ASK JUDY YOUR REAL ESTATE QUESTIONS Dear Judy, I am in escrow on a 25- year- old home and the inspection revealed a lot of issues that need to be resolved! The HVAC is original and needs servicing, the hot water heater is at “end of life,” the dual paned windows have broken seals, there is a crack in one of the trusses . . .these are serious items. My realtor prepared the Buyers Inspection Notice and we listed my requested repairs. The seller has responded by refusing to fix a thing! Is this even legal? The seller said I “got a deal” and didn’t pay full price, so I should “take it or leave it.” I want the house but want the seller to cooperate!

Dear Frustrated, Yes, what you have described is difficult and unfortunate. And it sounds as though the seller already gave you his answer. It is legal for a seller to refuse to make any repairs. It is also legal for you to cancel the contract due to this and be refunded your earnest deposit. It sounds like you want the house, so therein lies the problem. Not knowing what you paid, and whether you got a “deal,” it is not possible for me to advise. Talk to your realtor, because you only have a certain number of days to respond to the seller’s refusal to repair items. Have you had the house appraised? This is often the way to ascertain real value and might help you determine if the repairs required are worth it. You could also get contractor estimates on repairs so you can understand a dollar amount that you would need to fix these issues. With information, you can decide if cancelling or going forward with the closing is the best solution. But time is of the essence . . .so good luck.
