ARE WE AT THE TOP OF THE RENTAL CYCLE? As we hit our strides in 2018 and get into the year properly, we’re starting to ask the question - are we at the top of the rental cycle? The Sydney office rental market may very well be near its peak, however with limited new supply we expect rents to remain firm. There’s no doubt that the rapid pace of rental growth we saw in 2017 has ended. Low vacancy rates have led to landlords becoming very focused on renewing existing tenants. The focus allows for capturing significant market rental uplift from leasing deals that may have been struck two or three years ago and are now at option and review to market stage. The result of this is we are seeing tenants being served with ‘market review’ notices, sometimes 20%30% above their current rental. This rental jolt is bringing tenants out to inspect vacant properties for lease, however we’re anecdotally finding they soon come to the realisation that rents have increased and eventually agree to significant rental uplift when renewing in their current location.

So what does this mean for the market? Landlords with vacant properties will now need to compete harder to secure tenants from competing assets, which will bring more balance back to the market. The rush of tenants vacating buildings set for demolition is over and leasing transaction times are now more extended. Sydney is expected to outperform in the short term driven by growth in the service sector and minimal supply. With below average vacancy of 5.4%, prime and secondary gross effective rents have risen +20.5% and +13.3% over the year. Rising secondary rents and withdrawals are driving strong take-up of prime space with circa 104,200 sqm of net absorption recorded in 2017. A guarantee is a written promise to guarantee the liability and obligations of one party to another party. In the form of a lease, the guarantors will be guaranteeing to the landlord the obligations of the tenant under the lease including the payment of rent.

WHAT TO BE AWARE OF IF YOU ARE SIGNING A PERSONAL GUARANTEE ON BEHALF OF YOUR COMPANY To protect yourself when signing lease documents it is important that you read and understand all clauses contained therein and understand the obligations of the tenant that you are guaranteeing. A landlord will often recommend and in some instances insist that a person providing a guarantee seeks independent legal advice on the terms of the guarantee. This is done to ensure that the guarantor understands the legal ramifications of signing the guarantee and cannot at a later stage raise a defence on the basis of “not knowing what was being signed”.

Guarantees are almost always continuing guarantees, which means that the guarantee continues and cannot simply be terminated by the guarantor or be released from the guarantee when it chooses without the express written approval from the landlord, who has the benefit of the guarantee. This situation often arises when a director who provided a guarantee resigns as a director or is removed as a director, the guarantee will still continue despite this. In such a situation, it will be the onus of the guarantor to seek the release from the landlord and failing that obtaining an indemnity from the tenant or other remaining guarantors.

In summary it is important to ensure that a guarantee is valid and enforceable and such factors to ensure enforceability include:

If there are more than one guarantors, then the guarantee is almost always a joint and several guarantee which means the landlord can if required sue one of the guarantors severally or all the guarantors jointly.

A guarantee needs to be validly executed in order to be enforceable. As such if a guarantor is an individual then the guarantor must execute the guarantee in the presence of an independent witness over the age of 18 years old and that witness must also execute the guarantee in the execution clause. If the guarantor is a corporate entity, then the company needs to validly execute the guarantee by having the sole director execute the guarantee if the company only has one director or two directors if the company has more than one director or under a valid company seal or valid power of attorney.

HOW DID YOU GET STARTED? After several years in the hospitality industry my father made several unsubtle attempts to get me to think about entering into real estate. So I went to TAFE and passed my licensing course and thankfully gained employment as a trainee within an independent commercial agency in the CBD. WHAT IS YOUR CURRENT ROLE? I’m a Senior Sales and Leasing Agent and I’m responsible for winning business - I list new stock then actively market and sell or lease. It’s a transaction focused role, but I’m also responsible for proactively maintaining existing clients.

