreement Language: ELECTRONIC SIGNATURES. ______ /______ If this paragraph is initialed by both parties, then in accordance with the Uniform Electronic Transactions Act (UETA) and the Electronic Signatures in Global and National Commerce Act, or E-Sign, regarding electronic signatures and transactions, the parties do hereby expressly authorize and agree to the use of electronic signatures as an additional method of signing and/or initialing this Agreement. The parties hereby agree that either party may sign electronically by utilizing an electronic signature service. New Listing Agreement Language: ELECTRONIC SIGNATURES. ______ /______ If this paragraph is initialed by Owner and Broker, then in accordance with the Uniform Electronic Transactions Act (UETA) and the Electronic Signatures in Global and National Commerce Act, or E-Sign, regarding electronic signatures and transactions, the parties do hereby expressly authorize and agree to the use of electronic signatures as an additional method of signing and/or initialing this Agreement. The parties hereby agree that either party may sign electronically by utilizing an electronic signature service. Revised transactions forms along with a separate consent document for use with non-CVR MLS forms can be found in Instanet.

Building a Quick and Easy Tripod for your Smartphone
E
very week I pour over materials covering smartphones, tablets, pads and apps looking for the latest technology solutions to assist Realtors® with their businesses. My goal is always the same-- to help folks work smarter, with solutions whose benefits outweigh the troubles or the cost. In the real estate industry in particular, we’re all working with much more video than ever before with the help of Skype, AT&T’s Face Time, shooting YouTube videos and using our Smartphone cameras for just about everything. I actually have Skype loaded on my iPhone and not on my computer. Why, you ask? Well, it’s because the newer Smartphones typically have better cameras than most webcams. Smartphones are now being shipped with 5, 8 and 12 mega pixels, and include front and rear cameras. The problem I’ve encountered, and seen others experience, however, is being able to hold the phone still enough so that the person on the other end doesn’t become dizzy. I know there are tripods on the market. For example, there’s a SunPak Mini Flexpod out there, but it cost $21.99. I thought I could do better, so I pulled out my graph paper and colored pencils and decided to build my own. After a quick trip to Best Buy and Lowe’s - success! The following tip offers quick and easy instructions on building a tripod mount for your Smartphone to resolve stabilization issues and it costs only $2.21! Yes, that’s it! And the only parts you will need are these; One Foot of ½” Schedule 80 PVC pipe Two ½” street elbows (19¢ ea) One ½“ Tee One ½” Cap One T-nut ¼” – 20

The entire project – sawing, filing, and gluing all pieces- took about 30 minutes. The tripod not only works remarkably well, but it looks very similar to what is out there already – but at only a fraction of the cost. I have allowed space from the bottom of the phone to the framework of the adapter. The reason for this is so that I can keep the phone charging, while in the tripod. I also added a wired headset which has a boom microphone, ear piece and across-the-top head support for times when I am sitting back further away from the phone. The phone sits in the tripod next to my computer charging with the headset connected. This makes it much easier to use the phone when texting, looking up contacts or anything else, while it’s mounted in the tripod. Whether shooting a video for YouTube, using Skype or even taking still photos this tripod is the answer. I have no plans of making and marketing these tripods, but I’m happy to be able to provide the list of pieces and steps for you to be able to build your own. Enjoy! Making Changes to a Listing MLS listings must be updated and maintained in accordance with CVR MLS Rules and Regulations. Price changes, status modifications and other revisions and updates made in a timely manner ensure that all listing content is accurate, current and in compliance with CVR MLS and the NAR Code of Ethics. Updates and modifications also help keep listings in line with changes in the marketplace and ensure the listing remains competitive. The CVR MLS Listing Modification Report Form may be submitted to CVR MLS as a request to make modifications. This form is intended to be used to request help from MLS staff in changing listing information when the Principal Broker, Office Administrator or Listing Agent is unable to make the change themselves. Change requests made of CVR MLS staff incur a $10 fee, which must be paid at the time of submission of the form. The modification form has been revised recently and no longer requires a Seller’s signature on the form itself. CVR MLS Participants and Subscribers should obtain the Seller’s written authorization for price changes, temporary withdrawal, and listing releases, but only a firm broker can advise as to a firms’ requirement for each of these situations. CVR MLS does, however, conduct verification of seller authorization by randomly auditing recently modified listings. W
ith only a one day extension of the regular session, the General Assembly adjourned sine die on Sunday, February 27, 2011. Overall, it was a productive session for the Virginia Association of ® REALTORS’ legislative package. Below is a quick recap of how the REALTOR® agenda fared and what changes are to be expected beginning July 1, 2011.
Agency/Disclosure Form/ Immunity from Prosecution VAR’s signature piece of legislation for the 2011 session was an omnibus bill that generally sought to make adherence to existing laws

more manageable. The legislation makes the following changes: • Grants licensees immunity from liability for using or relying on inaccurate data that is received from a public or governmental source; • Clarifies that brokers can keep records in an electronic format, under the provisions of the Uniform Electronic Transaction Act (UETA); • Moves the content from the Residential Property Disclosure Act Form to a website maintained by the Virginia Real Estate Board. Beginning July 1, 2011, purchasers will be given a form referring them to the VREB site. This will eliminate updating the form each year as changes are made to the form.

