The Dog Days Of Summer “It’s a smile, it’s a kiss, it’s a sip of wine... It’s summertime!” Kenny Chesney
T
he term “Dog Days” was coined by the ancient Romans, who called these hot and humid days “Caniculares Dies” or “Days of the Dogs” after the star Sirius.
Sirius resides in the constellation of Canis Major, the “Big Dog”, which is one of the hunting dogs of Orion, the Hunter in the constellation that bears his name. During the Dog Days of Summer Sirius rises and sets with the sun, and the two stars are in conjunction. The Dog Days are officially the 20 days before the conjunction and continuing to 20 days afterwards, spanning July 3rd to August 11th, the hottest and muggiest part of the season. During this time Sirius is the brightest star in the night sky and the ancients believed that the heat from Sirius added to the heat of the sun during this period of conjunction creating a stretch of especially hot and sultry weather. Hence, the Dog Days of Summer. Although the Dog Days are certainly the hottest period of the summer, the Earth is actually furthest away from the sun in summer. But, because of the tilt of the Earth’s axis in relation to the sun, here we are blasted by a direct hit of fiery heat. Time to cool down! Ed Bertha Summer 1

s the VUE continues to rise skyward we look back on the day a lone Reclinata Palm Tree, the only living thing on the job site except for the scurrying of craftsman and machines, was saved from obliteration by a move to the end of the Ritz Carlton driveway near 41. The tree was rumored to be planted in the early 1900’s, maybe predating the construction of John Ringling’s hotel. Where will this “tree on wheels” end up next?

Which is why I will be dedicating my upcoming REAL Style columns to “Style With A Cause” – Summer Style Trends. I will cover a bevy of fun style & beauty trends for fashionistas at all levels, and will be honoring amazing women who help raise funds to give back. When I think of amazing, successful, strong beautiful women who make a difference the Women’s Council of Realtors of Sarasota (WCR) comes to mind. Their Mission Statement: a network of successful REALTORS, advancing women as professionals and leaders in business, the industry and the communities they serve. This is an organization that exemplifies “Style Maryellen Paterson

CHEF PAUL MATTISON’S Beet and Goat Cheese Stack Serves four
Candied Walnuts
Walnut Vinaigrette
4 medium beets 2 Tbsp olive oil 2 tsp salt 12 goat cheese slices, ¼ inch 2 cups baby arugula Candied Walnuts
1 cup unsalted walnuts 2 Tbsp butter 2 Tbsp brown sugar ½ tsp cinnamon ½ tsp salt
1 egg yolk 1 tsp chopped shallots ½ chopped garlic clove 1 tsp Dijon mustard ½ cup rice wine vinegar ½ cup walnut oil ½ cup vegetable oil Salt and pepper to taste
Remove the tops and bottoms of the beets. Rub them with olive oil and sprinkle with salt. Cover and roast at 350ºF for 1¼ to 1½ hours. Peel and cool then cut into 16 slices, ¼ inch each. Starting with a beet slice, alternate with goat cheese slices, ending with a beet slice on top. Garnish with baby arugula, orange segments, grapes, Walnut Vinaigrette and Candied Walnuts.
Preheat oven to 350ºF. Rough chop the walnuts. Melt the butter in a large non-stick sauté pan over medium heat. Add the walnuts and stir to coat. Add the sugar, cinnamon and salt, then stir again until thoroughly coated. Spread out evenly on a sheet tray and bake for 5 minutes. Stir and cook for another 3 to 5 minutes. Be careful, the nuts can burn easily. Cool before serving.

Combine the egg yolk, shallots, garlic, mustard and vinegar in a blender and purée on high until smooth. Reduce speed to low and slowly drizzle in the walnut and vegetable oil. Season to taste.