My major leasing client is Tanert Pty Limited, a private family investment company. Anthony Harris and I service the leasing of their two CBD assets. One is at 66 Clarence Street, where we had a 4500 sqm mandate and I’m proud to say we successfully leased this vacancy. The other is the St James Centre, 111 Elizabeth Street, Sydney. I leased two and a half floors last year in 111 Elizabeth Street, about 2000 sqm in total.

YOUR POINT OF DIFFERENCE? Having a few grey hairs gives me experience dealing with people and managing realistic expectations of clients and tenants and buyers. Being knowledgeable and respectful are qualities that help me a lot when dealing with situations that require problem solving with challenging transactions.

WHAT DOES A TYPICAL DAY LOOK LIKE? I like to get into the office by 7.30am. I do a quick scan of the Fin Review, especially the property pages, write down tasks on my to do list, and make sure my appointments. I try to focus on new business opportunities in the morning and keep my inspections and other appointments during the afternoon. From 5pm - 7pm it’s paperwork and administration and a little planning for the coming day.

LAST MAJOR TRANSACTION? Noble Oak Insurance was my last one - we leased level 7, 66 Clarence Street to them, 870 sqm for our client Tanert. And Level 1, 16 O’Connell Street, at 266 sqm was sold for $3,050,00.00

LOCAL MARKET TRENDS? On the leasing front the vacancy level is heading towards 5%, indicating the available office space for lease is getting tighter. This represents solid rental growth for owners and leaner incentives. The sales market is running low on good quality stock for sale. The last 12 months has seen values increases by around 30% and in a low interest rate environment with no new supply, I anticipate these market conditions will remain for the next 12-18 months. Should the RBA increase the cash rate late this year, this could have the ability to make an impact on vendor’s expectations.

FAVE LOCAL HAUNT? After a successful month, I can justify a lunch at Felix, a great Parisian styled brasserie in Ash Street in the CBD.

HOW DID THE TRANSAC TION UNFOLD?

100 Harris Street is a landmark building in Pyrmont. Originally a woolstores, it now houses 26,879sqm of A-Grade office space in the thriving city fringe suburb. The building’s brick facade features soaring arched windows and decorated with ornate brickwork.

PMP Limited contacted Andrew Telepis looking to lease a large area for their growing business within the city fringe. Given their growth plans they were ideally looking for a short term lease and one that was already fitted out and furnished. The market for this type of requirement is extremely tight, with vacancy levels less than 3.3%, and even less so for space which has an existing fitout.

The windows let light stream in and the oversized ceilings add to the feeling of space. Inside the building, large timber beams and industrial staircases punctuate the space, which has been transformed into six generous floors. The tenancy is on the ground and first floors of 100 Harris Street.

After an exhaustive search, Andrew found that Domain Group had an area they wanted to lease on a short term basis in the beautifully rebuilt warehouse building, 100 Harris Street Pyrmont. The deal was struck quickly and PMP Limited moved in shortly afterwards.

EMPLOYEE WELLBEING

– configuring your office space to encourage social interaction can deliver a great boost to staff morale and productivity. Just one way to do this is to position an open kitchen in the middle of their floorplate to create a central social zone that’s easily accessible to all areas of the office. This helps bring people together that wouldn’t otherwise pass each other during the day, creating greater camaraderie and sense of belonging. We also recently installed standing desks in walkways for a client, which encouraged staff to hold ad-hoc meetings as they passed by chance in the hallway. This had a huge impact on productivity because staff were able to make collaborative decisions more efficiently rather than wait for a fixed meeting time. This client reported an uptick in staff positivity who said they were able to get their work done far more effectively.