In response to several concerns raised by members regarding problems working with professionally managed property owners associations, VAR introduced legislation to make a number of changes to the POA/Condo act, among them the revised legislation: • Permits educational courses sponsored by REALTOR® organizations to qualify someone to be an association manager; • Prohibits associations from charging fees relating to inspections and creation and delivery of disclosure packages that are not expressly set out in the law; • Allows an association to collect fees for providing a disclosure package if a sale has not closed within 45 days; • Brings self-managed associations within the purview of the law; • Exempts condominiums sold at auctions from the three day right of cancellation provision under Condominium Act disclosure packets. The REALTOR® legislative agenda works to protect both REALTORS® and the clients they represent. This strategy helps protect the entire industry. In pursuit of this goal, VAR worked to pass the following legislation that supports REALTORS® and home buyers:
Developers Prohibited from Private Transfer Fee Attachment Developers are prohibited from attaching private transfer fees to newly developed property for up to 99 years. Private transfer fees are paid each time the property is sold, with the proceeds going directly to the developer rather than to the neighborhood or homeowners associations. Specifically, this prohibits developers from using transfer fee revenue as equity on future developments, while still allowing the fees that directly affect the property, the mortgage or the overall development.
Burden of Proof Lowered for Assessment Appeals The burden of proof for taxpayers who appeal their assessments has been lowered. Currently, the burden of proof that taxpayers must meet to overturn as assessment is “clear and convincing evidence”-- which judges view as 85%-95% proof that the assessment is incorrect. Under the new legislation the taxpayer will need to prove by a “preponderance” of the evidence -- which judges view as 51% -- that the assessment is incorrect. Chinese Drywall Disclosure Enhancement
This requires that any agent (whether for a buyer, seller, landlord, or tenant) disclose any known defective drywall to a potential purchaser or tenant. If the landlord of a residential dwelling unit has actual knowledge of the existence of defective drywall in a dwelling unit that has not been remediated, the landlord shall provide to a prospective tenant a written disclosure that the property has defective drywall. The disclosure shall be provided prior to the execution by the tenant of a written lease agreement or, in the case of an oral lease agreement, prior to occupancy by the tenant. Any tenant who is not provided the disclosure may terminate the lease agreement at any time within 60 days of discovery of the existence of defective drywall, by providing written notice to the landlord in accordance with the lease, or as required by law.
RPAC Needs Supporters Now More Than Ever The success of the REALTOR® legislative agenda would not be possible without the help of our business conscious, RPAC supported legislators. These legislators work to protect REALTORS® and their clients in committee and on the House and Senate floor. This is a crucial year for RPAC, as all 140 members of the General Assembly and seven Boards of Supervisors in the region are up for re-election. Not only is every local and state elected official in the region up for re-election, but every legislative district has been redefined due to the census. Consequently, incumbent legislators do not have the usual advantage of running in a district that they have won before. RPAC has an opportunity to influence electoral outcomes in the Richmond area. Now more than ever, it is time to support the PAC that supports REALTORS’® livelihoods. RAR REALTOR® Members will be asked to make their $99 “Fair Share” contribution to RPAC via their thirdquarter MLS dues statement. Although this line item is voluntary, REALTORS® are strongly encouraged to contribute, given RPAC’s importance to public policy efforts at the local, state and national levels. If $99 is not feasible, please consider making a $50 or $25 dollar contribution. Any and all contributions help RPAC continue its mission. REALTOR® Lunch and Learn: An Opportunity to Learn About Buyer Financing and Interact with Local Nonprofits o kick off the month of Affordable Housing Awareness Week 2011, the Richmond Association of REALTORS® held a REALTOR® Lunch and Learn on the afternoon of Monday, April 4. After picking up a boxed lunch, participants gathered in the Atrium at RAR for a discussion about finding financing for first-time and low income homebuyers. The discussion began with an overview on the impact of foreclosures in the Richmond area, presented by Will Sanford, Housing Policy and Research Analyst with Housing Opportunities Made Equal. The New Sourcebook Provides a Comparative Look at Statewide Housing Affordability By Kate Loveluck, Communications and Marketing Coordinator
Housing Virginia, in cooperation with the Virginia Housing Development Authority, the Virginia Association of REALTORS® and Virginia Tech’s Center for Housing Research, has produced the Affordability Sourcebook, a database that syndicates statewide data on incomes, housing prices, mortgage payments and rental rates. This data, when viewed as a whole, paints a clearer picture on the affordability of housing within particular areas in Virginia. The national standard for “affordable” housing is 30% or less of a household’s income. A family is considered “cost-burdened” if their home exceeds 30% of the household’s income. One of the most valuable uses of the Sourcebook is to compare data on incomes in particular areas to the cost of housing in those areas. This shows not only the affordability of housing in an area, but also the number of “cost-burdened” households in the area. The data dates back several years and displays affordability trends, in addition to current information. These pieces of information can be particularly useful to non-profits and legislators. Because Housing Virginia partners with several other various organizations, including government, non-profits, academia, home builders and REALTORS®, data in the Sourcebook is considered a culmination of efforts, making it common, streamlined data that can be used for many different purposes. Urban planning, legislation, corporate moves and client advisory are just a few examples of the many purposes the Sourcebook can serve. A great use of the Sourcebook for REALTORS® is guiding clients who are considering relocation to weigh in the factor of housing affordability in a particular area against other factors, such as wages and commuting distances. O
n March 24, 2011, the Richmond Association of REALTORS® (RAR) hosted a housing forum with special guest speaker U.S. House Majority Leader Eric Cantor (R-VA), who represents Virginia’s 7th District. The forum, held at the University of Richmond Jepson Alumni Center in Richmond, Virginia, brought together over 200 REALTOR® members and industry experts to discuss pro-growth economic plans. Prior to Majority Leader Cantor’s presentation, a panel of local real estate industry executives had the opportunity to discuss personal stories and experiences concerning a number of rules and regulations that they deem to be problematic and cumbersome to their day-to-day business. The panel, which included Jerry Mabry, President of the Virginia Mortgage Bankers Association, Woody Hogg, Principal Broker of ERA Woody Hogg & Associates and Rick Jarvis, Principal Broker of One South Realty Group, LLC, discussed a number of topics ranging from increases in loan origination costs and more stringent qualification processes to new underwriting requirements placed on condo construction. Upon taking the stage, Representative Cantor, a real estate lawyer and developer himself, said "Of all industries that have been affected by the downturn in the economy, yours is one that has been, and is still, at the center of the storm. I salute you for your tenacity and resilience.” The crowd responded appreciatively with a round of applause.

