Having worked in integrated hospitals in China for years, we have a very good feel for when we can offer alternatives to conventional care and when Western medical procedures are the best option. Both my wife and I have medical doctorates in the clinical practice of Chinese medicine from China, which means we have a high level of skill in acupuncture and herbal medicine as well as exposure to emergency, acute and chronic conditions that come from being in an East-West integrated environment.” “Our not for profit board includes a neurosurgeon, which is an incredible
resource for a clinic to have. East or West, all of us who are in the health care profession want to see our patients get better. Unmanned vehicles take to the sky By Alphie Hyorth
The videos are all over YouTube Small unmanned flying machines sailing cameras over mountains, oceans, couples getting married in the woods, goats in the woods. You name it. We call them drones. But they are more correctly known as Unmanned Aerial Vehicles (UAV) or Unmanned Aircraft Systems (UAS). You can buy a UAV from Amazon, or any number of other outlets. They come in different sizes, configurations, power, numbers of motors, and on and on. They arrived under thousands of Christmas trees this past holiday, but they are far from toys. The Federal Aviation Administration regulates anything and everything that flies into what is called the National Airspace System (NAS). Look up. See the sky? That's the national airspace. The FAA maintains tight controls over flights of UAVs and began allowing limited use of unmanned aircraft in the National Airspace System in 1990. Legal flights are limited mainly to public (government) entities: The Department of Homeland Security, NASA and weather research, environmental monitoring, public safety by law enforcement agencies. Don't fit into any of those categories? You want to run a business based around flying a UAV? Not so much. Winter 2015 | Fine Homes of WNC 21
for profit is (pardon the pun) still up in the air. As Williams put it, suppose you are flying over a house making a video for a real estate company. Your video inadvertently shows the owner of the house next door engaged in some illegal activity that can only be viewed from the air. Is the UAV operator obligated to report that activity to the police, Williams asked. Can the UAV operator be sued for revealing what that homeowner is doing?
The FAA is saying "We own the air," as Dee Williams put it. Williams is an Asheville photographer who goes back a number of years. He now operates droneographer.com and has a number of drone-assisted videos on YouTube. He builds his own UAVs and flies for the love of it. He would like to to turn that love of flying into a profitable business. One day. In the meantime Williams realizes he and other photo UAV operators are walking a fine line when it comes to FAA regulations. He has friends who are investing in equipment to start UAV aerial photography businesses. "The FAA says no no no," Williams explained. Don't get all twisted up about this if you got a UAV for Christmas and you want to check it out with your new camera. According to FAA rules flying "strictly for hobby or recreational use" is fine as long as you follow some common sense safety guidelines. Keep away from airports and passenger jets. Keep the UAV in plain sight. Things like that. A lot of issues (related to safety, privacy and other things) have yet to be addressed and the legality of flying a UAV 22 Fine Homes of WNC | Winter 2015
This is how serious the FAA is when it comes to controlling drone flights for profit. Last year the agency fined a UAV operator $10,000 after the University of Virginia paid him to video the campus from a UAV. A judge threw out the fine but the FAA appealed that decision and won. Please send a check for $10,000 to the FAA, thank you very much. Just after the start of the New Year, the FAA announced it was asking local law enforcement for help. In other words, state and local police now have the FAA's blessing to seek out unauthorized or unsafe UAS operators. The FAA is concerned about the number of close encounters between UAVs and commercial passenger-carrying aircraft. At the end of November the agency announced it is putting together rules governing who can fly unmanned craft for profit, when they can fly, how high, and where. Severe regulations may be loosened, Williams said, but that's in the future. Actual implementation of FAA rules could take two years pending approval and review by other government entities including the White House. In the meantime you can petition the FAA for an exception that will allow your business to operate.
In September 2014, the FAA gave seven Hollywood production companies permission to shoot aerial footage with drones as long as the operators had a private pilot license, stayed at or below 400 feet and flew only in daylight. Outside of Hollywood an obvious use for UAVs is in real estate. One Realtor in Tucson, Arizona recently got permission from the FAA to use a UAV to video houses he's trying to sell. Williams added air quotes over the word "permission."