– there are countless ways an office can be designed to support the physical, emotional and mental wellbeing of staff. Paying attention to air quality, good natural light and water quality are critical. Many of our clients are successfully integrating chill out zones and even meditation pods into their office scheme to give their staff areas for clear thinking and reflection. They are reporting huge benefits, not just in encouraging innovation but also in reducing stress related issues and conflicts in the workplace. Forward thinking corporates are also exploring ways to provide healthy snack options for staff and encouraging them to do physical exercise. For example, many of our clients have successfully implemented adjustable sit/stand desks to promote employee comfort and fitness. According to their 2017 Report, research and consulting

firm Great Place to Work ® Australia cited that 82% of top-raking companies for employee happiness had carried out ergonomic assessments of most, if not all workstations. The same report noted that 88% had provided bike racks, and indeed, at Intermain we are passionate about providing our clients with great end-of-trip facilities that truly encourage staff to cycle, run and walk to work or exercise during their lunch break.

FLEXIBLE WORKING – is becoming commonplace at Australia’s most aspirational workplaces. Success starts with implementing the right technology in the office to facilitate remote work. Structuring the office to support agile working styles, such as providing communal work areas, ‘hot-desks’ and great locker systems helps to promote flexible working and has additional benefits of significantly lowering the real estate expenses for a company.

It’s February, and with Valentine’s Day upon us, it’s time to talk about something near and dear to our hearts at Gensler: Brand Strategy and Graphic Design. We love creating brands, telling brand stories through print, digital or other media, and communicating a client’s brand ethos through the built environment.

Unfortunately, brand strategy and graphic design can sometimes be an afterthought, especially on a workplace design project. It’s sometimes assumed that environmental graphics can just be quickly and easily applied after the fact. As a result, there is no shortage of office environments out there where the ideas behind the environmental graphics were clearly conceived of completely separately from the design of the rest of the workspace. As designers, we believe that kind of disconnect can easily be avoided by shifting the way brand is thought about, by viewing it as THE integral part of the interior design process rather than a secondary part of the process or “add on” later. The truth is that brand strategy and graphic design must be embedded in your workplace design process from the start. If you neglect your brand in your early thinking about what goes into the design or your workplace, then you run the risk of not being able to achieve the best outcome in the end. Both your employee experience and your customer experience will suffer.

P E O P L E A R E AT T H E H E A R T O F EVERY BRAND All the design that goes into a workplace has to come from somewhere, and our belief is that the best source of inspiration – if you want to ensure an authentic result in the end – is the client. The key to a successfully branded workplace is realising that the client is the brand. Not “the client has a brand,” but rather, “the client is the brand.” Some companies have a hard time fully grasping just how important this distinction is, but it can make all the difference between a workplace that wows and one that falls flat. And it’s the client’s people who live and breathe the brand every day. If they are not passionate about the brand, how can the client expect its customers to be? The worst mistake to make is assuming that a brand is simply a logo and a set of colours, when in fact, any brand (pause for a moment to think about your own brand) is so much more than that!

THE POWER OF THE BRANDED WORKPLACE A successfully branded workplace tells a story, one that connects with people at an emotional level. Your workplace is an extension of your brand. Whether they’ve told you or not, people – and most importantly your employees and your customers – want to feel a connection to your brand as soon as they set foot into your workplace. There’s no formula for success. What’s important is being honest about your culture and the message you want to communicate to, for example, your employees, your clients, new recruits, the outside community, etc.

Your workplace can represent who you are in a very literal or very subtle way. For example, you might tell the story of your company’s history through a timeline in your reception, or you might want to reflect your company’s culture in more nuanced ways, perhaps through artwork or some abstract way that is perceptible but not explicit. A key part of the design of Dropbox’s Sydney workplace was the integration of distinctive Aquabumps photography, not just hanging on the walls, but as an oversized wallcovering in one location and, in another, actually built into their custom ping-pong table. These were subtle yet impactful design decisions resulting from early conversations with the client about how we could explore expressing a sense of local pride.

C R E AT I N G A S E N S E O F P L A C E It’s not just the one feature graphic or piece of artwork in the lobby, nor is it the custom signage on the cleverly named conference rooms. It’s the combination of everything, the way all of these elements complement and reinforce each other, including the space planning, the furniture, the materials, all of it! Your workplace can be the first and lasting impression of your brand, and every little detail matters.