Cantor went on to describe how the weak housing market serves as an anchor on the economy. “Creating jobs and promoting entrepreneurship and business investment helps with recovery,” he said, “but we also must shore up the housing finance system.” He suggested that the House majority wants to foster a climate for the private sector to engage in lending, where the federal government has filled a void in the market. “We will work to eliminate the systemic risk that GSEs pose to our nation, but we are committed to doing it in a way that does not jeopardize the prospects for a rebound in the real estate industry. We need smart regulations for mortgage applications that mitigate risk, but do not close the doors to homeownership to responsible borrowers.”

The event was a part of the Richmond Association of REALTORS® continuing efforts to provide educational opportunities to REALTOR® members that help to inform them about economic and legislative affairs affecting their industry. The day was a tremendous success and the event gained national exposure. According to Cheryl Hamm, President of the Richmond Association of REALTORS® Board of Directors, “This was an excellent opportunity for our members to learn more about the big picture and the affects economic issues have on their business. The broader understanding helps members to better assist the buying and selling public here in the Richmond Metro area.” L

After high school, my dad talked me into buying a 5-acre tract in King William with some money I had earned working summer jobs. I sold it a couple of years later and made some money! After college, while working for Aetna, I met a friend who recruited me into the real estate business. I later went to work for the company Bowers, Nelms and Fonville, where I had a lot of fun, learned about development and sales and sold a lot of real estate. I became friends with John Thomas, another agent there, who also liked the idea of a smaller office, and we decided to start our own company together. My son Graham is now in the business and in his 6th year as an associate at Coldwell Banker Johnson & Thomas. Favorite Richmond Tradition There are a lot of traditions and I enjoy them all, especially fly fishing on the James and being a part of the rich history we have here through walks in city neighborhoods or parks along the James river and visiting local museums. Favorite Vacation Spot For years it was with my family on any beach: Nags Head, Figure Eight Island, Wrightsville Beach, or Islamorado, but now I find myself more frequently visiting Deltaville and the bay. Hobbies/Activities outside the office I enjoy spending time with my family, salt water fly fishing, going to summer baseball games, watching local college football or basketball, serving on various committees, and helping others.

I am presently a VAR RPAC Trustee. I am now serving my third term on the RAR Board of Directors. How did you get involved in real estate? My undergraduate degree is in Business Administration and I had always planned to go into the Real Estate business once all four of my children were in school. I have always loved domestic architecture and sales and have always enjoyed people, so it seemed a natural fit for me. Favorite Richmond Tradition I guess my neighborhood is my favorite Richmond tradition. I live on West Avenue in the Fan District and there are many traditions and neighborhood activities I enjoy there Favorite Vacation Spot There are so many – I love to travel and have enjoyed European trips as well as beach trips with my family. Hobbies/Activities outside the office I am still a student and take a course at Virginia Commonwealth University every semester. My favorite courses are history, art history and language. I am actually receiving a Bachelor of Arts degree this June in Art History. I have eight grandchildren here in Richmond, so there are many family-related activities to enjoy. My hobbies include gardening, cooking and various crafts