Meanwhile the industry continues to grow as manufacturers create UAV systems that are both more complex and easier to operate. Williams continues to pursue his love of flying and photography. To be up in the air ... "to see what the birds see."
That's because the FAA granted the exception only if the Realtor fulfilled a long list of requirements including one that the operator of the UAV obtain a private pilot license. In addition to setting mechanical and altitude restrictions, the FAA also mandated the posting of a sign that says “Attention Aerial Photography in Progress – Remain Back 150 Feet”. If you aren't up to speed on what you need to get a private pilot license, it is a lengthy process that can cost anywhere from $5000 to $10,000 depending on who your instructor is and where you train. In other words, it's not that simple. "I don't know what's going to shake out," Williams said about the FAA regulations.

Hickory Nut Gap Farm: Creating community for one hundred years En route to meet with John and Annie Ager the bustle of the city falls away as I wend my way towards Hickory Nut Gap Farm, which spreads out into the valley just before you drive up into the mountains on Highway 74. Turning into their drive is like stepping back in time. On this homestead is the oldest building in Buncombe County and it carries the flavor of its history to this day. My meeting began with John, who had just won a seat in the NC State Legislature a month earlier. True to a working farm, he was nowhere in the house, but rather out on the farm, heading up the hill to our meeting. John welcomed me as the Agers welcome everyone and invited me into the warmth of the woodfired kitchen hearth. We celebrated his recent win and he talked briefly about his campaign before taking me back to 1790 when the Ashworth family, the first settlers, moved into the area. John has written the extensive history of the family’s farm and life in the book We Plow God’s Fields. I was looking, however, for their roots in consciously creating community and I was delighted to discover that they go all the way back to 1916 when James (Jim) and Elizabeth McClure, Annie Clarke Ager’s grandparents, bought the property. Farming has always been challenging, but it was especially difficult after
World War I when commodity prices tumbled. Instead of packing it in, James founded the Farmer’s Federation, bringing mountain farm families together to try to make everyone’s lives better. Eventually, more than 10,000 farm families throughout the region collaborated to open stores and create markets for their products and to help one another learn how to be better businessmen as well as how to farm in new and more productive ways. In 1930, Annie’s other grandfather, Dumont Clarke, came to organize the Lord’s Acre. One of his projects was bringing running water to the farm houses, most often inspiring churches to get involved.The churches responded by creating water systems in many communities. In addition to supporting the farming industry, Jim McClure believed that education was important. Mountain families were large and all children needed a good education. He served on the Board of Education, ensuring that all children had an opportunity. The extended Clarke family has supported Warren Wilson College for years, taking in students and offering work opportunities for them. Annie, John’s wife, came in from the farm with an apple in hand. She poured us tea and offered me slices of the apple, fresh from their

create a community where everyone thrives. In addition to supporting a thriving “grow local” and organic farming community, they are actively engaged as board members and volunteers with schools in the area as well as the Fire Department, the Community Center and the Library. Under Jamie’s leadership, the farm has expanded into agri-tourism. They have a year-round farm store, host weddings, and in the fall sell apples, create a corn maze, offer hayrides and children’s games. In the summer they run a farm camp for 40-45 children who have the opportunity to ride horses
and engage in art, pottery and drama…and experience life on the farm. My time with Annie and John culminated in a tour of their homestead. The wall murals were painted by Annie’s grandmother. They tell the history of the family home and are still beautiful. The study is an original log building. As you walk up the steps and into the room everything becomes silent. Thick walls and bookcases lined with historical knowledge and wisdom let you know you have entered a kind of sanctuary. There on an old antique table is
In addition to the year-round farm store, they host weddings, sell apples, create a corn maze, and run a summer farm camp for children the family register, recording names and dates of people, both famous and not, who have stayed here. I left with an awareness that part of Conscious Community is connection to history, to honoring the past, learning from it and celebrating it. Bringing the stories forward helps inform the present, informs the values that are still alive in this family today. Community was important to the McClure’s at the outset and it has been passed down through the generations where is vibrant and alive today. The Agers are still inspiring a thriving community throughout the region and they are a pivotal part of the region expanding success for local, organic farming. Take a ride out to Hickory Nut Gap Farm and visit the store. Head south on Highway 74 towards the mountains.