DISCOVERING HEALTH: What’s In Your Tool Box? By Kimberly Burns, OTR/L, CLT
M
ost everyone has a toolbox of some sort. A tool box is generally thought of as a physical area that we keep special tools that you use around your home to maintain and repair household items. It contains different unique tools that you use alone or in conjunction with other tools. A therapist’s tool box may consist of different tests, a variety of therapeutic interventions such as different exercises, knowledge and other tools that we call modalities that we will use to help with a patient’s injury or disease. Parents with children that have special needs may have their own sensory tool box with activities to stimulate all of a child’s senses to improve the ability to develop. If you want to live in good health and fight injury and disease, being your own health advocate and gaining knowledge of what is available will assist you in developing your own wellness toolbox. Your wellness toolbox should contain physical and cognitive strategies for what your body needs related to diet, self-care, exercise and movement, relaxation, pain management, cognitive functioning. Just like a repair tool box, your wellness toolbox should contain a unique set of tools that you can choose from to address the specific need your body may be having. As you begin your practice of developing your wellness tool box there are a few words that should describe you, or how you could be, if you are going to succeed in becoming your own health advocate and learn to manage your health daily and successfully. Consistent: Regular practice is necessary to learn and experiment with all the tools there are to help you manage your health in a way that meets your body’s sensory and physical needs. If you use
the tools/interventions regularly and in the appropriate manner, good results will naturally occur. Adaptable: You need to be able to adjust to the changes that may need to occur as the result of trying something. You may need to put up with a difficult process or provide more attention to completing an activity in order to see results. Sometimes what you feel works for a particular ailment will not always work due to what you may need to do that day or it may be unavailable for use. Open Minded: This is a hard one for some as they have predispositions to what will work or what they want to try. There are also a lot of therapies that you wouldn’t even give the time of day to, but you can always learn something from them even if it’s the extent someone will go to find comfort or make sense of the world. And if it works for them and they are happy, who is to say how farfetched they really are. Positive: Don’t let the negative thoughts creep into your head. “I’ve had this for years and nothing helps.” “The doctors say there is nothing more they can do.” Have the spirit of “I am still going looking for the thing that will work to help me manage this disease from spiraling out of control.” They are out there. You just haven’t discovered them yet. Keep searching and believing there’s an answer. Be determined. You will find what works for you. Change how you think and you will find new doors opening up. Proactive: In managing your health, what is most important is being proactive vs reactive. Proactiveness will keep your body well before you have symptoms to treat. If you already have a disease like spondyloarthropathy, which is a type of arthritis which has its own set of

rules to play by, you know that it is an inflammatory disease. Being proactive would be to look at lifestyle changes needed specific to the cause and effect of the nature of this disease. Being reactive would to treat the symptoms of the disease such as the swelling and pain that have already occurred. All the while the condition itself goes on, continuing to cause these symptoms and multiplying. And my favorite word “Particular” when you know what works for your body and gives the relief you may not have had in weeks, months or years, be particular with the items you use. All things are not the same. Generic is cheaper for a reason. While it may work well for one person, your particular condition and body make up is different, and responds differently, and may not have the same result as using the brand name item. The same is true for medication, food, clothing and even the toothpaste and shampoo you use. Being your own health advocate means taking the time to understand what’s going on within your body and following your intuition on how you feel. Develop your senses and attention to detail. Don’t accept that the only route to go is medication or live with it. Get second options. Learn about all the interesting research that is out there on new techniques through verified medical websites and journals. Dedicate time to learning about how they affect the body and if it’s something that’s going to work for you. Take it one day at a time and keep looking forward!

However, there are some homemade tricks that can make all the difference and make your hair beautiful, hydrated and silky. In this article I want to give you some suggestions for homemade masks and tricks that can improve the appearance of your hair. Coconut and Avocado Mask • Two tablespoons of coconut oil • A tablespoon nut oil of Argan • One tablespoon of honey • A dessert spoon of soy extract • An egg yolk • Two tablespoons of avocado Mix all the ingredients well until you have a paste. Then, apply it on your hair and massage in thoroughly. Leave it in your hair for about an hour. After an hour, wash your hair using a mild shampoo. For best results, repeat this procedure twice a week until you are happy with the results. Olive Oil and Egg Yolk Mask • Olive oil • An egg yolk

T
he Roman historian Tacitus was certainly not commenting about a modern day home inspection, but nevertheless home buyers should heed his advice. Nowhere is the Latin phrase Caveat Emptor, (Buyer Beware) more feared than in the real estate market. It really is the responsibility of the home buyer to ascertain exactly what he is buying in terms of the condition of the property. In most cases, detailed inspections will be performed after a contract for sale of a home has been agreed. Why spend money on professional inspections if you don’t know whether buyer and seller can agree on terms of the sale? There are occasions, however, when a seller may conduct presale inspections of a home in order to give buyers a sense of security in moving forward with a purchase. In this situation, the buyer should still make their own inspections. It is important to consider inspections at the time you make an offer to purchase a property. Any offer should be contingent upon the buyer being satisfied with the result of any inspections and/or the seller agreeing to make repairs to address issues that arise during the inspections, or giving the buyer the right to cancel the contract. Home inspections should be carried out by qualified, licensed professionals. Can a buyer make their own inspections? Yes they can, but a word of caution. Just how much does the buyer really know about construction and buildings? They may be purchasing a property in another country or state where the standards of construction and the systems used are not familiar. Consider the buyer from Alaska purchasing a home in Florida, and how
different insulation requirements would be, or the Alaskan’s unfamiliarity with outdoor pool equipment. Should you inspect a brand new house? Many buyers of newly constructed homes do not make a formal home inspection. They choose to skip this step as they believe the builder will remedy any issues under the builder warranty. This is usually the case, but some absentee owners/investors do perform professional inspections, especially if the new home is to be rented immediately. The tenant may not appreciate the importance of reporting problems promptly if those problems do not interfere with their enjoyment of the house. For instance, if an electrical outlet is not working, the tenant may simply use another outlet and neglect to inform the owner, builder or property manager about the issue. What should be inspected? The objective of a home inspection is to ascertain the condition of the building. The number and type of components included in the inspection will vary depending upon the particular property, but the inspection should address such things as: • Type and standard of construction • Foundation • Roof • Windows • Doors • Plumbing • Electrical systems • Heating and cooling systems • Appliances • Pool The inspection report will indicate the age and condition of the home and whether things are functioning in the correct manner.

A home inspector should be licensed and belong to one of the professional home inspection organizations such as the American Society of Home Inspectors (ASHI) or the National Society of Home Inspectors (NAHI). It is important that the buyer personally select the inspector who will carry out the work. Buyers may receive recommendations from their real estate agent, but a professional agent will be careful not to steer customers to a particular inspector, rather they will encourage the customer to call several inspectors and select the one they feel most comfortable with. How do I choose a home inspector? Call the inspector directly or look at their websites. Always check that they are licensed and belong to a professional association. Ask to see an example of the kind of report they produce. Some reports will be made up of a list with check boxes, while others will have more narrative. Ask how many photographs are usually included in the report – especially important if you will not be present during the inspection. Taking care to choose the right home inspector to carry out an extensive inspection on behalf of a home buyer will most certainly pay dividends and help the buyer avoid what could be a costly mistake. Does Title Insurance Really Protect a Property Owner from Zoning Issues? By William Henry, PhD Title Insurance is a policy to protect and/ or indemnify against loss or damage resulting from defects in the title and deed to the property. What does Title insurance cover? The basic title insurance policy that is not “overly endorsed” includes the following: 1) Representation as to the actual owners of the property, 2) Representation that the property is free of encumbrances, i.e. other mortgage liens, mechanics liens, and potential claims that have not been recorded, and 3) Representation that there is access to the property that will allow the current use to continue in operation. Potential purchasers of property in Florida are often mistakenly led to believe that the title insurance purchased warrants that the zoning and land use entitlements in place conform to the existing or intended use. For instance, unbeknownst to the seller and/or his agent, a property zoned multi-family residential may be in the process of undergoing a government initiated land use change. Local planning officials could be planning a change which would affect the entitlements to build additional improvements or to rebuild after a catastrophic fire or storm. These land use ‘updates’ to an approved area comprehensive land use plan are routinely undertaken by local government land planning agencies to change the approved comprehensive long range plan. This was enacted by the State legislature some years ago to prevent urban sprawl and corrupt local officials from giving in to special real estate investment interests. More specifically it was enacted to discourage development beyond the ‘urban service area’. In other words government is loathing paying for sewer and roads into the hinterlands if redevelopment can be given incentives closer to the urban core.
States without the sensitive ecology of Florida with extensive coasts and wetlands are less likely to experience this kind of government intervention. Therefore they pose less risk that the zoning code can be modified and limit some types of building development. According to some title insurance representatives, there isn’t a week that goes by that a financial institution or potential real estate purchaser doesn’t request that a title insurance policy be underwritten in Florida to provide coverage for zoning conformance. When they are told that the title insurance provider cannot, they often request that an attorney provide an opinion letter as a substitute that the bank and/or investors can look to. Attorneys specializing in providing these letters of conformance are reluctant to do so without charging large fees to offset potential liabilities and charges for professional liability insurance. Thus ‘overly endorsed’ title insurance policies in Florida may include coverage for other potential encumbrances such as, mezzanine loan securitization. This extra endorsement insures that the proceeds from a sale (equity) inure to the benefit of a mezzanine lender. This is tantamount to a second mortgage whose lien is never recovered on the property— but again they will not include zoning conformance insurance. We as planners and land use specialists have been asked on many occasions to write informed professional opinions concerning land use and zoning conformance. These opinions are based upon a number of factors which include not only the current designated land use and designated zoning categories in question, but also covenants and restrictions and the potential for waivers from the approved land use. In short,
government staff now has inordinate authority to recommend that waivers be granted to an applicant in order to facilitate desired projects. Desired development in today’s government oriented mass transit environment could include density bonuses, setback waivers, parking allowances, and other measures to grant ‘relief ’ to potential developers. Opposed to this are often neighborhood interests and other stakeholders who believe that these waivers constitute a threat to neighborhood “cohesiveness”. The zoning battles that ensue in front of elected official governing municipal and county boards are often costly drawn out affairs where both parties really lose.
